WHEREAS, the City Council of the City of Palm Desert, California,
did on the _3rd day of August, 19'90, hold a duly noticed public hearing
to consider a requested appeal and modification by PETER DELUCA of
Community Development/Planning Condition No. 5 of Planning Commission
Resolution No. 145 relating to standards for one and two story hornns
associated with a 16. lot single-family subdivision on five acres on the
north side of Country Club Drive, east of Portola Avenue; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to
be heard, said city council did find the following facts to .justify
their actions:
i. . The requested one and two story standards are consistent with
requirements and placed on adjacent properties.
The shifting of the single story buffer zone is consistent
with the general city policy protecting single story
development.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Palm Desert, California, as follows:
1 . I'hat the above recitations are true and correct and constitute
the findings of the council in this case.
That Department of Community Development/Planning Condition
No. 5 of Planning Commission Resolution No. 145:3 is hereby
modified as reflected in the attached conditions of approval .
Also the single story limitations as it impacts TT 24923 lots
42 through 54 shall be shifted to lots 9 through 16 Tract
5'945.

CONDITIONS OF APPROVAL

1 . The development of the property shall conform substantially with
e :hibits on file with the department of community
development/planning , as modified by the following conditions.
2. Recordation of the final map shall occur within 24 months from the
d.ste of this approval unless an e:-::tension of time is Granted;
otherwise said approval shall become null , void and of no effect
whatsoever.
The development of the property described herein shall be subject
to the restrictions and .limitations set forth herein which are in
addition to all municipal ordinances and state and federal statutes
now in force, or which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval , the applicant shall first obtain
permits and/or clearance from the following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Department
Evidence of said permit or clearance from the above agencies shall
be presented to the department of building and safety at the time
Of issuance of a building permit for the use contemplated herewith.
5. The following development standards shall apply:

6. Development shall. be subject to Coachella Valley Fringe-Toed Lizard
mitigation fee of $/.00/acre.

1 . Drainage fees, in accordance with Section 26. 4'? of the Palm Desert
Municipal Code and Palm Desert Ordinance Number 507, shall be paid
prior to recordation of final map.
�. Drainage facilities, as designated within the Northside Area Master
Drainage Plan, shall be provided to the specifications of the
director of public works.
Storm drain construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and
approved by the department of public works prior to start of
constriction.
4. Si.gnalization fees, in accordance with City of Palm Desert
Resolution Nos. 7' -17 and 79-55, shall be paid prior to recordation
of final map.
5. Full public improvements, as required by Sections 26. 40 and 26-. 44
of the Palm Desert Municipal Code, shall be installed in accordance
with applicable city standards.
6. As required under Palm Desert Municipal Code Section 26.28, and in
accordance with Sections 26. 40 and 24. 44, complete improvement
plans and specifications shall be submitted to the director of
public works for checking approval before construction of any
improvements is commenced. Offsite improvement plans to be
approved by the public works department and a surety posted to
guarantee the installation of required offsite improvements prior
to recordation of final map. Such offsite improvements shall
include, but not be limited to, curb and gutter, asphalt paving and
concrete sidewalk in an appropriate size and configuration. "As-
built" plans shall be submitted to, and approved by, the director
of public works prior to acceptance of the improvements by the
city.

7. Improvement plans for water and sewer systems shall be approved by
the respective service districts with "as-built" plans submitted
to the department of public works prior to project final .
A:L1 public improvements shall be inspected by the department of
public works and a standard inspection fee shall be paid prior to
issuance of grading permits.
>. Landscaping maintenance for the individual properties shall be
provided by the property owners. The subdivider shall provide for
the formatian of a landscape maintenance district for the
maintenance of proposed landscaping along the proposed Rosita Drive
property frontage.
1 In accordance with Palm Desert Municipal Code Section 26. 44,
complete grading plans and specifications shall be submitted to the
director of public works for checking and approval prior to
issuance of any permits.
1. 1 . As required by Sections 26. 32 and 26. 44 of the Palm Desert
Municipal Code, and in accordance with the Circulation Network of
the City General Plan half-street right-of-way at _:0 feet on the
proposed Rosita Drive and full right-of-way at 60 feet on "A"
street shall be offered for dedication on the final map.
12. Traffic safety striping shall be installed to the specifications
of the Director of Public Works. A traffic control plan must be
submitted to, and approved by, the director of public works prior
to the placement of any pavement markings.
13. Full improvements of interior streets based on residential street
standards in accordance with Section 26. 40 of the Palm Desert
Municipal Code shall be provided.
14. Complete tract map shall be submitted as required by ordinance to
the director of public works for check:inq and approval and be
recorded before issuance of any permits.
15. Any and all offsite improvements shall be preceded by the approval
of plans and the issuance of valid encroachment permits by the
department of public works.
16.. A complete preliminary soils investigation, conducted by a
registered soils engineer, shall be submitted to and approved by
the department of public works prior to the issuance of a grading
permit.

