A RESOLUTION OF THE PLANNING CU44ISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A 20 LOT SUBDIVISION NORTH OF HOVLEY LANE, 500 FEET EAST OF MEADOW LANE CASE NO. TT 25373 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the day of December 5, 1989, hold a duly noticed public hearing to consider the request of Hovley Group for project described above; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89, " in that the director of community development has determined that the project will not significantly impact the environment and a negative declaration is hereby reccmTended for approval; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify approval of the tentative tract map: (a) That the proposed map is consistent with applicable general and specific plans. (b) That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. (c) That the site is physically suitable for the type of development. (d) That the site is physically suitable for the proposed density of development. (e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. (f) That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. (g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision. WHEREAS, in the review of this tentative tract map the planning ccRmission has considered the effect of the oontemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs, with available fiscal and environmental resources. NOW, THEREFORE, BE IT RESOLVED by the Planning Cartnission of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the carmissicn in this case; 2. That it does hereby approve the above described Tentative Tract Map No. TT25373, subject to fulfillment of the attached conditions. The final map shall conform substantially with the tentative tract map as modified by the following conditions. 2. Applicant shall obtain clearance from the following agencies -prior to construction: Public Works Department Palm Desert Architectural Review Process City Fire Marshal Coachella Valley Water District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. 3. The applicant shall pay all applicable fees in accordance with city policy including school, art-in-public-places, and lizard fees. 4. Setbacks shall be as follows: front and rear at 20', side at 51 . 5. Maximum building height - one story 15' or 18' with architectural commission approval. 6. Six foot wood fence required along interior boundary of drainage easement if drainage facility is not constructed prior to subdivision. If and when facility is constructed, then easement shall include slopes to acoannodate grades anticipated on adjacent parcel to the west, and oconstruction of a 6' masonry wall which is also required along east of property line. Department of Public Works: 1. Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal Code and Palm Desert Ordinance Number 507, shall be paid prior to recordation of final map. 2. Any storm drain construction associated with this project shall be contingent upon a drainage study prepared by a registered civil engineer that is reviewed and approved by the Department of Public Works prior to start of construction. 3. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and 79-55, shall be paid prior to recordation of final map. 3 PLAN IIM Cal MISSION RESOLUTION NO. Full public improvements, as required by sections 26.40 and 26.44 of the Palm Desert Municipal Code, shall be installed in accordance with applicable city standards. 5. As required under Palm Desert Municipal Code Section 26.28, and in accordance with Sections 26.40 and 26.44, complete improvement plans and specifications shall be submitted to the Director of Public Works for checking approval before construction of any improvements is cc menced. Offsite improvement plans to be approved by the Public Works Department and a surety posted to guarantee the installation of required offsite improvements prior to recordation of final map. Such offsite improvements shall include, but not be limited to, curb and gutter, asphalt paving and an 8 foot wide meandering concrete sidewalk in an appropriate size and configuration. "As-built" plans shall be submitted to, and approved by, the Director of Public Works prior to the acceptance of the improvements by the city. 6. Improvement plans for water and sewer systems shall be approved by the respective service districts with "as-built" plans submitted to the Departrnent of Public Works prior to project final. 7. All public improvements shall be inspected by the DepaxtTient of Public Works and a standard inspection fee shall be paid prior to issuance of grading permits. 8. Landscaping maintenance on Hovley Lane shall be provided by the homeowners association. If no homeowners association is formed for this project, the property shall be annexed into the existing Lighting and Landscape Maintenance District. All costs associated with the annexation process shall be the responsibility of the applicant. 