APPROVAL OF MINUTES: Consideration for approval of the March 5, 1985, meeting minutes. Action: Moved by Commissioner Downs, seconded by Commissioner Wood, to approve the minutes as submitted. Carried 4-0. (Commissioner Richards absent at that time.) V. SUMMARY OF COUNCIL ACTION Mr. Diaz summarized the actions of the council from its March 14, 1985, meeting. VI. CONSENT CALENDAR NONE. VII. PUBLIC HEARINGS A. Case Nos. PP 85-2 and"TT 20 47 3� HLM DEVELOPMENTS (Harold Maddy), Applicant Request for approval of a precise plan of design, tentative tract map, and negative declaration of environmental impact to allow 13 residential condominium units on a 40,500 square foot property in the R-3 20,000 (3) zone located on the north side of Shadow Mountain Drive, 750 feet west of Portola Avenue. Mr. Smith presented a video presentation of the site and reviewed the staff report. He indicated that an additional condition should be added to the public works conditions on both resolutions as #9 to say that installation of curbs and gutters at 20 feet from centerline and matching paving. Staff recommended adoption of the proposed resolutions. Commissioner Wood asked for the record if the proposed 26 foot height (two stories) was within the zoning and building codes. Mr. Smith answered affirmatively. Chairman Crites opened the public testimony and asked the applicant to address the commission. � I MINUTES PALM DESERT PLANNING COMMISSION MARCH 19, 1985 MR. HAROLD MADDY, 73-517 Haystack Road, explained that he understood that there might be some opposition from his neighbors. He stated that all the requirements had been met and that he had a verbal drainage easement in exchange for landscaping for the rear neighbor. He felt that the neighborhood would be upgraded. Chairman Crites noted that the applicant said that the back units would be stepped down and asked by how many feet. Mr. Maddy replied three to four feet. Chairman Crites asked if anyone wished to speak in FAVOR or OPPOSITION to the proposed project. MR. MASON ERICK, owner of the Casa Larrea Hotel, expressed concern regarding the building height blocking the mountain view of his quests and asked what the three to four feet would be measured from. Mr. Cablay inquired if the engineer would address the commission regarding the three to four steps down and the drainage of water. MR. JERRY DENTON, 73-400 Highway 111, engineer, stated that the three to four feet would be measured from grade and that the wall would extend to approximately 20 feet and that he would try to drain water to the back of the property. He indicated that the building itself would be 24 feet and that with the grading it would be dropped two feet. Commissioner Richards asked Mr. Smith how many feet the rear setback was. Mr. Smith replied 15 feet and indicated that the building would be 15 feet from the building. Commissioner Richards asked if there were some regulations about building two story buildings next to one story buildings. Mr. Diaz replied that the adjacent properties were R-3 and that the adjacent property was developed as one story, but could be two story, unless the ordinance was amended to permit only one story. Commissioner Downs asked Mr. Erick about the height of his building. Mr. Erick replied approximately 12 feet. Chairman Crites noted that a part of the land to the north was vacant. Mr. Erick concurred. Mr. Erick noted that the applicant would be saving two to four feet in height by using his property. MR. JOSEPH LYONS, 73-860 Shadow Mountain, explained that he was part owner of the property to the east of the proposed development. He explained that he was not objecting to the two story, though he felt that the two story was not in characteristic with the neighborhood. He stated that he was concerned about the carports on the west of the property. He indicated that he would like to see the carports enclosed because of car lights and noise. Commissioner Downs commented that there would be a six foot block wall that should block car lights. Mr. Lyons indicated that if the carports were enclosed, this would also reduce noise and did not feel that this was an unreasonable request. Commissioner Wood indicated that he could sympathize with Mr. Lyons and felt that it should be made a conditon of approval. Mr. Diaz concurred that this could be done. Mr. Lyons replied that if that condition is met, he would not object to the two story. Mr. Maddy described the proposed design design of the carports and stated that he had taken the surrounding properties into consideration. Commissioner Downs asked the applicant if there would be a problem enclosing the carport on the back side. Mr. Maddy replied no. MS. HELEN HUNTINGTON stated that she objected to the two story on the right front. Mr. Smith explained that the building in the front was one story. -2- r MINUTES PALM DESERT PLANNING COMMISSION MARCH 19, 1985 MR. CLYDE ERNST indicated that his property was across the street and that the property had been recently flooded twice. He stated that the water goes through his property and then down Shadow Mountain Drive. Mr. Cablay indicated that the public works department was going to address that issue when the grading plans are submitted. He stated that the future street improvements would also help divert some of the water. _ Commissioner Richards noted that some of the streets in that area such as Desert Patch would not be receiving street improvements and that those areas needed to be protected. MR. RON WINKLER, 73-758, also expressed concern regarding flooding. Mr. Cablay stated that an addition could be made to condition number 3 to say that the storm drain study be reviewed and approved prior to issuance of any permits. Commissioner Downs noted that construction of the Portola storm drain is scheduled to begin at the end of the year. Chairman Crites asked Mr. Cablay is staff could notify adjacent property owners when the study is complete so that they could express any concerns. Mr. Cablay stated that he would. Chairman Crites suggested adding that as part of the condition. Chairman Crites closed the public testimony and asked the commission for comments and action. Mr. Diaz noted that at the planning commission/city council tour the