Re: TR 25445 - Noise Control Construction Requirements for
Two Story Residences at Northeasterly Portion of Site
Dear Mr. Solomon:
In accordance with your request during your recent meeting with Bruce
Walker, we have reviewed the noise control construction requirements for
two story residences proposed for construction on the lots at the
northeasterly portion of the site. We computed the composite exterior'
noise exposure at the second floors. of these units with the following
assumptions:
■ Highway I-10 modeled utilizing "soft-site minus 4 dB" based on the
field measurements and Caltrans projections for future traffic;
■ SPRR modeled utilizing "soft-site" based on field conditions;
■ Pennsylvania Avenue/Tamarisk Row Road modeled utilizing "hard-site"
to account for the elevated receiver location and the 9 ft wall at
the perimeter of the site. Traffic was assumed to be 24,000 ADT,
per the original study. However, a more reasonable traffic mix for
a residential area consisting of 2% medium trucks and 1% heavy
trucks was utilized, rather than the 3% medium, 5% heavy mix
specified by the County for the original study.
The table below summarizes the results of the calculations. It can be
seen that the exterior noise exposures at the second floors will range
from a maximum of approximately L " 72 at the rear elevation on Lot 61 to
approximately Ld" 68 at the frontds on Lots 54 and 60.

It should be noted that the 0.1 dB level of precision shown in the table
above is a computational artifact, and was only retained for illustrative
purposes. For reference, an increase of approximately 1 dB is normally
judged by an "average" listener to be just discernable, a 3 dB change is
definitely noticeable, and a change in level of 10 dB is necessary for the
difference to be judged to be half or twice as loud.

■ Exterior walls should be stucco exterior with R-11 (minimum)
insulation and 1/2" minimum interior drywall .
■ Sliding patio doors in bedrooms should be well sealed units having
a minimum acoustical rating of SIC 33. Suitable assemblies include:
Rolleze type U810 with 3/8" laminated acoustical glass, ref.
WEAL 86-143 STC 33;
A.B.C. Products type 450 with 9/16" laminated acoustical glass, ref.

■ Sliding windows in bedrooms should be well sealed units utilizing
1/4" minimum monolithic glass or thermal glass with at least one
lite of 3/16" minimum glass. The windows should have a minimum
acoustical rating of STC 29. Laminated acoustical glass would be
preferred if the cost is not excessive. Suitable assemblies
include:
International type 1220/1720 with 1/4" glass, ref. WEAL 87-189
STC 29;
Alenco Series I412 with 1/4" glass, ref. WEAL 87-122 STC 30;
Guaranteed type SS670 with 1/4" laminated acoustical glass, ref.

Two story residences constructed on Lots 54 through 60 should utilize well
sealed sliding windows incorporating 3/16" (minimum) thickness monolithic
glass or thermal glass with individual panes not less than 1/8" thickness,
and should have an acoustical rating of STC 27 or higher. Suitable
assemblies include:
Rolleze type U710 with 3/16" glass, ref. WEAL 85-115 STC 27;
Premier type 500 with 3/16" glass, ref. WEAL 87-129 STC 28;
Windowmaster type 410 with 1/8"-3/8"-1/8" thermal glass, ref. WEAL

We have also investigated the acoustic shielding that could be provided by
construction of solid walls around second floor balconies facing
Pennsylvania/Tamarisk, the SPRR and I-10. In order to reduce the noise
experienced by a person seated on the balcony to Ld" 65, or below, the top
of the balcony rail should be 48" above the deck surface. However, it
should be noted that a 48" high barrier would provide essentially no
shielding for a person s-tanding,on the balcony. The exterior face of the
balcony rail should be`stucco and the interior face can be stucco, or
other material as preferred architecturally.

ANALYSIS•
The subdivider requests approval for the division of a 48 acre undeveloped
site into 92 residential lots and five open space lots. The site is located
northerly of country Club Drive and westerly of Pennsylvania Avenue.
Surrounding land uses to the west include an 113 lot single family tract that
was developed by the applicant , the Southern Pacific Railroad to the north
and vacant land to the south . Immediately east of the site is an 118 acre
parcel upon which an amendment to the Western Coachella Valley Plan was
requested from Residential 28 to Industrial /Manufacturing . This general plan
amendment ( CGPA No . 159 ) was tentatively denied by the Planning Commission on
January 17, 1990. CGPA No . 159 will ultimately be heard by the Board of
Supervisors .
The site is zoned R-1-12,000. Surrounding parcels are zoned R-1-12,000 to
the west , east and south . Change of zone No . 5329, a change from R-1-12,000
to I-P was filed concurrently with CGPA No . 159. The change of zone will be
scheduled for public hearing pending Board of Supervisors action on CGPA No .
159.

