A RESOLUTION OF THE PLANNING., COMMISSION OF THE
CITY OF PALM DESERT, CALIFORNIA, FOR APPROVAL OF
A TEN LOT SINGLE FAMILY SUBDIVISION LOCATED ON
THE SOUTH SIDE OF HOVLEY LANE, 1650 FEET EAST OF
MONTEREY AVENUE.
CASE NO: TT 22713
WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the Ist day of September, 1987, hold a duly noticed public hearing to
consider the request of SAM ALACANO for above mentioned project.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89", in that the director of environmental services has
determined that the project will not have an adverse environmental impact and
a negative declaration is hereby certified.
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all persons des iringto be heard, said
planning commission did find the following facts and reasons to exist to
justify the granting of said tentative tract map.
a. That the proposed map is consistent with applicable general and
specific plans.
b. That the design or improvement of the proposed subdivision is
consistent with applicable general and specific plans.
C. That the site is physically suitable for the type of development.
d. That the site is physically suitable for the proposed density of
development.
e. That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.
f. That the design of the subdivision or the type of improvements is
not likely to cause serious public health problems.
g. That the design of the subdivision or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of, property within the proposed subdivision.
h. That the design of the subdivision will not restrict solar access.
WHEREAS, in the review of this tentative tract map the Planning Commission
has considered the effect of the contemplated action on the housing needs of
the region for purposes of balancing these needs against the public service
needs of the residents of the City of Palm Desert and its environs, with
available fiscal and environmental resources.
NOW, THEREFORE, BE IF RESOLVED by the Planning Commission of the City of
Palm Desert, as follows:
I . That the above recitations are true and correct and constitute the
Findings of the commission in this case.

CONDITIONS OF APPROVAL
CASE NO. TT 22713
Department of Community Development:
I . The development of the property shall conform substantially with exhibits
on file with the department of community development, as modified by the
following conditions.
2. Construction of a portion of said project shall commence within one year
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null , void and of no effect
whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain permits
and/or clearance from the following agencies:
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Public Works Department
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. Applicant to pay applicable lizard, art and school impact fees in
accordance with adopted city policies.
6. Additional 8' of scenic easement required along Hovley Lane in accordance
with other projects along Hovley lane.
7. Perimeter wall to be constructed at top of slope and/or anticipated pad
height.
8. Interior property lines to be located at top of slopes between pad
heights.
9. Front setbacks shall be 20 feet for all lots.

10. Side setbacks shall total 20' , 8' minimum for all lots.
11 . Rear setbacks shall be 20' for all lots, except lots 6-10 the rear
setback shall be 30 feet if a second story is proposed.
12. Maximum building height shall be two stories or 24 feet for all lots,
except lots 6-10 the maximum building height shall be 22 feet or two
stories.
13. The only development
p ent allowed on the lots will be single family detached
residences, except for lot 11 , to be used for retention purposes only.
Department of Public Works:
1 . Drainage and signalization fund fees, as required by city ordinance,
shall be paid prior to recordation of the final map or grading permit
issuance, whichever occurs first.
2. Full public improvements, including traffic safety lighting, as required
by ordinance and the director of public works, shall be installed in
accordance with city standards.
3. Complete improvement plans and specifications shall be submitted, as
required by ordinance, to the director of public works for checking and
approval before construction of any improvements is commenced. The
engineer shall submit "as-built" plans prior to the acceptance of the
improvements by the city.
4. All private streets shall be inspected by the engineering department and a
standard inspection fee shall be paid prior to grading permit issuance or
recordation of the final map, whichever occurs first.
5. Landscaping maintenance on Hovley Lane shall be provided by the
homeowner's association.
6. Existing utilities shall be undergrounded per each respective utility
district' s recommendation. If determined_ to be unfeasible applicant
shall agree to participate in any future utility undergrounding district.
7. Complete grading plans and specifications shall be submitted, as required
by ordinance, to the director of public works for checking and approval
prior to issuance of any permits.
8. Dedication of 11 feet of right-of-way on Hovley Lane shall be done prior
to issuance of any permits and approval of plans.
9. Installation of curb and gutter , matching paving and 8 foot wide
meandering sidewalk on Hovley Lane.