17. Pad elevations as shown on the tentative map are subject to review
and modification in accordance with Chapter 27 of the Palm Desert
Municipal Code.
1. :. Waiver of access to proposed Rosita Drive a>::cept at approved
locations shall be granted on the final map.
19. Applicant shall agree to participate in and contribute their fair
share to the Cook. Street e:-,%tension and bridge project when
requested.
20. Retention Basin area, as shown on the tentative tract map, shall
be designed so that it will retain stormwaters associated with a
1. )0 year, 6 hour event and shall include provisions for overflow
conditions.
1. . Applicant shall provide for the ongoing maintenance of that area
designated on the tentative map as "Retention Basin" . Applicant
and property owners association will maintain the retention area
in that the applicant will not object to the establishment of an
assessment district 'to ultimately maintain that area in the event
the homeowners association fails to do so.
Riverside County_Fire Department:
1. . With respect to the conditions of approval regarding the above
referenced plan check. the fire department recommends the following
fire protection measures be provided in accordance with City
Municipal Code, NFPA, UFC, and UBC and/or recognized Fire
Protection Standards.
2. Provide, or show there a-xists a water system capable of providing
a potential gallon per minute 1500 for single family, 2500 for
multifamily, and :3000 for commercial . The actual fire flow
available from any one hydrant connected to any given water main
shall be 1500 gpm for two hours duration at 20 psi residual
operating pressure.
A fire flow of 1500 gpm for a i hour duration at 20 psi residual
operating pressure must be available before any combustible
material is placed on the job site.
4. The required fire flow shall be available from a Super hydrant (s)
(G" :. 4" . . 2- 1/2" . . 1/2" ) , located not less than 25' nor more
than 200 ' single family, 165' multifamily, and 150' commercial from
any portion of the building (s) as measured along approved vehicular
travelways. Hydrants installed below :3000' elevation shall be of
the "wet barrel " type.

5. Provide written certification from the appropriate water company
having jurisdiction that hydrant (s) will be installed and will
produce the required fire flow, or arrange field inspection by the
fire department prior to request for final inspection.
6. A combination of on-site and off-site Super fire hydrants, (6" : .
4" : . ._- 1/'2" : . 1/2" ) , will be required, located not less than
or more than 200' single family, 165' multifamily, and 150'
commercial from any portion of the building ( s) as measured along
approved vehicular travelways. The required fire flow shall be
available from any adjacent hydrant (s) in the system.
7. Prior to the application for a building permit, the developer shall
furnish the original and two copies of the water system plan to the
county fire department for review. No building permit shall be
issued until the water system plan has been approved by the county
fire chief. Upon approval , the original will be returned. One
copy will be sent to the responsible inspecting authority.
_ . Plans shall confirm to fire hydrant types, location and spacing,
and the system shall meet the fire flow requirements. Flans shall
be signed by a registered civil engineer and may be signed by the
local water company with the following certification: " I certify
that the design of the water system is in accordance with the
requirements prescribed by the Riverside County Fire Department. "
J. All buildings shall be accessible by an all-weather roadway
extending to within 150" of all portions of the exterior walls of
the first story. The roadway shall not be less than 24' of
unobstructed width and 1="6" of vertical clearance. Where parallel.
parking is allowed, the roadway shall be 6" wide with parking on
both . sides, :_z' wide with parking on one side. Dead-end roads in
excess of 150" shall be provided with a minimum 45" radius turn-
around (55' in industrial developments) . Fountains or garden
islands placed in the middle of these turn-arounds shall not exceed
a 5 ' radius or 10' diameter. g
If gated, whenever access into private property is controlled '
through use of gates, barriers, guard houses or similar means,
provision shall be made to facilitate access by emergency vehicles
in a manner approved by the fire department. All controlled access
devices that are power operated shall have a radio-controlled over-
ride system capable of opening the gate when activated by a special
transmitter, located in emergency vehicles. Devices shall be
equipped with backup power facilities to operate in the event of
power failure. All controlled access devices that are not power
operated shall also be approved by the fire department. Minimum

opening width shall be 16* with a minimum vertical clearance of
1_ '6" .
11. . A dead-end sinqle access over 5()ir`' in length may require a
secondary access, sprink:lers, or other mitigative measure.
122. All new residences/dwellings are required to have illuminated
residential addresses meeting both city and fire department
approval . Shake shingle roofs are no longer permitted in the
cities of Indian Wells, Rancho Mirage or Palm Desert.

