APPLICANT: Ironwood Associates 41-555 Cook Street, Suite 200 Palm Desert, CA 92260 I . BACKGROUND: A. SITE DESCRIPTION: The property consists of a vacant parcel with sand dunes and native scrub. A retention basin in the northeast corner of the parcel collects the runoff from the industrial park. B. ADJACENT ZONING AND LAND USE: North: PR-4. O.S./Marriott Golf Course South: RIM/Portola Country Club and Vacant East: S. I . , S.P./Cook Corporate Center West: PR-5 and O.S./Vacant C. GENERAL PLAN LAND USE DESIGNATION: Park. II . PROJECT DESCRIPTION: The proposal is for development of an approximately 26 acre family golf center consisting of a driving range, practice green with pitching area, stadium miniature golf and a 2,000 square ..Foot club house. A small pond is proposed at the southwest corner of the property. The primary use is recreation and teaching golf. Parking will be located at the northwest corner of the site with access off Hovley Lane. DISCUSSION: The proposed project is consistent with the zoning designation of open space which allows private recreation as a conditional use. Under the zoning designation the design and physical suitability of the site would be acceptable. Staff could recommend approval of the request for a conditional use permit if the additional parking spaces were provided to meet the requirement. Staff will require submittal of a complete lighting plan to assure the pr-o.ject will not affect surrounding properties. The general plan designation of this parcel as 'park' requires some interpretation. Most of the park designations on the general plan land use map are privately held lots. Prior applications, such as the Marriott Golf Course, have received general plan amendments changing the land use designation from 'park' to 'open space' which was intended to provide for private recreation as a next best choice to the public recreation the land was apportioned for. The application under review offers the same opportunity for the city to provide a much needed recreational development for its youth. The city is fast moving toward realization of centralizing all its public recreation resources to the civic center area. In line with this policy, the release of land previously designated as 'park' seems the only reasonable course of action. Thus allowing vacant, unimproved areas to be developed. IV. ANALYSIS: A. FINDINGS FOR APPROVAL OF A TENTATIVE: TRACT MAP: 1 . That. the Proposed mjr) is consistent with apPlicable c,leneral and specific_ plans. Justification: The project subdivision is permitted on the property as zoned and, therefore, is consistent with the general plan, 2. That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. 2 PC STAFF REPORT CUP 87-I1 , TT 22794 SEPTEMBER 15, 1987 Justification: All public streets will be dedicated and improved and sufficient drainage facilities will be provided in conformance with the general plan guidelines and city ordinances. 3. That the site is physically suitable for the type of development. Justification: The 25.86 acre site is sufficiently large to allow the project as proposed. The relatively flat terrain, access to major streets, and amount of open space insure that the site is physically suitable for the project. 4. That the site is physically suitable for the proposed density of development. Justification: The design of the project indicates that the site is suitable for the proposed density of development because the site can be served by respective utilities, the city, and existing or proposed circulation system. • 5. The design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. Justification: The design will not cause substantial environmental damage or injure fish or wildlife or their habitat because it , will be constructed in compliance with applicable regulations and the proposed negative declaration has determined that any adverse environmental impacts will be mitigated. 6. That the design of the subdivision or the type of improvements are not likely to cause serious public health problems. Justification: The design will not cause serious public_ health problems because it will be in compliance with applicable health, safety and building codes. 7. That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. 3 PC STAFF REPORT CUP 87-1I , TT 22794 SEPTEMBER 15, 1987 Justification: There have been no easements acquired by the public at large for access through or use of property within the proposed subdivision. B. ENVIRONMENTAL REVIEW: The director of community development has determined that the proposed project will not have any significant adverse impacts on the environment that cannot be mitigated. Therefore, a Negative Declaration of Environmental Impact has been prepared and is recommended for approval . The mitigation measures have been incorporated into the recommended conditions of approval . V. RECOMMENDATION: Staff recommends: A. Adoption of the findings; B. CUP 87-I1 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 15th day of September, 1987, hold a duly noticed public hearing to consider the above mentioned project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89, " in that the director of community development has determined that the project will not have an impact on the environment and a negative declaration is hereby certified; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify the granting of said conditional use permit: 1 . The proposed location of the conditional use is in accord with the objectives of the zoning ordinance and the purpose of the district in which the site is located. 