BACK ROUND: The 4.58 acre parcel was originally included in change of zone 89-2 PR-5 to O.P. When the case was heard by the city council, the applicant and adjacent property owners withdrew-from =the-change of-zor)e-request due-to their-objection=to-the-office floor area restrjctictlg r`§baffiuended"by-the Planning=cmEdssiOn. Ultimately only the Smallwood and Stoltzman parcels at the corner of Country Club and Portola received the O.P. zone with the balance remaining PR-5. After the failure of the attempt to organize the various property owners into an office project, staff then proceeded to encourage cooperation in master planning a residential project. The applicant and the owner of 30 acres to the north and east (United Savings) succeeded in agreeing on a master residential tract design which could incorporate the two smaller parcels to the east. The plan meets all the city's original objectives including limited access and a 35 foot landscaped buffer on Country Club, and an overall design far superior to the typical five acre cul-de-sac plan. In addition it will improve the safety and convenience for the Manor Care skilled nursing facility. TT 24214 will be the first phase of the master plan. United Savings has also filed a tentative map covering their 30 acres which will be ready for hearing next month. The two smaller parcels to the west have yet to begin the map process. TT 24214 is designed so that it can function independently if development of future phases is delayed. With the completion of the master plan Country Club medians will be installed. Median breaks will be designed to allow left-turn entrance but only right- turn exit. II. ANALYSIS: The property is zoned PR-5 allowing 23 units. The PR zone permits both condominium planned developments and traditional single family detached s; STAFF REPORT TT 24214 MJGMT 1, 1989 subdivisions. To compensate for the lack of catmon open space in single family tracts it has been the city's policy to require a minimum of 8000 square foot lots. This effectively reduces allowable density from five to four units per acre. The density of the proposed map is 3.9 units per acre with minimLrn lot sizes ranging from 8400 to 9800 square feet. As has been discussed previously, the map is part of a larger design which meets all the city's objectives and hopefully will serve as a pattern for cooperation among property owners within the balance of the quarter section. III. FINDINGS: 1. The proposed map, its design, improvements, type of development, and density are consistent with the State Subdivision Map Act, the Palm Desert Subdivision and Zoning Ordinance, and General Plan. 2. The map has been designed as part of a master plan developed in cooperation with adjacent property owners which implements specific city goals and objectives for the area. 3. The design of the subdivision and required mitigation measures insure that the project will not result in environmental damage, injure fish or wildlife, degrade water quality or create public health problems. 4. The map will not conflict with public easements. 5. The map will allow unrestricted solar access to all lots. IV. Such offsite improvements shall include, but not be limited to, curb and gutter, asphalt paving and concrete sidewalk in an appropriate size and configuration, and the installation of a deceleration lane for west bawd traffic entering the project. "As-built" plans shall be submitted to, and approved by, the director of public works prior to acceptance of the improvements by the city. 7. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as-built" plans submitted to the department of public works prior to project final. 8. All public improvements shall be inspected by the department of public works and a standard inspection fee shall be paid prior to issuance of grading permits. 9. Landscaping maintenance for the individual properties shall be provided by the property owners. The subdivider shall provide for the formation of a landscape maintenance district for the maintenance of proposed landscaping along the Country Club Drive property frontage. 10. In accordance with Palm Desert Municipal Code Section 26.44, complete grading plans and specifications shall be submitted to the director of public works for checking and approval prior to issuance of any permits. 4 PLANNING CXZ44 SICN FdOOLUTICN NO. 11. As required by Sections 26.32 and 26.44 of the Palm Desert Municipal Code, and in accordance with the Circulation Network of the City's General Plan half-street right-of-way at 55 feet on Country Club Drive and full right- of-way at 60 feet on "A" Street and "B" Street, and 50 feet of "C" street shall be offered for dedication on the final map. 12. In accordance with the Circulation Network of the City of Palm Desert's General Plan, installation of one-half landscaped median island in Country Club Drive shall be provided. Median island shall be designed so that left turn ingress and egress are prohibited. A cash payment in lieu of actual installation may be submitted at the option of the director of public works. 13. Traffic safety striping shall be installed to the specifications of the Director of Public Works. A traffic control plan must be submitted to, and approved by, the director of public works prior to the placement of any pavement markings. 14. Full improvements of interior streets based on residential street standards in accordance with Section 26.40 of the Palm Desert Municipal Code shall be provided. 15. Complete tract map shall be submitted as required by ordinance to the director of public works for checking and approval and be recorded before issuance of any permits. 16. Any and all offsite improvements shall be preceded by the approval of plans and the issuance of valid encroachment permits by the department of public works. 17. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the department of public works prior to the issuance of a grading permit. 