(1 ) Make a finding that the developer has lowered the pad heights in accordance with his commitment and allow him to proceed with development of the subdivision. (2) That the City Council waive further reading and Adopt Resolution No. gZ-L approving Tract Map 21791 . (3) Instruct the Director of Building & Safety to rescind the current stop work order. BACKGROUND: The City Council deferred any action on the approval of this tract pending a review by the city staff as to the conformance of the revised plans to the agreement reached with the developer at a meeting held in November 1986. The staff has field checked the location and the attached Public Works staff report indicates the compliance by the developer. Exhibit "A" shows the heights of both tracts along the Joint property line. The staff will present an explanation of this exhibit plus others to clarify the concerns expressed by the affected Sagewood residents. it is difficult to grasp the significance of approved grades in relationship to the undisturbed ground elevations; however, the staff will have other exhibits as well as a video tape to explain the situation. Several communications have been sent to the city by Mr. Noel ) Robinson. The staff has reviewed these, and Mr. Robinson's concerns can be summarized as follows: (1 ) COMMENT: Mr. Robinson says that the entire tract (Tract No. 21791 ) should be lowered. FINDING: Only Lots 10 and 11 were to be lowered 2.0 feet. This was completed. City Council and City Manager Page 2 January 22, 1987 (2) COMMENT: The masonry wall elevation behind his wall 1s suppose to be 8`-6" to 9'-6" behind Mr. Robinson's house. FINDING: The masonry wall will be about even or possibly slightly higher at the west end of the project. (3) COMMENT: The pad certification for Lots 10 and 11 are in error accord- ing to Mr. Robinson. FINDING: The staff found Lots 10 and 11 to be in conformance. This field check was made on Thursday, January 15, 1987. (4) COMMENT: According to Mr. Robinson, the retaining wall heights are added to the normal height of the wall to get heights of 8'-6" at the west end and ll '-6" at the east end. FINDING: Including both the retaining and the garden wall heights should be considerably less. The wall height measurements in relation- ship to the Sagewood property will be presented to the residents and to the City Council later. It is proposed to have a six-foot masonry wall at basically the same height as the existing wood fence at the west end of the project. At the east end of the project, the height of the wall wliI be seven feet with a four-foot differential between the ground on the south and north sides of the wall . CONCLUSIONS: The Sagewood residents backing up to the Germain project have understandable concerns regarding deviations of the elevations of the Tract 21791 pads and wall heights. The staff found the pads to be in conformance. Unfortunately, the Sagewood tract (Tract 11791 ) was excavated lower than we would allow at this time. As a result, the differential between the two tracts is greater than actually needed. It is difficult to measure the lot elevations using a regular measuring rule. The city staff used an engineering leveling device and a calibrated rod to make the determination, as noted in the report from Joseph S. Gaugush to Richard Folkers, which is attached. Therefore, It is the staff's recommendation that the City Council make a finding that the developer has lowered the pad heights in accordance with his commitment and allow him to proceed with develRpment of the subdivision; waive further reading and adopt Resolution No. 97 approving Tract Map 21791 ; and instruct the Director of Building and Safety to rescind the current stop work order. One drawing is of a wall proposed to be behind our homes by Germain Development Co. The handwritten note was done by Mr. Germain prior to mailing the drawing to me . The measurements show a wall of from -'8" 6" to 9 ' 6" behind my house , which is the highest home of the five that are affected by the development . The second drawing is a tract plot supplied by Germain . I used a yellow marker to show the retaining wall heights shown on, the `� original plan . The retaining wall heights need to be added 'to the six foot height of the wall . The wall heights run from 8 ' 6" at � the west end to 11 ' 6" at the East end. There are several discrepancies that I would like to bring to your attention . I must assume that pad 10 and 11 are the proper height as I have no way of measuring them, and with the construction of the wall in progress I cannot compare them to the Sagewood Lots . The approved plans show pad 10 to be 219 .0 and pad 9 to be 219 . 8 , a difference of 8 inches , the actual. difference is 1.5 inches , which would mean that one of them is off by 7 inches . If pad nine is too high , then the balance of the pads should also be off by the same amount . The approved plans show pad 11 to be 218 . 9 and pad 12 to be 219 . 8 , a difference of 11 inches . The actual difference is 14 inches , this would also affect all of the other pads . The approved plans show pad 12 to be 219 . 8 and pad 13 to be 220 . 