A TENTATIVE TRACT MAP TO ALLOW THE CONSTRUCTION OF TWO CONDOMINIUM UNITS IN THE PR-5 ZONE LOCATED IN CHAPARRAL COUNTRY CLUB. CASE NO. TT 18495 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the nth day of April, 1982, hold a duly noticed public hearing to consider the request of DAME CONSTRUCTION COMPANY for approval of a three lot Tentative Tract Map to ` allow the construction of two condominium units on .23 acres in the PR-5 (Planned Residential, 5 d.u./acre) zone, located in Chaparral Country Club, more particularly described as: APN 622-090-001 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project has previously been assessed. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons as justified in the staff report for TT 18495 dated March 2, 1982, on file in the Department of Environmental Services, to exist to approve the Tentative Tract Map: (a) That the proposed map is consistent with applicable general and specific plans. (b) That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. (c) That the site is physically suitable for the type of development. (d) That the site is physically suitable for the proposed density of development. (e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. (f) That the design of the subdivision or the type of improvements is not likely to cause serious public health problems.. (g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. WHEREAS, in the approval of this Tentative Tract Map the Planning Commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the above described Tentative Map No. 18495 for the reasons set forth in this Resolution and subject to the attached conditions. FURTHER, BE IT RESOLVED that the recommended conditions of approval do include a requirement that the applicant pay in-lieu fees to comply with the requirements of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In return, the City agrees to use said fees for park purposes in conformance with an adopted master plan, within five (5) years of the recordation of the final map. N MINUTES PALM DESERT PLANNING COMMISSION APRIL 6, 1982 MR. DENVER JOHNSTONE, 40-329 Sagewood, stated that when the agreement was signed he assumed the setback from the market to the residence would be the normal required by code and not less. Mr. Diaz explained that if the setback was set at the normal 40 ft. then consequently the market would have to be moved towards Country Club Drive and the parking area to the back, which means greater noise impact would be created to the residence from the cars in the parking lot. He also stated that the building would not act as a buffer as presently proposed. Chairman Kryder closed the public hearing. Moved by Commissioner Wood, seconded by Commissioner Crites, to adopt'findings as recommended by Staff. Carried unanimously 5-0. Moved by Commissioner Wood, seconded by Commissioner Crites, to waive further reading and adopt Planning Commission Resolution No. 788, approving DP 01-82, ADJ 01- 82 and 164 C, subject to amended conditions. Carried unanimously 5-0. (Note: a condition included states that the project will be redesigned to mitigate the noise levels, and revised plans to be reviewed by Planning Commission prior to submission of final construction drawings). B. CASE NO. CUP 03-82 - MARIO LALLI, Applicant Request for approval of a CUP to allow conversion of, a bank into a 150 seat restaurant in the C-1, S.P. (General Commercial, Scenic Preservation Overlay) located at the southeast corner of San Luis Rey Avenue and Palm Desert Drive. Mr. Diaz reviewed the staff report and recommended approval with conditions that valet parking be prohibited and additional landscaping be added. Chairman Kryder opened the Public Hearing and asked if the applicant wished to make a presentation. The applicant was present and agreed to the conditions set by staff. Chairman Kryder asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. MR. CHARLES RILEY, Manager of the building, felt that it would benefit the City and requested approval. Chairman Kryder closed the Public Hearing. Chairman Kryder asked why staff was recommending that valet parking be prohibited. Mr. Diaz responded that it would eliminate conflicts due to proximity of the Presidents' PLsz•.t iat :;.IJ frontage road. (Office Professional) and a Negative Declaration of Environmental Impact for property located at the northeast corner of Larrea Street and Lantana Avenue. Mr. Diaz reviewed the staff report and noted that previously the Planning Commission denied a request for a Change of Zone to this property because rezoning to C-1 for an unspecified use was not desirable. The applicant now wishes to have the property rezoned to O.P. in order to convert the existing residence to an office use. Letters have been received in favor and one in opposition. Staff recommended approval. Chairman Kryder opened the Public Hearing and asked if the applicant wished to make a presentation. The applicant was present. Chairman Kryder asked if anyone wished to speak in FAVOR or OPPOSITION to this case. There being none, the Public Hearing was closed. City of Palm Desert Department of Environmental Services Staff Report TO: Planning Commission DATE: April 6, 1982 CASE NO: TT 18495 REQUEST: Approval of a three lot Subdivision to allow the construction of 2 condominium units in a PR-5 zone located on the south side of Camino Arroyo northwest of Joya Drive.. APPLICANTS: DAME CONSTRUCTION COMPANY P.O. Box 1856 Palm Desert, CA 92261 I. BACKGROUND: A. DESCRIPTION OF SITE: The site lies within Chaparral Country Club and would be part of the Phase III portion of the development. Presently private streets exist on the site but no units have been constructed in this Phase. B. ADJACENT ZONING AND LAND USE: North: PR-5/Open Space; PR-5/Condominiums South: PR-5/Open Space East: PR-5/Open Space; Condominiums West: PR-5/Condominiums C. GENERAL PLAN LAND USE DESIGNATION: Low Density Residential 3-5 d.u./acre H. PROJECT DESCRIPTION: The project consists of a three lot subdivision. Two of the lots will have units built on them while the third lot will be open space. The project would add two units to Phase III of Chaparral Country Club. Phase III and Phase IV comprised TT 13881. Originally TT 13881 was approved with 322 units but was later reduced to 294 units. The addition of the two units by this map amendment will increase the number of units to 296. III. ANALYSIS: A. FINDINGS: Specific findings and justifications must be made in order to approve a Tentative Tract Map . Those findings are as follows: 1. That the proposed map is consistent with applicable general and specific plans. 