SUBJECT: TENTATIVE TRACT 26412 - TIME EXTENSIONS
Dear Mr. Housley:
In response to your letter dated August 8, 1994, the following
is provided.
Tentative Tract 26412 received initial Planning Commission
approval on September 4, 1990 . That approval was valid for a two-
year period. On August 4, 1992, a one-year time extension was
approved which extended the tentative map expiration date to
September 4, 1993 . On August 3, 1993, a second one-year time
extension was granted resulting in a tentative map expiration date
of September 4, 1994 .
On September 13, 1993, legislation adding Section 66452 . 11 to
the Government Code was approved by the governor. Simply put,
Government Code Section 66452 . 11 provided an additional two years
of "life" to any tentative map which had not expired on the
effective date of the legislation (September 13, 1993) . Based on ,
Section 66452 . 11, the expiration date of Tentative Tract 26412 is .
now September 4, 1996 . There is one additional one-year time
extension available, subject to Planning Commission approval, which',
, would provide for a final expiration date of September 4 , 1997 ; for
Tentative Tract 26412 . A request for the final one-year extension
would need to be submitted prior to the September 4, 1996 date.
Regarding the ten-year approval period referenced in your
letter, I am assuming you are making reference to Government Code
Section 664542 . 6 (a) which, in certain specific cases, provides for
a maximum approval period of ten years . Tentative Tract 26412 does
not meet the criteria specified in Section 66452 . 6(a) and would not
be subject to the ten-year approval period.

Title Action in court to eliminate a cloud on the title concerning
a cul-de-sac that was originally planned many years ago. This
matter has now been resolved. We are in the process of making the
financial arrangements to proceed with the development during this
depressed economic environment.

Request for approval of a Negative
Declaration of Environmental Impact and a
conditional use permit to allow
construction of a new school/
administration building and new parking
lot at 43-775 Deep Canyon Drive.
Mr. Diaz explained that this matter was continued because of
the concern raised by a proposed staff condition based on some
of the testimony heard that there would not be any further
expansion of the school into the La Paz community area for 25
years . The matter was continued to receive clarification.
Since that meeting, he spoke with a Mr. Lemann who was with
the law firm that represents the Diocese of San Bernardino,
and Mr. Lemann stated that the Diocese did not intend to
expand any further into the La Paz area and if they did, they
would assist in relocating any residents in the area similar
to what was done previously. Mr. Diaz stated to Mr. Lemann
that it would be nice if some representative from the Diocese
could be at the meeting to say that as part of the public
record and to give commission and the residents the assurance
that would happen. He asked if anyone was present
representing the Diocese; there was no response. He felt that
everyone was after the same thing; the best possible parish
situation and insure that the current residents were not
disrupted.
Commissioner Downs noted that in the letter from the attorney
dated July 29 it said that five to ten years was the time
frame. He suggested conditioning it ten years . Mr. Diaz said

Dear Mr. Diaz:
I am writing to record my objections to Case No.
TT 26412 , a proposal to subdivide an area north of
Crosby Lane.
I own the home at 49150 Della Robbia Lane as well
as the north lot adjacent. My wife and I are perma-
nent residents of Palm Desert. Today, we examined the
drawing of the proposed five lot subdivision at the
Planning Commission offices.
In our opinion, the proposal would produce a result
inconsistent with the surrounding homes and homesites
and would have the effect of lowering property values
in the surrounding area. You will note, for example,
that the proposal seeks to place five homes in the
area when, on an equivalent area facing Carriage Trail,
only four sites exist. Furthermore, the proposed
access road arrangement limits access more than on
equivalent sites (a single road as opposed to several
roads ) . I believe that the same comparisons can be
made respecting sites fronting on Crosby Lane and
JFK.
In our opinion, only four homes should be permitted
on this site, in order to maintain its consistency
with neighboring homesites on all sides.

