He showed how the new sign had been placed on the end of the rafters temporarily, and indicated that he did not know of any other place on the building where the sign could be placed. Commission noted their concerns with the amount of signs on the building. Commissioner Urrutia felt that the proposed sign looked out of scale in that it was a very small frontage and there were a lot of signs filling up the entire front of the building. WHEREAS, an appeal of a decision of the City of Palm Desert Architectural Commission was appealed to the Palm Desert City Council; and WHEREAS, said appeal objected to the dwelling unit size approved on April 11, 1995; and WHEREAS, after a series of public review by the Palm Desert City Council on May 11 and May 25, • 1995, the council determined that a revision of the unit size was in order to assure compatibility with existing development. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, that the smallest housing unit having area shall be increased to a size of 2520 square feet; and BE IT FURTHER RESOLVED that the minimum unit size on Parcels 10, 9, 8, 7, 90, 92, 76, 71, 96, 40, 27, 28, 29, 30, 31, 32, 33, 34 and 35, l as shown on Attachment "A", shall be 2662 square feet of living area. Typical lots have dimension ranges from 95 ' x 140 ' to 115 ' x 130 ' . Four dwelling units have been constructed. These include the original three model units as well as one unit on Lot #91 (the Arons) . Mr. Aron was present and spoke to ARC. Mr. Varner submitted a letter which was presented. Issues discussed by Mr. Aron at this meeting were: i) units should be same height ii) should be same number of units iii) maintain similar architecture iv) should retain front courtyard areas v) expressed concern over smaller unit size 2 STAFF REPORT TT 25711 MAY 11, 1995 Issues discussed in Mr. Varner' s letter (copy attached) : i) concern over landscaping quality ii) desire to maintain "upscale" neighborhood iii) concern over the lower selling price The application was continued at this time to allow the applicant to address these concerns plus the concerns of ARC which were as follows : i) need additional detailing ( i .e. overhangs, type of materials, corbelling details, materials and color samples) ii) site plan showing existing units, proposed new model complex location, location of first phase iii) courtyards and/or walls iv) extend detail treatment deeper on sides March 28, 1995 the matter was back before ARC. The applicant provided a conceptual landscape plan, eave detailing, material samples and roof tile samples . The plans provided for 3 models each having 3 different elevations . Mr. Varner submitted another letter expressing concern with the size of the homes and their selling price. Mr. Aron was present and expressed similar concerns, as well as concern over the lack of courtyards . Lisa Ballenger spoke and concurred with Mr. Aron' s comments . Commission discussed the courtyard concerns; transitioning of landscape treatments, need for additional details to see how plans tie together. The matter was continued once again to allow applicant to provide floor and roof plan with elevations; provide some front yard walls; provide detailed landscape plans . The matter was before ARC for a third time on April 11, 1995 . Additional detailing was provided on the side and rear elevations . As well, courtyards and/or walls were incorporated in 9 of the possible 12 unit combinations . Mr. Aron was present and expressed concern over whether there would be 2 or 3 car garages . The applicant indicated that they would offer purchasers the option of converting one of the garage spaces to habitable space. Preliminary approval was granted subject to the final working drawings delineating front elements being continued around the side yard elevations to a minimum depth equal to the side yard walls and provide for additional depth on the fascia. 3 STAFF REPORT TT 25711 MAY 11,. 1995 Two appeals were subsequently filed to the ARC decision. Mr. Varner filed his appeal April 13, 1995 and expressed concern over the unit sizes . Mr. and Mrs . Aron filed their appeal April 18, 1995 expressing concern that the approval would have a "large negative impact on property value" . C. CONCLUSION: The property is zoned PR-5, planned residential . Code section 25 . 24 . 250 B provides All single-story single-family detached buildings shall comply with the provisions of Chapter 25 . 16 with the majority of lot sizes determining the standard. " Lot sizes in the tract range from 12,653 square feet to 22, 128 square feet. The majority of lots fall in the 12000-15000 square foot range. For this reason the standards prescribed in Municipal Code Section 25 . 16 . 060 are appropriate. This code section provides for minimum 1250 square foot homes and maximum 18 foot unit height. The proposed units comply with these standards as well as the setback requirements . The proposed units are smaller than those previously approved back in 1992, but they are still well in excess of the minimum. The ARC considered extensively its prescribed duties as detailed in section 25 . 70 . 