I. BACEQTROUND:
The project consists of an additional five acre subdivision associated
with tracts 24923 and 24214 approved north of Country Club Drive east of
Monterey. The subject tract would be located 660 feet north of Country
Club and would have access to Portola via the interior road being
developed as part of the previously approved tracts and the Stoltzman
medical complex.
Internal design will be the standard cul-de-sacred plan. Minimum lot
sizes will range from 10,780 square feet to 14,500 square feet. The city
engineer has determined that the tentative map as conditioned complies
with the city's subdivision ordinance and the State Map Act.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 3rd day of July, 1990, hold a duly noticed public hearing to
consider a request by PETER DELUCA for approval of a negative declaration of
environmental impact and a 16 lot single-family subdivision on 5 acres on the
north side of Country Club Drive, east of Portola Avenue; and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89, " in that the director of community
development has determined that the project will not have a significant adverse
impact on the environment and a negative declaration has been prepared; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts to justify their
actions, as described below:
1. The proposed map, its design, improvements, type of development, and
density are consistent with the State Subdivision Map Act, the Palm
Desert Subdivision and Zoning Ordinance, and General Plan.
2. The map has been designed as part of a master plan developed in
cooperation with adjacent property owners which implements specific
city goals and objectives for the area.
3. The design of the subdivision and required mitigation measures insure
that the project will not result in environmental damage, injure fish
or wildlife, degrade water quality or create public health problems.
4. The map will not conflict with public easements.
5. The map will allow unrestricted solar access to all lots.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Palm Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That a Negative Declaration of Environmental Impact Exhibit "A" and
TT 25945 on file in the department of conm=Aty development/planning
is hereby approved, subject to conditions.

14. Complete tract map shall be submitted as required by ordinance to the
director of public works for checking and approval and be recorded before
issuance of any permits.
15. Any and all offsite improvements shall be preceded by the approval of
plans and the issuance of valid encroachment permits by the department of
public works.
16. A complete preliminary soils investigation, conducted by a registered
soils engineer, shall be submitted to and approved by the department of
public works prior to the issuance of a grading permit.
17. Pad elevations as shown on the tentative map are subject to review and
modification in accordance with Chapter 27 of the Palm Desert Municipal
Code.
18. Waiver of access to proposed Rosita Drive except at approved locations
shall be granted on the final map.
19. Applicant shall agree to participate in and contribute their fair share to
the Cook Street extension and bridge project when requested.
20. Retention Basin area, as shown on the tentative tract map, shall be
designed so that it will retain stormwaters associated with a 100 year, 6
hour event and shall include provisions for overflow conditions.
21. Applicant shall provide for the ongoing maintenance of that area
designated on the tentative map as "Retention Basin".

PLAAAIM C(I- IISSION RESOLUPION NO.
Riverside County Fire Department:
1. With respect to the conditions of approval regarding the above referenced
plan check the fire department recommends the following fire protection
measures be provided in accordance with City Municipal Code, NFPA, UFC,
and UBC and/or recognized Fire Protection Standards.
2. Provide, or show there exists a water system capable of providing a
potential gallon per minute 1500 for single family, 2500 for multifamily,
and 3000 for commercial. The actual fire flow available from any one
hydrant connected to any given water main shall be 1500 gpm for two hours
duration at 20 psi residual operating pressure.
3. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual operating
pressure must be available before any combustible material is placed on
the job site.
4. The required fire flow shall be available from a Super hydrant(s) (6" x 4"
x 2-1/2" x 2-1/2"), located not less than 25' nor more than 200' single
family, 165' multifamily, and 150' commercial from any portion of the
building(s) as measured along approved vehicular travelways. Hydrants
installed below 3000' elevation shall be of the "wet barrel" type.
5. Provide written certification from the appropriate water company having
jurisdiction that hydrant(s) will be installed and will produce the
required fire flow, or arrange field inspection by the fire department
prior to request for final inspection.
6. A combination of on-site and off-site Super fire hydrants, (6" x 4" x 2-
1/2" x 2-1/2"), will be required, located not less than 25' or more than
200' single family, 165' multifamily, and 150' counercial from any portion
of the building(s) as measured along approved vehicular travelways. The
required fire flow shall be available from any adjacent hydrant(s) in the
system.
7. Prior to the application for a building permit, the developer shall
furnish the original and two copies of the water system plan to the county
fire department for review. No building permit shall be issued until the
water system plan has been approved by the county fire chief. Upon
approval, the original will be returned. One copy will be sent to the
responsible inspecting authority.
8. Plans shall conform to fire hydrant types, location and spacing, and the
system shall meet the fire flow requirements. Plans shall be signed by a
registered civil engineer and may be signed by the local water company
with the following certification: "I certify that the design of the water
system is in accordance with the requirements prescribed by the Riverside
County Fire Department. "

9. All buildings shall be accessible by an all-weather roadway extending to
within 150' of all portions of the exterior walls of the first story. The
roadway shall not be less than 24' of unobstructed width and 13'6" of
vertical clearance. Where parallel parking is allowed, the roadway shall
be 36' wide with parking on both sides, 32' wide with parking on one side.
Dead-end roads in excess of 150' shall be provided with a mininwn 45'
radius turn-around (55' in industrial developments). Fountains or garden
islands placed in the middle of these turn-arounds shall not exceed a 5'
radius or 10' diameter.
10. If gated, whenever access into private property is controlled through use
of gates, barriers, guard houses or similar means, provision shall be made
to facilitate access by emergency vehicles in a manner approved by the
£ire department. All controlled access devices that are power operated
shall have a radio-controlled over-ride system capable of opening the gate
when activated by a special transmitter located in emergency vehicles.
Devices shall be equipped with backup power facilities to operate in the
event of power failure. All controlled access devices that are not power
operated shall also be approved by the fire department. Minimum opening
width shall be 16' with a minimum vertical clearance of 1316".
11. A dead-end single access over 500' in length may require a secondary
access, sprinklers, or other mitigative measure.
12. All new residences/dwellings are required to have illuminated residential
addresses meeting both city and fire department approval. Shake shingle
roofs are no longer permitted in the cities of Indian Wells, Rancho Mirage
or Palm Desert.
13. Submit underground water plans to show minimum fire flow is met.