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. 3. That the site is physically suitable for the proposed density of development. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially injure fish or wildlife or their habitat. 6. That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. -I- Staff Report TT 18495 April 6, 1982 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. The justification in support of those findings are as follows: 1. The adopted General Plan indicates 3-5 d.u./acre, and the proposed Tract Map provides only 2 units more than the previously approved Tract Map which was well within permitted densities of the General Plan. 2. Adjacent private streets are improved and drainage facilities are provided in conformance with the adopted General Plan and Master Drainage Plans. The proposed residential development and surrounding Country Club, is consistent with the adopted General Plan. 3. & 4. The site is of sufficient size, shape and topography for the proposed type and density of development. 5. & 6. The design of the subdivision is not likely to cause substantial environmental damage or serious public health problems because it will be developed in concert with applicable local, state and federal regulations. 7. There have been no easements acquired by the public at large for access through or use of property within the proposed subdivision. Based on the above justification, there appears to be sufficient grounds for approval. B. ENVIRONMENTAL REVIEW: The proposed project has been previously assessed in connection with Case No. DP 01-79, and no further documentation is deemed necessary by the Director. IV. STAFF RECOMMENDATION: Based on the justifications in the staff report and draft Resolution, staff recommends approval of Tentative Tract No. 18495 by adoption of Planning Commission Resolution No. , subject to conditions. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may he in force. 2. Full public improvements including traffic safety lighting as required by ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Depart- ment of Environmental Services with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environmental- Services. . 4. Access rights on Portola Avenue (except for one private street entrance and one maintenance/emergency access) shall be offered to the City as a dedication on the Final Map. 5. The C.C.&R's for this development shall be submitted to the Director of Environmental Services for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the Director of Environmental Services: a. The document to convey title. b. Covenants and restrictions to be recorded (which have been approved) . C. Management and maintenance agreement to be entered into with the owners of the units of the project (which has been approved) . d. Long term agreements relating .to the ownership of the golf course. r 6. Improvement plans for water and sewer systems shall meet the requirements of Il the respective service districts. 7. Area shall be annexed to appropriate improvement districts having jurisdiction over the subject area. 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 9. All on-site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as built" plans prior to acceptance of the subdivision improvements by the City. 11. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal . 12. Prior to recordation of the Final Map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 13. All requirements of the City Fire Marshal from his letter of June 9, 1980, shall be met as a part of the development of this tract. 14. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system of Tract No. 13881 is in accordance with the requirements prescribed by the City Fire Marshal . " 15. Drainage shall be subject to approval of the City Engineer. Applicant shall provide engineered data as requested. RESOLUTION NO. 81-47 Page Four 16. Al l private streets shall be inspected by the Engineering Department and a Standard Inspection Fee shall be paid. 17. All requirements of the Planning Commission action on the Development Plan 01-79 shall be met as a part of the development of this tract. 18. The total number of lots shall be limited to 294 condominium unit lots, plus other lots deemed necessary to define common areas, recreation areas, and private streets. 19. The applicant shall have twelve (12) months from the date of the approval or conditional approval to the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council . 20. Signalization Fund contributions as required by City Ordinance shall be made prior to recordation of the Final Map. 21. Developer shall pay a fee in lieu thereof as a condition of the Final Map, for park and recreation purposes. The City shall commit the use of any such fees received within a five year period. SPECIAL CONDITIONS 1. A Final Tract Map for the subject site shall not be approved until the Design Review process has been completed. 2. The area of this tract within the Whitewater Storm Channel shall be placed in turf and permanently maintained (except for approved impervious surfaces) , or provided with an adequate alternative protection as approved by the Director of Public Works, and Coachella Valley Water District. 3. A site boundary wall as required in DP 01-79 and as approved through the Design Review process shall be designated on the Final Map. 4. The subdivider shall make a $3,700 per acre contribution or pay a fee in amount effective at time of recordation to the City of Palm Desert Drainage Fund. Area within Whitewater Channel as determined by the Director of Public Works to be exempt. 5. Safety street lighting shall be installed at the tract entrance, if not already provided as required and approved by the Director of Public Works. 6. Retention basin(s) shall be constructed in conformance with Ordinance No. 218. 7. This case was not considered and will be placed on Agenda at a future date because of improper property owner's list submitted by applicant. VIII.