090 (copy attached) . Specifically, subsection IC, which reads as follows : C. That the design and location of the proposed development is in keeping with the character of the surrounding neighborhood and is not detrimental to the harmonious, orderly and attractive development contemplated by this title and the general plan of the city; The proposed homes are all 70 foot wide units . Two of the three previous units were 70 feet wide - one was 72 feet wide. This, along with the proposed architecture and the additional detailing which was required by ARC, should assure that the units are in keeping with the character of the surrounding neighborhood" . When viewed from the street the units size will not be obvious . A similar concern regarding unit size occurred in the new section of Belmonte which is under construction at Cook and Hovley. Here we had 13-14 existing homeowners with 75 remaining lots . Steve Smith reported that the applicant was before the commission at it' s last meeting and the commission had asked for additional detailing. The applicant has now included a conceptual landscape plan, eave detailing for the building elevations, and material samples for the trim and roof tiles . The applicant, Mr. Bruce Maize, noted that there are three floor plans with three different elevations . The intention is to use all six proposed color schemes . Commissioner Urrutia asked what the difference was between the stucco and the base stucco. Mr. Maize indicated that the accents on the buildings were the base stucco colors . Mr. Smith distributed a letter received from Mr. Varner stating his concerns with the size of the proposed homes and how they will impact on the selling price of his homes . Commissioner Holden understood the concern and was sympathetic with the existing homeowners, but did not understand why an adjacent project should be a concern of the commission. Mr. Norman Aron, homeowner, noted that he had spoken to Mr. Varner and understood that he is a separate development, but noted that Mr. Varner has invested a substantial amount of money to continue the streets to their projects . He noted that as you drive down E1 Dorado Drive now, the only two developments are this one and Mr. Varner' s project. Mr. Aron stated that he had two real estate people from Prudential come out to his home yesterday and when he informed them that the homes could be as small as 2200 square feet, they felt that his property, as well as Mr. Varner' s property, would be dramatically impacted for appraisal purposes . 11 MINUTES ARCHITECTURAL REVIEW COMMISSION MARCH 28, 1995 Mr. Aron felt that the value of his home will go down approximately $200,000 if these smaller homes are approved and built. Mr. Aron feels that the front courtyards are very important, and understands that the new plans do not include courtyards . He wanted to go on record with his concerns and wanted to know where to go from here to have his concerns heard. Commissioner Holden noted that the commission did ask for yard walls, etc. to give the appearance of added amenities, but they can not set things such as size. He stated that the commission is here to see that the homes fit in with the existing homes . Mr. Smith stated that if the homeowners are still concerned that their needs have not been adequately met, there is a 15-day appeal period from the date this commission makes a decision. The applicant can file an appeal with the city clerk' s office to take this issue to city council . Ms . Lisa Ballenger, existing homeowner, spoke and agreed with Mr. Aron' s concerns . Mr. Smith stated that perhaps the commission would like to request that the larger homes be adjacent to the existing homes . Mr. Maize reported that the existing homes were Lot 68 at 3150 square feet, Lot 69 at 3480 square feet, Lot 70 at 3760 square feet, and Lot 91 at 3480 square feet. The first of the lots to be built would be Lot 76 at 2429 square feet with a 280 square foot guest house, Lot 75 at 2650 square feet, and Lot 74 at 2920 square feet. Commissioner Connor asked if the proposed plant pallet complies with the existing landscaping. Chairman Gregory noted that the proposed plans show more of a water conservative approach with only one model being a drought tolerant plan. Commissioner Holden noted that one of the things discussed at the last meeting was where the architecture ends on the sides. He did not see this addressed here today. Chairman Gregory asked if it would be difficult to add a courtyard wall to Lot 75 . Commissioner Holden did not think it had to be a courtyard, but maybe just a privacy wall . He did not think it was necessary to add courtyards on every lot but felt that some front walls 12 MINUTES ARCHITECTURAL REVIEW COMMISSION MARCH 28, 1995 would help to break up the properties . Mr. Maize indicated that their intention with the side garages is their way of addressing the streetscape. Commissioner Holden showed how the opportunity was there to continue the front elevations around on the side of the elevations. He felt that the walls give the homes a more custom look. Mr. Maize felt that these walls could be incorporated on certain elevations . Mr. Maize indicated that he wants to provide the owner with the option of choosing a landscape plan. There would be at least three landscape plans that could be intermixed throughout the development. Chairman Gregory noted that there needs to be some type of transition between the different lots. Commissioner Urrutia suggested that the landscape architect design all the landscape schemes so that they will all blend in some way. He added that because there are smaller homes going on the same size lots, you have more opportunity to do more landscaping than on the previous lots . If it is done right, it could be a positive aspect. Commissioner Urrutia felt that the proposed details presented today were fine, but needed to see how they apply to the elevations . Mr. Maize felt that the side garages and window treatments should address the concerns . Commissioner Urrutia felt that what was submitted today was very conceptual . He needs to see how it all works together and asked to see a floor plan and roof plan all at the same time with the elevations to see how it all ties in together. This is to insure that the applicant has studied the issues and worked them all