DECLARATION OF
COVENANTS, CONDITIONS AND RESTRICTIONS
FOR
SONATA II
HOMEBUYER AWARENESS PACKAGE
This Declaration of Covenants, Conditions and
Restrictions for Sonata II, Tract 24254 ("Declaration") is
made this _ day of , 1990 , by BARCON DEVELOPMENT, a
California Limited Partnership ("Declarant") with reference to
the following:
A. Declarant is the owner of certain real property
located in Palm Desert, County of Riverside, California,
more particularly described on Exhibit "A" attached hereto
and by this reference made a part hereof (the "Property" ) .
Declarant intends to subdivide and develop all or part of
the Property which is or will be comprised of 94 legally
subdivided residential lots. Declarant desires to impose
mutually beneficial restrictions over the Property under a
general plan of the improvement for the benefit of all estates
created in the Property.
B. Declarant hereby declares that all of the Property
is to be held, conveyed, hypothecated, encumbered, leased,
rented, used, occupied and improved subject to the
following covenants, conditions and restrictions, all of
which are declared and agreed to be in furtherance of a plan
for the protection and improvement of the Property for the
purpose of enhancing the value, desirability and attractiveness
of the Property. All provisions of this Declaration are hereby
imposed as equitable servitudes upon the Property and shall run
with the land and be binding on and for the benefit of all of
the Property and all parties having or acquiring any right
title or interest in the Property, or any part thereof, and
their successive owners and assigns.
ARTICLE I
DEVELOPMENT
It is the present intention of Declarant to develop lots on
the Property with single family residences (individually a
"Residence" and collectively the "Residences") on separate lots
(individually a "Lot" and collectively the "Lots") ; or to
develop lots for sale without Residences constructed by
Declarant.
ARTICLE II
USE RESTRICTIONS
The Property shall be held, used and enjoyed by each Owner
(as defined below) , subject to the following limitations and
restrictions, and subject to the exemptions for Declarant set
forth in this Declaration. "Owner" shall mean and refer to one
or more persons or entities who alone or collectively are the
record owner of a fee simple title to a Residence or Lot, but
excluding those having any such interest merely as security for
the performance of an obligation.
Section 2. 01 The following Lots contained in the
Property are approved by the City of Palm Desert for the
construction of two-story Residences: Phase 1 Lots
9 ,10, 11, 18 ,19, 20 ,21 ,22,23 ,24 ,25 of Tract Map 24254-1; Phase 2
. Lots 2, 3 ,4,5,6,7,8,9,13 ,14,15,20,21, 26 ,27 of Tract Map
24254-2; and Phase 3 Lots 16,17,18,19, 22 ,23 ,24 ,29 ,30, 31 of
Tract Map 24254 . . These identified Lots may, but need not
necessarily, be utilized for a two-story Residence. All other
Lots within the Property not specifically identified in this
paragraph are only authorized by the City of Palm Desert for
the construction of a one-story Residence.
Section 2. 02 As to the Lots authorized by the City for a
two-story Residence, the following rules and restrictions shall
apply, in addition to and as a supplement to any other rules or
regulations promulgated by the City of Palm Desert and its
residential approval process: (a) The side yard setbacks on
two-story Residences shall be twelve (12) feet on each side,
as interpreted by the City; however, if a two-story Residence
is designed so that effectively one side of the Residence is at
a one-story height (such as a split-level home) , then the side
yard setback on the side with the single story height maybe
five (5) feet. (The applicable side yard setbacks on a single
story Residence are five (5) feet on each side) . (b) The
front and rear yard setbacks for both two-story and single
story Residences are as defined in the Palm Desert Municipal
Code.
Section 2.03 The minimum Residence size, exclusive of
garage and patio areas, for any Residence (one-story or
two-story) constructed on a Lot in the Property shall be 1800
square feet interior of livable space.
Section 2 .04 Each and every Residence constructed on Lots
in the Property shall be in one of the following styles only:
(a) A Mediterranean/Spanish style substantially similar or
compatible with the Residences constructed by Declarant, or
(b) That style often referred to as "Desert Modern" best
identified with the Residences designed by the Palm Desert
architects of Holden and Johnson.
All architectural and building plans for each Residence
must be approved by the City of Palm Desert.