18. A fire flow of 1500 gpm for a 2 hour duration at 20 psi residual operating pressure must be available before any combustible material is placed on the job site. 3. The required fire flaw shall be available from a Super hydrant(s) (6" x 4" x 2-1/2" x 2-1/2"), located not less than 25' nor more than 200' from any portion of the building(s) as measured along approved vehicular travelways. Hydrants installed below 3000' elevation shall be of the "wet barrel" type. 4. Prior to the application for a building permit, the developer shall furnish the original and two copies of the water system plan to the county fire department for review. No building permit shall be issued until the water system plan has been approved by the county fire chief. Upon approval, the original will be returned. Cne copy will be sent to the responsible inspecting authority. 5. Plans shall conform to fire hydrant types, location and spacing, and the system shall meet the fire flaw requirements. Plans shall be signed by a registered civil engineer and may be signed by the local water company with the following certification: "I certify that the design of the water system is in accordance with the requirements prescribed by the Riverside Country Fire Department-" 6. Certain designated areas will be required to be maintained as fire lanes. 7. Where parallel parking is allowed, the roadway shall be 36' wide with parking on both sides, 32' wide with parking on one side. Dead-and roads in excess of 150' shall be provided with a minimum 45' radius turn-around (55' in industrial developments). 8. Contact the fire department for a final inspection prior to occupancy. He described the proposed scenario and indicated that there would be a right-turn in, right-turn out Highway 111 access; access from the frontage road to El Paseo would be eliminated; two-way traffic along the existing frontage road for property to the east would be allowed; no access would be allowed from Panorama; access would be available to E1 Paseo. He indicated that this would be the solution in the short-term. In the long-term when the property to the east fully development, the frontage road would be completely eliminated. Commission and staff discussed aspects of the scenario and commission concurred with the presentation. He suggested a survey be done once a year. Mr. Bishop indicated that the owner of this property owns ten buildings in that area and parking is more than adequate; the problem exists in other areas. Mr. Diaz suggested formation of a two-member committee and staff to go out during the business day and see where problems exist and determine potential solutions. Commissioner Jonathan suggested getting a list/percentage of businesses and offices, then possibly going out. Commissioner Richards noted that the worst areas were created before the city incorporated or have since annexed into the city and he felt business people were usually the last ones to complain about neighbors until it gets out of control. Commissioner Whitlock did not feel it would be appropriate to penalize this developer and was in favor of approving the project. The other application had not been submitted at that time and was pushed up as far as it could be. Commissioner Richards noted that there was not even a set policy for setbacks and i he was concerned with privacy. LARRY JOHNSON, Engineering Services, stated that the original plan called for straight streets that would be cul-de- '; sacced with 18 lots. The proposed project involves four separate owners who all want to hold onto their property. A master plan development was conceived and their property ended up with 16 lots. He felt there was a good system, but did not know for certain what kind of houses United Savings or Pacific i Theatres would have, but they would be similar; he also did riot know how many two story houses they would request. He felt that along Manor Care and back down the Stoltzman/Smallwood piece would be single story. He requested the flexibility inherent in the zone to allow for the two story. Chairman Erwood asked if anyone present wished to speak in FAVOR or i OPPOSITION to the proposal. There was no one and Chairman Erwood closed the public testimony. Commission Richards felt the hearing should be continued and felt that two weeks was not that much of a delay. He agreed that the city had put them off, but work in that area had been continuous. BACPn;KXIIID: The 4.58 acre parcel was originally included in change of zone 89-2; PR-5 to O.P. When the case was heard by the city council, the applicant and adjacent property owners withdrew from the change of zone request due to their objection to the office floor area restrictions recamnended by the planning commission. Ultimately only the Smallwood and Stoltzman parcels at the corner of Country Club and Portola received the O.P. zone with the balance remaining PR-5. After the failure of the attempt to organize the various property owners into an office project, staff then proceeded to encourage cooperation in master planning a residential project. The applicant and the owner of 30 acres to the north and east (United Savings) succeeded in agreeing on a master residential tract design which could incorporate the two smaller parcels to the east. The plan meets all the city's original objectives including limited access and a 35 foot landscaped buffer on Country Club, and an overall design far superior to the typical five acre cul-de-sac plan. In addition it will improve the safety and convenience for the Manor Care skilled nursing facility. TT 24214 will be the first phase of the master plan. United Savings has also filed a tentative map covering their 30 acres which will be ready for hearing next month. The two smaller parcels to the west have yet to begin the map process. TT 24214 is designed so that it can function independently if development of future phases is delayed. with the completion of the master plan Country Club medians will