Storm drain construction shall be contingent upon a drainage study prepared by a registered civil engineer that is reviewed and approved by the Department of Public Works. Said study will include, but not be limited to, the investigation of both upstream and downstream impacts with respect to existing and proposed conditions as well as analysis of proposed detention areas. 4. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79- i7 and 7q-55, shall be Paid prior to recordation of final map. At the developers option the payment of signalization fees may ce deferred until issuance of building permits provided that a surety, acceptable to the City Attorney, is posted with the city in as amount equal to the required Fees. 5. Full public improvements, as required by Sections 26.40 and 26.44 of the Palm Desert Municipal Code, shall be installed in accordance with applicable City standards. All improvements within State Highway 74 right-of-way shall be in accordance with Caitrans standards. 6. improvement plans For water and sewer systems shall be approved by the respective service districts with "as-built" plans submitted to the Department of Public Works prior to project final . 7. Improvement plans for all improvements, public and private, shall be reviewed and approved by the Public Works Department. The installation of such improvements shali be inspected by the Public Works Department and a standard inspection fee shall be paid prior to issuance of grading permits. 8. As required under Palm Desert Municipal Code Section 26.28, and in accordance with Sections 26.40 and 26.44, complete improvement plans and specifications shall be submitted to the Director of Public Works for checking approval before construction of any improvements is commenced. Offsite improvement plans for all improvements within existing and proposed public right-of-way to be approved by the Public Works Department and a surety posted to guarantee the installation of required offsite improvements prior to recordation of final map. Such offsite improvements shall include, but not be limited to, curb and gutter, asphalt paving and concrete sidewalk in an appropriate size and configuration and provisions for construction of full improvements on Cahuilla Way. "As-built" plans shall be submitted to, and approved by, the Director of Public Works prior to the acceptance of the improvements by the City of Palm Desert, except that the Director of Public Works may exercise discretion and accept the improvements when the improvements are 90 percent complete, so long as the developer's surety for completion is in place. 7 PLANNING COMMISSION RESOLUTION NO. 1468 of Public Works prior to the issuance of any permits associated with this project. - 19, Pao eievations, as shown on the tentative map are subject to review and modification in accordance with Chapter 27 of the Palm Desert Municioal Code. 20. Applicant shall comply with those recommendations specified in the Caltrans Development Review dated April 5, 1990. 23. Applicant shall provide a phasing plan which specifies the project construction activity with respect to on-site/off-site infrastructure improvements as well as possible final map filing. 24. Provision for the continuation/modification of any existing access rights which may be affected by this project shall be included as a part of the final map process. DISCUSSION: The applicant has clarified conditions of approval and staff has incorporated these into the original resolution. Perimeter wall and fence plans have also been submitted showing mostly wrought iron fencing set back from Hwy 74 curbface 15' to 30' . An amended grading plan has also been submitted lowering by 5 feet pad heights adjacent to the maintenance facility. II . RECOMMENDATION: Staff recommends: 1 . Approve findings. 2. A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE TRACT MAP FOR A 62 LOT SINGLE FAMILY SUBDIVISION AND 2. 1 ACRE MAINTENANCE FACILITY ON 50 ACRES SOUTHWEST OF HIGHWAY 74 AND CAHUILLA WAY. CASE NO. TT 26018 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 19th day of June, 1990 and continued to August 21 , 1990 and September 18, 1990, hold a duly noticed public hearing to consider the request by Westinghouse Desert Communities for the project described above; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project has been previously assessed as part of the Bella Vista project; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify approval of the tentative tract map: (a) That the proposed map is consistent with applicable general and specific plans. (b) That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. (c) That the site is physically suitable for the type of development. (d) That the site is physically suitable for the proposed density of development. Yard shall be screened and approved by city's architectural commission. City Fire Marshal : 1 . Provide, or show there exists, a water system capable of providing a potential gallon per minute 1500 for single family, 2500 for multifamily, and 3000 for commercial . The actual fire flow available from any one hydrant connected to any given water main shall be 1500 GPM for two hours duration at 20 PSI residual operating pressure. 2. A fire flow of 1500 GPM for a 1 hour duration at 20 psi residual operating pressure must be available before any combustible material is placed on the job site. 3. The required fire flow shall be available from a Super hydrant(s) (6" x 4" x 2-1/2" x 2-1/2") , located not less than 25' nor more than 200' single family, 165 multifamily, and 150' commercial from any portion of the building(s) as measured along approved vehicular travelways. Hydrants installed below 3000' elevation shall be of the "wet barrel" type. 4. Provide written certification from the appropriate water company having jurisdiction that hydrant(s) will be installed and will produce the required fire flow, or arrange field inspection by the Fire Department prior to request for final inspection. 5. A combination of on-site and off-site Super fire hydrants, (6" x 4" x 2-1/2" x 2-1/2") , will be required, located not less than 25' or more than 200' single family, 165' multifamily, and 150' commercial from any portion of the building(s) as measured along approved vehicular travelways . The required fire flow shall be available from any adjacent hydrant(s) in the system. 