Section 2.05 Exterior colors of the Residences to be
constructed on Lots in the Property, for both stucco color
and trim, shall be substantially similar or compatible (such as
soft desert tones) with the colors similarly utilized by
Declarant on the Residences constructed by Declarant.
Section 2.06 Any interior Lot line walls to be
constructed by Owners shall be of the same type and color of
slump stone walls as utilized by Declarant on the Lots and
Residences constructed in the Property by Declarant. Each
Residence constructed in the Property must be completed with
all Lot line walls completed; thus, an Owner who constructs a
Residence on a Lot will have to complete all applicable Lot
line walls if such Residence is the first completed among
adjacent lots.
Section 2 .07 Prior to completion of construction on
a Residence on a Lot in the Property, with completion defined
as the issuance by the City of Palm Desert of a "Certificate of
Occupancy" , the front yard landscaping shall be completed, with
automated irrigation system.
Section 2. 08 Prior to the commence of construction of any
Residence to be constructed on a Lot in the Property, it must
be confirmed with the City of Palm Desert that pad elevations
and lot drainage will be constructed and maintained pursuant to
the drainage plan approved for the Property, as applicable to
the particular Lot for which the approval is sought. In
particular, there shall be no interference with the planned
and/or established drainage pattern over any Lots and/or the
Property unless an alternative provision for proper drainage is
approved by the City of Palm Desert.
Section 2 .09 Phase 3 Lots 8,9,10, 11,12 ,13 ,14 are each
encumbered by a sewer easement for the benefit of the City of
Palm Desert, which is located upon, across and under the
easterly twenty (20) feet of each such Lot. No construction of
any improvement or major (not easily moved) landscaping shall
be done which would hinder the ability of the City of Palm
Desert or appropriate governmental or utility agency from
inspecting or repairing the underground line or lines which
maybe located in the easement area. Neverthless, owners of Lots
8,9 ,10 ,11 ,12,13 and 14 shall have the right to utilize the
"open space" easement area as part of their respective rear
yards.
In addition, as to Phase 3 Lot 14, the Lot in the
southeastern most corner of the Property, it is acknowledged
that if the exterior Property wall at the southeast corner of
such Lot is removed by the City of Palm Desert or appropriate
governmental or utility agency in order to repair or otherwise
inspect the underground easement area, that the sole and
complete responsibility for prompt replacement and repair of
the wall, and for the cost thereof, shall be borne by the Owner
of such Phase 3 Lot 14 .
Section 2.10 No signs, posters, billboard, advertising
device or other display of any kind shall be displayed to the
public view, except such signs as may be used by Declarant in
connection with its development and sale of Lots and the
Property and except such signs as may be displayed from a Lot
advertising that said Lot is for sale provided that such signs
conform with the City of Palm Desert sign ordinance.
ARTICLE III
ENFORCEMENT
Section 3 .01 Any owner, including Declarant so long as it
owns all or any portion of the Property, shall have the right
to enforce by proceedings at law or in equity, all
restrictions, conditions, covenants and reservations, now or
hereafter imposed by the provisions of the Declaration or any
amendment thereto, including the right to prevent the violation
of any such restrictions, conditions, covenants, or
reservations and the right to recover damages for such
violation.
ARTICLE IV
GENERAL PROVISIONS
Section 4.01 All rights, options and remedies of
Declarant or Owners under this Declaration are cumulative, and
not one of them shall be exclusive of any other, and Declarant
and Owners shall have the right to pursue any one or all of
such rights, options and remedies or any other remedy or relief
which may be provided by law, whether or not stated in herein.
Section 4.02 Invalidation of any one or a portion of
these covenants, conditions or restrictions by judgment or
court order shall in no way affect any other provisions which
shall remain full force and effect.
Section 4.03 The covenants, conditions and restrictions
of this Declaration shall run with and bind the Property and
shall inure to the benefit of and be enforceable by any Owner
including Declarant, their respective legal representatives,
heirs, successors and assigns, for a term of fifty (50) years
from the date this Declaration is recorded, after which time
said covenants, conditions and restrictions shall be
automatically extended for a successive period of ten (10)
years, unless an instrument signed by a majority of the then
Owners has been recorded at least one (1) year prior to the end
of any such period, agreeing to change said covenants,
conditions and restrictions in whole or in part.