9. In accordance with Palm Desert Municipal Code Section 26.44, complete grading plans and specifications shall be submitted to the Director of Public works for checking and approval prior to issuance of any permits. 10. As required by Sections 26.32 and 26.44 of the Palm Desert Municipal Code, and in accordance with the Circulation Network of the City's General Plan half-street right-of-way at 44 feet on Hovley Lane and full right-of-way at 50 feet on the proposed cul-de-sac street shall be offered for dedication on the final map. 4 PLANMIWG COMMISSION RESOLL)TiCN N0. 11. Traffic safety striping shall be installed to the specifications of the Director of Public Works. A traffic control plan must be submitted to, and approved by, the Director of Public Works prior to the placement and pavement markings. 12. Full improvements of interior streets based on residential street standards in accordance with section 26.40 of the Palm Desert Municipal Code shall be provided. 13. Complete tract map shall be submitted as required by ordinance to the Director of Public Works for checking and approval and be recorded before issuance of any pezmiits. 14. Any and all offsite improvements shall be preceded by the approval of plans and the issuance of valid encroachment permits by the Department of Public Works. 15. A complete preliminary soils investigation, conducted by the registered soils engineer, shall be submitted to, and approved by, the Department of Public Works prior to the issuance of a grading permit. 16. All proposed pad elevations are subject to review and modification in accordance with Chapter 27 of the Palm Desert Municipal Code. 17. Waiver of access to Hovley Lane except at approved locations shall be granted on the final map. 18. Applicant and/or their engineering representatives shall coordinate the proposed grading design with properties to the east (Tentative Tract No. 24254) and west in order to minimize pad grade differentials. 19. applicant shall provide for the construction of those elements of the Northside Area Drainage Master Plan which are contiguous to this project unless alternative arrangements, acceptable to the city, are established. The construction of such improvements shall be in accordance with City of Palm Desert Project 509-87 approved plans. As provided for in Section 26.49.030 of the Palm Desert Municipal Code the costs associated with the construction of this system over and above the amount of drainage fees assessed against this project may be subject to reimbursement, at the discretion of the City Council. 20. Applicant shall provide a minimum 20' wide easement in a north/south direction along the westerly property line for storm drain purposes. 21. Hovley Lane street improvements shall be based on City of Palm Desert Project No. 509-87 design criteria. 5 PLANNIM CU4 IISSICN RESOLUTIM NO. City Fire Marshal: 1. Provide or show there exists a water system capable of providing a potential fire flow of 1500 gpn and the actual fire flow available from any one hydrant connected to any given water main shall be 1500 gpn for 2 hours duration at 20 psi residual operating pressure. 2. A fire flow of 1500 gpm for a 2 hour duration at 20 psi residual operating pressure must be available before any combustible material is placed on the job site. 3. The required fire flow shall be available from a Super hydrant(s) (6" x 4" x 2-1/2" x 2-1/2"), located not less than 25' nor more than 200' from any portion of the building(s) as measured along approved vehicular travelways. Hydrants installed below 3000' elevation shall be of the "wet barrel" type. 4. Prior to the application for a building permit, the developer shall furnish the original and two copies to the water system plan to the County Fire Department for review. No building permit shall be issued until the water system plan has been approved by the County Fire Chief. Upon approval, the original will be returned. One copy will be sent to the responsible inspecting authority. Plans shall conform to fire hydrant types, location and spacing, and the system shall meet the fire flow requirements. Plans shall be signed by a Registered Civil Engineer and may be signed by the local water company with the following certification: "I certify that the design of the water system is in accordance with the requirements prescribed by the Riverside County Fire Department". 5. Certain designated areas will be required to be maintained as fire lanes. 6. Dead-end roads in excess of 150' shall be provided with a minimum 45' radius turn-around (55' in industrial developments). 