6. Prior to the application for a building permit, the developer shall furnish the original and two copies of the water system plan to the County Fire Department for review. No building permit shall be issued until the water system plans has been approved by the County Fire Chief. Upon approval , the original will be returned. One copy will be sent to the responsible inspecting authority. 7. Plans shall conform to fire hydrant types, location and spacing, and the system shall meet the fire flow requirements. Plans shall be signed by a Registered Civil Engineer and may be signed by the local waste company with the following certification: "I certify that the design of the water system is in accordance with the requirements prescribed by the Riverside County Fire Department". 4 PLANNING COMMISSION RESOLUTION NO. 8. If the clubhouse is constructed using Type III materials (non- combustible, steel , concrete, etc. . ) , and has a sprinkler system, it will require a hydrant or hydrants, capable of 1500 gpm, within 150 feet of the furthest point of the building. If sprinklers are not provided, the hydrant supply rate requirement increases to 3000 gpm. If the clubhouse is constructed using Type V materials (wood structure) , and has a sprinkler system, it will require a minimum of two (2) hydrants, capable of 1500 gpm, within 150 feet of all points of the building. If sprinklers are not provided, the hydrant supply rate requirement increases to 3000 gpm. 17. All cul-de-sac streets over 500 feet in length will require either secondary "all weather" hardened access to alleviate the dead-end situations; or will require those homes located more than 500 feet from the looped access be constructed with a sprinkler system. Sprinkler systems will be designed in accordance with N.F.P.A. 13-R standards. Secondary "all weather" access will require a hardened surface, at least 14 feet wide, constructed with an acceptable material such as concrete, asphalt, or pavers. Turning radius for truck #33 will be required for all access including 45' cul-de-sac or "hammer head" turnarounds at the ends of all dead-end streets as approved by the Fire Marshall . 18. The portable water system for the first phase of development will be supplied from the Coachella Valley Water District's water system located immediately north of the Bighorn development in the Cahuilla Hills neighborhood. Via booster station, this domestic system will supply the 1500 gpm required for the hydrants serving the above mentioned construction and facilities, the most remote hydrant will produce 1500 gpm at 20 P.S. I . for a 2 hour duration. A secondary back- up means of fire protection, using the on site golf course lakes and irrigation systems, is possible, but not anticipated at this time. 19. The permanent clubhouse building must be fire sprinklered per N.F.P.A. 13 if over 5000 square feet. Public Works Department: I . Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal Code and Palm Desert Ordinance Number 507 and the approved development agreement, shall be paid prior to recordation of final map. 2. Drainage facilities shall be provided to the specifications of the Director of Public Works . In addition , proposed drainage facilities/improvements that impact the Palm Valley Channel shall be subject to review and approval by the Coachella Valley Water District. 6 PLANNING COMMISSION RESOLUTION NO. 3. Landscaping maintenance of State Highway 74 and Cahuilla Way shall be the responsibility of the homeowners association. 10. In accordance with Palm Desert Municipal Code Section 26.44, complete grading plans and specifications shall be submitted to the Director or Public Works for checking and approval prior to issuance of any permits. 11 . As required by Sections 26.32 and 26.40 of the Palm Desert Municipal Code, and in accordance with the Circulation Network of the City's General Plan, dedication of half-street right-of-way at 55 feet on State Highway 74 and full right-of-way at 60 feet on Cahuilla Way shall be provided on the final map. 12. As required under Section 12. 16 and 26.44 of the Palm Desert Municipal Code, any existing overhead utilities shall be placed underground per each respective utility districts recommendation. If such undergrounding is determined to be unfeasible by the City and the respective utility districts, applicant shall agree to participate in any future utility undergrounding district. 13. Traffic safety striping on State Highway 74 and Cahuilla Way shall be provided to the specifications of the Director of Public Works and Caltrans. A traffic control plan must be submitted to, and approved by, the Director of Public Works and Caltrans prior to the placement of any pavement markings. 14. Full improvements of interior streets based on residential street standards in accordance with Section 26.40 of the Palm Desert Municipal Code shall be provided. The proposed interior street sections as shown on the tentative tract map are acceptable for this project. Provisions for emergency access for Street "B" shall be designed to the satisfaction of the Fire Marshall and the Director of Public Works 15. Complete tract map shall be submitted as required by ordinance to the Director of Public Works for checking and approval prior to the issuance. 16. Waiver of access to State Highway 74 and Cahuilla Way except at approved locations shall be granted on the Final Map. 17. Any and all offsite improvements shall be preceded by the approval of plans and the issuance of valid encroachment permits by the Department of Public Works and Caltrans, as applicable. 18. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to, and approved by, the Department of Public Works prior to the issuance of any permits associated with this project. 