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PALM
DESERT, CALIFORNIA, APPROVING A 5 LOT SUBDIVISION NORTH OF
CROSBY LANE - 225 FEET EAST OF DELLA ROBBIA LANE.
CASE NO. TT 26412
WHEREAS, the Planning Commission of the City of Palm Desert, California, did on
the day of hold a duly noticed public hearina to consider the request of JEAN HIRSCHI
AND DR. ROTTSCHAEFER for the proiect described above: and
WHEREAS, said application has complied with the requirements of the "City of
Palm Desert Procedure for Implementation of the California Environmental Quality Act,
Rasolution No. 84-89. " in that the director of community development has determined
that the proiect will have no possible significant effect on the environment; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said planning
commission did find the following facts and reasons to exist to justify approval of
the tentative tract map:
(a) That the proposed map is consistent with applicable general and specific
plans.
(b) That the desion or improvement of the proposed subdivision is consistent
with applicable general and specific plans.
(c ) That the site is physically suitable for the type of development.
(d) That the site is physically- suitable for the proposed density of
development.
(e) That the desion of the subdivision or the proposed improvements are not
likely to cause substantial environmental damage or substantially and
avoidably injure fish or wildlife or their habitat.
( f) That the design of the subdivision or the type of improvements is not
liF::ely to cause serious public health problems.
(a) That the design of the subdivision or the type of improvements will not
conflict with easements, acquired by the public at large, for access
through or use of property within the proposed subdivision.
WHEREAS, in the review of this tentative tract map the planning commission has
considered the effect of the contemplated action on the housing needs of the region
for purposes of balancing these needs against the public service needs of the
residents of the City of Palm Desert and its environs, with available fiscal and
environmental resources.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Palm
Desert. California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the commission in this case.
2. That it does hereby approve the above described Tentative Tract Map No.
TT 26412, subject to fulfillment of the attached conditions.

CONDITIONS OF APPROVAL
CASE NO. TT 26412
Department of Community Development:
1 . The develooment of the property shall conform substantially with exhibits on
file with the department of community development/planning, as modified by the
following conditions.
_. Recordation of map shall occur with two years from the date of final approval
unless an extension of time is granted; otherwise said approval shall become
null , void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and state and federal statutes now in force, or which
hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use contemplated
by the approval, the applicant shall first obtain permits and/or clearance from
the following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Department
Evidence os said permit or clearance from the above agencies shall be presented
to the department of building and safety at the time of issuance of a building
permit for the use contemplated herewith.
5. Property lines and perimeter wall shall be located at top of slopes.
Department of Public Works:
1 . Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal
Code, shall be paid prior to recordation of final map.
2. Sianalization fees, in accordance with City of Palm Desert Resolution Nos. 79-
17 and 79-55, shall be paid prior to recordation of final map.
3. Any storm drain/retention area construction shall be contingent upon a drainage
study prepared by a registered civil engineer that is reviewed and approved by
the Department of Public works. Individual drainage retention areas shall be
desioned at the 100 year storm level and shall include provisions for overflow
conditions including easements as may be necessary.

4. In accordance with Palm Desert Municipal Code Chapter 27, complete grading plans
and specifications shall be submitted to the Director of Public Works for
chec4::ing and approval prior to the issuance of any permits.
5. All private street construction shall be in accordance with Chapter 26 of the
Palm Desert Municipal Code and be inspected by the Department of Public Works
with a standard inspection fee paid prior to issuance of any permits associated
with this project. Maintenance of private streets/driveways ( lots A and B)
shall be the responsibility of the lot owners.
6. A complete preliminary soils investigation, conducted byu a registered soils
enoineer, shall be submitted to and approved by the Department of Public Works
Prior to the issuance of the grading permit.
7. Complete tract map shall be submitted to the Director of Public Works for
checking and approval prior to the issuance of any permits associated with this
project.
8. Proposed pad elevations as shown on the tentative tract map shall are subject
to review and modification in accordance with Chapter 27 of the Palm Desert
Municipal Code. Site grading design shall include consideration of existing
topooraphy as well as existing development adjacent to the subject site.