7. Whenever access into private property is controlled through use of gates, barriers, guard houses or similar means, provision shall be made to facilitate access by emergency vehicles in a manner approved by the Fire Department. All controlled access devices that are power operated shall have a radio-controlled over-ride system capable of opening the gate when activated by a special transmitter located in emergency vehicles. Devices shall be equipped with backup power facilities to operate in the event of pacer failure. all controlled access devices that are not power operated shall also be approved by the Fire Department. minimum opening width shall be 12' , with a minimum vertical clearance of 1316". 8. Case No. TT 25373 i 1IC7 Ey G1=p' Applicant Request for approval of a 20 lot single family subdivision north of Hovley Lane, 500 feet east of Meadow Lane. Mr. Diaz outlined the salient points of the staff report and recommended approval subject to the conditions. Chairperson Whitlock asked if the wood fence would be temporary. Mr. Diaz replied that the six foot wood fence along the interior was temporary. It could be removed at such time as the drainage was installed to delineate the 20 foot drainage easement. Commissioner Jonathan asked about the normal side setback requirements. Mr. Diaz stated that in these developments the side yards are five feet to property line and ten between structures. Ccnniussioner Jonathan asked if some of the lots were under 8,000 square feet. Mr. Diaz stated that the sizes were smaller because of the easement; he indicated that the 8,000 square foot lot size minimum was what staff had determined should be the normal minimum for single family detached in the planned residential zone. He informed camnission that the reason for that was because the smallest R-1 zoning the city had at the time of incorporation was R-1 8,000; in this particular case to achieve that on both sides of the street there would be a 20 foot drainage easement where people could not develop and their depth would be less; staff felt having the smaller lot size would balance that. He noted that if the drain was eventually put in and undergrounded, then people could do something. 2 • MINITPFS PALM DESERT PLANNING OC[� IISSION DECEMBER 5, 1989 Commissioner Jonathan asked what alternatives were looked at and asked if there could be a requirement to underground the drainage so there wouldn't be wider lots on the west side. Mr. Diaz stated that the drain would have to be constructed by the city, not by the developer, and there would still be the 20 foot easement--it couldn't be used for a pool or any amenity such as that. Chairperson Whitlock opened the public testimony and asked if the applicant wished to address the commission. MR. JOHN ADDICKERS, civil engineer, 4501 E. Sunny Dunes in Palm Springs, informed commission he was present to answer any questions. Commissioner Jonathan asked if any alternatives had been considered that would result in lots larger than 7,800 square feet on the east side. Mr. Addickers stated that the lot averaged at about 8,000 square feet and the type of home being proposed would work well on the lots. He indicated that the lots were 130 feet deep which would provide an ample backyard. Commissioner Jonathan asked what size hones were envisioned on the east side lots and Mr. Addickers stated that the hones would be the same on both sides, approximately 2,000 square feet. Chairperson Whitlock asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposal; there being no one, the public testimony was closed. Commissioner Jonathan stated that he was not in favor because of the size of the lots; he had a problem with 8,000 square foot lots and would rather see a minimum of 10,000 square feet. He indicated he understood the need for smaller lots, but felt that area was not high density and did not want the lots getting smaller and smaller with no break up in how the streets were formed--with five foot setbacks there would be cramped houses and he did not like this to be the direction of the city for that area. Commissioner Downs indicated that under normal circumstances he would agree, except in this case the city was taking a 20 foot easement which was resulting in only 200 feet less. He did not feel that was being fair to the developer. Commissioner Jonathan sympathized but wanted to find some other alternative and he felt that whoever bought the property knew that going in and noted there was vacant property on either side that could be incorporated into a larger project. 