council and commission expressed concern over the intent versus wording and suggested that the commission might want to consider this in their deliberation. Commissioner Richards stated that the condition regarding the change of carports to garages should be added. Mr. Smith stated that the condition would be added to PP 85-2 as public works condition #11 and that the design would go to the architectural review commission for review. Commissioner Wood asked the city attorney for direction as to the appropriate action to take. Mr. Erwin indicated that the zoning should be followed and suggested that the commission not deny the two story. Chairman Crites reopened the public testimony. MR. MADDY gave a brief background of the 1978 flood and the action that was taken at that time. He stated that in order to put in garages, one end of the carport could be closed as long as it complies with code. Mr. Diaz indicated that it would have to be a structural bearing wall eight feet from the side yard. Chairman Crites asked how that complies with city requirements. Mr. Diaz answered that the city allows it within five feet. Commissioner Richards suggested that a condition be added to say that the Palm Desert Homeowners Association and the architectural review commission review and mitigate any noise and/or light concerns. Chairman Crites closed the public testimony and asked the commission if it wished to take final action or continue the case. Action: Moved by Commissioner Richards, seconded by Commissioner Downs, adopting the findings as presented by staff. Carried 5-0. Moved by Commissioner Richards, seconded by Commissioner Downs, adopting Planning Commission Resolution No. 1032, approving TT 20743, subject to conditions as amended. Carried 5-0. Vill. MISCELLANEOUS ITEMS A. Case No. DP 01-82 (Amendment #2) - CARVER MANAGEMENT CORP., Applicant Adoption of a resolution approving an amendment to a previously approved development plan for a shopping center to permit deliveries on the west side of the market on Saturdays in addition to the Monday through Friday deliveries already approved, for property zoned PC (2) (District Commercial Center) and located at the southeast corner of Monterey Avenue and Country Club Drive. Mr. Diaz explained that the resolution would enact .the action of the commission given at its prior meeting. Commissioner Wood asked if this would go before the city council. Mr. Diaz replied that this would only go to the city council if appealed. Action: Moved by Commissioner Downs, seconded by Commissioner Wood, to adopt Planning Commission Resolution No. 1033, approving the amendment. Carried 5-0. IX. ORAL COMMUNICATIONS NONE X. COMMENTS Mr. Diaz discussed curb requirements in relation to line of sight. Commissioner Downs asked why the San Rios awning extends into the San Luis Rey. Mr. Diaz indicated that they had approval from the Palm Desert Homeowners Association. Mr. Sandy Baum, 45-800 Deep Canyon, stated that he had been traveling around the city and noted that there were alot of infractions. He indicated that on the property line on Country Club and that if a diagonal part not inside the property itself. He was trying to put up a fence. He stated that Mr. McClellan came to look at his corner and felt that there would be no problem. Mr. Baum indicated that other properties are not 25 feet and that he did not understand why he must change this because of the way someone is reading the code. Chairman Crites asked Mr. Baum if he had applied for a variance. Mr. Baum replied that it would take six to eight weeks. Commissioner Richards suggested that Mr. Baum apply for a variance. Commissioner Downs suggested that Mr. Baum apply for a variance to avoid being liable for traffic problems. Mr. Baum replied that this item has not been adhered to in the past. Chairman Crites asked Mr. Baum to report any places that are causing traffic hazards. XI. ADJOURNMENT Moved by Commissioner Downs, seconded by Commissioner Erwood, to adjourn the meeting. Carried 5-0. -4- PLANNING COMMISSION RESOLUTION NO. 1032 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE TRACT MAP FOR A 13 UNIT CONDOMINIUM PROJECT LOCATED ON THE NORTH SIDE OF SHADOW MOUNTAIN DRIVE APPROXIMATELY 730 FEET WEST OF PORTOLA AV N.UE_, CASE NO. T 20743 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of March, 1985, hold a duly noticed public hearing to consider the request of H.L.M. DEVELOPMENTS for approval of a tentative tract map and negative declaration of environmental impact to allow construction of a 13 unit condominium project on 40,500 square feet in the R-3 zone on property located on the north side of Shadow Mountain Drive, approximately 750 feet west of Portola Avenue, more particularly described as: APN 627-273-013 and 014 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have an adverse impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said Planning Commission did find the following facts and reasons as justified in the staff report dated March 19, 1985, on file in the department of environmental services, to exist to approve the tentative tract map: (a) That the proposed map is consistent with applicable general and specific plans. (b) That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. (c) That the site is physically suitable for the type of development. (d) That the site is physically suitable for the proposed density of development. (e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. (f) That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. (g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of, property within the proposed subdivision. (h) That the design of the subdivision will not restrict solar access. WHEREAS, in the review of this tentative tract map the Planning Commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the 4ty of Palm Desert, as follows: 1. That the above recitations are -true and correct and constitute the findings of the commission in this case; 2. That it does hereby approve the above described Tentative Map No. 20434 for the reasons set forth in this resolution and subject to the attached conditions. 