out. Commissioner Holden agreed and felt that the commission needed to see how the walls, details, etc. are all brought together. Commissioner Urrutia noted that there were some windows on the garages but not on the floor plans . He stated that the commission needs to see reality. Commissioner Holden felt that the proposals are going in the right direction, and if all things are compatible, it would be acceptable. He would just like to see the little extras the commission has asked for on the plans . Commissioner O'Donnell asked the homeowners if they had talked to the developer since the last meeting to see what changes had been made. Mr. Aron stated that he had not seen the revised plans . Ms . Her main concerns were the size of the units and the impacts they will have on the value of her home. Steve Smith reported that in 1992 a 100 lot tract was approved for this development of which there are now three or four existing homes . There - were three plans approved in 1992 with the typical lot being 90 ' x 1301 . The homes approved in 1992 were 70 ' wide on 90 ' lots allowing for 20 foot setbacks . Plan 1 consisted of 3190 square feet with a 619 square foot garage, 70 ' wide, 17-1/2 ' high and a blend of hip and gable roofs . Plan 2 was 3431 square feet with a 620 square foot garage, 70 ' wide, 16-1/2 ' high with hip roofs . Plan 3 was 3717 square feet with a 677 square foot garage, 72 ' wide, 16-1/2 ' high with hip roofs . Three years later the proposal shows Plan 1 at 2400 square feet, 70 ' wide, 17 ' 8" high with hip roofs . Plan 2 shows 2634 square feet, 70 ' wide, 18 ' high with hip roofs . Plan 3 shows a 2912 square foot unit, 70 ' wide, 17 ' 10" high with hip roofs . Mr. Smith indicated that he did not know if the proposed figures include garages . The applicant, Mr. Bruce Maize, noted that the recent figures do not include the three car garage or the detached optional guest unit. He presented the original elevations as well as a colored street scape showing the new proposed units outlining the changes in the elevations as well as the side garages . He also showed the addition of covered patios in the rear yards on all the plans to provide attractive exterior treatments on all sides . Mr. Maize expressed how important it is to communicate with the existing homeowners to make sure they are appraised of his progress. He indicated that he has also met with the representatives from The Lakes and their support of his proposal. Mr. Norman Aron, first resident at Sierra Nova, spoke on behalf of 'the homeowners association complimenting Mr. Maize on keeping the existing homeowners informed. He stated that the homeowners want to make sure that the developers comply with the same height and number of existing units, as well as keeping with the existing architecture. Mr. Maize indicated that the C.C.&R. 's were amended by Granite Construction and now state the square feet. small as 2200 s right to build a home as q Right now the smallest home is in the range of 2400 square feet. Mr. Aron added that one of the features on the existing homes are front courtyards. The proposed plans do not call for courtyards. He felt that this was a major change. He indicated that the proposed plans show homes that are 25% smaller than their smallest home and that much difference in the square footage would have a very negative impact on the value of their homes . He would like to see something more in the range of 10% smaller homes than what is existing. Mr. Aron also read a letter from the attorney of Mr. David Jacobs, an existing homeowner, which states that any changes would be objected by his client. The letter also stated that any changes in the plans from the original plans be forwarded to the attorney for review. Commissioner Urrutia felt it was important that the applicant, as well as the homeowners, understand that the architectural commission is not the planning commission, and any concerns they may have with the size change does not come through this board as they are concerned with 6 MINUTES ARCHITECTURAL REVIEW COMMISSION MARCH 14, 1995 aesthetics only. Mr. Smith reported that a letter from Mr. Bob Varner was received and distributed by staff and is on file for the record. Mr. Varner then asked about a landscaping plan. He noted that the original homes sold for $495,000 and now the new revised homes will be sold for less than half of that. Mr. Drell informed Mr. Varner that the city could not mandate the price of homes . Commissioner Urrutia reiterated that all the commission can do is look at the architecture and landscaping to make sure that it complies with the existing homes . Mr. Smith asked how many units would be started now if approval is received. Mr. Maize indicated that they would start with three models and then six homes . He added that a developer does not make his money on the small homes, so the skew of their mix will be the larger homes. Mr. Smith asked what their intentions are on the roof tiles and fascia details . Mr. Maize indicated that they will be incorporating the same type tile on the roof . Fascia details would be the wood form details with stucco soffits . The garage doors will be consistent with the use of metal doors that will look the same on the exterior as the existing doors . Commissioner Urrutia felt that conceptually, what is being proposed is very compatible. He would, however, like to see more developed drawings showing how they plan to execute the details, such as overhangs, type of materials, corbelling, and material and color samples . Commissioner Urrutia added that the site plan is important because the commission needs to see what is there now, where the model complex will be and what is proposed in the first phase.