3 MINUTES PALM DESERT PLANNING CU44ISSION DECEMBER 5, 1989 MR. MICHAEL CASTELLI, applicant, stated that during his business hours with the patio open or enclosed, they could not do any more dinners if it were closed. With it open, there was enough parking and if it were closed, he felt he would still have enough parking but the city said he didn't, which was why he got more parking next door. Commissioner Richards noted that one problem was that 50% of all restaurants fail the first year and 20% were left after five years and most restaurants in Palm Desert move around quite a bit. He indicated that it was difficult for the commission to make exceptions in places where someone was doing something right and noted it was a complicated situation. He stated that it was a severe restriction on the property if commission allowed the applicant to commit some funds to enclose this patio and then if the business was sold to the next tenant who might request lunch hours to stay in business. He stated that the decision was difficult because it might start a precedent. He stated that if the expansion were approved the business sold, the next tenant would have to tear out the new improvements and wanted to make sure both the applicant and property owner understood that. Mr. Drell indicated that the next tenant would be restricted to dinner only, or if he wanted to serve lunch, he would have to take out that improvement or somehow propose to the city's satisfaction some alternative to meet the parking. Mr. Castelli informed ccnmdssion that his restaurant in San Clemente had been there eight years and did not see his Palm Desert location going anywhere since business had been good. Chairperson Whitlock asked if anyone present wished to speak in FAVOR of the proposal. Commissioner Downs indicated that he would like to hear from the landlord. MR. CHARLIE MILLER informed commission that he had the property next door and felt that Mr. Castelli had done a good job. He indicated that he owned the property in the back which would eventually be parking, so he would have ample roan to build onto the back of his building if he had to. Mr. Miller stated that Mr. Castelli had been a remarkable tenant and very cooperative with the city and his neighbors. MR. JAMES COLES informed commission that his wife owned the property and they recognized the problem with parking and that dinner hours only was conditioned because of the parking and if 9 • ' MINU'PCS 'PALM DESERT PLANNING CCR 1SSION DECEMBER 5, 1989 the property changed hands, felt adequate parking could be provided because it was not a walk-in trade area, but a dinner trade area and valet parking was almost a requirement because of the type of clientele that had been generated. He noted that all the neighbors were absentee after 5:00 p.m, and felt that this would enhance property on the north side of Highway 111 and the enhanced appearance might motivate other properties to improve. Chairperson Whitlock asked if anyone else present wished to speak in FAVOR or OPPOSITION to the proposal; there being no one, the public testimony was closed. Commissioner Jonathan asked how many tables were included in 600 square feet. Mr. Castelli replied ten tables were in and ten tables out. Chairperson Whitlock felt that the expansion in eliminating the existing awnings would enhance the site and the whole street and felt that it was an extraordinary circumstance and felt that a fine restaurant had been brought into the caTnTunity and if the owner of the site understood the caveat and the applicant was prepared to make the addition, she felt conrtission should proceed and allow the applicant the conditional use permit. Commissioner Jonathan stated that he was torn because he felt it would enhance the appearance of the corner which was needed, but on the other hand there was an existing restaurant with an awning that might not be legal. Mr. Drell stated that the existing overhead structured awning was legal and would remain; what was illegal was the drapery and that would be removed. Commissioner Jonathan indicated there was a restaurant with 10 to 20 tables with 6 parking spaces plus the street and expansion would add to the parking problem, while on the other hand would improve the appearance. Chairperson Whitlock noted that the applicant had leased the parking lot next door and would provide valet parking. Commissioner Jonathan stated that if it is good food the tables would be filled up and that would mean 20 cars. Mr. Drell indicated that there was a lot of on- street parking spaces available. Commissioner Jonathan stated that he wanted to go on record as being concerned and did not want to see a precedent that would allow the increased activity without parking and hoped there would eventually be parking in the rear. He stated that he would move for approval of the findings and added condition no. 9. 