ALL WALLS THAT FACE ANY STREET OR COMMON AREA MUST BE STUCCO AND
OF A COLOR AND TEXTURE CONSISTENT WITH SUNTERRACE AND THE HOUSE.
ALL WALLS MUST BE SIX FOOT HIGH BLOCK AND HAVE SOLID,NOT
SEE-THROUGH, SIDE YARD GATES. FRONT COURTYARD WALLS MAY BE LESS
THAN SIX FEET IN HEIGHT .
SINCE TRASH PICKUP IS FROM BEHIND SIDE GATES, ALL HOMES MUST PROVIDE
A MOSTLY HARD SURFACE PATHWAY TO THE GATE FROM THE FRONT OF THE
HOME OR DRIVEWAY.
CHIMNEY SPARK ARRESTORS MUST BE PAINTED AND VARIED IN SHAPE AND
SIZE TO AVOID A"TRACT" DEVELOPMENT LOOK
ROOFS MUST BE SUFFICIENTLY VARIED IN COLOR TYPE OF TILE AND SHAPE, IN
ORDER TO PRESERVE THE"SEMI-CUSTOM" LOOK, WHICH IS CURRENTLY IN
EXISTENCE IN THE MAJORITY OF THIS DEVELOPMENT. AT LEAST FOUR HOMES

Re: Sunterrace/Lots 7, 9 and 11 of Tract 23940-2
Dear Mr. Foxx:
This law firm represents the Sunterrace Homeowners Association. We are advised by the
Association that Foxx Development Company has commenced pouring foundations on Lots 7, 9 and
I of the above-referenced tract. As you are aware, the Association's Architectural Review
Committee must review and approve all plans before any construction may commence. The
Architectural Review Committee has rejected the plans which Foxx Development previously
submitted for Lot 9, and no new plans for Lot 9 have been resubmitted to date. No plans have been
submitted for either Lot 7 or Lot 11.
All construction on these lots must immediately cease until the plans for each lot have been
approved by the Architectural Review Committee. We request that you immediately contact the
Architectural Review Committee to schedule a meeting regarding the Lot 9 plans. Furthermore, it
is necessary for you to immediately submit plans for the construction on Lots 7 and 11 to the
Architectural Review Committee for evaluation.
Be advised that if construction does not immediately cease on Lots 7, 9 and 11, we will be
forced to obtain an injunction against Foxx Development Company enjoining any further
construction. The Association will be entitled to recover its attorney's fees and costs to obtain such
relief, pursuant to the CC&Rs.

The commission reviewed the final working drawings with the representative for the
applicant, Mr. Steve Lewis. Mr. Lewis indicated that the landscaping plans were not
included in the final working drawings; however, assured the commission that the
plans had not changed from the approved preliminary landscape plan. Commissioner
Urrutia stated his concerns with not seeing the landscape plan included in the final
working drawings as he wanted to see how the landscaping would integrate with the
exterior elevation changes.

California 92260.

Mr. Smith presented the one set of landscape plans received by staff noting that Eric
Johnson had reviewed the plan and listed his comments. Mr. Smith added that the
plans were reviewed by a number of people at Sunterrace but that Mr. David
Dominick, current Director of the Sunterrace Homeowners Association, was not
among the people who was asked to review the plans. He noted that Mr. Dominick
was there today to review the plans and comment. Mr. Smith indicated that there
was a homeowners meeting a couple of weeks ago with a reorganization of the Board
of Directors and now there was some concern whether the right parties reviewed the
plans.
Mr. Cunningham reported that the original plans were shown to the Sunterrace
Architectural Committee who gave him their guidelines. He asked that he have the
opportunity to take all of the comments back to the homeowners for their review and
input. Mr. Smith noted that Eric Johnson was looking for more color and came up
with alternate trees. He informed Mr. Johnson that the applicant was trying to
conform to what landscaping was out there now. Commissioner Gregory added that
some of Mr. Johnson's suggestions are not consistent with what the commission is
trying to do with drought tolerant planting. Mr. Dominick presented pictures of
existing homes in Sunterrace showing the landscaping concept that they want
continued throughout. He indicated that plans were reviewed by the homeowners
association back in January but that they were architectural plans only, no
landscaping. Mr. Dominick asked that the commission allow him time to take the
proposed landscaping plans to their next homeowners meeting. He indicated that by
looking at the plans today the biggest problem he saw was the depth of the planters
as they do not want grass going up 12" to 18" from the house. Mr.Dominick added

that the existing yards have berming and he did not see any of this in the new plans.
Action:
It was moved by Commissioner Connor, seconded by Commissioner Urrutia, to
continue the request to allow the applicant time to review the landscaping plans
further with the Sunterrace Homeowners Association. Motion carried 5-0.

Mr. Smith presented the revised landscape plan for a minor part of the parking lot as
well as the final working drawings. Mr.Buchanan indicated that with the new front
entrance the handicap parking will be eight stalls with front-in parking. He noted
that it was better than what they are showing on the plans.
Action:
It was moved by Commissioner O'Donnell, seconded by Commissioner Holden, to
approve the landscaping plan and final working drawings for the building addition
and remodel as submitted. Motion carried 5-0.

Mr. Smith indicated that Century Homes will be building homes in part of
Sunterrace. The plans have been reviewed by some homeowners in the tract and the
Homeowners Association Architectural Committee. Mr.Pat Lahey and Mr. A.Kauti
wrote letters indicating acceptance of the plans subject to conditions. Mr. Kauti was
present to support the request. Mr. Dennis Cunningham was present on behalf of
Century Homes and made a brief presentation. Bruce Maize was present on behalf
of Sierra Nova to the north and asked Mr. Cunningham questions relating to height. .
Homes will comply with the 18 foot height limit.
Action:
It was moved by Commissioner Urrutia, seconded by Commissioner Van Vliet, to
grant preliminary approval of the architectural and landscaping plans as presented.
Motion carried 6-0.