2 , a difference of 6 inches . The actual. difference is 10 inches , add this to the difference in the other pads and you really have an error in the heights . I did not measure the balance of the pads , but from this initial difference I would suspect that all of the pads are off by an equal or greater amount . If this is true and my measurements are correct then the certification is incorrect and the final approval should not be issued. As you are aware the question of the pad heights is before the city council at this time and the council is scheduled to hear more facts from your department at the next meeting . I would like to ask your department to check the heights of the pads . It should only take a few minutes to determine if what I have said is correct , then report back to one of the homeowners and the city council the results of your investigation . Attached is a copy of a fetter to the Department of Public Works . I have , taken' the time to compare the actual heights of one lot against the height of another in this tract. As you can see I have found discrepancies with the first four lots I checked. I 'm grasping at straws to find ammunition so that you can support a change in the pad heights without subjecting the city to a law suit from the builder. Please give me a little help and ask the Department of Public Works to investigate the heights . It may be that if you received bad figures and the homeowners received bad figures that ne have a common bond and can make a change without the threat of the builder suing . The plot plan shows !h pad elevation of 221 for all of the pads in the Germain Development . The pad elevation of my house is shown as 216 . 8 . The difference is 4 ' 4" . The wall plan supplied by Germain shows a retaining wall height of 2 ' 6" to 3 ' 6" . The retaining wall holds the dirt from his project back from our project, so the retaining wall height is the same as the difference in the two properties . Mr. Germain claimed at the City Council meeting that the numbers supplied were rough estimates . . . . . I cannot accept this , he is in the building business and had the exact numbers on the plans that he sent to us. . . . .why should they be estimates . If you actually measure the heights of the land at each edge of my property' you will find that the real difference is even higher than 4 ' 4" . I was using the Germain numbers during our meetings with the city and Germain . Had I known the actual numbers I never would have accepted his agreement to lower the grade two feet . If the .real numbers had been shown to the homeowners and they had understood the actual differences between the two properties there would have been such a furor that the city would have had great difficulty approving the plans . As representatives of the people living in the City of Palm Desert you, the City Council should stand up for what is right. TT 21791 , PP 86-36 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 15th day of July, 1986, hold a duly noticed public hearing to consider the request of GERMAIN DEVELOPMENT CO. , INC. , for approval of a precise plan of design, tentative tract map, and negative declaration of environmental impact to allow construction of a 20 lot single family detached project on a 5.02 acre parcel in the PR-5 zone located on the north side of Hovley Lane east of Monterey Avenue, more particularly described as: APN 622-020-010 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89, " in that the director of community development has determined that the project will not have an adverse impact on the environment and a negative declaration has been re ared. P P WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify granting approval of said precise plan and tentative tract map: 1 . The proposed map is consistent with applicable general and specific plan in that the net density of 5. 14 falls well within the general plan's density for the area of 5 to 7 units per acre. It also reflects the current goals of the city to encourage the development of single family detached housing. 2. The design or improvements proposed are consistent with applicable general and specific plans in that all public improvements will be to city standards and the public infrastructure (see environmental documents) can accommodate the proposed development at ultimate build out and occupancy. 3. The site is physically suited for the proposed subdivision in that no variances or code modifications are requested or necessary for the project's development. 4. The site is physically suited for the proposed density of development in that the 20 units can be constructed without modification and PLANNING COMMISSION RESOLUTION NO. 1167 will be compatible to previously developed R-1 zoned single family detached developments. 5. The design and improvements will not cause substantial environmental damage or injure fish and wildlife habitat in that as identified in the environmental documents the short and long range environmental impacts are minor and conditions of approval will mitigate the minor impacts identified. 6. The design of the subdivision and improvements will not cause public health problems in that all energy and building requirements must be complied with. 7. The subdivision will not conflict with any existing public easements In that any existing easement that is needed by the public will be retained or relocated as necessary. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm Desert, California, as follows: I . That the above recitations are true and correct and constitute the findings of the commission in this case; 2. That approval of Precise Plan 86-36 and TT 21791 are hereby granted for reasons subject to the attached conditions. ANALYSIS: The city's planned residential zone provides for the development of single family detached housing, leaving the development standards to generally be set at the precise plan hearing. In the recent past the need and desire to encourage development of single family detached housing has been affirmed by the residential committee of the Year 2000 Plan, the city council , and the planning commission itself. The project In question has a gross density (number of units total site area) of 3.96 units per acre with the zoning permitting five units per gross acre. The project's net density is 5. 14 units per acre (number of units/total site area, area for street right-of-way), the general plan calls for medium density residential land uses of 5 to 7 units per acre. The project, in short, conforms to both the underlying zoning and the general plan. The findings required for approval of a tentative tract map can be made affirmatively on this project. 1 . The proposed map is consistent with applicable general and specific plan in that the net density of 5. 14 falls well within the general plan's density for the area of 5 to 7 units per acre. It also reflects the current goals of the city to encourage the development of single family detached housing. 2. EARTH The grading that is involved is typical subdivision grading not requiring excavation or major earth movements. Based on previous projects developed in the area there is no evidence of unusual geologic substructures or soils conditions in the area. 2. AIR A. During construction there will be dust, which should not impact existing residents in the area because of one, prevailing wind direction and two, normal code dust control requirements. B & C The project site of five acres P J c s will not have an impact on climate or produce objectional odors. 3. WATER A. The site is a vacant parcel , without water running through the site, therefore, currents will not be effected. B. The net impact on in-absorption will be minimal in that while ground area that Is covered with non-absorption development will be offset by landscaping which will absorb greater amounts of water. In addition, runoff will be properly directed. C. 8 D. The project will be required to pay appropriate drainage fees to be used for the eventual development of flood control facilities In the area. In the short range waters will be directed to the proper point of disposal . E. Excavation is not required on the site. F. The Coachella Valley Water District states there is adequate water supply to serve the project. In addition, should public water needs requirements fall short they shall be given priority per normal policy. 4. PLANT LIFE There are no rare or endangered species of plant life on the site. While landscaping will introduce new species of Plants to the site, the materials used have been used previously in the Coachella Valley. INITIAL STUDY TT 217§1 5. ANIMAL LIFE: This wi l l result in the el iminatJon of fringe-toed lizard habitat area. However,, the impact will be mitigated by imposition of a $600 per acre fee to be used to acquire habitat area per the plan established by the U. S. Wildlife Service and California State Department of Fish and Game. 6. NATURAL RESOURCES The rate of use of natural resources will not be increased by the project since it must meet all current energy and construction requirements. The project will not require the use of any non-renewable natural resource. 7. ENERGY See discussion under item 6. 8. RISK OF UPSET Explosives or other hazardous materials will not be used on the project, with the exception of normal engine fuels used in grading equipment. 9. ECONOMIC LOSS See discussion under items 1 and 3. 10. NOISE Current DSNA and local regulations preclude the use of equipment which produce noise and vibration levels which exceed acceptable community standards. 11 . LAND USE The general area is developed and proposed to be developed with residential land uses. 12. OPEN SPACE The site is designated for residential development. 13. EMPLOYMENT While the project will result In short-term construction jobs, it will not result in any long term or permanent additional employment opportunities. 15. HOUSING The project's overall size assures that it will have no impact on the city's housing stock. 16. TRANSPORTATION/CIRCULATION While additional vehicles will be added to the street system, the volume falls into the planned street holding capacity and, therefore, will not have an adverse impact on the community. 17. PUBLIC SERVICE (FIRE PROTECTION) The project will have the usual demand on public facilities and school impact mitigation fees, as required by Desert Sands Unified School District, are being imposed. In terms of impacts on other public facilities the site is classified as infill and the public infrastructure has been developed to accommodate this development. 18. PUBLIC FISCAL BALANCE Again the project's size means no real appreciable impact on this area. 19. UTILITIES All public utilities indicate they can and will serve the project. 20.
