ZONE, LOCATED AT THE NORTHEAST CORNER OF HWY III AND EL PASEO (WEST). CASE NO. TT 18942 WHEREAS, the Planning Commission of the city of Palm Desert, California, did on the 16th day of November, 1982, hold a duly noticed public hearing to consider the request of the PALM DESERT TOWN CENTER ASSOCIATES for approval of a tentative tract map to create up to nine (9) lots in the PC (3) S.P. zone, located at the northeast corner of Hwy I I I and El Paseo (west), more particularly described as: APN 629-030-006 and 629-050-051 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that the project has been previously assessed in connection with GPA 02-82, C/Z 07-82 and DP 12-79 (Amendment) and therefore, no further documentation is deemed necessary. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons as justified in the staff report for TT 18942 dated November 16, 1982, on file in the department of environmental services, to exist to approve the tentative tract map: (a) That the proposed map is consistent with applicable general and specific plans. (b) That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. (c) That the site is physically suitable for the type of development. (d) That the site is physically suitable for the proposed density of development. (e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. (f) That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. (g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the city of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That it does hereby approve the above described Tentative Tract Map No. 18942 for the reasons set forth in this resolution and subject to the attached conditions. Tentative Tract Map 18942 is granted for the land as described in the attachments hereto, and as shown on exhibits on file with the department of environmental services and the requirements herein. 2. All requirements of any law, ordinance or regulation of the state, city and any other applicable government entity, shall be complied with as a part of this map. 3. Pursuant to municipal code requirements, tentative tract map shall be recorded within two years from date of approval, unless an extension of time is granted, otherwise said approval shall become null, void and of no effect whatsoever. Department of Public Works: 1. Proposed lot lines for lots 7 and 8 shall conform to existing lot lines (of PM 15723) or excluded property to north of tentative map shall be included to preclude creation of remnant lots. (Regional Commercial District, Scenic Preservation Overlay) zone, located at the northeast corner of Hwy 111 and El Paseo (west). DESCRIPTION OF SITE: The property is the Palm Desert Town Center site located north of Hwy 111, east of El Paseo. May Company has been completed and is in operation. The balance of the site is vacant. B. ADJACENT ZONING AND LAND USE: North: PR-6, S.P. and R-1; vacant and residential South: PC (3) S.P. and C-1; commercial East: R-1 and R-2; residential and vacant West: PR-6; vacant C. GENERAL PLAN LAND USE DESIGNATION: Regional Commercial II. PROJECT DESCRIPTION: The purpose of the tract map is to create eight to nine lots for financing and sale purposes. Each of the major department stores would be constructed its own lot with this proposal. No requirements for joint parking and access between lots is needed with this map. This is because the recorded real estate agreement (REA) among the parties in interest insures that shopping center parking and circulation function properly. This is the normal procedure for large regional shopping center. III. ANALYSIS- Required findings: 1. That the proposed map is consistent with applicable general and specific plans. Justification: The General Plan indicates the property as regional commercial which is consistent with the existing and proposed plans. 2. That the design or improvement of the proposed subdivision is Staff Report TT 18942 November 16, 1982 consistent with applicable general and specific plans. Justification: The proposed subdivision is to be improved consistent with standards applicable to regional commercial uses. Therefore, it is consistent with the General Plan. 3. That the site is physically suitable for the proposed density of development. Justification: The site is physically suitable to accommodate the size of the development approved. 4. That the site is physically suitable for the proposed type of development. Justification: The site is physically suitable to accommodate a regional commercial center in that it is adjacent to a major highway and commercial zoning. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. Justification: The subdivision will be developed in concert with applicable local, state and federal regulation which will insure that no substantial environmental damage occurs. 6. That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. Justification: The design of the subdivision will not cause serious public health problems since it will be developed in concert with applicable local, state, and federal regulations. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. Justification: There have been no easements acquired by the public at large for access through or for use of property within the proposed subdivision. Staff feels there are sufficient grounds to justify approving this request. IV. STAFF RECOMMENDATION: Staff feels the request is acceptable and recommends: A. Approval of findings; B. CONSENT CALENDAR All matters listed on the consent calendar are considered to be routine and will be enacted by one roll call vote. There will be no separate discussion of these items unless members of the planning commission or audience request specific items be removed from the consent calendar for separate discussion and action. A. Case No. TT 16133, J.M. PETERS CO. - Approval of an one year extension of time for a tentative tract map for 156 condominium units on 34 acres at the northeast corner of Hovley Lane and Cook Street. Rec: Approve as presented. Moved by Commissioner Downs, seconded by Commissioner Crites, to approve the consent calendar item as presented. Carried unanimously 5-0. VII. PUBLIC HEARINGS A. Case No. K, 18:942)- PALM DESERT TOWN CENTER ASSOCIATES, Applicants Request for approval of a tentative tract map to create up to nine (9) lots in the PC (3) S.P. zone located at the northeast corner of Hwy I I I and El Paseo (west). Mr. Sawa reviewed the staff report and proposed conditions. Staff recommended approval. Commissioner Kryder voiced a concern as to whether the parking lot would still function properly with these lot separations. Mr. Sawa responsed that the parking area would not change and will continue to function as one project. Chairman Wood opened the public hearing and asked if the applicant wished to -1- I MINUTES PALM DESERT PLANNING COMMISSION NOVEMBER 16, 1982 make a presentation. MR. JAY TARANTON, project manager for center, was present for any questions the commission might have. He noted, in addressing Commissioner Kryder's concern, that each lot would have the correct number of parking spaces available for each building size. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Moved by Commissioner Richards, seconded by Commissioner Kryder, to adopt findings as recommended by staff. Carried unanimously 5-0. Moved by Commissioner Richards, seconded by Commissioner Kryder, to adopt Planning Commission Resolution No. 828, approving TT 18942, subject to conditions. Carried unanimously 5-0. B. Case No. CUP 13-80 (Amendment) - Palm Tree Restaurant, Applicant Request for approval of an amendment to a conditional use permit to allow a dinner only restaurant to open for lunch in the C-1, S.P. zone located at 73-520 El Paseo. Mr. Diaz reviewed the staff report and indicated that staff's major concern was the amount of parking modification required to grant the request. He explained that when the restaurant first opened the minor parking deficiency was not a problem because the hours of operation were in the evening. However, the request to open for lunch would create a major code deficiency due to the parking requirements for the center. He stated that staff is recommending denial based on past policies and decisions. Mr. Diaz noted that correspondence had been received in support of this request from the Chamber of Commerce and the tenants of the center. Mr. Diaz also stated that an alternative could be approved granting the request for a two year period. Commissioner Richards stated that he has yet to hear any complaints regarding parking space deficiencies due to business expansion. He felt that it might be necessary to begin a study of the city's parking requirements, especially for restaurants. He also felt that this restaurant could be used as part of the study and allowed to open for lunch for a two year period. Commissioner Crites asked staff if this would set a precedent. Mr. Diaz replied that only if the exact same situation arose again, it would. Commissioner Crites asked if there had ever been any conditional use permits approved and then revoked, and if so, what are the legalities involved. Mr. Diaz explained that this has not happened in this city but it has been done in other municipalities. He also stated that it is legal to impose a condition stating that if a problem arose in the future the conditional use permit could be revoked. Commissioner Downs asked if staff had contacted other restaurants in the area for their opinions. Mr. Diaz replied they had not. Commissioner Downs stated he did ask other restaurant operators and they were in favor of this request. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. JACK KLOTZ, owner of the Palm Tree Restaurant, was present to answer any questions the commission might have. He felt that there would not be a problem with the parking and asked for approval. The plans were checked, revised and approved under this concept. The tentative tract map 18942 proposes the Town Center building be sub- divided into six distinct parcels of property (i.e. five anchor stores and the mall). The problem arises with obtaining conformance with Uniform Building Code Section 504 and Table 5A, which is also adopted by the State of California in Title 24 California Administrative Code, Part two, Chapter 2-5. This section states that building walls, on a B-2 occupancy, within 20' of a property line, requires a one hour rated protection and furthermore, building walls located within 5' of a property line are not permitted any openings, (such as an opening between the anchor stores and the mall). Uniform.Building Code Section 508 addresses fire resistive substitutions and specifically prohibits reducing the fire resistive construction for building wall protection due to proximity of property lines per Section 504 (b) .