10 MINLYIES PALM DESERT PLANNIIU 034 IISSION DECEMBER 5, 1989 Commissioner Richards stated that he was more concerned with the property to the west and the possibility that Auto Sound could be sold and it could be turned into a restaurant or something else because nothing is permanent. He indicated that commission's decisions were not made lightly. He felt that staff did a good job on the staff report. Commissioner Richards expressed concern over the parking and asked if it was a lease situation. Mr. Drell replied yes and indicated that the applicant would pay $100 per month until the year 2002 or until the city parking were provided. SITE DES(RIP'T'ION• The vacant 4.75 acre site is zoned PR-5 which would allow up to 23 units. The site is directly behind the vacant Foundation for the Retarded property that fronts onto Country Club Drive. It is also two lots east of the Meadows Lane cul-de-sac, adjacent to Sonata II, a 94 lot subdivision to the east, and directly across Hovley Lane from the Evangelical Church. II. PROJECP DESCRIPTION• The proposed map is similar to the Monterey Meadows subdivision with the exception that this project will extend the 20' parkway from the 94 lot Sonata II project. No house plans are being submitted at this time so restrictions will be established for any hones that are constructed. The standards are identical to those for R-1 lots. Five foot side setbacks are recommended due to the 60' wide lots compared to the 70' normal for R-1 lots. Ten foot setbacks are recommended for the northern and southern project boundary. A 20' drainage easement is required along the west property line to drain the Sagewood subdivision, so lots here are 150' deep compared to 130' on the east side of the proposed cul-de-sac. The drainage facility may not be constructed initially so a wood fence will be permissible at the easement in the interim period. After the facility is constructed a 3' to 4' slope up will be installed to accommodate any future pads of a project to the west, which will be higher than this project, which is in turn 3' to 4' higher than the Sonata II project. PUBLIC HEARINGS A. Case No. 73�- HOVLEY Gzap, Applicant. Request for approval of a 20 lot single family subdivision north of Hovley Lane, 500 feet east of Meadow Lane. Mr. Diaz outlined the salient points of the staff report and recommended approval subject to the conditions. Chairperson Whitlock asked if the wood fence would be temporary. Mr. Diaz replied that the six foot wood fence along the interior was temporary. It could be removed at such time as the drainage was installed to delineate the 20 foot drainage easement. Commissioner Jonathan asked about the normal side setback requirements. Mr. Diaz stated that. in these developments the side yards are five feet to property line and ten between structures. Can issioner Jonathan asked if some of the lots were under 8,000 square feet. Mr. Diaz stated that the sizes were smaller because of the easement; he indicated that the 8,000 square foot lot size minimum was what staff had determined should be the normal minimum for single family detached in the planned residential zone. He informed commission that the reason for that was because the smallest R-1 zoning the city had at the time of incorporation was R-1 8,000; in this particular case to achieve that on both sides of the street there would be a 20 foot drainage easement where people could not develop and their depth would be less; staff felt having the smaller lot size would balance that. He noted that if the drain was eventually put in and undergrounded, then people could do something. 2 MINUTES PALM DESERT PLANNIM Ca441ISSION DECO-IBM 5, 1989 Commissioner Jonathan- asked what alternatives were looked at and asked if there could be a requirement to underground the drainage so there wouldn't be wider lots on the west side. Mr. Diaz stated that the drain would have to be constructed by the city, not by the developer, and there would still be the 20 foot easement--it couldn't be used for a pool or any amenity such as that. Chairperson Whitlock opened the public testimony and asked if the applicant wished to address the commission. M. JOHN ADDICERS, civil engineer, 4501 E. Sunny Dunes in Palm Springs, informed commission he was present to answer any questions. CcmmLissioner Jonathan asked if any alternatives had been considered that would result in lots larger than 7,800 square feet on the east side. Mr. Addickers stated that the lot averaged at about 8,000 square feet and the type of home being proposed would work well on the lots. He indicated that the lots were 130 feet deep which would provide an ample backyard. Commissioner Jonathan asked what size hones were envisioned on the east side lots and Mr. Addickers stated that the hones would be the same on both sides, approximately 2,000 square feet. Chairperson Whitlock asked if anyone present wished to speak in FAVOR or OPPOSITION to the proposal; there being no one, the public testimony was closed. Commis sioner Jonathan stated that he was not in favor because of the size of the lots; he had a problem with 8,000 square foot lots and would rather see a minimum of 10,000 square feet. He indicated h qu e understood the need for smaller lots, but felt that area was not high 9 density and did not want the lots getting smaller and smaller with no break up in how the streets were formed--with five foot setbacks there would be cramped houses and he did not like this to be the direction of the city for that area. Commissioner Downs indicated that under normal circumstances he would agree, except in this case the city was taking a 20 foot easement which was resulting in only 200 feet less. He did not feel that was being fair to the developer. Commissioner Jonathan sympathized but wanted to find some other alternative and he felt that whoever bought the property knew that going in and noted there was vacant property on either side that could be incorporated into a larger project. 