We request that the present conditions on Tract Map 22712 allow for two (2) phases of construction. During each phase the developer would build approximately 46 homes. (see attachment) 2.) The Applicant request that he be allowed to delete the Recreation Lots to accommodate larger Lot sizes. The deletion will allow each home-owner to build their own private pools and Spas. In addition, the removal of these Lots will reduce the maintenance burden on the Home-Owners Association. CASE NO: TT 22712 APPLICANT: SAM ALACANO THE FLYING BUTTRESS P.O. Box 2247 73-241 Highway Ill Suite 4C Palm Desert, CA 92261 Palm Desert, CA 92260 1. BACKGROUND: The project previously was scheduled for public hearing but a continuance was requested by the applicant when he expanded the project from three five acre lots to five and included a new approach. The commission previously was misinformed that the applicant had withdrawn his application but new legal notices were mailed out none the less. The project site totals 23.75 acres and is adjacent to Casa Blanca on the east, is two lots or 660 feet east of Germain's Monterey Meadows project and bounded to the north by 660 feet of the vacant McBail property on the east end of the property and 160 feet on the west end by other vacant land, all of which is also zoned PR-5. San Tropez Villas also borders 820 feet to the north and is zoned AHDPR 22. The vacant PR-5 zoned land across Hovley has only one project approved for it; a five acre single family development proposed by the same applicant, consisting of 12,000 square foot lots and across Hovley from the western 330 feet of project. The Evangelical Church is also across Hovley but is directly across from vacant land that borders the site. The map on the legal notice further shows the vicinity. II. MAP DESCRIPTION The applicant's intention is to assemble the property, which he has done, then get a map approved with input from an ultimate builder that will purchase the project after map approval . He is locally represented by Moran/Smith and Associates. Architectural drawings will be submitted at a later date but setbacks and heights established at time of map approval and a wall constructed on the perimeter as part of the first phase. TT 22712 STAFF REPORT The map intended to duplicate somewhat the Sagewood project, that is a single family development of 100 8,000 square foot lots designed with curvi-linear streets sharing a common pool area. A copy of the Sagewood tract is included to show the similarities. The differences are that the streets will be private rather than public and gate entry provided. This enables the streets to be reduced in width but also means the association will assume maintenance responsibilities. Another difference will be that instead of one recreation area that also serves as a retention area at Sagewood ( 1 .7 acres) , the project provides three swimming pool lots spread throughout the site. A third difference will be that the applicant wants the right to be able to mix two story wherever possible on the site, similar to "The Regency" development on Country Club Drive adjacent to Palm Valley Country Club. The consolidation of the five lots into one enables limited access onto Hovley Lane while the design allows for a twenty foot wide area for an eight foot wide meandering sidewalk to be maintained by an association. The grading of the subdivision is designed to match adjacent grades with further detail shown on attached sheets. The setbacks are based on R-I standards with the 15' permissable if a side-in garage is utilized and 5' minimum sides permissable on both sides instead of only one which is the R-1 standard ( 14' total , 5' minimum) . The applicant's intention of mixing some two story into the project resulted in the condition that 25% of the lots could be two story and identified in the CC&R's on those particular lots. 2 TT 22712 STAFF REPORT A condition that should be paid some attention concerns the street improvements along Hovley Lane and tying the street improvements from this project to those from Germain's project. Public works is asking for full improvements but a more reasonable condition may be to provide extra pavement for the required travel lane only with the city acquiring the necessary right-of-way. III . FINDINGS: 1. The map is consistent with the general plan by providing four dwelling units per acre in an area designated as 3-5 dwelling units per acre. 2. The design and improvements are applicable with the general plan by providing limiting access onto Hovley Lane and a scenic easement. 3. The site is physically suitable for the type of development by being surrounded by residentially zoned land. 4. The site is physically suitable for the density by being able to be fairly level after minimal grading and matching adjacent project densities. 5. The project will damage wildlife habitat but will mitigate this through payment of fees. 6. The residential development will not produce any product that could cause public health problems. 7. The only necessary areas for easements through the property are already in place and will not be disturbed by the project. IV. ENVIRONMENTAL DOCUMENTATION: The director has determined the project not to have a significant environ- mental impact and a negative declaration has been prepared. V. RECOMMENDATION: To approve application and findings by adoption of Planning Commission Resolution No. Prepared by Reviewed and Approved by /dlg 3 PLANNING COMMISSION RESOLUTION NO. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, FOR APPROVAL OF A TENTATIVE TRACT MAP TO ALLOW A 100 LOT (97 HOME) SUBDIVISION LOCATED ON THE NORTH SIDE OF HOVLEY LANE BETWEEN PORTOLA AND MONTEREY AVENUE. CASE NO: TT 22712 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 1st day of December, 1987, hold a duly noticed public hearing to consider the request of SAM ALACANO for above mentioned project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a significant environmental impact and a negative declaration is hereby approved. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said tentative tract map. 1 . The map is consistent with the general plan by providing four dwelling units per acre in an area designated as 3-5 dwelling units per acre. 2. The design and improvements are applicable with the general plan by providing limiting access onto Hovley Lane and a scenic easement. 3. The site is physically suitable for the type of development by being surrounded by residentially zoned land. 4. WHEREAS, in the review of this tentative tract map the Planning Commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. RESOLUTION NO. NOW, THEREFORE, BE IF RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1 . That the above recitations are true and correct and constitute the findings of the commission in this case. 2. That it does hereby approve the above described Tentative Map No. 22712 for the reasons set forth in this resolution and subject to the attached conditions. DIAZ, Secretary /dlg 2 RESOLUTION NO. ° CONDITIONS OF APPROVAL CASE NO. TT 22712 Department of Community Development: 1 . The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 2. The applicant shall have twenty-four (24) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time as permitted by code is granted by planning commission. 3. All on-site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the director of environmental services. 4. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the city and free of all liens and encumbrances. 5. The CCSR's including setback and height restrictions for this development shall be submitted to the director of environmental services for review and final approval by the city attorney prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the city engineer: a. the document to convey title. b. covenants and restrictions to be recorded. C. management and maintenance agreement to be entered into with the owners of the units of the project. 6. Prior to submittal of the final map, the applicant shall provide the department of community development with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the director of community development. 7. Developer shall pay a fee in lieu thereof, as a condition of the final map, for park and recreation purposes per city requirements. The city shall commit the use of any such fees received within a five year period. 3 t RESOLUTION NO. B. Side yard setbacks shall be five feet, rear yard setbacks shall be 15 feet and front yard setbacks shall be 20 feet except where a side facing garage is used this may be reduced to 15 feet. 9. Maximum building heights shall be 15 feet with 25 lots allowed to be two story and 24 feet maximum height and recorded on the CCBR's but not to include lots on the periphery with the exception of those facing the apartment complex. 10. Periphery grades and pad heights shall be the same height or lower than adjacent grades and pad heights. 11 . Three lots shall be common recreation lots for swimming pools but shall not be adjacent to existing developments. 12. Maximum slope shall be 20% for the area between perimeter wall and top of curb along Hovley Lane. Department of Public Works: I . Drainage and signalization fund fees, as required by city ordinance, shall be pa i d prior to recordation of the final map as provided for by ordinance no. 218 and no. 507 and resolution no. 79-17 and 79-55. 2. Drainage facilities shall be provided, per Ordinance No. 218 and the master drainage plan, to the specifications of the director of public works. 3. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 4. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 5. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as-built" plans submitted to the department of public works prior to the project final . 6. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the director of public works for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 7. All private streets shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 4 RESOLUTION NO. 8. Landscaping maintenance on Hovley Lane shall be provided by the homeowner's association. 9. Existing utilities shall be undergrounded per each respective utility district's recommendation. If determined to be unfeasible applicant shall agree to participate in any future utility undergrounding district. 10. Traffic safety striping on Hovley Lane shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to and approved by the director of public works before placing pavement markings. 11 . Complete grading plans and specifications shall be, submitted, as required by ordinance, to the director of public works for checking and approval prior to issuance of any permits. 12. Dedication of Il feet of right-of-way on Hovley Lane as provided for within the circulation element of the C.P.D. General Plan shall be done prior to issuance of any permits and approval of plans. 