10. Waiver of access to Movley Lane except at approved locations shall be
granted on the final map.
11 . Offsite improvement plans to be approved by public works department and a
surety posted to guarantee the required offsite improvements prior to
recordation of the final map or grading permit issuance, whichever occurs
first.
12. Full improvement of interior streets based on private street standards as
established in accordance with Chapter 26, Section 26.40.040, C.P.D. Code.
13. Complete tract map shall be submitted as required by ordinance to the
director of public works for checking and approval and be recorded before
issuance of any permits.
14. Any and all off-site improvements shall be preceded by the approval of
plans and issuance of valid encroachment permits by the department of
public works.
15. A complete preliminary soils investigation, conducted by a registered
soils engineer, shall be submitted to and approved by the department of
public works prior to issuance of the grading permit.
16. Pad elevations as shown on the tentative map are subject to review and
revision by the director of public works.
City Fire Marshal :
The following fire protection requirements are in accordance with the Uniform
Fire Code and Life Safety Code standards.
1 . Install a water system capable of delivering 1500 GPM fire flow from any
fire hydrant for a 2 hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time of
measurement.
2. Install Riverside County super fire hydrants so that no point of any
building is more than 250 feet from a fire hydrant measured along approved
vehicular travel ways.
a. exterior surface of hydrant barrels and heads shall be painted
chrome yellow and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each
hydrant.
C. hydrants shall not be located closer than 25 feet to any building.

3. Prior to issuance of a building permit, the developer shall furnish the
original and three copies of the water system plan to the fire marshal
for review. Upon approval , one copy will be sent to the building
department and the original will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer and
approved by the water company with the following certification: "1
certify that the design of the water system in TT 22713 is in accordance
with the requirements prescribed by the fire marshal ".
5. Prior to delivery of combustible materials to the building site, the
required water system shall be installed, operating and delivering the
required flow.
6. Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approval .

Ms. Sass outlined the salient points of the staff report, noting
that parking spaces are available because of empty space in the
building and recommended approval .
Commissioner Whitlock received clarification regarding the ability
to revoke the additional seating if parking becomes a problem. Ms.
Sass also indicated that under the ordinance 12 seats are allowed,
but stated that this is a larger area. Commissioner Ladlow asked if
the empty part of the building could be rented to someone else. Ms.
Sass replied yes. Chairman Erwood asked if more parking would be
required. Ms. Sass replied that it would be difficult to lease
space without parking.
Commissioner Richards felt that commission should determine whether
or not there was enough parking, noting that some parking was
available across the street. Commissioner Downs stated that there
were 100 spaces open last time he was there.
Mr. Diaz noted that if the parking becomes a problem, the conditional
use permit can be revoked under the nuisance ordinance, which allows
staff the ability to resolve any future problems.
Chairman Erwood opened the public testimony and asked if the
applicant wished to address the commission.
MR. DAVID FOREMAN stated that he was present to answer any
questions. He noted that there is parking across the street
available at all times and on-street parking.
Chairman Erwood asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed. The being no one, the public testimony
was closed.

Moved by Commissioner Downs , seconded by Commissioner Richards,
adopting the findings as presented by staff. Carried 5-0.

Mr. Diaz outlined the salient points of the staff report and added a
condition to community development that the only development allowed
on the lots will be single family detached units, except for lot 11 ,
to be used for retention purposes only.
Chairman Erwood opened the public testimony and asked if the
applicant wished to address the commission.
MR. MICHAEL HURST, 3699 Cathedral Canyon, stated that he had no
problems with the conditions. Commissioner Downs asked if he
concurred with the added condition. Mr. Hurst replied yes.
Chairman Erwood asked if anyone present wished to speak in FAVOR or
OPPOSITION to the proposed.
MR. VICTOR VILLENEUVE, 73-241 Highway 111 , expressed concern
with condition #6 and how the easement would be handled, final
map or separate easement. Mr. Diaz replied final map. Mr.
Villeneuve also expressed concern regarding condition #9. Mr.
Diaz explained that there was a concern regarding double wall
construction. After further discussion, commission concurred
with the deletion of condition #9.
Commissioner Ladlow addressed the issue of individual buyers
requesting to build two-story homes. Mr. Villeneuve clarified that
property would be sold as custom home sites. Mr. Villeneuve also
discussed heights. Staff clarified that landscaping would be
maintained by an association.
Chairman Erwood closed the public testimony.
Action:
Moved by Commissioner Downs , seconded by Commissioner Whitlock,
adopting the findings as presented .by staff. Carried 5-0.

