It is my opinion that the Agreement is of paramount importance to all of the voters of the Coachella Valley and, for that reason, should be discussed by all of their representatives. In that light, I have requested this issue be discussed and decided before a General Assembly meeting rather than just 1 representative for each city in the Executive Committee. I believe we owe it to our constituents for all representatives at one forum to air their views on this critical issue given that the subject so drastically impacts every voter in the Coachella Valley. I ask for your concurrence in my request. A majority of the Executive Committee members can call such a General Assemby meeting. DATE: April 28, 1988 SUBJECT: Certificate of Amendment for Portion of Final Tract Map 11636 (Map 23485) Map 23485 would amend Tract Map 11636 as agreed upon by Lewis Homes, Salt Cedar Homeowners and the City of Palm Desert. That agreement stipulates that all litigation involving the parties will terminate upon approval of this amendment. The amendment accomplishes the following: 6 1. Removes the lots formerly abutting the Salt Cedar Homeowners. 2. Relocates Desert Holly Drive northerly to abut the rear of the Salt Cedar parcels. 3. Lowers the street and parcel elevations in the area. 4. Creates six additional residential lots to mitigate the costs of items 1 through 3. The lots in question are all above 10,000 square feet in area and all will side on to Desert Holly. As council will recall Lewis Hanes was prohibited from constructing hones on eleven lots abutting properties on Salt Cedar. The prohibition was generated because of objections raised by property owners over the lot elevations. Lewis Hanes subsequently filed suit for release of construction permits. After an extensive series of negotiations between Palm Desert, Salt Cedar homeowners, and Lewis Hanes this amendment to the map was agreed upon. The city attorney determined that a public hearing should be conducted by the council to formalize the proposed agreement. The map as amended meets all code requirements and continues to meet the findings necessary for approval of Tract Map 11636. 1. It is consistent with the city's adopted general plan in that the density remains below that identified in the city's general plan. 2. The improvements and density proposed are consistent with Palm Desert adopted general and specific plans and zoning ordinance in that no variances are required for approval and development.