3 MINUTES PALM DESERT PLANND G C(PNISSION DECEMBER 5, 1989 MR. MICHAEL CASTELLI, applicant, stated that during his business hours with the patio open or enclosed, they could not do any more dinners if it were closed. With it open, there was enough parking and if it were closed, he felt he would still have enough parking but the city said he didn't, which was why he got more parking next door. Ccmmissicner Richards noted that one problem was that 50% of all restaurants fail the first year and 20% were left after five years and most restaurants in Palm Desert move around quite a bit. He indicated that it was difficult for the oonnission to make exceptions in places where someone was doing something right and noted it was a complicated situation. He stated that it was a severe restriction on the property if catmlission allowed the applicant to cornnit some funds to enclose this patio and then if the business was sold to the next tenant who might request lunch hours to stay in business. He stated that the decision was difficult because it might start a precedent. He stated that if the expansion were approved the business sold, the next tenant would have to tear out the new improvements and wanted to make sure both the applicant and property owner understood that. Mr. Drell indicated that the next tenant would be restricted to dinner only, or if he wanted to serve lunch, he would have to take out that improvement or somehow propose to the city's satisfaction some alternative to meet the parking. Mr. Castelli informed ccnwdssion that his restaurant in San Clemente had been there eight years and did not see his Palm Desert location going anywhere since business had been good. Chairperson Whitlock asked if anyone present wished to speak in FAVOR of the proposal. Commissioner Downs indicated that he would like to hear from the landlord. MR. CHARLIE MILLER informed connission that he had the property next door and felt that Mr. Castelli had done a good job. He indicated that he owned the property in the back which would eventually be parking, so he would have ample room to build onto the back of his building if he had to. Mr. Miller stated that Mr. Castelli had been a remarkable tenant and very cooperative with the city and his neighbors. MR. JABS COLES informed comnission that his wife owned the property and they recognized the problem with parking and that dinner hours only was conditioned because of the parking and if 9 MINUTES PALM DESERT PLANIM COMMISSION DECEMBM 5, 1989 the property changed hands, felt adequate parking. -could be provided because it was not a walk-in trade area, but a dinner trade area and valet parking was almost a requirement because of the type of clientele that had been generated. He noted that all the neighbors were absentee after 5:00 p.m. and felt that this would enhance property on the north side of Highway 111 and the enhanced appearance might motivate other properties to improve Chairperson Whitlock asked if anyone else present wished to speak in FAVOR or OPPOSITION to the proposal; there being no one, the public testimony was closed. Commissioner Jonathan asked how many tables were included in 600 square feet. Mr. Castelli replied ten tables were in and ten tables out. Chairperson Whitlock felt that the expansion in eliminating the existing awnings would enhance the site and the whole street and felt that it was an extraordinary circumstance and felt that a fine restaurant had been brought into the community and if the owner of the site understood the caveat and the applicant was prepared to make the addition, she felt commission should proceed and allow the applicant the conditional use permit. Ca[mii ssioner Jonathan stated that he was torn because he felt it would enhance the appearance of the corner which was needed, but on the other hand there was an existing restaurant with an awning g that might not be legal. Mr. Drell stated that the existing overhead structured awning was legal and would remain; what was illegal was the drapery and that would be removed. Commissioner Jonathan indicated there was a restaurant with 10 to 20 tables with 6 parking spaces plus the street and expansion would add to the parking problem, while on the other hand would improve the appearance. Chairperson Whitlock noted that the applicant had leased the parking lot next door and would provide valet parking. Commissioner Jonathan stated that if it is good food the tables would be filled up and that would mean 20 cars. Mr. Drell indicated that there was a lot of on- street parking spaces available. Commissioner Jonathan stated that he wanted to go on record as being concerned and did not want to see a precedent that would allow the increased activity without parking and hoped there would eventually be parking in the rear. He stated that he would move for approval of the findings and added condition no. 9. 