ENVIRONMENTAL ASSESSMENT :
The Initial Study performed pursuant to Environmental Assessment No . 34513
identified environmental concerns associated with this project development as
including :
Blowsand Aesthetics
Flooding Noise
Wildlife
The initial study (a copy of which is attached ) determined that approval of
the proposed project would not have a significant effect on the environment .
All environmental impacts would be clearly mitigated to a level of
insignificance. A monitoring program was incorporated into the initial
study.
GENERAL PLAN CONSISTENCY:
The site is designated Residential 22 ( 2 to 5 dwelling units per acre ) on the
Western Coachella Valley Plan (WCVP ) . The R-1 zone is considered "highly
compatible" with a Residential 28 land use category , according to the
WCVP Zoning Consistency Guidelines Matrix . Tentative Tract Map 25445 has a
density of 2. 0 dwelling units per acre .
The WCVP land use policies require a full range of public facilities and
services. The Coachella Valley Water District has agreed to furnish
sanitation service and domestic water to the site.
The site is subject to noise from traffic on Interstate 10 and the SPRR to
the north and Country Club Drive to the south . An acoustical analysis was
prepared as an additional information requirement . The study determined
that , due to train vibration, Lot. Nos . 59 and 60 should become open space
parcels . In addition, it is uncertain what the response of second floor
residences to ground vibrations would be within 500 feet of the SPRR,
therefore the study recommends that two story structures should not be
permitted within this area. The 500 foot setback includes Lot Nos. 53
through 58 and 59 through 65.

FINDINGS:
1 . The subdivider proposes to divide 39 acres into 92 residential
lots and five open space lots.
2 The site is vacant and located northerly of Country club Drive
and westerly of Pennsylvania Avenue.
3. Surrounding land uses are vacant , railroad , and single family
residences.
4. The site and surrounding parcels are zoned R-1-12, 000.
5. The findings of Environmental Assessment No . 34513 ( a copy of
which is attached ) are incorporated herein by reference.
6. The site is designated Residential 213 ( 2 to 5 dwelling units
per acre ) on the Western Coachella Valley Plan (WCVP) .
7. The R-1 zone is considered "highly compatible" with a
Residential 28 designation pursuant to the WCVP Zoning
Consistency Matrix .
2. The related tract map design presently identified a density of
2. 5 dwelling units per acre.
9. The site is subject to noise impacts of up to 70dba from the
Southern Pacific Railroad right-of-way.
RECOMMENDATION:
ADOPTION of the Negative Declaration for E. A. No . 345i3. The Planning
Department has found that approval of the proposed project will not have a
significant effect on the environment and has completed a negative
declaration.

APPROVAL of Tentative Tract Map No . 25445, subject to the attached conditions
and based on the above stated findings and following conclusions :
1 . The proposed tract map is consistent with the Western Coachella

2. Approval of this tract will not be detrimental to public
health , safety and welfare.
3. The environmental impacts of this project have been mitigated
to an insignificant level by project design and the attached
conditions of approval .

The Riverside County Board of Supervisors has taken the following
action on the above referenced tentative map at its regular meeting
of March 20 , 1990 :

The tentative map has been found , unless denied or withdrawn , to
be consistent with all pertinent elements of the Riverside County
Comprehensive General Plan and is in compliance with the California
Environmental Quality Act of 1970 .
A conditionally approved tentative map shall expire 24 months after
the approval at the Board of Supervisors hearing , the date of which
is shown above , unless within that period of time a final map shall
have been approved and filed with the County Recorder. Prior to
the expiration date , the land divider may apply in writing for an
extension of time. Application shall be made to the Planning
Director thirty ( 30 ) days prior to the expiration date of the
tentative map . The Board of Supervisors may extend the period for
one year and upon further application a second and a third year .