13. Installation of curb and gutter, matching paving and 8 foot wide meandering sidewalk on Hovley Lane. 14. Waiver of access to Hovley Lane except at approved locations shall be granted on the final map. 15. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to recordation of the final map. 16. Full improvement of interior streets based on private street standards as established in accordance with Chapter 26, Section 26.40.040, C.P.D. Code. 17. Traffic analysis to be prepared for the project to address the specific impacts on existing networks (street and intersections) and the proposed mitigation measures recommended for approval by the city. 18. Installation of sewers to serve this project. 19. Complete tract map shall be submitted as required by ordinance to the director of public works for checking and approval and be recorded before issuance of any permits. 20. Any and all off-site improvements shall be preceded by the approval of plans and issuance of valid encroachment permits by the department of public works. 5 RESOLUTION NO. 21 . A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the department of public works prior to issuance of the grading permit. 22. The subdivision shall be designed as necessary to provide for conformance with the city's proposed north side storm drain system and ultimate roadway profile and improvements for Hovley Lane. 23. Hovley Lane street improvements shall include the construction of curb, gutter, match-up paving and eight foot meandering sidewalk westerly of the proposed subdivision to match existing improvements. City Fire Marshal : The following fire protection requirements are in accordance with the Uniform Fire Code and Life Safety Code standards 1 . Install a water system capable of delivering 1500 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in TT 22712 is in accordance with the requirements prescribed by the fire marshal". 6 RESOLUTION NO. 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Whenever access into private property is controlled through use of gates, barriers, guard houses or similar means, provision shall be made to facilitate access by emergency vehicles in a manner approved by the fire department. All controlled access devices that are power operated shall have a radio controlled over-ride system capable of opening the gate when activated by a special transmitter located in emergency vehicles. Devices shall be equipped with backup power facilities to operate in the event of power failure. All controlled access devices that are not power operated shall also be approved by the fire department. Developer shall pay a fee in lieu thereof, as a condition of the final map, for park and recreation purposes per city requirements. the city shall conrnit the use of any such fees received within a five year period. 8. All structures shall be single story with a maximum height of 18 feet, however, any structure over 15 feet in height must be approved by the Palm Desert Architectural Commission. 10. Periphery grades and pad heights shall be the same height or lower than adjacent grades and pad heights. 11 . Three lots shall be common recreation lots for swimming pools but shall not be adjacent to existing developments. 12. Maximum slope shall be 20% for the area between perimeter wall and top of curb along Hovley Lane. 13. Applicant shall pay fringe-toed lizard mitigation fee prior to recordation of final ($600 per acre) . 14. Applicant shall construct a six foot high masonry wall around the perimeter of the project. a. Said wall must be submitted and approved by the director of community development prior to construction.. b. Wall along Hovley Lane shall be located 20 feet from curb face. 15. Applicant shall submit interior fencing plans and materials to the director of community development for approval . 16. Because of the unusual shape of some parcels it may be necessary for setback modifications to be granted to. permit construction of homes of equal size and aesthetic impact of other units in the development. Such modifications shall be approved by the director of community development. 17. The lots needing said modifications identified in condition 16 above, shall he identified by the applicant and approved by the planning commission prior to the recordation of a final map. 18. Perspective buyers shall be informed of those lots which may require setback modifications. The City of Palm Desert shall be provided with documentation that this information has been dispensed. The method of accomplishing this condition shall be approved by the director of community development prior to recordation of final map. 19. Perspective buyers adjacent to vacant land should be informed that future development on such land (condition 9) could impact their views. The method of providing such information shall be approved by the director of community development prior to recordation of final map. 4 PLANNING COHNISSION RESOLUTION NO. 1266 Department of Public Works: I . DraInace and signaIization fund fees, as required by r_ity ordinance, shall he paid prior to recordation of the final map as provided for by ordinance no. 218 and no. 507 and resolution no. 79- 17 and 79-55. 2. Drainage facilities shall be provided, per Ordinance No. 218 and the .master drainage plan, to the specifications of the director of public works. 3. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 4. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 5. improvement plans for water and sewer systems shall be approved by the respective service districts with "as-built" plans submitted to the department of public works prior to the project final . 