Section 4.04 The provisions of this Declaration shall be
liberally construed to effectuate its purpose. The Article and
Section headings have been inserted for convenience only, and
shall not be considered or referred to in resolving question of
interpretation or construction.
Section 4.05 Whenever the context of this Declaration
requires same, the singular shall include the plural and the
masculine shall include the feminine and the neuter.
Section 4 .06 The result of every act or omission, whereby
any provision, condition, restriction, covenant, easement, or
reservation contained in this Declaration is violated in whole
or in part, is hereby declared to be and constitutes a
nuisance, and every remedy allowed by law or equity against a
nuisance, either public or private, shall be applicable against
every such result. Such remedy shall be deemed cumulative and
not exclusive.
Section 4.07 In the event action is instituted to enforce
any of the provisions contained in this Declaration, the party
prevailing in such action shall be entitled to recover from the
other party thereto as part of the judgment, reasonable
attorney's fees and costs of such suit.
Section 4.08 Any notice to be given to an Owner under the
provisions of this Declaration shall in writing and shall be
deemed to have been properly delivered when delivered
personally or placed in the first class United States mail,
postage prepaid, to the street address of such Owner's
Residence. Any notice so deposited in the mail within
Riverside County, California, shall be deemed delivered
forty-eight (48) hours after such deposit.
Section 4. 09 This Declaration is made for the purposes
set forth in the Recitals herein and Declarant makes no
warranties or representations, express or implied, as to the
binding effect or enforceability of all or any portion of this
Declaration, or as to the compliance of any of these provisions
with public laws, ordinances and regulations applicable
thereto.
Section 4. 10 Subject to the other provisions of this
Declaration, this Declaration may be amended upon (a) the
affirmative written assent or vote of not less than sixty-six
and two-thirds percent (66-2/3%) of the Owners and, further,
this amendment provision shall not be amended to allow
amendments by the written assent or vote of less than sixty-six
and two-thirds percent (66-2/3%) of the voting power of the
Owners and (b) an amendment or modification has been approved
as hereinabove provided, and recorded in the Official Records
of Riverside County, California.
Section 4.11 Neither Declarant, Owners, nor their
successors or assigns may convey title to a Residence or any
portion thereof separate and apart from the conveyance of title
to the Lot on which such Residence is constructed.
Section 4. 12 Breach of any provision of this Declaration
or any entry upon a Lot by reason of such breach, shall not
defeat or render invalid the lien of any mortgage or deed of
trust made in good faith and for value on any of the Property.
Any lender or other person who succeeds to the ownership of a
Lot by foreclosure, trustee's sale or otherwise, shall be bound
by the provisions, easements, conditions, restrictions and
covenants set forth herein.
ARTICLE V
HOMEBUYER AWARENESS PACKAGE
Each purchaser of a Lot in the Property, subject to this
Declaration, acknowledges and agrees that this Declaration of
Covenants, Conditions and Restrictions is also deemed to be and
is a "Homebuyer Awareness Package" for the benefit of such
purchaser and as requested by the City of Palm Desert. The
purpose of this Homebuyer Awareness Package is to ensure that
all current and future purchasers and Owners of Lots in the
Property are aware and fully understand that the Property will
be developed in a manner which intends that not all Residences
will be built by the Declarant, that variations of
architecture, color and style may occur throughout the
Property which, while compatible with each other, will prevent
a fully uniform appearance in the community, and that the
authorization on certain Lots identified in this Declaration
for two-story Residences to be constructed may result in
certain purchasers and Owners owning a Residence on a Lot in
the Property which is a single story Residence which will be
next door to a two-story Residence, thus having an impact on
views, privacy, and uniformity of appearance. Your execution
of the receipt certifying that you have received a copy of this
Declaration and that it constitutes a Homebuyer Awareness
Package pursuant to this Article V will also serve to
unconditionally signify that you have reviewed the Declaration,
understand its contents, and have agreed to abide by the same.
IN WITNESS WHEREOF, Declarant has executed this instrument as

Dear Phil:
Pursuant to our telephone conversation this morning, enclosed please find copies of the
following:
1. The "Homebuyer Awareness Package" ("HAP") given to each of the 26 purchasers(from
Barcon) of existing units at the project (note that there are 68 remaining improved lots); and
2. The relevant Conditions of Approval (specifically item 8 as to the HAP ) imposed upon
Barcon by the City.