2. The proposed location of the conditional use and the conditions under which it will be operated and maintained will not be detrimental to the public health, safety or general welfare, or be materially injurious to properties or improvements in the vicinity. 3. The proposed conditional use will comply with each of the applicable provisions of this title, except for approved variances or adjustments. 4. The proposed conditional use complies with the goals, objectives, and policies of the city's adopted general plan. NOW, THEREFORE, BE IT RESOLVED by the Plarming Commission of the City of Palm Desert, California, as follows: 1 . That the above recitations are true and correct and constitute the findings of the commission in this case; 2. The development of the property shall conform substantially with exhibits on file with the department of community development/planning, as modified by the following conditions. 2. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise, said approval shall become null , void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Commission City Fire Marshal Public Works Department Palm Desert Water & Services District Palm Desert Disposal Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 5. Payment of lizard mitigation fees required prior to issuance of grading permit. 6. Project shall pay fees as determined by .;;Desert Sands Unified School District. 7. Payment of park dedication fees in lieu of land dedication as per Ordinance No. 328. 8. Eighty (80) parking spaces shall be provided to upgrade site plan to comply with code. 3 PLANNING COMMISSION RESOLUTION NO. 9. Detailed parking lot and building lighting plan shall be submitted to, staff for approval , subject to applicable lighting standards, plan to be prepared by a qualified lighting engineer. 10. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of the final map. 2. Drainage facilities shall be provided per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the director of public works. 3. Full public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance .with city standards. 4. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the director of public works for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 5. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to recordation of the final map. 6. Landscaping maintenance on Hovley Lane/42nd Avenue shall be providedby the property owner. 7. Existing utilities shall be undergrounded per each respective utility district' s recommendation. If determined to be unfeasible, applicant shall agree to participate in any future utility undergrounding district. 8. Traffic safety striping on Hovley Lane/42nd Avenue shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to and approved by' the director of public works before placing pavement markings. 9. Complete grading plans and specifications shall be submitted, as required by ordinance, to the director of public works for checking and approval prior to issuance of any permits. 4 PLANNING COMMISSION RESOLUTION NO. 10. Dedication of 44 feet of right-of-way on 42nd Avenue shall be done prior to issuance of any permits and approval of plans. 11 . Installation of curb and gutter, matching paving and eight foot meandering sidewalk on Hovley Lane and 42nd Avenue. 12. Waiver of access to Hovley Lane/42nd Avenue except at approved locations shall be granted on the final map. 13. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to recordation of the final map. 14. Installation of one-half landscaped median in Hovley Lane or cash payment for one-half the cost of landscaped median at the option of the director of public works. 15. Size, number and location of driveways to public works specification with two driveway approaches to be allowed to serve this property. 16. Complete parcel map shall be submitted as required by ordinance to the director of public works for checking and approval and be recorded before issuance of any permits. 17. Any and all off-site improvements shall be preceded by the approval of plans and the issuance of valid encroachment permit(s) by the department of public works. IS. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the department of public works prior to issuance of the grading permit. 19. Storage capacity of the existing retention basin located on parcelno. 2 shall be maintained. Fire Marshal : 1 . Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi• residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet or a distance acceptable to the fire marshal from a fire hydrant measured along approved vehicular travel ways. 5 PLANNING COMMISSION RESOLUTION NO. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. C. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the Fire Marshal for review. Upon approval , one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in CUP 87-II is in accordance with the requirements prescribed by the fire marshal ." 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval . 7. All buildings over 5000 square feet require an approved fire sprinkler system. 6 PLANNING COMMISSION RESOLUTION NO.