4 . Legal access as required by Ordinance No. 460 shall be provided from
the tract map boundary to a county maintained road.
5 . All delinquent property taxes shall be paid prior to recordation of
the final map.
6 . If any grading is proposed, the land divider shall submit one
print of a comprehensive grading plan to the Riverside County
Surveyor's Office. The plan shall comply with the Uniform Building
Code, Chapter 70, as amended by Ordinance No. 457 . A grading
permit shall be obtained from the Department of Building and Safety
prior to commencement of any grading outside of county maintained
right-of-way. Proposed grading in excess of quantities indicated
in Ordinance No. 457 may require environmental assessment approval
from the Planning Department prior to acceptance of the plans by the
Building Department. One mylar copy of the approved grading plan
shall be submitted to the Department of Building and Safety for
transmittal to the Road Department.
7 . The land divider shall submit one copy of a soils report to the
Riverside County Surveyor 's Office and two copies to the Department
of Building and Safety . The report shall address the soils
stability and geological conditions of the site .
*8. The land divider shall comply with the street improvement
recommendations outlined in the County Road Department's letter
dated February 15, 1990 , a copy of which is attached.
9 . The land divider shall install all water and sewerage disposal
facilities in accordance with the provisions set forth in the
Riverside County Health Department's letter dated January 19 , 1990,
a copy of which is attached.
10 . The land divider shall comply with the flood control recommendations
outlined by the Coachella Valley Water District's letters dated
November 29, 1989 and January 22, 1990, copies of which are
attached. If the land division lies within an adopted flood control
drainage area pursuant to Section 10.25 of Ordinance No. 460,
appropriate fees for the construction of area drainage facilities
shall be collected by the Road Commissioner prior to recordation
of the final map.
11 . The land divider shall provide fire protection in accordance with
Schedule A of Ordinance Nos . 460 and/or 546 and the Fire Marshal 's
letter dated November 27 , 1989, a copy of which is attached.

12. The land divider shall comply with the water and sewer service
recommendations contained in the Coachella Valley Water District
letter dated November 29 , 1989 , a copy of which is attached.
* 13 . The land divider shall comply with the recommendations outlined in
the Special Services Divisions of the Health Department transmittal
dated February 2 , 1990, and amendments a copy of which is attached.
14. PRIOR TO THE ISSUANCE OF A GRADING PERMIT, the subdivider shall
prepare and submit a written report to the Planning Director of the
County of Riverside demonstrating compliance with those conditions
of approval and mitigation measures of this map and E. A. No.
34513 which must be satisfied prior to the issuance of a grading
permit.
PRIOR TO RECORDATION OF THE FINAL MAP, the subdivider shall prepare
and submit a written report to the Planning Director of the County
of Riverside demonstrating compliance with those conditions of —
approval and mitigation measures of this map and E. A. No. 34513
which must be satisfied prior to recordation of the final map.
PRIOR TO THE ISSUANCE OF A BUILDING PERMIT, the subdivider shall
prepare and submit a written report to the Planning Director of
the County of Riverside demonstrating compliance with those
conditions of approval and mitigation measures of this map and
E. A. No. 34513 which must be satisfied prior to the issuance of a
building permit.
PRIOR TO THE ISSUANCE OF OCCUPANCY PERMIT, the subdivider shall
prepare and submit a written report to the Planning Director of
the County of Riverside demonstrating compliance with all remaining
conditions of approval and mitigation measures of this map and E.
A . No. 34513 .
The Planning Director may require inspection or other monitoring to
assure such compliance.

15 . The Habitat Conservation Plan has identified this map as being
within the boundaries of the mitigation area of the Coachella
valley Fringe-toed Lizard. PRIOR TO THE RECORDATION OF THE FINAL
MAP OR ISSUANCE OF ANY GRADING PERMITS OR BUILDING PERMITS,
whichever occurs first, the land divider shall submit to the
Riverside County Surveyor 's Office a document which demonstrates to
the satisfaction of the County that the land divider has provided
sufficient mitigation for the taking of habitat area. The total
amount of land to be disturbed by this project will be a minimum of
48 acres , and no final map improvements are authorized that will
disturb an area in excess of the area ultimately approved for
development.
16 . PRIOR TO THE RECORDATION OF THE FINAL MAP, the land divider shall
submit written clearances to the Riverside County Road and Survey
Department that all pertinent requirements outlined in the attached
conditions relating to the following agencies have been
met:

Fire Department Environmental Health Division
Nature Conservancy Special Services Division
Coachella Valley Water District
* 17 . PRIOR TO RECORDATION OF THE FINAL MAP, the final map shall conform
to the following design requirements:
a. The land divider shall provide sufficient evidence that
each residential lot contains a net area of no less than
12 ,000 square feet.
b. Lot Nos. 59, 60 and 96 shall be combined into one ( 1 ) lot
and labeled as a common recreational lot on the final map,
not to be used for residential purposes.
C. Lot No. 95 may be divided into two (2 ) residential lots
of 12 ,000 square foot, or larger, size, as approved by the
Planning Director Lot lines of adjacent lots may be
adjusted to accomplish this purpose as approved by the
Planning Director.
18. Lots created by this land division shall be in conformance with the
development standards of the R-1-12000 zone.

