PLANNING OU4'1 SSICN RESOLUTION NO. 1349 A RESOLUTION OF THE PLANNING CU44ISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING AN 8 LOT SINGLE FAMILY SUBDIVISION LOCATED NORTH OF FRED WARING DRIVE, 350 FEET EAST OF PHYLLIS JACKSON. CASE NO: TT 24486 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 18th day of April, 1989, hold a duly noticed public hearing to consider the request by KEN-MJR ENTERPRISES for the above mentioned project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that there is no possible, significant effect on the environment and is therefore exempt. WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify approval of the tentative tract map: i (a) That the proposed map is consistent with applicable general and specific plans. (b) That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. (c) That the site is physically suitable for the type of development. (d) That the site is physically suitable for the proposed density of development. (e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. (f) That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. (g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. NOW, THEREFORE, BE IF RESOLVED by the Planning Commission of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the commission in this case; 2. The final map shall conform substantially with the tentative tract map as modified by the following conditions. 2. Applicant shall obtain clearance from the following agencies prior to construction: Public Works Department Palm Desert Architectural Review Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 3. The applicant shall pay all applicable fees in accordance with city policy including school and art in public places fees. 4. Front setbacks - 20' to main garage door, straight driveway; or - 10' �— otherwise, rear setbacks - 15' , side setbacks - 5', bull height - 18' maximum. 5. Twenty feet of landscaped area along Portola and Hovley for an 8' wide meandering sidewalk. f 6. Perimeter decorative walls required at minumun 6' , and maximum 8' if used in conjunction with retaining walls. Department of Public Works: 1. Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal Code and Palm Desert Ordinance No. 507, shall be paid prior to recordation of final map. 2. Storm drain construction shall be contingent upon a drainage study prepared by a civil engineer that is reviewed and approved by the department of public works. 3. Signalization fees, in accordance with City of Palm Desert Resolution No's. 79-17 and 79-55, shall be paid prior to recordation of final map. 3 PL WNG COMMISSION RESOLVPION NO. 1349 4. Pull public improvements, as required by Sections 26.44 and 26.40 of the Palm Desert Municipal Code, shall be installed in accordance with applicable city standards. 5. As required under Palm Desert Municipal Code Section 26.28, and in accordance with Sections 26.40 and 26.44, complete improvement plans and specifications shall be submitted to the director of public works for checking and approval before construction of any improvements is commenced. Off-site improvement plans to be approved by public works department and a surety posted to guarantee the installation of required off-site improvements prior to recordation of the final map. Such off-site improvements shall include, but not be limited to, curb and gutter, asphalt paving and concrete sidewalk in an appropriate size and configuration. "As-built" plans shall be submitted to, and approved by the director of public works prior to the acceptance of the improvements by the city. 6. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as-built" plans submitted to the department of public works prior to the project final. 7. All public improvements shall be inspected by the department of public works and a standard inspection fee shall be paid prior to issuance of grading permits. 8. Landscaping maintenance shall be provided by the individual property owner. 9. In accordance with Palm Desert Municipal Code Section 26.44, complete grading plans and specifications shall be submitted to the director of public works for checking and approval prior to issuance of any permits. 10. As required by Section 26.32 and 26.44 of the Palm Desert Municipal Cede, and in accordance with the Circulation Network of the City's General Plan, dedication of half-street right-of-way at 55 feet on Fred Waring Drive and 19 feet on Lot "B" with full right-of-way at 36 feet on Lot "C" shall take place prior to final map approval. 11. In accordance with the Circulation Network of the City of Palm Desert's General Plan, installation of one-half landscaped median island in Fred Waring Drive shall be provided. A cash payment in lieu of actual installation may be submitted to at the option of the director of public works. 12. Traffic safety striping on Fred Waring Drive and Lot "B" shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to and approved by the director of public works i prior to the placement of any pavement markings. 4 f. . PLANNING 00[NMSSION RESOLUMCK NO. 1349 O 13. Full improvement of interior streets based on residential street standards in accordance with Chapter 26.40 of the Palm Desert Municipal Code shall be provided. 14. Complete tract map shall be submitted, as required by ordinance, to the director of public works for checking and approval and be recorded before issuance of any permits. 15. Any and all off-site improvements shall be preceded by the approval of plans and the issuance of valid encroachment permit(s) by the department of public works. 16. A completed preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the department of public works prior to issuance of the grading permit. 17. Pad elevations, as shown on the tentative map are subject to review and modification in accordance. with Chapter 27 of the Palm Desert Municipal Code 18. Waiver of access to Fred Waring Drive except at approved locations shall be granted on the final map. 19. Drainage easements, as shown on the tentative tract map shall be a minim= width of 10 feet. 20. Applicant shall provide for the design and construction of drainage facilities, including easements as may be necessary, to accombdate the conveyance of project stormwaters. City Fire ,,.•arsha, 1. The Fire Department is required to set a mirunnnn fire flow for the re el or construction of all coirnercial buildings per Uniform Fire Code Section 10.301C. 2. A fire flow of 1500 gpn for a 2 hour duration at 20 psi residual operating pressure must be available before any combustible material is placed on the job site. 3. The required fire flaw shall be available frrni a Super hydrant(s) (6" x 4" x 2 1/2" x 2 1/2"), located not less than 25' nor more than 2007 from any portion of the building(s) as measured along approved vehicular travelways. Hydrants installed below 3000' elevation shall be of the "wet barrel" type . 4. Prior to the application for a building permit, the developer shall furnish the original and two copies of the water system plan to the County, Fire Department for review. No building permit shall be issued until the water system plan has been approved by the County Fire Chief. Upon approval, the original will be returned. One copy will be sent to the responsible inspecting authority. PLANNING OOVMISSION RESOLVPION NO. 1349 Plans shall conform to fire hydrant types, location and spacing, and the system shall meet the fire flaw requirements. Plans shall be signed by a Registered -Civil Engineer and may be signed by the local water company with the following certification: "I certify that the design of the water system is in accordance with the requirements prescribed by the Riverside County Fire Department. 5. Dead-end roads in excess of 150' shall be provided with a minimum 45' radius turn-around (55' in industrial developments). 6. Whenever access into private property is controlled through use of gates, barriers, guard houses or similar means, provision shall be made to facilitate access by emergency vehicles in a manner approved by the Fire Department. All controlled access devices that are power operated shall have a radio-controlled over-ride system capable of opening the gate when activated by a special transmitter located in emergency vehicles. Devices shall be equipped with backup power facilities to operate in the event of power failure. All controlled access devices that are not power operated shall also be approved by the Fire Department. FEN STENDELL, representing KEN-MDR, felt this was a good project and asked for any questions. Chairman Erwood asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposed. Setbacks for the hones will be similar to others in the PR zone with the front measured from curb-face.