B. DISCUSSION:
On July 3, 1990 the planning commission approved the 16 lot, 15 single
family unit tentative map on five acres in the interior of the southwest
quarter of Section 4 north of Country Club Drive and East of Portola
Avenue (see legal notice). It is associated with the previously approved
Tracts 24923 and 24214 which include 40 acres to the west.
Those tracts were approved with conditions which allowed two story hones
within the interior, but prohibited them on all perimeter lots. Although
the PR-5 zone allows two story generally, the planning commission wanted
to protect future development of adjacent parcels if they chose not to
have two story hones. In addition, special standards were provided for
the interior two story homes which included lamer setbacks and reduced
ground coverage.

The subject tentative tract is one of those adjacent properties which the
planning commission intended to protect. The applicant wishes to have the
option of having some two story units along the west boundary of the tract
adjacent to TT 25945. With the consent of the owner of TT 25945 the
applicant requested that the one story buffer zone be shifted to the
perimeter units of his tract. Staff believes that the request is
consistent with the conditions placed on TT 25945 and the city's general
policy of providing° buffer between two story and single story projects.
Staff therefore recommends that the buffer zone be shifted and the two
story standards added to the conditions for TT 25945.
The planning comission had considered the request at the hearing and
concluded that the tract should be limited to one story.
The second issue appealed by the applicant is condition no. 5 relating to
the single story side setbacks. Since the minimum lot sizes exceed 10,000
square feet, side yards were set consistent with the R-1 (10,000)
standards: combined 20 feet, minimum 8 feet. Due to the inherent
geometry of the applicant's 5 acre parcel, the lots are narrower and
deeper than a typical R-1 10,000 lot which have a 90 foot minimum width.
The subject lots with 77 foot widths are more consistent with the R-1
8,000 standards which include combined 14 foot side yards with a five foot
minimum. The applicant feels that he shouldn't be penalized and required
to design narrow hones because he chose to provide larger lots and a lower
overall density. Other similar five acre parcels have been developed with
8,000 square foot lots.
Staff considers this request reasonable and recarmends modification of
condition no. 5 to reflect 14 foot ocmbined, 5 foot minimum side yards.
This issue had not been brought up at the planning ocnmtssicn hearing.

WHEREAS, the City Council of the City of Palm Desert, California, did on
the 23rd day of August, 1990, hold a duly noticed public hearing to consider a
requested appeal and modification by PETER DELUCA of Community
Development/Planning Condition No. 5 of Planning Commission Resolution No. 1453
relating to standards for one and two story homes associated with a 16 lot
single-family subdivision on five acres on the north side of Country Club
Drive, east of Portola Avenue; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and argimpnts, if any, of all interested persons desiring to be
heard, said city council did find the following facts to justify their actions:
1. The requested one and two story standards are consistent with
requirements and placed on adjacent properties.
2. The shifting of the single story buffer zone is consistent with the
general city policy single story development.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the council in this case.
2. That Department of Community Development/Planning Condition No. 5 of
Planning Commission Resolution No. 1453 is hereby modified as
reflected in the attached conditions of approval. Also the single
story limitations as it impacts TT 24923 lots 42 through 54 shall be
shifted to lots 9 through 16 Tract 25945.

1. The development of the property shall conform substantially with exhibits
on file with the departrnent of catmunity development/planning, as modified
by the following conditions.
2. Recordation of the final map shall occur within 24 months from the date of
this approval unless an extension of time is granted; otherwise said

grading plans and specifications shall be submitted to the director of

11. As required by Sections 26.32 and 26.44 of the Palm Desert municipal Code,
and in accordance with the Circulation Network of the City's General Plan
half-street right-of-way at 30 feet on the proposed Rosita Drive and full
right-of-way at 60 feet on "A" street shall be offered for dedication on

12. Traffic safety striping shall be installed to the specifications of the

1. with respect to the conditions of approval regarding the above referenced
plan check the fire department recomends the following fire protection
measures be provided in accordance with City Municipal Code, NFPA, UFC,
and UBC and/or recognized Fire Protecticn Standards.
2. Provide, or show there exists a water system capable of providing a
potential gallon per minute 1500 for single family, 2500 for multifamily,
and 3000 for commercial. The actual fire flow available from any one
hydrant ccnnected to any given water main shall be 1500 gpm for two hours
duration at 20 psi residual operating pressure.
3. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual operating
pressure must be available before any combustible material is placed on
the job site.
4. The required fire flow shall be available from a Super hydrant(s) (6" x 4"
x 2-1/2" x 2-1/2"), located not less than 25' nor more than 200' single
family, 165' multifamily, and 150' commercial from any portion of the
building(s) as measured along approved vehicular travelways. Hydrants
installed below 3000' elevaticn shall be of the "wet barrel" type.
5. Provide written certificaticn from the appropriate water company having
jurisdiction that hydrant(s) will be installed and will produce the

