Commissioner Holden felt that the wording on the north side of the building should be brought together somehow. Action• It was moved by Commissioner Urrutia, seconded by Commissioner Connor, to continue the preliminary plans directing the applicant to address the following: 1 ) Applicant to design some type of colonnade or trellis structure that will give the building some relief from Fred Waring Drive. Commission recommended approval of this structure in the setback area. 2) Signage on the north side of the building should be stacked instead of the proposed linear sign. 3) The "Econo Lube N'Tune" on the north side of the building should be reduced in size. 4) Signage above the garage bays to be removed. 5) Tile roof to be extended towards the east side of building. 6) Screen wall to be extended along the west side of building. 7) Landscape architect to contact the city' s landscape consultant for specific information on desert type and size of plant material to be used. 8) Color of signage to be burnt orange with dark brown trim. Chairman Gregory noted that the ground cover base was not indicated and directed applicant to show Palm Springs Gold as the ground cover. Commissioner Connor felt that the plan needed to be cleaned up before commission could make any accurate decisions. The plans, as presented, were not acceptable (i.e. the plan calls for plants at 4 feet on center in a 60 foot planter, yet shows 20 plants. . .which is correct?). Action: It was moved by Commissioner Connor, seconded by Chairman Gregory, to continue the landscape plans directing the applicant to clarify the revised drawings as there were too many inconsistencies throughout the plan. Mr. Diaz reported that the only thing holding up the process on approving the fence was the hold harmless agreement to be signed by the applicant. Mr. Campbell noted that he was given approval by the haneowners association to sign this hold harmless agreement. Mr. Campbell indicated that the reason the association was asking for the fence extension was because of the high theft rate in the country club. III. ADOPTED DEVELOPMWr STANDARDS Each project will be reviewed on the basis of its conformance to the following adopted development standards. In those areas determined by the architectural commission to be "unacceptable", it is the responsibility of the applicant to redesign that portion of the project. A. ACCESS & CIRCULATION STANDARDS 1. All air conditioning and ventilation equipment shall be located and screened in a manner to prevent exposure to public rights-of-way and adjacent properties, in addition said equipment shall not be located where its noise will impact adjacent property. D. VEHICLE PARKING STANDARDS 1. Off-street parking shall be located in proximity to facilities it serves. 2. Parking areas should be screened fron view wherever possible by means of berms, garden walls and landscaping. 3. Parking areas shall be shaded where practical. 4. Carports for apartment developments shall not front onto a public right-of-way. 5. Garages should be encouraged not to front onto a public right-of-way. 6. All parking areas for recreational and accessory vehicles and trailers shall be architecturally screened or landscaped or otherwise concealed from public view. 7. Adequate handicapped parking spaces shall be provided. E. ARCHITECTURAL STANDARDS 1. Architectural design shall be applied to entire structure or complex rather than just to those sides exposed to public view. 3. Architectural design shall be appropriate to the climatic conditions of the desert area and shall be done in a manner which minimizes the consumption of energy required for heating and cooling. 4. Entrances shall include appropriate lighting and identification. 5. Architectural design shall employ materials and colors which are compatible and complementary to the desert area. 6. Architectural design shall incorporate provisions for signage (if applicable) as an integrated part of the overall design. 7. Architecture and landscaping shall be coordinated and complementary. 8. All air conditioning, exhaust and ventilation, accessory mechanical and electrical equipment and control panels shall be located and screened in a manner to prevent exposure to public rights-of-way and adjacent properties. F. LANDSCAPIr�G STANDARDS 1. Landscaping shall be an integral part of the site planning and architectural design on all projects. 2. Provisions for the adequate maintenance and irrigation of landscaping shall be made through the use of underground irrigation systems. 3. Landscaping, walls and fences shall not create unsafe conditions along public rights-of-way. 4. All required street trees shall be a minimum of 24" box in size at time of installation. 5. The required fire flow shall be available from a Super hydrant(s) (6" x 4" x 2 1/2" x 2 1/2" ), located not less than 25' nor more than 200' from any portion of the building(s) as measured along approved vehicular travelways. Hydrants installed below 3000' elevation shall be of the "wet barrel" type . 5. Prior to the application for a building permit, the developer shall furnish the original and two copies of the water system plan to the County Fire Department for review. No building permit shall be issued until the water system plan has been approved by the County Fire Chief. Upon approval, the original will be returned. Rights of eminent domain unless notice of the exercise thereof has been recorded in the public records at Date of Policy, but not excluding from coverage any taking which has occurred prior to Date of Policy which would be binding on the rights of a purchaser for value without knowledge. 3. Defects, liens, encumbrances, adverse claims or other matters: (a) created, suffered, assumed or agreed to by the insured claimant; (b) not known to the Company, not recorded in the public records at Date of Policy,but known to the insured claimant and not disclosed in writing to the Company by the insured claimant prior to the dale the insured claimant became an insured under this policy; (c) resulting in no loss or damage to the insured claimant; (d) attaching or created subsequent to Date of Policy (except to the extent that this policy insures the priority of the lien of the insured mortgage over any statutory lien for services, labor or material or the extent insurance is afforded herein as to assessments for street improvements under construction or completed at date of policy); or (e) resulting in loss or damage which would not have been sustained if the insured claimant had paid value for the insured mortgage. 4. Unenforceability of the lien of the insured mortgage because of the inability or failure of the insured at Date of Policy, or the inability or failure of any subsequent owner of the indebtedness, to comply with applicable "doing business laws" of the stale in which the land is situated. 5. Invalidity or unenforceability of the lien of the insured mortgage, or claim thereof, which arises out of the transaction evidenced by the insured mortgage and is based upon usury or any consumer credit protection or truth in lending law. 6. Any statutory lien for services, labor or materials (or claim of priority of any statutory lien for services, labor or materials over the lien of the insured mortgage) arising from an improvement or work related to the land which is contracted for and commenced subsequent to Dale of Policy and is not financed in whole or in part by proceeds of the indebtedness secured by the insured mortgage which at Date of Policy the insured has advanced or is obligated to advance.