10 MINUTES PALM DESERT PLANNIIU CCn-USSION DECEMBER 5, 1989 Commissioner Richards stated that he was more concerned with the property to the west and the possibility that Auto Sound could be sold and it could be turned into a restaurant or scmething else because nothing is permanent. He indicated that commission's decisions were not made lightly. He felt that staff did a good job on the staff report. Coudssioner Richards expressed concern over the parking and asked if it was a lease situation. Mr. Drell replied yes and indicated that the applicant would pay $100 per month until the year 2002 or until the city parking were provided. Commissioner Richards indicated that answered his questions. Chairperson Whitlock stated that she would second the motion. SITE DESCRIPTION• The vacant 4.75 acre site is zoned PR-5 which would allow up to 23 units. The site is directly behind the vacant Foundation for the Retarded property that fronts onto Country Club Drive. It is also two lots east of the Meadows Lane cul-de-sac, adjacent to Sonata II, a 94 lot subdivision to the east, and directly across Hovley Lane from the Evangelical Church. II. PST DESCRIPTION• The proposed map is similar to the Monterey Meadows subdivision with the exception that this project will extend the 20' parkway from the 94 lot Sonata II project. No house plans are being submitted at this time so restrictions will be established for any hones that are constructed. The standards are identical to those for R-1 lots. Five foot side setbacks are recornnended due to the 60' wide lots compared to the 70' normal for R-1 lots. Ten foot setbacks are recommended for the northern and southern project boundary. A 20' drainage easement is required along the west property line to drain the Sagewood subdivision, so lots here are 150' deep compared to 130' on the east side of the proposed cul-de-sac. The drainage facility may not be constructed initially so a wood fence will be permissible at the easement in the interim period. After the facility is constructed a 3' to 4' slope up will be installed to accommodate any future pads of a project to the west, which will be higher than this project, which is in turn 3' to 4' higher than the Sonata II project. It is also two lots east of the Meadows Lane cul-de-sac, adjacent to Sonata II, a 94 lot subdivision to the east, and directly across Hovley Lane from the Evangelical Church. II. PROJECP DESCRIPTION• The proposed map is similar to the Monterey Meadows subdivision with the exception that this project will extend the 20' parkway from the 94 lot Sonata II project. No house plans are being submitted at this time so restrictions will be established for any homes that are constructed. The standards are identical to those for R-1 lots. Five foot side setbacks are recom�mended due to the 60' wide lots compared to the 70' normal for R-1 lots. Ten foot setbacks are recommended for the northern and southern project boundary. A 20' drainage easement is required along the west property line to drain the Sagewood subdivision, so lots here are 150' deep compared to 130' on the east side of the proposed cul-de-sac. The drainage facility may not be constructed initially so a wood fence will be permissible at the easement in the interim period. After the facility is constructed a 3' to 4' slope up will be installed to accommodate any future pads of a project to the west, which will be higher than this project, which is in turn 3' to 4' higher than the Sonata II project. Offsite improvement plans to be approved by the Public Works Department and a surety posted to guarantee the installation of required offsite improvements prior to recordation of final map. In accordance with Palm Desert Municipal Code Section 26.44, complete grading plans and specifications shall be submitted to the Director of Public Works for checking and approval prior to issuance of any permits. 10. As required by Sections 26.32 and 26.44 of the Palm Desert Municipal Code, and in accordance with the Circulation Network of the City's General Plan half-street right-of-way at 44 feet on Hovley Lane and full right-of-way at 50 feet on the proposed cul-de-sac street shall be offered for dedication on the final map. 11. Traffic safety striping shall be installed to the specifications of the Director of Public Works. A traffic control plan must be submitted to, and approved by, the Director of Public Works prior to the placement and pavement markings. 12.