Riverside County Fire Departments
1 . With respect to the conditions of approval regarding the above referenced plan
check the Fire Department recommends the following fire protection measures be
provided in accordance with City Municipal Code. NFPA, UFC, and UBC and/or
recognized Fire Protection Standards.
2. Provide, or show there exists a water system capable of providing a potential
gallon per minute 1500 for single family, 2500 for multifamily, and 3000 for
commercial. The actual fire flow available from any one hydrant connected to
any given water main shall be 1500 GPM for two hours duration at 20 PSI residual
operating pressure.
3. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual operating
oressure must be available before any combustible material is placed on the job
site.
4. The required fire flow shall be available form a Super hydrant(s) (6" x 4" x: 2-
1/2" z 2-1/2"), located not less than 25' nor more than 200' single family, 165'
multifamily, and 150' commercial from any portion of the building(s) as measured
along approved vehicular travelways. Hydrants installed below 3000' elevation
shall be of the "wet barrel" type.

5. Provide written certification from the appropriate water company having
jurisdiction that hydrant(s) will be installed and will produce the required
fire flow, or arrange field inspection by the Fire Department prior to request
for final inspection.
6. A combination of on-site and off-site Super fire hydrants. (6" x 4" ;. 2-1/2" x
2-1/2' ) , will be required, located not less than 25, or more that 200' single
farraIy, 1E.5' multifamily, and 150' commercial from any portion of the
buildina(s) as measured along approved vehicular travelways. The required fire
flow shall be available from any adjacent hydrant(s) in the system.
7. Prior to the application for a buildina permit, the developer shall furnish the
original and two copies of the water, system plan to the County Fire Department
for review. No building permit shall be issued until the water system plan has
been approved by the County fire Chief. Upon approval,- the original will be
returned. One copy will be sent to the responsible inspecting authority.
Plans shall conform to fire hydrant types. location and spacing, and the system
shall meet the fire flow requirements. Plans shall be signed by a Registered
Civil Engineer and may be signed by the local water company with the following
certification: "I certify that the design of the water system is in accordance
with the requirements prescribed by the Riverside County Fire Department."
S. All buildings shall be accessible by an all-weather roadway extending to within
150' of all portions of the exterior walls of the first story. The roadway
shall be not less than 24' of unobstructed width and 13' 6" of vertical
clearance. Where parallel parking is allowed, the .roadway shall be :36' wide
with parking on both sides, 32' wide with parking on one side. Dead-end roads
in excess of 150' shall be provided with a minimum 45' radius turn-around (55'
in industrial developments) . Fountains or gargen islands placed in the middle
of these turn-arounds shall not exceed a 5' radius or IV diameter.
9. Whenever access into private property is controlled through use of gates,
barrier---, guard houses or similar means, provision shall be made to facilitate
acce55 by emergency vehicles in a manner approved by the Fire Department. All
controlled access devices that are power operated shall have a radio-controlled

Mr. Joy ouCtlined the salient points of the staff reportq
described the letters that had been received in opposition ,
and recommended approval .
Chairperson Whitlock asked staff if the project was part of
a homeowners association and Mr. joy replied no.
Commissioner Jonathan asked what the smallest lot size would
be if there were five lots and Mr. Joy answered they would
be a 20, 000 square feet minimum.
Chairperson Whitlock: opened the public testimony and asked
if the applicant wished to address the commission .
MR. HAROLD HOUSLEY , project engineer, 45- 175 Panorama,
Suite F, informed commission that he had a number of
meetings with staff to prepare this development and it
met all zoning requirements. He indicated that the
fire marshal was asking a 24 foot width, but he would
prefer 0 feet, which was equal or larger that other
roads in the area. He stated that he would discuss the
matter further with the fire marshal . He felt their
lot sizes were consistent with other lots in the area.
He also felt that the applicant had a right to build