1. BACKGROUND:
A. SURROUNDING ZONING/LAND USE:
North: PR-5/vacant
South: PR-5/Monterey Country Club
East: PR-5/vacant
West: PR-5/Desert Evangelical Free Church
B. PROPERTY DESCRIPTION:
The property is zoned PR-5, shown on the general plan as 3-5 DU/acre,
on the north sphere plan being prepared by WRT as R-I 3.2-5 DU/acre
and consists of rolling sand dunes.
11- PROJECT DESCRIPTION:
The map consists of a cul-de-sac with five lots on each side, a center
landscaped median and a retention area at the street's end. The
cul-de-sac has a slight bend creating varying lot depths enabling lot
sizes to range from 12,500 square feet to 20,000 square feet. The center
median is 10 feet wide and would be maintained, together with the Hovley
Lane frontage by an association. The Hovley landscaping is conditioned
to be 20 feet wide with the intention being to place the perimeter wall
at the top of all slopes so that no new walls would be necessary. it
would also be the intent to locate property lines at the top of slopes in
the interior of the subdivision to avoid future retaining walls between
lots.
STAFF REPORT TT 22713
The site topography dictates the grading of the subdivision. The site
naturally slopes from south to north and west to east. The lots on the
west side of the proposed cul-de-sac then will be from 2 to 6 feet below
the adjacent church's parking lot level with off-site grading onto the
applicant's property previously approved for the church while the lots on
the east side of the proposed cul-de-sac will range from I to 8 feet
above adjacent vacant land. In this situation any perimeter subdivision
wall will be built at the top of slope, regardless of property line
adjustments or off-site grading permits to again avoid the necessity of a
second wa 1 1 when a home is constructed on the lot. The site itself is
proposed to drain to the rear, similar to what was done on the church
site, into a retention basin to be maintained by the association. This
avoids excessive filling adjacent to Monterey Country Club which is
separated by a dense row of tamarisk trees and a six foot masonry wall
constructed by Monterey Country Club. The project will be conditioned
not to be allowed to construct a new wall along it's southern boundary so
not to create an alleyway that would be impossible to maintain.
The applicant has also stated that he would like the ability to sell the
lots individually (custom lots) and the buyers be allowed to build two
story if requested. Staff does not see' a problem with this for the lots
on the west side of 'the cul-de-sac since the adjacent church is graded
higher and the church structure itself is 30 feet but on the east side
of the cul-de-sac the situation is different where the adjacent vacant
lot wi l l be lower and has no plans. Condition numbers 12 and 13 wi l l
address this in a fashion that staff believes will not create view
obstructions.

traffic onto a secondary roadway.

being adjacent to other residential developments.
4. That the site is physically suitable for the proposed density
of development by being rolling sand dunes and primarily level .
5. That the design of the subdivision or the proposed improvements

substantially and avoidably injure fish or wildlife or their habitat
by mitigating existing known endangered species impacts.
6. That the design of the subdivision or the type of improvements
are not likely to cause serious public health problems by being a
standard residential project.
7. That the design of the subdivision or the type of improvements
will not conflict with easements, acquired by the public at large,
for access through or use of property within the proposed subdivision
by dedications as conditions of approval .