7. Prior to the application for a building permit, the developer shall
furnish the original and two copies of the water system plan to the county
fire department for review. No building permit shall be issued until the
water system plan has been approved by the county fire chief. Upon

8. Plans shall conform to fire hydrant types, location and spacing, and the
system shall meet the fire flow requirements. Plans shall be signed by a
registered civil engineer and may be signed by the local water company

10. If gated, whenever access into private property is controlled through use
of gates, barriers, guard houses or similar means, provision shall be made
to facilitate access by emergency vehicles in a manner approved by the
fire department. All controlled access devices that are power operated
shall have a radio-controlled over-ride system capable of opening the gate
when activated by a special transmitter located in emergency vehicles.
Devices shall be equipped with backup power facilities to operate in the
event of power failure. All controlled access devices that are not power
operated shall also be approved by the fire department. Minumim opening
width shall be 16' with a minimum vertical clearance of 13'6".
11. A dead-end single access over 500' in length may require a secondary
access, sprinklers, or other mitigative measure.
12. All new residences/dwellings are required to have illuminated residential
addresses meeting both city and fire department approval. Shake shingle
roofs are no longer permitted in the cities of Indian Wells, Rancho Mirage
or Palm Desert.

Chairperson Whitlock opened the public testimony and asked if the
applicant wished to address the commission. The applicant indicated
no. Chairperson Whitlock asked if anyone present wished to speak in
FAVOR or OPPOSITION to the proposal. There was no one and the public
testimony was closed.
Commissioner Richards stated that he had no problem with the proposal
and felt the architect had created a nice building.

Moved by Commissioner Downs, seconded by Commissioner Richards,
approving the findings as presented by staff. Carried 3-0.

Request for approval of a negative declaration of
environmental impact and 16 lot residential
tentative tract map containing 15 residential
lots and 1 water retention lot on 5 acres in the
southwest quarter of section 4 north of Country
Club Drive, east of Portola Avenue.
Mr. Drell outlined the salient points of the staff report. He
explained that the applicant wished the option of building two
stories; he noted the conditions only included standards for one
story buildings. Staff indicated they had no problem with the
request. Chairperson Whitlock asked for and received clarification
as to location of the perimeter road and point of access onto Country
Club.
Chairperson Whitlock opened the public testimony and asked if the
applicant wished to address the Commission.
M. KAY SHURKIN, representing Mr. Deluca, stated that they would
like condition no. 5 to be amended to include two story
buildings, and public works condition no. 21 be reworded to
include that the retention area would be maintained until such
time as annexed into a city maintenance district.
Mr. Holtz indicated that was acceptable. Staff and commission
discussed the assessment district and Mr. Diaz concluded that
condition no. 21 should be reworded to add, "The applicant and
property owners association will maintain the retention area in that
the applicant will not object to the establishment of an assessment
district to ultimately maintain that area in the event the homeowners
association fails to do so. " Mr. Deluca concurred with the
rewording. Staff indicated that condition no. 5 should show the side
setback requirement as no one side less than 8 feet, not 5 feet as
stated.
Chairperson Whitlock asked if anyone present wished to speak in FAVOR
or OPPOSITION to the proposal. There was no one and the public
testimony was closed.
Commission expressed approval of the project, but opposition to the
request for any two story use. Chairperson Whitlock reopened the
public testimony to allow the applicant to readdress the commission.

Request for approval of a parking variance to
allow a school for protection officers to occupy
1,317 square feet of floor area during evening
hours, located west of Melanie Place 175 feet
south of Merle Drive.
Mr. Diaz outlined the salient points of the staff report. He noted
that a letter had been received fmn Cook Square and indicated their
concerns were addressed in the conditions of approval. He stated
that an additional condition could be placed that in the event of a
parking problem, the city would have the right to evoke the variance.
Chairperson Whitlock opened the public testimony and asked if the
applicant wished to address the commission. They chose not to do so
and Chairperson Whitlock asked if anyone present wished to speak in
FAVOR or OPPOSITION to the proposal. There was no one and the public
testimony was closed.

Moved by Commissioner Richards, seconded by Carnnissioner Downs,
approving the findings as presented by staff. Carried 3-0.