consistent with projects around the area. Addressing
concerns mentioned in the letter that had been
received, he felt the property values would not go down
since the project was consistent with the neighborhood
and toning and the project would be improve the area.
MS. - JEAN ANN HIRSHY, applicant, felt the project would
be aesthetically pleasing and would not block views.
DR. ROTTSHAEFFER noted that the proposal was within
city require""S7 it should increase the value of the
land, and should not to hinder views.
Chairperson Whitlock asked if anyone present wished to speak
in FAVOR or OPPOSITION to the proposal .
MR. EDWARD BRITTONHOUSE, Crosby Lane Homeowners
Association, informed commission there were
approximately 15 different associations in Ironwood.
He expressed concern regarding traffic, lot sizes, and
ingress/egre5.
MR. i0E GRANGER, 72-975 Carriage Trail , spoke in
opposition. He indicated that his lot abuts one and a
half of the lots in question; one lot was seven feet
higher and the other nine feet higher than his. He
Felt that the proposal would cut his view to the south
and was concerned about road width and drainage.
MR. RICHARD SCHOENBERG, 49-300 Della Robbia, owner of
the lot to the south of the project , spoke in
opposition to the proposal and felt that the lots were
not consistent with the other two tracts that had been
approved in that area. He asked that the matter be
continued to allow more people to return from vacation .
He also expressed concern regarding setbacks. He felt
that the project should join into a legal property
owners association. He indicated that they probably
would belong to the Ironwood Master Maintenance
District and felt they should also comply with
standards within the Ironwood Country Club.
Chairperson Whitlock asked if the applicant would give a
rebuttal .

MR. HOUSL.F_Y readdressed the commission and reiterated
that the configuration and size of the lots met city
requirements. He indicated that they plan to be good
neighbors and these would be nice homes. He also noted
that no parking would be allowed on a 24 foot wide
street and was not an issue. He indicated that the
actual grading plan would come before commission later
with a specific proposal .
Mr. Diaz informed commission that the grading plan would not
come before the commission for a public hearing.
Mr. Housley indicated that commission would be _able to
comment on the tentative map and stated that they would
step down the pads from south to north onto Carriage
Trail .
Commissioner Jonathan asked the applicant to give some type
of reassurance to the residents regarding_ drainage. Mr.
Hous.l.ey indicated that the conditions of approval require
them to retain a 100 year storm on site and felt that all
reasonable flows would be retained on site.
MR. ROT7SHAEFFER addressed commission and indicated
that he had not been aware that there was a Crosby Lane
Homeowners Association and he had owned this land
before Ironwood incorporated and they were not notified
about belonging , but he expressed a willingness to join
the association.
Chairperson Whitlock closed the public testimony.
Mr. Rittenhouse asked to address the commission to rebut
comments by the applicant; commission informed him that the
public testimony portion was closed.
Commissioner Downs felt the project was not consistent with
the area and stated that an extension of time was in order
or a denial .
Commissioner Jonathan felt that the proposal complied with
the zoning and was not persuaded by the objections. He did
not see a reason not to grant approval . Commissioner Erwood
concurred with Commissioner Jonathan and felt the project
was not inconsistent with the neighborhood. Chairperson

1. BACKGROUND:
The site is comprised of two 1 .25 acre lots zoned R-I , 20,000 and shown as
medium density residential on the general plan. The site is vacant and
contains native desert vegetation. The site slopes north down to existing
residences. Surrounding zoning and land use is as follows:
,North - R-1 , 20,000/Single family homes
South - R-1 , 20,000/Vacant subdivided lots
East - R-1 , 20,000/Vacant
West - R-1 , 20,000/Vacant
11 . DISCUSSION:
If the two lots were developed separately each parcel would only have
enough acreage for 2 lots each - 4 total , while the consolidation totals
enough acreage for five 20,000 square feet lots. The flag lot
configuration is similar to TT 22622 approved June 87 - and adjacent to
the south.
The design of 3 lots in back and 2 in front was done to accommodate a
wider and shorter access to parcels in back - which was a concern of the
fire marshal . The grading design of the homes to the north creates an
awkward situation for this project since it was done not anticipating
development at a higher elevation to the rear at the northeast corner of
the subject site. The result is that the proposed pad heights will be at
existing contours at least 6 feet higher than the pad heights of the homes
to the north. The problem is that the 3-1 slope between the two pads will
need to be all on the applicants property, so the property line will be at
the bottom of the slope. Since no homes are proposed at this time final
detailed grading plans including building footprints will be reviewed by
the public works department when submitted for new home construction.
This will need to include 100 year storm water retention since the lower
tract did not provide a drainage easement.