19 . Land division phasing, including any proposed common open space area
improvement phasing, if applicable, shall be subject to
Planning Department approval pursuant to Section 8.3 of Ordinance
No. 460. Any proposed phasing shall provide for adequate vehicular
access to all lots in each phase, and shall substantially conform
to the intent and purpose of the subdivision approval . No approval
for any number of units or phases is given except as provided by
Ordinance No. 460 .
* 20 . PRIOR TO RECORDATION OF THE FINAL MAP, a change of zone application
shall be filed with the Planning Department to the R-5 (Open
Area) zone for Lot Nos. 59 , 60, 93 , 94 , 96, and 97 . This change of
zone application must ultimately be heard by the Planning
Commission.
*21 . PRIOR TO RECORDATION OF THE FINAL MAP, the land divider shall submit
the following documents to the Planning Department for review,
which documents shall be subject to the approval of that department
and the Office of the County Counsel .
1 ) A declaration of covenants, conditions and restrictions;
and — —
2 ) A sample document conveying title to the purchaser of an
individual lot or unit which provides that the declaration
of covenants, conditions and restrictions is incorporated
therein by reference.
The declaration of covenants, conditions and restrictions submitted
for review shall (a) provide for a minimum term of 60 years, (b)
provide for the establishment of a property owners' association
comprised of the owners of each individual lot or unit, (c) provide
for ownership of the common area (Including but not necessarily
limited to Lot Nos. 59, 60, 93, 94, 96 and 97 ) by either the
property owners' association or the owners of each individual lot
or unit as tenants in common and (d) contain the following
provisions verbatim:
"Notwithstanding any provision in this Declaration to the
contrary, the following provisions shall apply:

The property owners' association established herein shall
manage and continuously maintain the 'common area' , more
particularly described on Tract Map 25445 attached hereto,
and shall not sell or transfer the 'common area ' , or any
part thereof, absent the prior written consent of the
Planning Director of the County of Riverside or the
County ' s successor-in-interest.
The property owners ' association shall have the right to
assess the owners of each individual lot or unit for the
reasonable cost of maintaining the ' common area' and
shall have the right to lien the property of any such
owner who defaults in the payment of a maintenance
assessment. An assessment lien, once created, shall be
prior to all other liens recorded subsequent to the notice
of assessment or other document creating the
assessment lien.
This Declaration shall not be terminated, 'substantially '
amended or property deannexed therefrom absent the prior
written consent of the Planning Director of the County of
Riverside or the County's successor-in-interest. A
proposed amendment shall be considered ' substantial ' if
it affects the extent, usage or maintenance of the
'common area' .
In the event of any conflict between this Declaration and
the Articles of Incorporation, the Bylaws or the property
owners ' association Rules and Regulations, if any, this
Declaration shall control .
once approved, the declaration of covenants, conditions and
restrictions shall be recorded at the same time that the final map
is recorded.
22 . The common open space area(s) shall be labeled as a common lot(s)
on the final map and shall be owned in fee simple title as tenants
in common by a property owner' s association.
23. The land divider shall comply with the following parkway and median
landscaping installation and maintenance conditions :

a. PRIOR TO RECORDATION OF THE FINAL MAP, the land divider
shall file an application with the Road Department for
the formation of, or annexation to, a parkway maintenance
district for the parkways and median strip located
within Country Club Drive in accordance with the
Landscaping and Lighting Act of 1972, unless the project
is within an existing parkway maintenance district.
PRIOR TO THE ISSUANCE OF BUILDING PERMITS, the land
divider or the land divider' s successors shall secure
approval of proposed street landscaping and irrigation
plans from the Road and Planning Departments. All plans
and specifications shall be prepared in a reproducible
format suitable for permanent filing with the Road
Department. All landscaping and irrigation plans shall
be coordinated with similar plans for internal
development.
C . PRIOR TO FINAL BUILDING INSPECTION APPROVAL , or at the
time of final inspection approval of street improvements
by the Road Department, whichever is first, the land
divider or the and divider's successors shall install the
parkway and median improvements, or shall have completed
all necessary financial arrangements therefore, including
but not limited to the posting of a landscaping
performance bond which shall be released concurrently
with the release of any performance bonds guaranteeing the
viability of all landscaping which will be installed prior
to the assumption of the maintenance responsibility by the
district.
d . The land divider or the land divider's successors shall
be responsible for all parkway landscaping maintenance
until such time as maintenance is taken over by the
district.
* 24 . PRIOR TO RECORDATION OF THE FINAL MAP, twelve ( 12 ) folded copies of
a plot plan for the development of improvements , including
landscaping and recreational facilities , on Lot Nos . 59 , 60, 93 , 94,
96 and 97 (common area and retention areas) shall be submitted for
approval of the Planning Department pursuant to the requirements of
Section 18.30 (Planning Department only) of Ordinance No. 348 ,
including the required fees in effect at the time of submittal . The
plot plan submittal shall contain all application requirements for
such plot plans in effect at the time of submittal and shall include
landscaping and irrigation plans. Tennis court plans shall
incorporate a 10: 00 p.m. automatic cut-off timer on lighting
facilities for the courts.