6. Dedication of II feet of right-of-way on Hovley Lane as provided for within the circulation element of the C.P.D. The subdivision shall be designed as necessary to provide for conformance with the city' s proposed north side storm drain system and ultimate roadway profile and improvements for Hovley Lane. 23. Hovley Lane street improvements shall include the construction of AC paving to a width of twenty-four feet north of the Hovley Lane center line from the westerly project boundary to the existing improvements of Tract 21791 . The subdivider shall enter into a reimbursement agreement with the city to provide for reimbursement of only the actual construction costs associated with the fulfillment of this condition. 6 PLANNING COMMISSION RESOLUTION NO. 1266 City Fire Narshal : The following fire protection requirements are in accordance with the Uniform Fire Code and Life Safety Code standards. I . Install a water system capable of delivering 1500 GPM fire flow from any fire hydrant for a 2 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. r_. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer: 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: " I certify that the design of the water system in TT 22712 is in accordance with the requirements prescribed by the fire marshal ". Prior to rlellvory of comhu,tible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Whenever access into private property is controlled through use of gates, barriers , guard houses or similar means, provision shall be made to facilitate access by emergency vehicles in a manner approved by the fire department. All controlled access devices that are power operated shall have a radio controlled over-ride system capable of opening the gate when activated by a special transmitter located in emergency vehicles. Devices shall be equipped with backup power facilities to operate in the event of power failure. All controlled access devices that are not power operated shall also be approved by the fire department. Case No. TT 22� SAM ALACANO, Applicant Request for approval of a 100 lot residential subdivision and negative declaration of environmental impact located on the north side of Hovley Lane, 2,000 feet east of Portola Avenue (west of Casablanca) . Mr. Diaz outlined the salient points of the staff report and expressed concern for installing an exterior wall to surround the project and creating a double wall in one area. He stated that a condition could be added that a six foot masonry wall be constructed along the perimeter of the project. He also explained that applicant is being required to pay for an additional travel lane between his project and the Germain project to the west and that staff believes that this condition is appropriate in that when this development occurs, there will be traffic generated on Hovley Lane, creating the need for additional improvements. Mr. Diaz indicated that a reimbursement agreement should be recorded that when the two vacant lots develop, the applicant will be repaid at a one to one cost. Mr. Gaugush also indicated that public works condition #23 should be amended to read that Hovley Lane street improvements shall include the construction of AC paving to a width of twenty-four feet north of the Hovley Lane center line from the westerly project boundary to the existing improvements of Tract 21791 . Commissioner Whitlock asked for and received clarification regarding the amount of open space being provided. Vice Chairman Richards informed commission that study was being done on some of the open space requirements and felt that in the ordinance there are some sections that need revision. Vice Chairman Richards opened the public testimony and asked if the applicant wished to address the commission. MR. MARK MORAN, 54-510 Avenida .Ruplo in La Quinta, stated that the homeowners association was contacted in Casablanca and described the recreational amenities to be provided. He also stated that the potential developer is from outside the area, but possesses extensive experience in California. He informed commission that the two story units would be in the middle of the project and next to San Tropez. Mr. Moran indicated that staff recommended that persons purchasing homes and lots be informed of the two story units and found this acceptable. He requested that they be allowed to work with staff to eliminate one of the walls, preferably extending their property to the existing wall , and provide landscaping. Mr. Diaz requested the name of the potential developer. Mr. Moran replied Kaufman 8 Broad, in conjunction with the Lyle Fain Companies out of Warwick, Rhode Island. Upon questioning by Vice Chairman Richards, Mr. Moran indicated that they wished to provide two story units because of some irregular lot configurations. Vice Chairman Richards did not feel the two story units and lot configurations were indicative of city goals. Commissioner Whitlock asked about the number of exits and Mr. Moran replied there are two. I Vice Chairman Richards asked if anyone present wished to speak in FAVOR or opposition to the proposed. MR. MARK NETTLEY, resident of Casablanca, informed commission that he works for Best, Best 8 Krieger, but was present as a i board member of the homeowners association. He indicated that his concern regarding the two-story structures had been addressed, since they would be away from Casablanca. He also expressed concern regarding an urgent need for a traffic signal