10. In accordance with Palm Desert Municipal Code Section 26.44, complete
grading plans and specifications shall be submitted to the director of
public works for checking and approval prior to issuance of any permits.
11. As required by Sections 26.32 and 26.44 of the Palm Desert Municipal Code,
and in accordance with the Circulation Network of the City's General Plan
half-street right-of-way at 30 feet on the proposed Rosita Drive and full
right-of-way at 60 feet on "A" street shall be offered for dedication on
the final map.
12. Traffic safety striping shall be installed to the specifications of the
Director of Public Works. A traffic control plan must be submitted to,
and approved by, the director of public works prior to the placement of
any pavement markings. -
13. Full improvements of interior streets based on residential street
standards in accordance with Section 26.40 of the Palm Desert Municipal
Code shall be provided.
14. Complete tract map shall be submitted as required by ordinance to the
director of public works for checking and approval and be recorded before
issuance of any permits.
15. Any and all offsite improvements shall be preceded by the approval of
plans and the issuance of valid encroachment permits by the department of
public works.
16. A complete preliminary soils investigation, acted by a registered
soils engineer, shall be submitted to and approved by the department of
public works prior to the issuance of a grading permit.
17. Pad elevations as shown on the tentative map are subject to review and
modification in accordance with Chapter 27 of the Palm Desert Municipal
Code.
18. Waiver of access to proposed Rosita Drive except at approved locations
shall be granted on the final map.
19. Applicant shall agree to participate in and contribute their fair share to
the Cook,"Street extension and bridge project when requested.
20. Retention Basin area, as shown on the tentative tract map, shall be
designed so that it will retain stormwaters associated with a 100 year, 6
tour event and shall include provisions for overflow conditions.
21. Applicant shall provide for the ongoing maintenance of that area
designated on the tentative map as "Retention Basin". Applicant and
property owners association will maintain the retention area in that the

applicant will not object to the establishment of an assessment district
to ultimately maintain that area in the event the haneowners association
fails to do so.
Riverside County Fire Department:
1. With respect to the conditions of approval regarding the above referenced
plan check the fire department recommends the following fire protection
measures be provided in accordance with City Municipal Code, NFPA, UFC,
and UBC and/or recognized Fire Protection Standards.
2. Provide, or show there exists a water system capable of providing a
potential gallon per minute 1500 for single family, 2500 for multifamily,
and 3000 for commercial. The actual fire flow available from any one
hydrant connected to any given water main shall be 1500 gpn for two hours
duration at 20 psi residual operating pressure.
3. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual operating
pressure must be available before any combustible material is placed on
the job site.
4. The required fire flow shall be available from a Super hydrant(s) (6" x 4"
x 2-1/2" x 2-1/2"), located not less than 25' nor more than 200' single
family, 165' multifamily, and 150' comuercial from any portion of the
building(s) as measured along approved vehicular travelways. Hydrants
installed below 3000' elevation shall be of the "wet barrel" type.
5. Provide written certification from the appropriate water company having
jurisdiction that hydrant(s) will be installed and will produce the
required fire flow, or arrange field inspection by the fire department
prior to request for final inspection.
6. A combination of on-site and off-site Super fire hydrants, (6" x 4" x 2-
1/2" x 2-1/2"), will be required, located not less than 25' or more than
200' single family, 165' multifamily, and 150' aonmercial from any portion
of the building(s) as measured along approved vehicular travelways. The
required fire flow shall be available from any adjacent hydrant(s) in the
system.
7. Prior to the application for a building permit, the developer shall
furnish the original and two copies of the water system plan to the county
fire department for review. No building permit shall be issued until the
water system plan has been approved by the county fire chief. Upon
approval, the original will be returned. One copy will be sent to the
responsible inspecting authority.
S. Plans shall conform to fire hydrant types, location and spacing, and the
system shall meet the fire flaw requirements. Plans shall be signed by a

registered civil engineer and may be signed by the local water caqkUly
with the following certification: "I certify that the design of the water
system is in accordance with the requirements prescribed by the Riverside
County Fire Department."
9. All buildings shall be accessible by an all-weather roadway extending to
within 150' of all portions of the exterior walls of the first story. The
roadway shall not be less than 24' of unobstructed width and 13'6" of
vertical clearance. Where parallel parking is allowed, the roadway shall
be 36' wide with parking on both sides, 32' wide with parking on one side.
Dead-end roads in excess of 150' shall be provided with a minimum 45'
radius turn-around (55' in industrial developments). Fountains or garden
islands placed in the middle of these turn-arounds shall not exceed a 5'
radius or 10' diameter.
10. If gated, whenever access into private property is controlled through use
of gates, barriers, guard houses or similar means, provision shall be made
to facilitate access by emergency vehicles in a manner approved by the
fire department. All controlled access devices that are power operated
shall have a radio-oontrolled over-ride system capable of opening the gate
when activated by a special transmitter located in emergency vehicles.
Devices shall be equipped with backup power facilities to operate in the
event of paver failure. All controlled access devices that are not power
operated shall also be approved by the fire department. Minimum opening
width shall be 16' with a minirmmi vertical clearance of 13'6".
11. A dead-end single access over 500' in length may require a secondary
access, sprinklers, or other mitigative measure.
12. All new residences/dwellings are required .to have illuminated residential
addresses meeting both city and fire department approval. Shake shingle
roofs are no longer permitted in the cities of Indian Wells, Rancho Mirage
or Palm Desert.
13. Submit underground water plans to show minimim, fire flow is met.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the 3rd day of July, 1990, hold a duly noticed public hearing to
consider a request by PETER DELUCA for approval of a negative declaration of *,