3. That a negative declaration of environmental impact is hereby approved. FURTHER, BE IT RESOLVED that the conditions of approval do include a requirement that the applicant pay fees to comply with the requirements of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In return, the city agrees to use said fees for park purposes in conformance with an adopted master plan, within five (5) years of the recordation of the final map. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinance and state and federal statutes now in force, or which hereafter may be in force. 2. The applicant shall have twenty-four (24) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time as permitted by code is granted by planning commission. 3. All on-site utilities, including cable tv, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the director of environmental services. 4. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the city and free of all liens and encumbrances. 5. The CC & R's for this development shall be submitted to the director of environmental services for review and final approval by the city attorney prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the city engineer: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 6. All revisions to tentative tract map required by approval of PP 85-2 shall be made prior to recordation of final map. 7. Prior to recordation of final map, evidence in writing shall be provided to the city that the developers have made provisions with the Desert Sands Unified School District to pay local school impact fees as established by the city council. 8. Developer shall pay a fee in lieu thereof, as a condition of the final map, for park and recreation purposes per city requirements. The city shall commit the use of any such fees received within a five year period. Department of Public Works: 1. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of the final map. 2. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the director of public works. 3. Storm drain construction shall be contigent upon a drainage study by the private engineer that is approved by the department of public works. That the storm drain study be reviewed and approved prior to issuance of any permits. 4. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as-built" plans submitted to the department of public works prior to project final. 5. APPLICANT: HLM DEVELOPMENTS (Harold Maddy) 73-517 Haystack Road Palm Desert, CA 92260 1. BACKGROUND: A. DESCRIPTION OF SITE: The property is a relatively flat, vacant site on the north side of Shadow Mountain Drive between San Luis Rey and Portola. B. ADJACENT ZONING AND LAND USE: North: R-3 20,000 (3)/Motel South: R-3 13,000 (3)/Motel East: R-3 20,000 (3)/Motel West: R-3 20,000 (3)/Motel C. GENERAL PLAN LAND USE DESIGNATION: Medium Density Residential 5-7 du/acre II. PROJECT DESCRIPTION: The property is a rectangular shaped site having 300 feet of frontage on Shadow Mountain Drive and a depth of 135 feet. A. GENERAL: The applicant is proposing to construct 13 residential condominium units around a central recreation area which will include a pool. Parking is provided at both ends of the site. The units will be arranged in 2 blocks of five units each across the rear, 2 units cluster to the east of the pool and a single unit west of the pool. B. SITE DESIGN, CIRCULATION AND PARKING: As noted previously the 13 units will be oriented around a central recreation area while parking is provided at both ends of the rectangular shaped property. Code requires that a 13 unit condominium development provide a minimum of 26 covered spaces and at least 7 visitor spaces which may be open. The site plan provided conforms to the code requirement. Access to the parking areas will be controlled (card entry). The site design, circulation and parking are basically acceptable to staff. The applicant will be required to install perimeter walls on the north, east and west as well as the front wall shown on the site plan. In addition, staff is requiring that the trash enclosure units located outside the secured area be relocated into a more convenient location on the site. These units should also be located away from the street as a matter of aesthetics. C. ARCHITECTURE: The project architecture will be spanish in nature with exterior materials consisting of stucco walls, wood trim and tile roofing. The plans as submitted have been preliminarily approved by the Palm Desert Property Owners Association. In addition to these approvals the applicant will be required to obtain approval of the city architectural commission. D. UNIT TYPE AND MIX: The development will be a mix of one and 2 story structures. All the units will be two bedroom units. The two five unit clusters located across the rear (north) of the property will be 2 story and have a maximum height of 26 feet. Each of these units will have an area of 1334 square feet. The remaining 3 units will be single story structures with each unit having an area of 974 square feet. E. TENTATIVE TRACT MAP: The tentative map will consolidate the site into one lot (presently 2 lots) for condominium purposes. III. ANALYSIS: A. FINDINGS FOR APPROVAL OF A PRECISE PLAN: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. Justification: The use is attractive and acceptable from a design aspect and not incompatible with other uses existing in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in vicinity by the occupants thereof for lawful purposes. Justification: Existing uses in the immediate area are all motels. Residential condominiums and motels are permitted in the R-3 zone. Development of the type proposed should not unreasonably interfere with the use or enjoyment of property in the vicinity. 3. The precise plan will not endanger the public peace, helath, safety, or general welfare. Justification: The project, as conditioned, is designed in a manner that will not endanger the public peace, health,safety, or general welfare. Staff feels these findings can be justified in this case. B. FINDINGS NEEDED FOR APPROVAL OF TENTATIVE TRACT MAP: 1. That the proposed map is consistent with applicable general and specific plans. Justification: The proposed map is consistent with the zoning and the zoning is consistent with the general plan. 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans.