at Monterey to be installed immediately, and a sight distance 5 MINUTES PALM DESERT PLANNING COMMISSION DECEMBER 1, 1987 problem which could be addressed by adoption of a condition requiring grading the hill down and indicated that there has been many near accidents at the church. He also expressed concern regarding the double wall and 11 foot drop. He stated that they are working with the developer to eliminate one wall and provide landscaping, but the matter has not been resolved. Mr. Nettley also noted that the map calls for a 20 feet setback that was not included in the conditions and requested that it be added. Vice Chairman Richards informed Mr. Nettley of the city's study to use Monterey Avenue and Cook Street to allow traffic in and out of the city and would not be in favor of a traffic signal . He indicated that it was a situation where a small group of people would benefit from the signal versus no signal to benefit the whole city. Mr. Nettley felt that the additional light would not impede through traffic. MR. VICTOR VILLENEUVE, 43-349 Juaquln, spoke as the engineer representing the applicant and addressed the issue of the sight-distance problem. He explained that the grade would be up 4 112 feet at Casablanca and would make a gradual drop of 6 112 feet, which would change the profile of Hovley lane and eliminate this problem. Mr. Villeneuve also reviewed the _. location of the two-story units. Vice Chairman Richards did not feel the two-story units were appropriate and suggested an alternative of waiving setback requirements on the odd-shaped lots and reduce the units to one story. Mr. Diaz stated that this is allowable in the planned residential zone. Vice Chairman Richards asked if anyone else present wished to address the commission. There being no one, he closed the public testimony. Commissioner Downs concurred with the deletion of the two-story units and felt that a common wall was needed. Commissioner Whitlock asked if there was anything the city could do ' to reduce the sight-distance problem at the church. Mr. Gaugush stated that the grading to be done goes beyond the limits of the subdivision and would include eliminating the problem at the church. Commissioner Whitlock asked if condition #23 should be modified to include east, and Mr. Diaz replied no, that the city would be providing that portion. All on-site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the director of environmental services. 4. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the city and free of all liens and encumbrances. 5. The CCBR's including setback and height restrictions for this development shall be submitted to the director of environmental services for review and final approval by the city attorney prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the city engineer: a. the document to convey title. b. covenants and restrictions to be recorded. C. management and maintenance agreement to be entered into with the owners of the units of the project. 6. Prior to submittal of the final map, the applicant shall provide the department of community development with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the director of community development. 7. Developer shall pay a fee in lieu thereof, as a condition of the final map, for park and recreation purposes per city requirements. Side yard setbacks shall be five feet, rear yard setbacks shall be 15 feet and front yard setbacks shall be 20 feet except where a side facing garage is used this may be reduced to 15 feet. 3 PLANNING COMMISSION RESOLUTION NO. 9. All structures shall be single story with a maximum height of 18 feet, however, any structure over 15 feet in height must be approved by the Palm Desert Architectural Commission. 10. Periphery grades and pad heights shall be the same height or lower than adjacent grades and pad heights. 11 . Three lots shall be common recreation lots for swimming pools but shall not be adjacent to existing developments. 12. Maximum slope shall be 20% for the area between perimeter wall and top of curb along Hovley Lane. 13. Because of the unusual shape of some parcels it may be necessary for setback modifications to be granted to permit construction of homes of equal size and aesthetic impact of other units in the development. The lots needing said modifications identified in condition 16 above, shall be identified by the applicant and approved by the planning commission prior to the recordation of a final map. 18. Perspective buyers shall be informed of those lots which may require setback modifications. The City of Palm Desert shall be provided with documentation that this information has been dispensed. The method of accomplishing this condition shall be approved by the director of community development prior to recordation of final map. 19. Perspective buyers adjacent to vacant land should be informed that future development on such land (condition 9) could impact their views. The method of providing such information shall be approved by the director of community development prior to recordation of final map. 4 PLANNING COMMISSION RESOLUTION NO. Department of Public Works: 1 . Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of the final map as provided for by ordinance no. 218 and no. 507 and resolution no. 79-17 and 79-55. 2. Drainage facilities shall be provided, per Ordinance No. 218 and the master drainage plan, to the specifications of the director of public works. 3. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 4.