25 . This property is located within the Coachella Valley and all
landscape planting shall comply with the requirements of the State
Agriculture Code and the directives of the Riverside County
Agricultural Commissioner. All landscaping plans submitted to the
Planning Department shall include the following notation: "WARNING:
Plant material listed may or may not have been approved by the
Agricultural Commissioner ' s office. Landscape contractor, please
contact the developer for status of Agricultural Commissioner's
approval or denial . Plant material not conforming with quarantine
laws may be destroyed and civil action taken. All plant material
is subject to inspection at the discretion of the Agricultural
Commissioner's office. All plant material must be free from Red
Scale (Aonidiella aurantii . ) "
26 . The "General Telephone Company" site shown on the tentative map
shall be appropriately labeled on the .final map and shall be
conveyed to the General Telephone Company , or incorporated into the
common area of this subdivision, PRIOR TO RECORDATION OF THE FINAL
MAP.
27 . All lots created by this land division shall have a minimum area-of
12 ,000 square feet net.
28. Lots less than one-half acre in size shall be calculated in terms
of net area excluding all street right-of-ways.
29 . All lot length to width ratios shall be in conformance with Section
3 .8C of Ordinance No. 460.
30. Corner . lots shall be provided with additional area pursuant to
Section 3.8C of Ordinance No. 460.
31 . The land divider shall be responsible for maintenance and upkeep of
all landscaped areas and irrigation systems until such time as those
operations are the responsibilities of other parties.
32 . All new electrical , telephone and television services within this
land division less than 35kV shall be installed underground as
approved by the affected utility.
33. All privately maintained street lights and other outdoor lighting
shall be shown on electrical plans submitted to the Department of
Building and Safety for plan check approval and shall comply with
the requirements of Riverside County Ordinance No. 655. Privately
maintained street lights shall be of a low pressure sodium vapor
type.

34 . An Environmental Constraints Sheet ( ECS) shall be prepared with the
final map to delineate identified environmental concerns and shall
be permanently filed with the office of the County Surveyor. PRIOR
TO THE RECORDATION OF THE FINAL MAP, a copy of the ECS shall be
transmitted to the Planning Department for review and approval .
The approved ECS shall be forwarded with copies of the recorded
final map to the Planning Department and the Department of Building
and Safety.
* 35 . The following note shall be placed on the ENVIRONMENTAL CONSTRAINTS
SHEET: "This property is affected by potential noise and vibration
impacts from the Southern Pacific Railroad. No two-story structures
shall be permitted in the area of potential noise and vibration
without mitigation of the impact as approved by the Special Services
Division of the Environmental Health Department. This constraint
affects Lot Nos. 54 through 58 , 61 through 64 and 95 . " (or
renumbered as actually shown on the final map) .
36 . The following note shall be placed on the ENVIRONMENTAL CONSTRAINTS
SHEET: "At the time of tentative map approval by the County of
Riverside, the Bermuda Dunes Airport maintained operations to the
southeast of this property. Dwelling units within this development
may be subject to overflight and noise as necessary to operate
aircraft from the Bermuda Dunes Airport. "
37 . THE ENVIRONMENTAL CONSTRAINTS SHEET shall delineate the areas of
highest noise and vibration impact as determined by the Health
Department's Special Services Division within which one ( 1 ) story
structures only shall be allowed.
38. PRIOR TO THE ISSUANCE OF GRADING PERMITS, appropriate hydrologic
calculations and grading plans prepared by a California registered
civil engineer shall be submitted to the Department of Building and
Safety for review. The calculations and plans shall provide for the
acceptance of off-site stormwaters tributary to the property and for
their conveyance through the property with minimal off-site
stormwater diversion or concentration as determined by the
Department of Building and Safety. The calculations and plans shall
demonstrate that the incremental increase of runoff from a natural
condition to a developed condition shall be retained on site unless
coordination with the Road Department allows the use of streets for
drainage purposes. Flood protection shall be provided for all
on-site buildings. Calculations at a minimum shalt include storms
up to a 100 year, 24 hour storm.