Phil, as we discussed, the HAP was approved by the City prior to its conveyance to
purchasers, and the purchasers did sign and acknowledge receiving the HAP. However, because
Barcon forfeited its interest in the remaining 68 lots in the project to the construction lender, the
lender, and thus any party which purchases the lots from the lender, is not bound by the provisions
of the HAP-specifically,for example,as to minimum residence size and location of two-story units.
Given that the HAP, and the disclosures therein, were made by Barcon at the requirement
of and after consultation with the City, we request that the City, in reviewing any future proposed
residential construction at the project, reasonably require the builder/developer(s) to conform
building plans with the provisions of the HAP.
Although Barcon has no interest of any type in the project or subject property, we believe
that City approvals consistent with the HAP will serve the best interests of the project, the City and
existing Sonata II residents. As is apparent, certain Sonata II residents have inquired of us as to
"what will be built" on the remaining lots at the project.

Dear Phil:
Thank you for your courtesy in our telephone conversation yesterday regarding the
Conditions of Approval and the Homebuyers Awareness Package("HAP")as to the referenced tract.
As we discussed,the uniqueness, at the time the Sonata II map was approved, of the project(relative
to the inclusion of two-story houses and our stated and explicit intention to sell lots without houses)
resulted in the HAP as effectively a "condition" of the tract "by incorporation".
As you indicated,we do not anticipate a practical problem in the future,since we assume that
any new developer of the remaining lots at the tract will,in fact,voluntarily conform with the criteria
set forth in the HAP (as all other tract Conditions must be complied with). Nevertheless, given that
"forewarned is forearmed",we conveyed our May 30, 1996 package to Phil Joy of the City since we
felt it prudent that the City be again aware of the planning issues raised by the HAP (and recently
raised by several Sonata I1 homeowners) at the earliest possible time.

B. PROPERTY DESCRIPTION
The vacant 23.75 acres subject site is zoned PR-5 (5 units per
acre), and designated as low density residential, 3-5 units per
acre, on the general plan. It is comprised of five 4.75 acre lots
which are 331.38 x 661.84 individually and 1656. 9 x 661 . 84
circulative. The site is within the fringe of the blow sand area and
is cauprised of rolling dunes, but is low in relation to surrounding
property.
II. DISCUSSION:
The project was previously (twice) before the carmiission as TT 22712,
which consisted of curvi-linear streets with the first map having a couple
of cc mm swimming pool lots and the second deleting the ccMM pool lots.
Both times the owner was working with an engineer to get a map approved
facilitating the sale of the consolidated lots.

This application is primarily being made by Barcon Development, a builder
who previously constructed Waring Place in the city and recently received
approval of a 16 lot subdivision at Portola and Hovley, referred to as
"Sonata". This subdivision is being called "Sonata II" . Barcon's
application is different from the original application (TT 22712), by
having north-south public streets rather than curvi-linear private
streets. The same 20 foot greenbelt and 8 foot meandering sidewalk
along Hovley is shown. Barcon has also been working with Casablanca to
provide open space easements for the lots backing up to Casablanca since
their perimeter wall is 20 feet east of property line.
The previous applicant also requested development standards allowing
two-story hones, but did not have plans to show the commission since he
did not intend to build the project himself. Barcon is also requesting
24 foot high two-story homes in the interior of the project, and has
prepared elevations of the hones as part of his application to enable the
commission to see what the homes would look like. The maximum height
limit in the PR zone is 30 feet. Recently 26 foot, two-story villas were
approved by the cc mission at Desert Falls. The conmiissicn previously
denied the request for two-stories for TT 22712 due to it being a
single-family detached development. However, staff is again in favor of
allowing some two-story due to three reasons.
1. The zoning of the property allows two-story development and there
would probably be little concern if this were a two-story condominium
project, but the city is encouraging single-family housing and the
applicant should not be penalized.
2. The PR zoning is intended to give the commission flexibility in its
standards and staff feels the condition that the perimeter of the
project be limited to one-story mitigates adjacent property owners
concerns; while assurances can be obtained that residents of single
story hones are fully aware of a two-story hone being built next
door.