Offsite grading easements will be necessary to the east since this
property is lower while property to the west is generally the same
elevation. An offsite drainage easement to the east may also be possible
but would require cooperation from that property owner.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the day of hold a duly noticed public hearing to consider the request of
JEAN HIRSCHI AND DR. ROTTSCHAEFER for the project described above; and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89," in that the director of community
development has determined that the project will have no possible significant
effect on the environment; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exist to justify approval of the tentative tract map:

WHEREAS, in the review of this tentative tract map the planning commission
has considered the effect of the contemplated action on the housing needs of
the region for purposes of balancing these needs against the public service

Department of Community Development:
I . The development of the property shall conform substantially with exhibits
on file with the department of community development/planning, as modified
by the following conditions.
2. Recordation of map shall occur with two years from the date of final
approval unless an extension of time is granted; otherwise said approval
shall become null , void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and state and federal statutes now in force, or which
hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by the approval , the applicant shall first obtain permits
and/or clearance from the following agencies:

Evidence os said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance

Department of Public Works:
1 . Drainage fees, in accordance with Section 26.49 of the Palm Desert
Municipal Code, shall be paid prior to recordation of final map.
2. Signalization fees, in accordance with City of Palm Desert Resolution Nos.
79-17 and 79-55, shall be paid prior to recordation of final map.
3. Any storm drain/retention area construction shall be contingent upon a
drainage study prepared by a registered civil engineer that is reviewed
and approved by the Department of Public works. Individual drainage
retention areas shall be designed at the 100 year storm level and shall
include provisions for overflow conditions including easements as may be
necessary.

4. In accordance with Palm Desert Municipal Code Chapter 27, complete grading
plans and specifications shall be submitted to the Director of Public
Works for checking and approval prior to the issuance of any permits.
5. All private street construction shall be in accordance with Chapter 26 of
the Palm. Desert Municipal Code and be inspected by the Department of
Public Works with a standard inspection fee paid prior to issuance of any
permits associated with this project. Maintenance of private
streets/driveways ( lots A and B) shall be the responsibility of the lot
owners.
6. A complete preliminary soils investigation, conducted byu a registered
soils engineer, shall be submitted to and approved by the Department of
Public Works prior to the issuance of the grading permit.
7. Complete tract map shall be submitted to the Director of Public Works for
checking and approval prior to the issuance of any permits associated with
this project.
8. Proposed pad elevations as shown on the tentative tract map shall are
subject to review and modification in accordance with Chapter 27 of the
Palm Desert Municipal Code. Site grading design shall include
consideration of existing topography as well as existing development
adjacent to the subject site.
Riverside County Fire Department:
1. With respect to the conditions of approval regarding the above referenced
plan check the Fire Department recommends the following fire protection
measures be provided in accordance with City Municipal Code. NFPA, UFC,
and UBC and/or recognized Fire Protection Standards.
2. Provide, or show there exists a water ,system capable of providing a
potential gallon per minute 1500 for single family, 2500 for multifamily,
and 3000 for commercial . The actual fire flow available from any one
hydrant connected to any given water main shall be 1500 GPM for two hours
duration at 20 PSI residual operating pressure.
3. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual operating
pressure must be available before any combustible material is placed on
the job site.
4. The required fire flow shall be available form a Super hydrant(s) (6" x 4"
x 2-1/2" z 2-1/2") , located not less than 25' nor more than 200' single
family, 165' multifamily, and 150' commercial from any portion of the
building(s) as measured along approved vehicular travelways. Hydrants
installed below 3000' elevation shall be of the "wet barrel" type.