be installed. Median breaks will be designed to allow left-turn entrance but only right- turn exit. II. ANALYSIS: The property is zoned PR-5 allowing 23 units. The PR zone permits both condominium planned developments and traditional single family detached STAFF REPORT TT 24214 Alla)ST 1, 1989 subdivisions. To compensate for the lack of common open space in single family tracts it has been the city's policy to require a min;mun of 8000 square foot lots. This effectively reduces allowable density from five to four units per acre. The density of the proposed map is 3.9 units per acre with minimum lot sizes ranging from 8400 to 9800 square feet. As has been discussed previously, the map is part of a larger design which meets all the city's objectives and hopefully will serve as a pattern for cooperation among property owners within the balance of the quarter section. III. FINDINGS: 1. The proposed map, its design, improvements, type of development, and density are consistent with the State Subdivision Map Act, the Palm Desert Subdivision and Zoning Ordinance, and General Plan. 2. The map has been designed as part of a master plan developed in cooperation with adjacent property owners which implements specific city goals and objectives for the area. 3. The design of the subdivision and required mitigation measures insure that the project will not result in environmental damage, injure fish or wildlife, degrade water quality or create public health problems. 4. The map will not conflict with public easements. 5. The map will allow unrestricted solar access to all lots. IV. Provide or show there exists a water system capable of providing a potential fire flow of 1500 gpm and the actual fire flow available from any one hydrant connected to any given water main shall be 1500 gpm for 2 hours duration at 20 psi residual operating pressure. 2. A fire flow of 1500 gpm for a 2 hour duration at 20 psi residual operating pressure must be available before any combustible material is placed on the job site. 3. Prior to the application for a building permit, the developer shall furnish the original and two copies of the water system plan to the county fire department for review. No building permit shall be issued until the water system plan has been approved by the county fire chief. Upon approval, the original will be returned. One copy will be sent to the responsible inspecting authority. 5. Plans shall conform to fire hydrant types, location and spacing, and the system shall meet the fire flow requirements. Plans shall be signed by a registered civil engineer and may be signed by the local water company with the following certification: "I certify that the design of the water system is in accordance with the requirements prescribed by the Riverside Country Fire Department," 6. Certain designated areas will be required to be maintained as fire lanes. 7. (April 13 , 1989) Dear Mr. Mayor and Members of the City Council : This office is legal counsel to Pacific Theaters, Inc. , the owner of a five acre parcel of property located near the northeast corner of Country Club Drive and Portola Avenue, with frontage on Country Club Drive, as more particularly shown in red on the attached site map. By way of brief background, our client acquired this property in or about December 1984. Prior to acquisition, Mr. George n Reiter, the representative of Pacific Theaters, Inc. , had o� MIX discussions with City of Palm Desert Planning Staff members regarding the development of a senior citizens ' facility with tpAlI convalescent hospital. Mr. Keiter was inf at the_C1ty would look favorably—upon Gu evelooment. After the property was purchased, Mr. Keiter approached the City Planning Department ' (y with sketches of such a facility. Mr. Keiter was then informed i06y� that the City was not interested in having another senior citizen lV facility and convalescent hospital since one had already been c{ built nearby the location, and another one was in process. xx Thereafter, a moratorium was imposed on any construction and no activity was taken with regard to the development of this parcel. :J After the moratorium was lifted, Mr. Keiter suggested the ✓✓�� development of a hotel on this parcel. The City Planning Staff completely rejected the idea of a hotel. Finally, frustrated at the inability to develop the parcel, Pacific Theaters , Inc. filed a 'Tentative Tract Map to develop eighteen residential lots consistent with the current PR-5 zoning. Shortly after the Tentative Tract Map application was filed with the City in December 1988 , my client received communication from the City Planning Department requesting a meeting to discuss the Tentative Tract Map and some other ideas SCHLECHT, SHEVLIN & SHOENBERGER A LAW CORPORATION LAWYERS April 13 , 1989 Page Two which City Planning Staff had for this property. A couple of meetings were held with the Staff at which it was proposed by Planning Staff that a General Plan Amendment be processed to change the land use designation from residential to commercial and that the property be zoned as Office Professional. The current Office Professional zoning ordinance permits fif�ttyy_jJer cent buildingcoverage story struc are was my c' ien s understanding that this zoning ordinance would apply to the property if the applications were approved. Planning Staff ' s only expressed concern was that there be agreement among the affected parcels for reciprocal easements and requested assistance from my client in obtaining such agreement. After the other property owners were contacted, and agreement reached with regard to reciprocal easements to limit the number of curb cuts on. Country Club Drive, the Planning Staff made application to the Planning Commission for a General Plan Amendment and zoning designation changing the property from PR-5 to Office Professional. Although it had not been discussed prior to the application, Planning Staff recommended that a Negative Declaration be