CUP 88-2 - SCHMITZ ENTERPRISES, INC., Applicant Request for approval of a conditional use permit and development agreement to construct a 17-unit senior citizens' apartment project in the R-2, S. 0. zone, on the south side of Santa Rosa Way, near San Pascual Avenue. In the applicant's absence, Mr. Diaz recommended that this item be moved to the foot of the calendar as the last public hearing item. B. CASE NO. Phil Joy outlined the the staff report and recommended approval. He added that the surrounding property owners have now cone forward with a petition to make known their concerns. APPLICANT: RICHARD SMITH, ET. AL. 960 E. Tahquitz-McCallum Way, Suite 201 Palm Springs, CA 92262 L BACKGROUND: A. ADJACENT ZONING AND LAND USES: NORTH: HPR,D/Vacant SOUTH: HPR,D/Vacant EAST: PR-8/Storm Channel and Condominiums WEST: HPR,D/Vacant B. GENERAL PLAN LAND USE DESIGNATION: Hillside Planned Residential. C. ENVIRONMENTAL REVIEW: Development will be confined to areas which have already experienced grading modification. Project will be required to renaturalize all existing and proposed cuts or fills. Five and one half percent (5.5%) of the hillside area will be left undisturbed. Thirty-six percent (36%) of the total site will be dedicated for permanent open space. A Draft Negative Declaration of Environmental Impact has been prepared. H. DESCRIPTION AND ANALYSIS: A. SITE DESCRIPTION: The 8.24 acre site is directly adjacent to the Palm Valley Storm Channel. It includes 2.38 acres at the base of the hills which has been filled and graded as part of the storm channel construction. The southwest portion of the property rises abruptly with slopes over 35%. On the northwest side, slopes are more moderate and previous owner had graded an access road and three small building pads. B. PROJECT DESCRIPTION: The applicant is utilizing Option No. 3 of the Hillside Planned Residential Ordinance. In this option, the applicant delineates areas within parcels with average slopes of less than 20%. In these areas, development can occur at a density of two units per acre. Total density for the whole property cannot exceed one unit per acre. On the subject property, four acres have been delineated with an average slope of 20%, allowing a total of eight building sites. The area corresponds to the previously disturbed portion of the property. Five lots will be located at the base of the slope in the area graded by Coachella Valley Water District. For the three hillside lots, grading is limited by the hillside ordinance to - 1 - 1 HDP 84-2 and TT 26024 10,000 square feet per pad. All exposed cuts or fills must be renaturalized to blend with undisturbed terrain. The eight lots and access road will account for 5.31 acres. Development rights to the remaining 2.93 acres shall be dedicated to the city for permanent open space. The extent of the grading on the hillside pads will be reviewed by the Planning Commission with the house plans. Roadway and drainage engineering must be approved by the Director of Public Works. III. CONCLUSION: The proposed hillside development plan and tentative tract map meets the intent and specific requirements of the hillside planned residential zone. The following findings support this conclusion: A. The design, improvements, type of development, and density of the proposed map and hillside development plan are consistent with the State Subdivision Map Act, Palm Desert Subdivision and Zoning Ordinance, General Plan, and the West Hills Specific Plan. B. The design of the subdivision will not result in substantial environmental damage, injure fish or wildlife, or result in public health problems. Water, sewer, and drainage improvement shall be as approved by the Coachella Valley Water District, the Riverside County Health Department, and the .engineering division of the Palm Desert Department of Public Works. C. The proposal will not conflict with public easements. D. The design will allow unrestricted solar access to all lots. IV. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the Building Department, and the original will be returned to the developer. 5. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in TT 20024, HDP 84-2, is in accordance with the requirements prescribed by the Fire Marshal ."
