Chairperson Whitlock informed commission that she would be abstaining. Mr. Smith outlined the salient points of the staff report and recommended approval, subject to conditions. He noted that the only unusual condition was the requirement of the street color be color- coated to blend in with the existing hillside. He also indicated that the applicant had expressed concern about condition #{4 of public works which required a mi.nimaun 32 foot wide travelway. They hoped to get by with something less. Mr. Safavian suggested a change that a travelway width not be limited, but as determined by the director of public works. Commissioner Jonathan asked about access. RICHARD HOWARD, 79-820 Camel Back in Bermuda Dunes, indicated that it was his intention with the developer to the north to improve the road and it was Mr. Clem's intent to bring the road up to the proposed property and share the cost, which they were in the process of working out with CVWD. He indicated that some type of instruction was needed from the city as to what standards the road should be and they were willing to work with Mr. Clan to the north with an overall plan conducive to all the property owners to access his property. He felt safe access to their property was necessary for their four homesites. He did not feel it was appropriate to put a large city requirement street structure, but something conducive with the natural terrain of the area. Commissioner Jonathan asked if the improvements to the road being contemplated extended down to Thrush. Mr. Howard replied yes, that it was approximately one mile from their property border to Thrush and they would pave in the areas between the concrete spillways. He stated that it was their intent to provide nice, paved roadways for the homeowners. After further discussion regarding the roadways and access, Chairperson Whitlock asked if anyone wished to speak in FAVOR or OPPOSITION to the proposal. M. HURBERT MEYER, 48-600 Oakwood Way, representing Somerset Homeowners Association. He had sane questions about the access and which bridge they would be using. He wondered how the construction equipment would be able to access the bridge roads. He was also concerned about the preservation of the hillside and did not want any visible roads. MS. IRENE TAFFY, 72-306 Blueridge Court, asked for and received clarification on the location of the road being discussed. Commissioner Jonathan explained that the road would go through Thrush bridge below the church and Indian Creek. She objected to viewing the hares from her patios. Commissioner Richards outlined the strict requirements for building in the hillside. Commissioner Jonathan explained that the hones would be there, but over five acres would remain undisturbed and while they might be visible, there would not be lush landscaping or a lot of roads. Commissioner Erwood explained that the hillside building requirements were restrictive and the city was in a position that it allow some restricted development or purchase the hillsides. MR. JERRY DENNINGMN, 74-894 Lennon Place, stated that he was the engineer on the project. He asked Commissioner Richards why he was concerned about the road being continued to the tract north of the project. Commissioner Richards stated that his reason was that the city standard was 32 foot wide roads, which probably couldn't be accomplished without blasting out rock; the spillways were there and while it might be possible to redesign them to handle traffic and still transport water, that had not yet been determined; the fire marshal would also need a minimum 24 foot road, but with some creative conditions, it could be changed (i.e. using sprinklers in the hones). He indicated that he would like to see the city come up with a better set of guidelines so that owners in that area would know what would be expected and the costs involved. Mr. Dennington concurred, but indicated that time was of the essence and felt they would be able to go along with the north tract as it was conditioned. Commissioner Richards stated that he dial not like the access as proposed and felt a bridge halfway in between might be a solution. MR. TOM JOHNSTON, 71-386 Halgar in Rancho Mirage, indicated that he was a principle in the project and stated that their neighbor to the north has an approved project and asked what requirements were asked of that property owner regarding the road. Commissioner Richards felt that the city had been sitting back too long and felt if more development was allowed, the requirements should not be done in a patchwork manner. He wanted set standards for roads in that area. After further discussion, it was determined that the matter would be continued for four weeks to allow the applicant to work with city staff and CVWD to determine set standards. In one area there was an easement granted by the original owner (Ahmanson) and under legal advice from his attorney, he indicated that whatever easements they had recorded and given to the property at that time may be addressed. In that regard the easement as originally given was to assay Highway 111, the non-interdicted highway to give this property freedom of movement east and west. Over the years the CVWD had interdicted Painters Path, which is the site of old Highway 111. He indicated there were two ways to go: 1) perfect the easement to the present Highway 111, which might not be in the best interest of the city; or 2) perfect the easement in Painters Path with a bridge. He stated that they were now in dialogue with CVWD on the basis that the interdiction was caused by CVWD. He felt that "them that broke it has to fix it", noting that their position may not be his. He indicated that the city's position was known, because it was decided at the city council. Continued Case Now SC MBES'T PARTNERS, Applicant Request for approval of a five lot tentative map and negative declaration to allow four homesites and dedicated open space on 7.73 acres generally located on the west side of the Palm Valley Storm Channel across from the Samnerset Condominiums. Mr. Diaz explained that the matter had been continued and was called up by city council to provide direction regarding the paving of streets outside of the subdivision area to the subdivision area. The city council at its meeting of April 12 voted to inform the planning commission at this time that paved access outside of the tentative tract map itself should not be required of this specific subdivision in the hillside area. He noted the matter was continued to allow staff to investigate a possibility of the involvement of the Air Quality Management District regarding the PM 10 particles of sand, air