Since the "Conditions" are exactly the same for both maps, the following discussion applies equally. Condition # 1 . Since all that we did was to create an air space condominium from an existing cooperative, and no construction or alterations of any sort are going to take place, I believe we have satisfied this condition. Condition # 2. We anticipate recording the two maps within the next 60 days. We are still working on removing a tax lien that one of our owners had recorded against his unit by the government. Condition # 3. No easements or other dedications were required. Condition # 4. Resort Apartments Inc has approved a merger of itself into the exisitng Shadow Mountain Homeowners Association. Therefore we will simply come under the CC&R' s of this already exisitng homeowners association as well as its operating rules and management, both of which the City approved years ago when Shadow Mountain condominiums were developed. Since the City has already approved Shadow Mountain Homewoners Association' s CC&R' s as well as its managment documents, I have not enclosed them. However I do enclose copies of the following documents in support of our merger with them: a. Unanimous Consent of R. A. I . Owners approving the merger. Conditions of Approval continued . . . page 2 b. Letter from the Board of Directors of Shadow Mountain Homeowners Assoication certifying that their owners have approved the merger pursuant to the appropriate section of their CC&R' s. C. A copy of the Supplemental Condominium Declaration for Shadow Mountain Resort and Racquet Club. This is the document which we will record simultaneously with the Map. It is the vehicle by which the former R. A. I . owners become members of Shadow Mountain. It is undated although fully executed as the title company will insert the appropriate date when we are ready to record. d. Sample of the Corporate Grant Deed by which Resort Apartments, Inc. will grant to each former cooperative unit/shareholder his own condominium unit. Thirty one of these will be recorded at the time we are able to record the map. There was also an item in the Conditions concerning the Department of Building and Safety. Again, this property is an existing project which was built over 20 years ago, and no physical changes, additions or alterations are or will take place as a result of the conversion. We have received verbal exemption from Building and Safety regarding this condition and understand that if in the future there were to be physical changes to the buildings, then the permit process would require that such changes meet the various building codes etc. , then in force. 1 would appreciate receiving confirmation from you that the materials submitted with reference to Item # 4 are sufficient and that our understanding that Resort Apartments, Inc. , has met all the other conditions for both maps is correct. Continued Case No. PP 87-19 - SION GANNON, Applicants Request for approval of a negative declaration of environmental impact and precise plan for a two story, 9800 square foot retail /office building to be located at the southeast corner of Highway III and Larkspur Lane. Mr. Drell updated commission on the plans of the applicant showing development for the entire property and elevations. Mr. Drell noted that if the commission were to require the applicant to develop the entire property. (making this a different project) , the case would have to be re-advertised. Chairman Erwood opened the public testimony and asked if the applicant wished to address the commission. MR. CHARLES MARTIN, 48040 Thunderbird, Rancho Mirage, stated that the plan shows the walkway as an enclosed space, but noted that his clients. did not know for sure if this would be open or enclosed and would come back to commission for approval if it is to be enclosed. Mr. Martin stated that the plan calls for a phase 1 and phase 2 and informed commission that the applicant wishes to build only phase 1 at this time. Commissioner Ladlow asked Mr. Martin for a construction time frame. Mr. Martin replied that the phase I building was overdue right now but did not know about phase 2 and described the work that would be done as part of phase I . Commissioner Richards asked for the age of the building. Mr. Martin felt it was approximately 25 years old. Commissioner Downs noted that Keedy's had been there 30 years. Mr—Smith stated that a letter had been received from the applicants requesting a withdrawal . Staff had explained to them that it could not be withdrawn because the case had already been advertised. Staff also indicated that the commission could direct staff to prepare a resolution of denial and advise the applicant to file a conditional use permit, Mr. Diaz suggested that the request just be amended and readvert.ised so that the applicant would not be charged double fees . Mr. Erwin stated that the case could be denied without prejudice and this would allow the applicant to amend the application. Commissioner Richards felt that the other uses on the street should be studied before making a determination and asked that staff provide that information when the case comes before planning commission again. Case No. ZOA 87-1 - CITY OF PALM DESERT, Applicant Request for consideration of possible amendments to some of the development standards in the R-2 and R-3 zones. Mr. Smith explained that the intent was to generate discussion to determine what should be developed in the P.-2 and R-3 zones in terms of setbacks , height , garage doors facing the scenic corridors, density, and unit size and followed up with suggestions for mitigating these concerns. Commissioner Downs felt that the rules were overdone already and felt that it would make projects unfeasible to build. Chairman Erwood noted that staff was carrying out the wishes of council and indicated that economic feasibility was not a factor . Mr. Diaz noted that there was a notable lack people present to speak regarding this issue and indicated that staff was proposing an increase in open space and a elimination of a corridor . Commissioner Richards felt that the R-3 zone was the problem. Commissioner Downs suggested down zoning the property and then the developer could request a higher density. Commissioner Richards also noted that smaller, new projects would not be able to bring down housing costs. As such its unit sizes and amount of parking provided may not be in accord with the current requirements for a condominium projects in the city. In order to approve the tentative map commission is not required to make a finding of consistency with the zoning ordinance. Commission may wish to condition this approval to require approval of necessary variances to bring this project into conformity with the zoning ordinance. Building department comments, copy attached, could severely impact this ownership conversion in that extensive plans will be necessary to establish that these units comply with current building code requirements.