39 . No environmental assessment for grading within the project
boundaries shall .be required provided such grading substantially
conforms to the grading plan submitted as part of the approved
tentative map and does not significantly exceed 136 ,000 cubic
yards of cut and 181 ,000 cubic yards of fill . The land divider
shall comply with all conditions of approval and ECS notes
requiring performance prior to the issuance of grading permits.
40 . The land owner shall institute blowsand and dust control measures
during grading and site development. These shall include but not
be limited to: a) The use of irrigation during any construction
activities; b) planting of cover crop or vegetation upon previously
graded but undeveloped portions of the site; and, c) provision of
windbreaks or windrows, fencing, and/or landscaping to reduce the
effects upon adjacent properties and property owners. The
landowner shall comply with directives of the Director of the
Building and Safety Department with regards to the applicable
sections of Ordinance No. 484 (Blowsand Control ) . All construction
and graded areas shall be watered at least twice daily while being
used to prevent the emission of dust and blowsand.
41 . Graded but undeveloped land shall be maintained in a condition so
as to prevent a dust and blowsand nuisance and shall be either
planted with interim landscaping or provided with other wind and
water erosion control measures as approved by the Director of
Building and Safety and state air quality management authorities.
42. PRIOR TO THE ISSUANCE OF BUILDING OR GRADING PERMITS, the land
divider, or the land divider's successor-in-interest, shall enter
into an agreement with the Department of Building and Safety for
the planting of street trees in connection with the development of
this land division pursuant to the requirements of Article XIIIa of
Ordinance No. 460. PRIOR TO FINAL BUILDING INSPECTION APPROVAL, the
street trees shall be planted. Any request for exemption from the
planting of street trees shall be made prior to the issuance of
building or grading permits.
43. PRIOR TO THE ISSUANCE OF BUILDING PERMITS, the land divider, or the
land divider 's successor-in-interest, shall ( 1 ) enter into an
agreement with the Coachella Valley Recreation and Park District to
provide for the payment of park and recreation mitigation fees as
identified in the District's Master Plan, and (2) shall submit
sufficient written evidence to the Riverside County Department of
Building and Safety that the park and recreation mitigation fees
have been paid to the District.

44. PRIOR TO FINAL BUILDING INSPECTION APPROVAL, each applicable
dwelling unit shall incorporate window and exterior wall , roof and
other design specifications identified in the acoustical analysis
prepared on January 11 , 1989 , by Walker, .Celano and Associates.
Alternative wall and roof design may be substituted upon written
certification from the Special Services Division of the Health
Department that the alternative design would provide equal or
greater reduction in interior noise levels.
45 . PRIOR TO FINAL BUILDING INSPECTION APPROVAL, a six (6) foot high
decorative masonry wall or combination landscaped earthen berm and
decorative masonry wall shall be constructed along Country Club
Drive and where residential lots abut Pennsylvania Avenue, also
along the boundary between Lot Nos. 92 , 93 and 85 . The wall and/or
berm shall be subject to the approval of the Director of Building
and Safety, and the appropriate flood control agency, and shall be
shown on all grading and landscaping plans.
46 . Notwithstanding the preceding conditions, wherever an acoustical
study is required for noise attenuation purposes , the heights and
location of all required walls shall be determined by the acoustical
— study where applicable .
47 . PRIOR TO FINAL BUILDING INSPECTION APPROVAL AND OCCUPANCY of any
portion of the development permitted hereby, all drainage facilities
identified through a drainage and hydrologic report by Coachella
Valley Engineers dated November 11 , 1989, on file with the Riverside
County Planning Department shall be constructed to protect the
development unless otherwise approved by the Department of Building
and Safety. Final improvement plans for these facilities shall be
prepared by a California registered civil engineer and approved by
the Coachella Valley Water District, and made a part of the
construction plans submitted to the Department of Building and
Safety.

Gentlemen: REVISED LETTER
With respect to the conditions of approval for the above referenced tentative land
division map, the Road Department recommends that the landdivider provide the following
street improvement plans and/or road dedications in accordance with Ordinance No. 460
and Riverside County Road Improvement Standards (Ordinance No. 461) . It is understood
that the tentative map correctly shows acceptable centerline profiles, all existing
easements, traveled ways, and drainage courses with appropriate Q's, and that their
omission or unacceptability may require the map to be resubmitted for further considera-
tion. These Ordinances and the following conditions are essential parts and a requirement
occurring in ONE is as binding as though occurring in all. They are intended to be
complementary and to describe the conditions for a complete design of the improvement.
All questions regarding the true meaning of the conditions shall be referred to the
Road Commissioner's Office.
1. The landdivider shall protect downstream properties from damages caused by
alteration or diversion of flow. Protection shall be provided by constructing
adequate drainage facilities including enlarging existing facilities and/or by
securing a drainage easement. All drainage easements shall be shown on the
final map and noted as follows: "Drainage Easement - no building, obstructions,
or encroachments by land fills are allowed". The protection shall be as
approved by the Road Department.
2. The landdivider shall accept and properly dispose of all offsite drainage flowing
onto or through the site. In the event the Road Commissioner permits the use of
streets for drainage purposes, the provisions of Article XI of Ordinance 460
will apply. Should the quantities exceed the street capacity or the use of
streets be prohibited for drainage purposes, the subdivider shall provide
adequate drainage facilities as approved by the Road Department.
3. Major drainage is involved on this landdivision and its resolution shall be as
approved by the Road Department.