3. The project involves consolidation of five parcels that if developed
separately, would result in five more cul-de-sacs along Hovley
Lane. There were originally 32 4.75 acre parcels along Hovley Lane
between Monterey and Portola and if developed separately would
result in 32 separate cul-de-sacs. The other consolidations on the
street (Winterhaven and Casablanca) were to accommodate condominium
projects built at the full five units per acre allowable while this
project is at 3.96 units per acre. The Monterey Meadows projects
are 4.2 units per acre. This type of project (cul-de-sac) might
be undesirable carried along the full length of Hovley Lane. Some
type of inducement should be made to consolidate the 5 acre parcels,

thereby reducing the number of access points on Hovley and improving
the visual character through the continuous green belt provided.
By locating the two-story units within the project accomplishes what
the Monterey Meadows type of project could not - that is building in
their own buffer between themselves and adjacent vacant property.
As far as precedents being set, none would be set for the current
R-1 sections of the city, since that zoning prohibits two-story
development. Staff has surveyed La Quinta, Rancho Mirage and
Cathedral City, which all allow two-story single family development
in this P.U.D. type of zoning. In the PR zoning it may lead to a
precedent being set for future parcel consolidations to enable built
in buffers.
The building elevations otherwise are identical to those that will
be constructed at "Sonata I", which are somewhat similar to the
Waring Place homes. Consisting of pitched the roofs.
The architectural commission reviewed and approved the plans subject
to the side setbacks being increased which is reflected in the
conditions of approval.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 7th day of February, 1989, told a duly noticed public hearing to
consider the request by BARCON DEVELOPMENT for the above mentioned project.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. 80-89", in that the director of environmental services has
determined that the project has been previously assessed.
WHEREAS, at said public hearing, upon hearing and considering all

Department of Community Development:
I. The final map shall conform substantially with the tentative tract map as
modified by the following conditions.

Evidence of said permit or clearance from the above agencies shall be
Presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
3. The applicant shall pay all applicable fees in accordance with city
policy including those for lizard and art in public places.
4. Front setbacks - 20' to main garage door, straight driveway; or 15'
otherwise, rear setbacks - 15', side setbacks - 5' single story, 12' for
two story; building height 15' maximum one story, 24' two story.
5. Twenty feet of landscaped area along Portola and Hovley for an 8' wide

Department of Public Works:
1. Drainage fees, in accordance with Section 26.49 of the Palm Desert
Municipal Code and Palm Desert Ordinance No. 507, shall be paid prior to
recordation of final map.
2. Drainage facilities, as designated within the Northside Area Drainage
Master Plan shall be provided to the specifications of the Director of
Public Works.
3. Storm drain construction shall be contingent upon a drainage study
prepared by a civil engineer that is reviewed and approved by the
department of public works.
4. Signalization fees, in accordance with City of Palm Desert Resolution
No's. 79-17 and 79-55, shall be paid prior to recordation of final map.
5. Full public improvements, as required by Sections 26.44 and 26.40 of the
Palm Desert Municipal Code, shall be installed in accordance with
applicable city standards.
6. As required under Palm Desert Municipal Code Section 26.28, and in
accordance with Sections 26.40 and 26.44, complete improvement plans and
Specifications shall be submitted to the director of public works for
checking and approval before construction of any improvements is
convened. Off-site improvement plans to be approved by public works
department and a surety posted to guarantee the installation of required
off-site improvements prior to recordation of the final map. Such
off-site improvements shall include, but not be limited to, curb and
gutter, asphalt paving and concrete sidewalk in an appropriate size and
configuration. "As-built" plans shall be submitted to, and approved by,
the director of public works prior to the acceptance of the improvements
by the city.
7. improvement plans for water and sewer systems shall be approved by the
respective service districts with "as-built" plans submitted to the
department of public works prior to the project final.
8. Landscaping maintenance on Hovley Lane shall be provided by the property
owner.
9. As required under Section 12.16 and 26.44 of the Palm Desert Municipal
Code, all existing utilities shall be undergrounded per each respective
utility district's recommendation. If determined to be unfeasible,
applicant shall agree to participate in any future utility undergrounding
district.
10. In accordance with Palm Desert Municipal Code Section 26.44, complete
grading plans and specifications shall be submitted to the director of
public works for checking and approval prior to issuance of any permits.