1. The proposed map, its design, improvements, type of development, and
density are consistent with the State Subdivision Map Act, the Palm

1. The development of the property shall conform substantially with exhibits
on file with the department of community development/planning, as modified
by the following conditions.
2. Recordation of the final map shall occur within 24 months from the date of
this approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and state and federal statutes now in force, or which
hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:

Palm Desert Architectural Commission
City Fire Marshal
Public Works Department
Evidence of said permit or clearance from the above agencies shall be

Department of Public Works:
1. Drainage fees, in accordance with Section 26.49 of the Palm Desert
Municipal Code and Palm Desert Ordinance Number 507, shall be paid prior
to recordation of final map.
2. Drainage facilities, as designated within the Northside Area Master
Drainage Plan, shall be provided to the specifications of the director of
public works.
3. Storm drain construction shall be contingent upon a drainage study
prepared by a registered civil engineer that is reviewed and approved by
the department of public works prior to start of construction.
4. Signalizaticn fees, in accordance with City of Palm Desert Resolution Nos.
79-17 and 79-55, shall be paid prior to recordation of final map.
5. Full public improvements, as required by Sections 26.40 and 26.44 of the
.Palm Desert Municipal Code, shall be installed in accordance with
applicable city standards.
6. As required under Palm Desert Municipal Code Section 26.28, and in
.' accordance with Sections 26.40 and 26.44, complete improvement plans and
specifications shall be submitted to the director of public
pub works for
checking approval before construction of any improvements is commenced.
Offsite improvement plans to be approved by the public works department
and a surety posted to guarantee the installation of required offsite
improvements prior to recordation of final map. Such offsite improvements
shall include, but not be limited to, curb and gutter, asphalt paving and
concrete sidewalk in an appropriate size and configuration. "As-built"
plans shall be submitted to, and approved by, the director of public works
prior to acceptance of the improvements by the city.
7. Improvement plans for water and sewer systems shall be approved by the
respective service districts with "as-built" plans submitted to the
department of public works prior to project final.
8. All public improvements shall be inspected by the department of public
works and a standard inspection fee shall be paid prior to issuance of
grading permits.
9. Landscaping maintenance for the individual properties shall be provided by
the property owners. The subdivider shall provide for the formation of a
landscape maintenance district for the maintenance of proposed landscaping
along the proposed Rosita Drive property frontage.

SUBJECT: TENTATIVE TRACT 25945, PETER DELUCA
DATE: June 25, 1990
The following should be considered conditions of approval for the above-
referenced project:
(1) Drainage fees, in accordance with Section 26.49 of the Palm Desert
Municipal Code and Palm Desert Ordinance Number 507, shall be paid prior
to recordation of final map.
(2) Drainage facilities, as designated within the Northside area Master
Drainage Plan shall be provided to the specifications of the Director of
Public Works.
(3) Storm drain construction shall be contingent upon a drainage study prepared
by a registered civil engineer that is reviewed and approved by the
Department of Public Works prior to start of construction.
(4) Signalization fees, in accordance with City of Palm Desert Resolution Nos.
79-17 and 79-55, shall be paid prior to recordation of final map.
5) Full public improvements, as required by Sections 26.40 and 26.44 of the
Palm Desert Municipal Code, shall be installed in accordance with
applicable City standards.
(6) As required under Palm Desert Municipal Code Section 26.28, and in
accordance with Sections 26.40 and 26.44, complete improvement plans and
specifications shall be submitted to the Director of Public Works for
checking approval before construction of any improvements is commenced.
Offsite improvement plans to be approved by the Public Works Department
and a surety posted to guarantee the installation of required offsite
improvements prior to recordation of final map. Such offsite improvements
shall include, but not be limited to, curb and gutter, asphalt paving and
concrete sidewalk in an appropriate size and configuration. "As-built"
plans shall be submitted to, and approved by, the Director of Public Works
prior to the acceptance of the improvements by the city.
(7) Improvement plans for water and sewer systems shall be approved by the
respective service districts with "as-built" plans submitted to the
Department of Public Works prior to project final.
(8) All public improvements shall be inspected by the Department of Public
Works and a standard inspection fee shall be paid prior to issuance of
grading permits.
(9) Landscaping maintenance for the individual properties shall be provided
by the property owners. The subdivider shall provide for the formation
of a landscape maintenance district for the maintenance of proposed
landscaping along the proposed Rosita Drive property frontage.
(10) In accordance with Palm Desert Municipal Code Section 26.44, complete
grading plans and specifications shall be submitted to the Director of
Public Works for checking and approval prior to issuance of any permits.
(11) As required by Sections 26.32 and 26.44 of the Palm Desert Municipal Code,
and in accordance with the Circulation Network of the City's General Plan
half-street right-of-way at 30 feet on proposed Rosita Drive and full
right-of-way at 60 feet on "A" street shall be offered for dedication on
the final map.
(12) Traffic safety striping shall be installed to the specifications of the
Director of Public Works. A traffic control plan must be submitted to,
and approved by, the Director of Public Works prior to the placement of
any pavement markings.
(13) Full improvements of interior streets based on residential street standards
in accordance with Section 26.40 of the Palm Desert Municipal Code shall
be provided.
(14) Complete tract map shall be submitted as required by ordinance to the
Director of Public Works for checking and approval and be recorded before
issuance of any permits.
(15) Any and all offsite improvements shall be preceded by the approval of plans
and the issuance of valid encroachment permits by the Department of Public
Works.
(16) A complete preliminary soils investigation, conducted by a registered soils
engineer, shall be. submitted to, and approved by, the Department of Public
Works prior to the issuance of a grading permit.
(17) Pad elevations, as shown on the tentative map are subject to review and
modification in accordance with Chapter 27 of the Palm Desert Municipal
Code.
(18) Waiver of access to proposed Rosita Drive except at approved locations
shall be granted on the final map.
(19) Applicant shall agree to participate in and contribute their fair share
to the Cook Street extension and bridge project when requested.
(20) Retention Basin area, as shown on the tentative tract map, shall be
designed so that it will retain stormwaters associated with a 100 year,
6 hour event and shall include provisions for overflow conditions.
(21) Applicant shall provide for the ongoing maintenance of that area designated
on the tentative map as "Retention Basin".