4. Streets "A", "C" (northerly of Street "A") , "E", "F" and Regency Way shall be
improved within the dedicated right-of-way in accordance with County Standard
No. 104, Section "A" (40'/60') .
5. Streets "B", "C" (southerly of Street "A") , "D", "G" and "H" shall be improved
within the dedicated right-of-way in accordance with County Standard No. 106,
Section "A" (32'/50') .
6. The interior streets are permitted to be private and may provide for access
control by posting or gating. If gating is installed, a minimum of 40 feet of
two-lane vehicular storage shall be provided between the required stopping
position for gate actuation and the curb face of both Pennyslvania Avenue and
Regency Way. The street section at the gates shall be sufficiently widened to
provide for U-turns.
7. Country Club Drive shall be improved with 8-inch concrete curb and gutter
located 43 feet from centerline and match-up asphalt concrete paving;
reconstruction; or resurfacing of existing paving as determined by the Road
Commissioner within a 55-foot half-width dedicated right-of-way in accordance
with County Standard No. 100.
8. Pennyslvania Avenue shall be improved with 38 feet of asphalt concrete pavement
within a 50-foot half-width dedicated right-of-way in accordance with County
Standard No. 101. This street shall be improved full-width in the vicinity of
Lot #94. — —
9. Tamarisk Row Drive shall be improved within the dedicated right-of-way in
accordance with County Standard No. 109 (70'/86') .
10. Six-foot wide concrete sidewalks shall be constructed throughout the land-
division and along the exterior streets in accordance with County Standards
No. 400 and 401 (curb sidewalk) . Excepted is the north side of Tamarisk Row
Drive and the segment of Pennyslvania Avenue adjacent to Lot #94. Interior
sidewalks may meander providing that the streets are private and providing that
landscape maintenance between the curb and sidewalk is a duty of the homeowners
association and required by the C C 6 R's.
11. Standard cul-de-sacs and knuckles shall be constructed throughout the landdivision.
12. Corner cutbacks in conformance with County Standard No. 805 shall be shown on the
final map and offered for dedication.
13. A striping plan is required for Country Club Drive, Pennyslvania Avenue and
Tamarisk Row Drive. The removal of the existing striping shall be the respon-
sibility of applicant. Traffic signing and striping shall be done by County
forces with all incurred costs borne by the applicant.

14. Grouped mailboxes, if required by the Postal Service, shall conform to
Riverside County Standard No. 812.
15. Street lighting shall be required throughout the subdivision either in
accordance with Ordinances No. 460 and 461 or as approved by the Road
Commissioner and the Planning Director. If the former is selected, the land
owner shall file an application with LAFCO for annexation into or creation of
a "Lighting Assessment District" in accordance with Governmental Code
Section 56000.
16. Lot access shall be restricted on Country Club Drive, Pennyslvania Avenue
and Tamarisk Row Drive and so noted on the final map. Excepted is Lot #94.
17. Improvement plans shall be based upon a centerline profile extending a minimum
of 300 feet beyond the project boundaries at a grade and alignment as approved
by the Riverside County Road Commissioner. Completion of road improvements
does not imply acceptance for maintenance by County.
18. All driveways shall conform to the applicable Riverside County Standards but
need not be shown on the street improvement plans. A minimum of four feet of
full height curb shall be constructed between driveways.
19. Prior to the filing of the final map with the County Recorder's Office, the
developer shall provide evidence of continuous maintenance of all proposed
private streets within the development asapproved by the Road Commissioner.
20. Prior to the recordation of the final map, the developer shall deposit with
the Riverside County Road Department a cash sum of $150.00 per lot as
mitigation for traffic signal impacts. The time of payment may be deferred to
the time of issuance of a building permit if a written agreement with the County
is consumated thereto.
21. Prior to the issuance of a building permit, the applicant shall pay a
Transportation Uniform Mitigation Fee (TUMF) in accordance with the provisions
of Riverside County Ordinance No. 673. The TUMF shall be paid at a rate of
$83 per average daily residential trip. The amount of the TUMF may be
periodically adjusted by the Board of Supervisors and the applicant shall pay
the fee amount in effect at the time of building permit issuance.