8 PLANNING COMMISSION RESOLUTION NO. 19. Pad elevations, as shown on the tentative map are subject to review and modification in accordance with Chapter 27 of the Palm Desert Municipal Code. 20. All city required offsite improvements for this project shall be installed in conjunction with this tract map. MAP DESCRIPTION: The map is designed around three holes of golf. The lots are a minimum 11 ,000 square feet and back up to the golf course for the most part. The cul-de-sac along the Palm Valley Channel exceeds the acceptable length for dead-end streets requiring a condition that all homes on this street must be sprinklered. The building standards will be identical to those for 25161 which were: front setback - 20' ; side setback - 8' ; rear setback - 10'; maximum height of 18' and no maximum lot coverage. The maintenance facility was carefully located adjacent to the Cahuilla/Highway 74 intersection with grades and areas provided for adequate screening from both the project and public streets. The closest lot will be elevated 30' above this private yard, while an 8' berm and 43' of landscaping is continued to screen this area from Highway 74. A masonry wall 20' setback from Cahuilla Way will screen this area from property to the north. All buildings shall be accessible by an all-weather roadway extending to within 150' of all portions of the exterior walls of the first story. Your insight to the various systems was greatly appreciated, especially the exemption allowing a 50% reduction in hydrant supply rate for the clubhouse. Your timely suggestions on fire hydrant spacings, and other cost effective measures, will be relayed to our design consultants and contractors for implementation. I would like to recount my understanding of our meeting, and ask you to annotate any item which does not meet with your understanding and transmit back a copy at your earliest convenience. A brief recap of each of the items: 1. Temporary golf facilities: Temporary golf facilities (double wide trailer) will require a hydrant, capable of supplying 1500 gpm, within 500 feet of the furthest point of the building. Page 6, Item 4 : Signalization fees are based on dwelling units and no ' impact would result until dwelling units are constructed. We suggest that the signalization fee be paid prior- to the issuance of a building permit for each homesite. Planning Commission Approval of TT 26018 Page 2 Page 20, Item 20: The domestic water system for the entire project approved by Coachella Valley Water District will eventually tie into the City Is domestic water grid at Hedgehog Street and Edgehill Drive. An interim system for the delivery of domestic water to this phase of the project will be installed in accordance with design plans approved by Coachella Valley Water District. (In addition, interim improvements to Highway 74 will be made in compliance with design plans approved by the City and Cal Trans in conjunction with this phase of the project. ) With regard to the Cal Trans comments on the signalization and lighting of the intersection of Cahuilla Way and Highway 74, we would propose that we have the option of posting a surety (acceptable to the City) for the completion of these improvements if such improvements are required. 's intention to grade a satisfactory access to her property with proper turn-around or looping configuration. 2) Three rock outcroppings on page 4 have been identified and mutually agreed upon with Dave Graham to be preserved. With the exception of these comments, we have found the plans consistent with the council's previous approvals and the Bella Vista development agreement. /PJ/db l (8) As required under Palm Desert Municipal Code Section 26.28, and in accordance with Sections 26.40 and 26.44, complete improvement plans and specifications shall be submitted to the Director of Public Works for checking approval before construction of any improvements is commenced. Offsite improvement plans for all improvements within existing and proposed public rights-of-way to be approved by the Public Works Department and a surety posted to guarantee the installation of required offsite improvements prior to recordation of final map. Such offsite improvements shall include, but not be limited to, curb and gutter, asphalt paving and concrete sidewalk in an appropriate size and configuration and provisions for construction of full improvements on Cahuilla Way. (9) Landscaping maintenance on State Highway 74 and Cahuilla Way shall be the responsibility of the homeowners association. (10) In accordance with Palm Desert Municipal Code Section 26.44, complete grading plans and specifications shall be submitted to the Director of Public Works for checking and approval prior to issuance of any permits. (11) As required by Sections 26.32 and 26.40 of the Palm Desert Municipal Code, and in accordance with the Circulation Network of the City's General Plan, dedication of half-street right-of-way at 55 feet on State Highway 74 and full right-of-way at 60 feet on Cahuilla Way shall be provided on the final map. (12) As required under Section 12.16 and 26.44 of the Palm Desert Municipal Code, any existing overhead utilities shall be placed underground per each respective utility districts recommendation. If such undergrounding is determined to be unfeasible by the City and the respective utility districts, applicant shall agree to participate in any future utility undergrounding district. (13) Traffic safety striping on State Highway 74 and Cahuilla Way shall be provided to the specifications of the Director of Public Works and Caltrans. A traffic control plan must be submitted to, and approved by, the Director of Public Works and Caltrans prior to the placement of any pavement markings. (14) Full improvements of interior streets based on residential street standards in accordance with Section 26.40 of the Palm Desert Municipal Code shall be provided. The proposed interior street sections as shown on the tentative tract map are acceptable for this project. Provisions for emergency access for Street "B" shall be designed to the satisfaction of the Fire Marshall and the Director of Public Works. (15) Complete tract map shall be submitted as required by ordinance to the Director of Public Works for checking and approval prior to the issuance (16) Waiver of access to State Highway 74 and Cahuilla Way except at approved locations shall be granted on the Final Map. (17) Any and all offsite improvements shall be preceded by the approval of plans and the issuance of valid encroachment permits by the Department of Public Works and Caltrans, as applicable. (18) A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to, and approved by, the Department of Public Works prior to the issuance of any permits associated with this project. (19) Pad elevations, as shown on the tentative map are subject to review and modification in accordance with Chapter 27 of the Palm Desert Municipal Code. (20) All required offsite improvements for this project shall be installed in conjunction with the first phase of development.