CONDITIONS OF APPROVAL

Department of Community Development:
1 . The development of the property shall conform' substantially with exhibits
on file with the department of community development, as modified by the
following conditions.
2. Construction of a portion of said project shall commence within one year
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null , void and of no effect
whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain permits
and/or clearance from the following agencies:
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Public Works Department
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. Applicant to pay applicable lizard, art and school impact fees in
accordance with adopted city policies.
6. Additional 8' of scenic easement required along Hovley Lane in accordance
with other projects along Hovley lane.
7. Perimeter wall to be constructed at top of slope and/or anticipated pad
height.
8. Interior property lines to be located at top of slopes between pad
heights.
9. No new wall to be constructed along southerly tract boundary.

10. Front setbacks shall .be 20 feet for all lots.
11 . Side setbacks shall total 20' , 8' minimum for all lots.
12. Rear setbacks shall be 20' for all lots, except lots 6-10 the rear
setback shall be 30 feet if a second story is proposed.
13. Maximum building height shall be two stories or 24 feet for all lots,
except lots 6-10 the maximum building height shall be 22 feet or two
stories.
Department of Public Works:
I . Drainage and signalization fund fees, as required by city ordinance,
shall be paid prior to recordation of the final map or grading permit
issuance, whichever occurs first.
2. Full public improvements, including traffic safety lighting, as required
by ordinance and the director of public works, shall be installed in
accordance with city standards.
3. Complete improvement plans and specifications shall be submitted, as
required by ordinance, to the director of public works for checking and
approval before construction of any improvements is commenced. The
engineer shall submit "as-built" plans prior to the acceptance of the
improvements by the city.
4. All private streets shall be inspected by the engineering department and a
standard inspection fee shall be paid prior to grading permit issuance or
recordation of the final map, whichever occurs first.
5. Landscaping maintenance on Hovley Lane shall be provided by the
homeowner's association.
6. Existing utilities shall be undergrounded per each respective utility
district' s recommendation. If determined to be unfeasible applicant
shall agree to participate in any future utility undergrounding district.
7. Complete grading plans and specifications shall be submitted, as required
by ordinance, to the director of public works for checking and approval
prior to issuance of any permits.
8. Dedication of 11 feet of right-of-way on Hovley Lane shall be done prior
to issuance of any permits and approval of plans.
9. Installation of curb and gutter, matching paving and 8 foot wide
meandering sidewalk on Hovley Lane.

10. Waiver of access to Hovley Lane except at approved locations shall be
granted on the final map.
11 . Offsite improvement plans to be approved by public works department and a
surety posted to guarantee the required offsite improvements prior to
recordation of the final map or grading permit issuance, whichever occurs
first.
12. Full improvement of interior streets based on private street standards as
established in accordance with Chapter 26, Section 26.40.040, C.P.D. Code.
13. Complete tract map shall be submitted as required by ordinance to the
director of public works for checking and approval and be recorded before
issuance of any permits.
14. Any and all off-site improvements shall be preceded by the approval of
plans and issuance of valid encroachment permits by the department of
public works.
15. A complete preliminary soils investigation, conducted by a registered
soils engineer, shall be submitted to and approved by the department of
public works prior to issuance of the grading permit..
16. Pad elevations as shown on the tentative map are subject to review and
revision by the director of public works.
City Fire Marshal :
The following fire protection requirements are in accordance with the Uniform
Fire Code and Life Safety Code standards.
1 . Install a water system capable of delivering 1500 GPM fire flow from any
fire hydrant for a 2 hour duration in addition to domestic supply. The
computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time of
measurement.
2. Install Riverside County super fire hydrants so that no point of any
building is more than 250 feet from a fire hydrant measured along approved
vehicular travel ways.
a. exterior surface of hydrant barrels and heads shall be painted
chrome yellow and the tops and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each
hydrant.
C. hydrants shall not be located closer than 25 feet to any building.

3. Prior to issuance of a building permit, the developer shall furnish the
original and three copies of the water system plan to the fire marshal
for review. Upon approval , one copy will be sent to the building
department and the original will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer and
approved by the water company with the following certification: "I
certify that the design of the water system in TT 22713 is in accordance
with the requirements prescribed by the fire marshal ".
5. Prior to delivery of combustible materials to the building site, the
required water system shall be installed, operating and delivering the
required flow.
6. Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approval .