southern Pacific Railroad (railroad operation data from Railroad
Company).
3. Noise measurements at the site (nearest project residence) of at least
three train passbys shall be made. The noise information should
minimally contain: noise histograms (Leq, L1, L10, L50, and 1,90 of

We have reviewed tract 25445 and our comments are as follows:
1. Please refer to our November 29, 1989, letter.
2. This area lies within the Mid-Valley drainage area. We are studying several
alternatives for draining this area. Several of the alternatives require
right-of-way through tract 25445. The developer shall provide an easement for
the Mid-Valley Stormwater Channel parallel to the Southern Pacific Railroad.
3. The developer has two options on the design of the channel through tract
25445. Option No. 1 is an open channel. This option will require a minimum
right-of-way width of 100 feet and the relocation of Tamarisk Row Drive. Option
No. 2 is a below ground channel within the right-of-way of Tamarisk Row Drive.
If the developer elects to select Option No. 2, he shall pay all costs to
underground the channel.
4. The developer shall provide us an agreement to cover the design and
construction of the Mid-Valley Stormwater Channel through tract 25445 prior to
the issuance of any grading and/or building permits.
5. We have reviewed and accepted the on-site hydrology study for this tract.

This area is designated Zone C on Federal Flood Insurance rate maps which are in
effect at this time.
Drainage from this area is contributory to the Mid-Valley Stormwater Project.
The interim flood control study for this project is presently being reviewed for
adcption by the affected agencies. Mitigation measures shall be incorporated
into the development to prevent flooding of the site or downstream properties.
These measures may include on-site retention of water from rare and unusual
storms, dedications of right-of-way for regional flood control facilities, and
payment of drainage fees or other participation in the financing of regional
flood control facilities.
Plans for stormwater protective works shall be submitted to Coachella Valley
Water District for review.
The district will furnish domestic water and sanitation service to this area in
accordance with the current regulations of this district. These regulations
provide for the payment of certain fees and charges by the subdivider and said
fees and charges are subject to change.
This area shall be annexed to Improvement District Nos. 16 and 70 of Coachella
Valley Water District for domestic water service.
The district will need additional facilities to provide for the orderly
expansion of its domestic water system. These facilities may include wells,
reservoirs and booster pumping stations. The developer will be required to
provide land on which some of these facilities will be located. These sites
shall be shown on the tract map as lots to be deeded to the district for such
purpose.

With respect to the conditions of approval for the above referenced land division,
the Fire Department recommends the following fire protection measures be provided
in accordance with Riverside County Ordinances and/or recognized fire protection
standards:
1 . Schedule A fire protection approved Super fire hydrants, (6" x 4" x 2}" x
2}") shall be located one at each street intersection spaced not more than
330 feet apart in any direction with no portion of any frontage more than
165feet from fire hydrant. Minimum fire flow shall be 1000 gpm for 2 hours
duration at 20 psi.
2. Prior to recordation of the final map, applicant/developer shall furnish one
blueline copy of the water system plans to the Fire Department for review.
Plans shall conform to the fire hydrant types, location and spacing, and,
the system shall meet the fire flow requirements. Plans shall be signed/approved
by a registered civil engineer and the local water company with the following .
certification: "I certify that the design of the water system is in accordance
with the requirements prescribed by the Riverside County Fire Department."
3. The required water system including fire hydrants shall be installed and
accepted by the appropriate water agency prior to any combustible building
material being placed on an individual lot.
4. MITIGATION
Prior to the recordation of the final map, the developer shall deposit with
the Riverside County Fire Department a cash sum of $400 per lot/unit as
mitigation for fire protection impacts.
5. Whenever access into private property is controlled through use of gates,
barriers, guard houses or similar means, provision shall be made to facilitate
access by emergency vehicles in a manner approved by the Fire Department.
All controlled access devices that are power operated shall have a radio-
controlled over-ride system capable of opening the gate when activated by a
special transmitter located in emergency vehicles. Devices shall be equipped
with backup power facilities to operate in the event of power failure. All
controlled access devices that are not power operated shall also be approved
by the Fire Department. Minimum opening width shall be 12' , with a minimum
vertical clearance of 13'6".

6. If public use type building(s) are to be constructed, additional fire
protection may be required. The fire flows and hydrant locations will be
stipulated when building plans are reviewed by the Fire Department.

and three common area lots . The site location is west of
Washington Street between Interstate 10 and Country Club Drive .
We offer the following comments :
The traffic generated by this development , when added to the
cumulative effect of other existing and proposed developments in '�
this area , will have a significant impact on the Washington
Street overcrossing at Interstate 10 . The adopted Coachella
Valley Transportation Study recommends widening the overcrossing
to four lanes . The developer should incur a responsibility
toward financing the improvements to this facility .