With respect to the conditions of approval regarding the above referenced
Vplan check the Fire Department recommends the following fire protection

A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual operating
/ pressure must be available before any combustible material is placed on the

The required fire flow shall be available from a Super hydrant (s) (6" x 4"
x 2 -1/2 x 2-1/2" ) , located not less than 25 ' nor more than 200 ' single
family, 165 ' multifamily, and 150 ' commercial from any portion of tY:e
building(s) as measured along approved vehicular travelways . Hydrants

Provide written certification from the appropriate water company havin-,
juri-diction that hydrant (s) will be installed and will procluce the
required fire flow; or arrange field inspection by the Fire Department
prior to request for final inspection.
A combination of on-site and off-site Super fire hydrants . (6" x 4" x
1/2" x 2-1/2") , will be required, located not less than 25 ' or more than
200 ' single family, 165 ' multifamily„ and 150 ' commercial from any portion
of the building(s) as measured along_ approved vehicular travelways . The
required fire flow shall be available from any adjacent hydrant (s ) in the
system. I
Prior to the application for a building permit , the developer shall furnish
the original and. two copies of the water system plan to the County Fire
Department for review. No building permit shall be issued until the water
system plan has been approved by the County Fire Chief . Upon approval , the
original will be returned . One copy will be sent to the responsible
inspecting authority.
Plans shall conform to fire hydrant types, location and spacing, and the
system shall meet the fire flow requirements . Plans shall be signed by a
Registered Civil Engineer and may be signed by the local water company with
the following certification: "I certify that the design of the water
system is in accordance with the requirements prescribed by the Riverside
County Fire Department . "
1 All buildings shall be -iccessible by an all-weat` -r roadway extending to
within 150 ' of all po ons of the exterior wall: f the first story . The
roadway shall be not less than 24 ' of unobstructed width and 13 ' 6" of
vertical clearance . Where parallel parking is allowed , the roadway shall
be 36 ' wide with ping on both sides, 32 ' wide with parking , on one side .
Dead--end roads in excess of 150 ' shall be provided with"a minimum 45"
radius turn-around (55 ' in industrial developments) . Fountains or garden
islands placed in the middle of these turn-arounds shall not exceed a 5 '
radius or 10 ' diameter .
The minimum width of interior driveways for multi-family or. apartment
complexes shall be :
SF a . 24 feet wide when serving less than 100 units, no parallel parking;
FAMILY carports or garages allowed on one side only.
b. 28 feet wide when serving between 100 and 300 units ; carports or
v garages allowed on both sides , no parallel parking .
C . 32 feet wide when serving over 300 units or when parallel parking is
allowed on one side .
d . 36 feet wide when parallel parking is allowed on both sides .
Whenever access into private property is controlled through use of gates ,
barriers , guard houses or similar means , provision shall be made to
facilitate access by emergency vehicles in a manner approved by the Fire
Department . All controlled access devices that are power operated shall
6A1m)have a radio-controlled over-ride system capable of opening the gate when
/ activated by a special transmitter located in emergency vehicles . Devices
Vshall be equipped with backup power facilities to operate in the event of
power failure . All controlled access devices that are not power operated
shall also be approved by the Fire Department . Minimum opening width shall
be 16' , with a minimum vertical clearance `of 13 ' 6" .
A dead end single access over 500 ' in length may require a secondary
access , sprinklers , or other mitigative measure .