approved with mitigating measures, including limiting building coverage to thirty per cent. At the Planning Commission meeting, there was public comment in which my client, and other property owners, spoke in favor of the applications. After the time for public comment was closed, the Planning Commission rejected the recommendation of thirty per cent building coverage and imposed a twenty-five per cent floor ratio maximum on these parcels . This was totally contrary to my client ' s understanding with the Planning Staff when my client agreed to pursue a General Plan Amendment and zoning designation changing the property from PR-5 to Office Professional. In a meeting with Planning Staff following the Planning Commission ' s hearing at which this action was taken, I expressed to Mr. Diaz our concern that it appeared the Planning Commission, and possibly, ultimately, the City Council, were attempting to create a new zone for the parcels in question without having first enacted a new zoning ordinance. It is our position that mitigation measures in a Negative Declaration are intended to address a particular problem at a particular site. In this instance, we believe the inclusion of a mitigation measure limiting the floor ratio to twenty-five per cent creates , in essence, a new zone without benefit of enactment of a new zoning ordinance inasmuch as there is no specific precise plan for development of my client ' s parcel before the City Council. Historically, it has generally been the case that � �I SCHLECHT, SHEVLIN & SHOENBERGER A LAW CORPORATION LAWYERS April 13, 1989 Page Three a mitigated Negative Declaration is adopted following discussion between the owner and the responsible governmental agency in an attempt to accommodate the interests of the parties with respect to the pending application. We further believe that the evidence which was before the Planning Commission, and which is now before the City Council, does not support the issuance of a mitigated Negative Declaration which includes limiting the floor ratio to twenty-five per cent to mitigate traffic impact. Please note the initial Study Environmental Check List prepared on March 1, 1989, in which Mr. Drell checked "maybe" in response to Paragraph 13 .a. inquiring whether the proposal would result in generation of substantial, additional vehicular movement. Mr. Drell also indicated in the Staff Report of March 7 , 1989 , which went to the Planning Commission, that an appropriate mitigation measure would be a limitation of total building coverage to thirty per cent, which would limit, theoretically, the total floor ratio to sixty per cent in a two story building. There is simply no evidence or support for limiting the floor, ratio to twenty-five per cent, or less than half of that recommended by Planning Staff to the Planning Commission. There is certainly nothing in Mr. Drell ' s report which would suggest that the traffic problems at this particular location are any more severe than traffic in any other location within the City of Palm Desert which is zoned Office Professional and which permits up to fifty per cent building coverage. It is unfair to single out this particular parcel with such restrictive zoning, absent substantial evidence warranting such a result. In our opinion, it would be appropriate for the City Council to approve the application for an amendment to the General Plan Circulation Element, to amend the General Plan Land Use Map, to change the zoning for the twenty-two acres to Office Professional and to approve a Negative Declaration, without a mitigating measure restricting the floor ratio to twenty-five per cent. Thereafter, when my client makes his application to the Planning Commission and City Council for approval of a Precise Plan, all of the issues and concerns now being expressed by the Planning Commission could certainly be addressed through the Precise Plan process. At that time, if there were a particular problem at this particular site which needed to be addressed, it would be my client ' s burden to propose an appropriate mitigation measure to be included in the Negative Declaration. It is not appropriate, in our opinion, for the City to impose a mitigation measure in the present, proposed Negative Declaration, the effect of which creates a sub-rosa zoning ordinance. A fire flow of 1500 gpm for a 2 hour duration at 20 psi residual operating pressure must be available before any combustible material is placed on the job site. The required fire flow shall be available from a Super hydrant (s) (6" x 4" x 2-112" x 2-112" ) , located not less than 25 ' nor more than 200 ' from any portion of the building(s) as measured along approved vehicular travelways. Hydrants installed below 3000 ' elevation shall be of the "wet barrel" type. Prior to the application for a building permit, the developer shall furnish the original and two copies of the water system plan to the County Fire Department for review. No building permit shall be issued until the water system plan has been approved by the County Fire Chief. Upon approval , the original will be returned. One copy will be sent to the responsible inspecting authority. Plans shall conform to fire hydrant types, location and spacing, and the system .shall meet the fire flow requirements. Plans shall be signed by a Registered Civil Engineer and may be signed by the local water company with the following certification: "Z certify that the design of the water system is in accordance with the requirements prescribed by the Riverside County Fire Department . " Certain designated areas will be required to be maintained as fire lanes. Where parallel parking is allowed, the roadway shall be 36 ' wide with parking on both sides, 32 ' wide with parking on one side. Dead-end roads in excess of 150 ' shall be provided with a minimum 45' radius turn-around (55 ' in industrial developments) . Contact the Fire Department for a final inspection prior to occupancy.