5. Provide written certification from the appropriate water company having
jurisdiction that hydrant(s) will be installed and will produce the
required fire flow, or arrange field inspection by the Fire Department
prior to request for final inspection.
6. A combination of on-site and off-site Super fire hydrants. (6" x 4" x 2-
1/2" x 2-1/2' ) , will be required, located not less than 25' or more that
200' single family, 165' multifamily, and 150' commercial from any portion
of the building(s) as measured along approved,vehicular travelways. The
required fire flow shall be available from any adjacent hydrant(s) in the
system.
7. Prior to the application for a building permit, the developer shall
furnish the original and two copies of the water system plan to the County
Fire Department for review. No building permit shall be issued until the
water system plan has been approved by the County fire Chief. Upon
approval , the or i g i na 1 will be returned. One copy wi 1 1 be sent to the
responsible inspecting authority.
Plans shall conform to fire hydrant types. location and spacing, and the
system shall meet the fire flow requirements. Plans shall be signed by a
Registered Civil Engineer and may be signed by the local water company
with the following certification: "I certify that the design of the water
system is in accordance with the requirements prescribed by the Riverside
County Fire Department."
B. All buildings shall be accessible by an all-weather roadway extending to
within 150' of all portions of the exterior walls of the first story. The
roadway shall be not less than 24' of unobstructed width and 13' 6" of
vertical clearance. Where parallel parking is allowed, the roadway shall
be 36' wide with parking on both sides, 32' wide with parking on one side.
Dead-end roads in excess of 150' shall be provided with a minimum 45'
radius turn-around (55' in industrial developments) . Fountains or garden
islands placed in the middle of these turn-arounds shall not exceed a 5'
radius or 10' diameter.
9. Whenever access into private property is controlled through use of gates,
barriers, guard houses or similar means, provision shall be made to
facilitate access by emergency vehicles in a manner approved by the Fire
Department. All controlled access devices that are power operated shall
have a radio-controlled over-ride system capable of opening the gate when
activated by a special transmitter located in emergency vehicles. Devices
shall be equipped with backup power facilities to operate in the event of
power failure. all controlled access devices that are not power operated
shall also be approved by the fire Department. Minimum opening width
shall be 16' , with a minimum vertical clearance of 13'6".

Gentlemen:
This confirms my verbal discussion with Joe Gaugish on September 5, 1990,
concerning the Department of Public Works Condition No. 3 in the staff
report to the Planning Commission dated September 5, 1990.
In addition to the retention requirement, the owner/developer also has the
option, providing the costs are reasonable, to drain all the stormwater
runoff to the streets providing acceptable drainage facilities are installed
and approval is obtained to construct the facilities as needed.
The subject property cannot drain to the northeast because the development
of Tract Nos. 20960 and 5564 have blocked the natural drainage. The
property could drain due east if the property owners cooperate. It is
understood, according to Phil Joy, Associate Planner, that the City can
require appropriate drainage easements from the subject property and
abutting property in order to implement a drainage plan to serve the area.
The owners of the subject Tentative Tract Map No. 26412 request the City to
acquire said drainage easements from the respective land owners to assure
that the properties can be properly drained. Lack of an overall drainage
plan for the properties could impact the quality of development.

The Crosby Lane Properties Homeowners Association, Inc. would like
to express our objections to Case No. TT 26412 as presently submit-
ted to the Commission.
The Tentative Tract Map No. 26412 prepared by Housley Associates,
Inc. , shows a five (5) lot subdivision. This is not consistent with
the properties surrounding the parcel in question. In keeping with
the parameters already established, four lots would be contiguous
with the surrounding properties.
It is also our belief that Crosby Lane should be 40 feet wide to
allow for sufficient on street parking. Half of Crosby Lane which
is currently developed as part of Tract No. 22622, is 20 feet wide.
To be consistent with the existing road, Lot A of Tract 26412 should
be 20 feet wide, not 12 feet as presently shown. Della Robbia Lane
and Carriage Trail are 40 foot wide streets.
Lot B, which accesses the northerly lots is questionable in shape
and dimension. As a reference, a suitable type access would be
Calle De La Silla or the 20 foot wide access drives to each lot that
are part of Tract No. 20960 or the combined 16 foot drives (total
32 foot ) that are part of Tract No. 22622.
If adequate frontage and access roads are taken into consideration.
It is doubtful that five lots containing the minimum square footage
of 20, 000 will remain. Another factor that is based on the develop-
ers advertised information for lots located north of Crosby Lane.
The twenty (20) lots comprising Tract No. 20960 average 24, 269
square feet. The minimum size is 20, 004 and the maximum is 36, 862
square feet. The 10 lots located south of Crosby Lane that are part
of Tract No. 22622 average 20, 088 square feet. The point here is
that, meeting the minimum lot size, is not the the only criteria ne-
cessary to determine compatibility with the surrounding properties.

