Mr. Joy reviewed the staff report and recommended approval. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. GERALD DUPREE, 74-040 El Paseo, concurred with staff's recommendations. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Moved by Commissioner Downs, seconded by Commissioner Richards, to approve the findings as presented by staff; carried unanimously 5-0. Moved by Commissioner Downs, seconded by Commissioner Crites, to adopt Planning Commission Resolution No. 898, approving TT 19637, subject to conditions. E. Case No. CUP 03-82 Amendment #1 - TULLIO LALLI, Applicant Request for approval of an amendment to a conditional use permit to expand hours of business to include lunch for the 3915 square foot restaurant at the southeast corner of Highway I I I and San Luis Rey Avenue. Mr. Joy reviewed the staff report and stated that the restaurant requires 44 parking spaces and there were three areas available to provide those spaces. He also noted that for a conditional use permit parking requirements can be modified. The adjacent business owners were contacted and they expressed approved. Staff recommended approval. Chairman Wood asked what the hours of lunch would be. It was stated that the hours would be from 11:00 a.m, to 3:00 p.m. Chairman Wood opened the public hearing and asked if the applicant wished to make a presentation. MR. TULLIO LALLI, 73-333 Salt Cedar, explained that because businesses in the area have asked if they would be serving lunch they felt a need to expand the hours to include lunch. He requested approval. Chairman Wood asked if anyone present wished to speak in FAVOR or OPPOSITION to this case. There being none, the public hearing was closed. Commissioner Richards and Commissioner Downs had expressed concern for the parking space shortage along the frontage road. But Commissioner Richards felt the expanded hours would not change the problem that already exists. TT 19637 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 1st day of November, 1983, hold a duly noticed public hearing to consider a request by ROBERT ROTTSCHAEFER, M.D. for the subdivision of office space as mentioned above. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project has been previously assessed. WHEREAS, in the review of this tentative tract map the Planning Commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. DESCRIPTION OF SITE: The 20,250 square foot site is located on the north side of Larrea Street, 300 feet west of Prickly Pear Lane and 500 feet east of San Luis Rey Avenue. The site measures 135 feet in depth and 150 feet in width. B. ADJACENT ZONING AND LAND USE: North: C-I/General Office and Retail South: R-3 20,000 (3)/Motel East: C-I/Parking lot West: R-3 20,00 (3)/Multi-family Residential C. GENERAL PLAN LAND USE DESIGNATION: Core Area Commercial and Related Uses. II. PROJECT DESCRIPTION: The proposed building will be made up of eight individual suites. As indicated during the precise plan of design process the applicant was proposing the entire building to be for medical offices, with the exception that no one tenant would take up more than 2,000 square feet which would then necessitate a conditional use permit and further parking modifications. The suites will range in size from 1,200 to 1,500 square feet and will be air-space condominiums in that it is a one lot tract map. III. ANALYSIS• A. FINDINGS AND JUSTIFICATIONS: 1. That the proposed map is consistent with applicable general and specific plans. Justification: The map is merely providing a means for occupying office space in a commercial zone. 2. That the design or improvement of the proposed subdivision is -1- Staff Report TT 19637 November 1, 1983 consistent with applicable general and specific plans. Justification: All public streets will be dedicated and improved and sufficient drainage facilities will be provided in conformance with the general plan guidelines and city ordinances. 3. That the site is physically suitable for the type of development. Justification: The site has previously been approved for the office building. 4. That the site is physically suitable for the proposed density of development. Justification: The design of the project indicates that the site is suitable for the proposed density of development because the site can be served by respective utilities, the city, and existing or proposed circulation system. 5. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. Justification: The design will not cause substantial environmental damage or injure fish or wildlife or their habitat because it will be constructed in compliance with applicable regulations. 6. That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. Justification: The design will not cause serious public health problems because it will be in compliance with applicable health, safety and building codes. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large for access through or use of property within the proposed subdivision. Justification: There have been no easements acquired by the public at large for access through or use of property within the proposed subdivision. B. ENVIRONMENTAL REVIEW: The director of environmental services has determined that the project has been previously assessed. IV.