quality that could require some paving. A second council concern was that providing paved access into the area would encourage additional traffic into the hillside area. In terms of tract maps and development in that area, council felt that it should only be interior local streets under consideration at this time. Commissioner Richards asked if this would prohibit a group of homeowners fran building their own road. Mr. Diaz replied no, but indicated there was some strong sentiment in that area not to have paved access. After further discussion on safety, paving standards and access issues, Chairperson Whitlock opened the public testimony and asked the applicant to address the commission. MR. Mr. Howard replied yes, that it was with property owners in his general area and they all agreed that some type of safer, cleaner access was needed. He explained that there were two issues involved: the CVWD maintenance road and road for access to the properties--the road to the channel and the road to the individual hone sites. It was noted that the Miller property might be developing their 640 acres, as well as the Clan property, which might be able to provide some type of future access. Commissioners Richards and Jonathan expressed concern as to safety and traversing the spillways, fire department access, and formation of an assessment district for road paving prior to beginning of construction. After further discussion, Mr. Diaz suggested the following be added under canmuiity development conditions: 10) Homes should be sprinklered to the satisfaction of the fire department; 11) Access along the Coachella Valley Water District maintenance road shall be approved by the Palm Desert City Engineer; and 12) Applicant and his successors in interest on the property shall agree to join an assessment district for the paving of said maintenance road should are be established in the next five (5) years. If the remaining area exceeds four acres, an additional unit may be developed in the hillside. If the remainder is less than four acres , the hillside must remain undeveloped. For a remainder larger than five acres , density will be deter- mined through Option No. 1 or No. 3. 317-3 (Palm Desert 9/83) 25 . 15 . 030 OPTION NO. 3--DWELLING UNIT BUILDING SITE , Instead of determining density by the average slope of the entire parcel as in Option No. 1 , the applicant may delineate specific dwelling unit building sites whose slopes are twenty percent or less and are not adjacent to the valley floor , if the following criteria is met : 1. Minimum area of one-half acre; 2 . Minimum dimension of one hundred feet; 3. Maximum of overall density of one dwelling unit per acre . The city may require any measure it feels necessary to mitigate adverse environmental or aesthetic impacts of grading or construction. Location and grades of access roads shall be as approved by the fire marshal and planning commission. If adverse aesthetic and environmental impacts of site and access grading cannot be adequately mitigated, then the designated location shall not qualify as a building site under this option. Density for the area remaining after the application of Option No. 3 , shall be determined via Option No. 1 or No. 2. Architectural design and materials shall to the greatest practical extent blend with the natural terrain. GRADING RESTRICTION FOR PROPERTIES OVER TEN PERCENT SLOPE DEVELOPED UNDER OPTION NO. 2 AND OPTION NO. 3 Grading on the site shall be limited to the minimum re- quired for safe access and the structural requirements of the dwelling unit. Grading for the building pad shall not involve an area greater than ten thousand square feet. That area dis- turbed by grading other than that required for access or build- ing foundation, including all visible cuts or fills , must be contoured and landscaped to blend with the surrounding natural terrain prior to final inspection or within one year follow- ing completion of grading if construction has not commenced. OPTION NO. 4--PREFERRED DEVELOPMENT AREA The ability of the city' s architectural review commis- -:.lion process to insure proper siting of units within the hill- side is directly proportional to the size of the parcel. Cer- tain lots may not contain any acceptable sites while- others may contain several. The larger the parcel, the greater the likelihood that suitable locations can be found. It is there- fore advantageous to encourage the consolidation of smaller parcels so that sites can be developed according to aesthetic and environmental criteria instead of arbitrary existing prop- erty lines. It is also the city' s desire to concentrate development on the less visible lower slopes. � r 317-4 (Palm Desert 9/83) 25 . 15 . 040--25 . 15 . 070 The following option offers increased density for larger parcels or combination of parcels submitted under one develop- ment plan if at least ten acres are located in the preferred development area as shown on the zoning map. Street alignments where possible shall para lel contours of the natural terrain and z be located in valleys or on ridges so as not to be visible from the valley floor. B. It is our. recommendation that the hillside roads be private with the City of Palm Desert assisting in the creation of a private maintenance district as approved by the City Attorney. Width The width of the roads should be the absolute minimum consistent with the safe movement of traffic. A width varying from 28 to 32 feet with a cross section design either as a crown with water diverted to the sides or an inverted section with water carried in the center of the street. Curb and gutter, or alternative methods, would be required solely for erosion protection, and 110 sidewalks should be required. Pavement color shall be required to blend with the hillside. Methods available to assure blending are as follows: ( 1 ) Use of chip seal using a color-coordinated aggregate over the asphalt surface. (2) Portland Cement brushed onto the asphalt surface. Surface It is recommended that asphalt concrete be used on grades of less than twelve percent, unless otherwise required by the fire department. On grades above twelve percent, Portland Concrete Cement with appropriate colorization would be required. The streets should be surfaced. This recommendation is based upon safety, air quality, and erosion control benefits. Storm Drain Considerations Special attention needs to be exercised to protect the Palm Valley Channel . The road surface's paving will require the Coachella Valley Water District's approval where the roadway encroaches into the District's rights-of-way as well as those areas where storm waters access the channel .