Existing lots of both Tracts Noe. 20960 and 22622 have been posi-
tioned, to allow reasonable view corridors in relation to one
another. As currently proposed Tract No. 26412 seriously impedes
this principal.
Another condition deemed important is that, any new Tract should be-
come a member of one of the existing adjacent Homeowners Associ-
ations. This will assure architectural control and adequate set
backs for any structures to be built.
Lastly, should all of the proceeding arguments be to no avail. We
feel that the timing for this hearing is such that most of the sur-
rounding Property Owners are not aware of the hearing, due to being
away during the summer months. At the very least, this hearing
should be deferred to a time when effected Property Owners can be
present and express their opinions.

1 . BACKGROUND:
The site is comprised of two 1 .25 acre lots zoned R-1 , 20,000 and shown as
medium density residential on the general plan. The site is vacant and
contains native desert vegetation. The site slopes north down to existing
residences. Surrounding zoning and land use is as follows:
North - R-1 , 20,000/Single family homes
South - R- 1 , 20,000/Vacant subdivided lots
East - R-1 , 20,000/Vacant
West - R-1 , 20,000/Vacant
11 . DISCUSSION:
If the two lots were developed separately each parcel would only have
enough acreage for 2 lots each - 4 total , while the consolidation totals
enough acreage for five 20 ,000 square feet lots. The flag lot
configuration is similar to TT 22622 approved June 87 - and adjacent to
the south.
The design of 3 lots in back and 2 in front was done to accommodate a
wider and shorter access to parcels in back - which was a concern of the
f i re marsha I . The grading design of the homes to the north creates an
awkward situation for this project since it was done not anticipating
development at a higher elevation to the rear at the northeast corner of
the subject site. The result is that the proposed pad heights will be at
existing contours at least 6 feet higher than the pad heights of the homes
to the north. The problem is that the 3-1 slope between the two pads will
need to be all on the applicants property, so the property line will be at
the bottom of the slope. Since no homes are proposed at this time final
detailed grading plans including building footprints will be reviewed by
the public works department when submitted for new home construction.
This will need to include 100 year storm water retention since the lower
tract did not provide a drainage easement.

Offsite grading easements will be necessary to the east since this
property is lower while property to the west is generally the same
elevation. An offsite drainage easement to the east may also be possible
but would require cooperation from that property owner.

DESERT, CALIFORNIA, APPROVING A 5 LOT SUBDIVISION NORTH OF
CROSBY LANE - 225 FEET EAST OF DELLA ROBBIA LANE.

WHEREAS, the Planning Commission of the City of Palm Desert, California,
did on the day of hold a duly noticed public hearing to consider the request of
JEAN HIRSCHI AND DR. ROTTSCHAEFER for the project described above; and
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
Quality Act, Resolution No. 80-89, " in that the director of community
development has determined that the project will have no possible significant
effect on the environment; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said planning commission did find the following facts and reasons to
exist to justify approval of the tentative tract map:

CONDITIONS OF APPROVAL

Department of Community Development:
1 . The development of the property shall conform substantially with exhibits
on file with the department of community development/planning, as modified
by the following conditions.
2. Recordation of map shall occur with two years from the date of final
approval unless an extension of time is granted; otherwise said approval
shall become null , void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to all
municipal ordinances and state and federal statutes now in force, or which
hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use
contemplated by the approval , the applicant shall first obtain permits
and/or clearance from the following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Department
Evidence os said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. Property lines and perimeter wall shall be located at top of slopes.
Department of Public Works:
I . Drainage fees , in accordance with Section 26.49 of the Palm Desert
Municipal Code, shall be paid prior to recordation of final map.
2. Signalization fees, in accordance with City of Palm Desert Resolution Nos.
79-17 and 79-55, shall be paid prior to recordation of final map.
3. Any storm drain/retention area construction shall be contingent upon a
drainage study prepared by a registered civil engineer that is reviewed
and approved by the Department of Public works. Individual drainage
retention areas shall be designed at. the 100 year storm level and shall
include provisions for overflow conditions including easements as may be
necessary.

4. In accordance with Palm Desert Municipal Code Chapter 27, complete grading
plans and specifications shall be submitted to the . DIrector of Public
Works for checking and approval prior to the issuance of any permits.
5. All private street construction shall be in accordance with Chapter 26 of
the Palm Desert Municipal Code and be inspected by the Department of
Public Works with a standard inspection fee paid prior to issuance of any
permits associated with this project . Maintenance of private
streets/driveways ( lots A and B) shall be the responsibility of the lot
owners.
6. A complete preliminary soils investigation, conducted byu a registered
soils engineer, shall be submitted to and approved by the Department of
Public Works prior to the issuance of the grading permit.
7. Complete tract map shall be submitted to the Director of Public Works for
checking and approval prior to the issuance of any permits associated with
this project.
B. Proposed pad elevations as shown on the tentative tract map shall are
subject to review and modification in accordance with Chapter 27 of the
Palm Desert Municipal Code. Site grading design shall include
consideration of existing topography as well as existing development
adjacent to the subject site.
Riverside County Fire Department:
1 . With respect to the conditions of approval regarding the above referenced
plan check the Fire Department recommends the following fire protection
measures be provided in accordance with City Municipal Code. NFPA, UFC,
and UBC and/or recognized Fire Protection Standards.
2. Provide, or show there exists a water system capable of providing a
potential gallon per minute 1500 for single family, 2500 for multifamily,
and 3000 for commercial . The actual fire flow available from any one
hydrant connected to any given water main shall be 1500 GPM for two hours
duration at 20 PSI residual operating pressure.
3. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual operating
pressure must be available before any combustible material is placed on
the job site.
4. The required fire flow shall be available form a Super hydrant(s) (6" x 4"
x 2-1/2" z 2-1/2") , located not less than 25' nor more than 200' single
family, 165' multifamily, and I50' commercial from any portion of the
building(s) as measured along approved vehicular travelways. Hydrants
installed below 3000' elevation shall be of the "wet barrel" type.

5. Provide written certification from the appropriate water company having
jurisdiction that hydrant(s) will be installed and will produce the
required fire flow, or arrange field inspection by the Fire Department
prior to request for final inspection.
6. A combination of on-site and off-site Super fire hydrants. (6" x 4" x 2-
112" x 2-1/2' ) , will be required, located not less than 25' or more that
200' single family, 165' multifamily, and 150' commercial from any portion
of the building(s) as measured along approved ,vehicular travelways. The
required fire flow shall be available from any adjacent hydrant(s) in the
system.
7. Prior to the application for a building permit, the developer shall
furnish the original and two copies of the water system plan to the County
Fire Department for review. No building permit shall be issued until the
water system plan has been approved by the County fire Chief. Upon
approval , the original will be returned. One copy will be sent to the
responsible inspecting authority.
Plans shall conform to fire hydrant types. location and spacing, and the
system shall meet the fire -flow requirements. Plans shall be signed by a
Registered Civil Engineer and may be signed by the local water company
with the following certification: "I certify that the design of the water
system is in accordance with the requirements prescribed by the Riverside
County Fire Department."
B. All buildings shall be accessible by an all-weather roadway extending to
within 150' of all portions of the exterior walls of the first story. The
roadway shall be not less than 24' of unobstructed width and 13' 6" of
vertical clearance. Where parallel parking is allowed, the roadway shall
be 36' wide with parking on both sides, 32' wide with parking on one side.
Dead-end roads in excess of 150' shall be provided with a minimum 45'
radius turn-around (55' in industrial developments) . Fountains or garden
islands placed in the middle of these turn-arounds shall not exceed a 5'
radius or 10' diameter.
9. Whenever access into private property is controlled through use of gates,
barriers, guard houses or similar means, provision shall be made to
facilitate access by emergency vehicles in a manner, approved by the Fire
Department. All controlled access devices that are power operated shall
have a radio-controlled over-ride system capable of opening the gate when
activated by a special transmitter located in emergency vehicles. Devices
shall be equipped with backup power facilities to operate in the event of
power failure. all controlled access devices that are not power operated
shall also be approved by the fire Department. Minimum opening width
shall be 16' , with a minimum vertical clearance of 13'6".

10. Contact the Fire Department for a final inspection prior to occupancy.
11 . All new residences/dwellings are required to have illuminated residential
addresses meeting both City and fire Dept approval . Shake shingle roofs
