Gentlemen:
As the representative for the Estate of William F. Stevens through John C. Mitchell, III, attorney and
co-personal.representative of the estate,I respectively request a one year(1) extension of time within
which to record Tentative Tract Map No. 26553. Further if a longer extension can be authorized i.e.,
2/3 years, we would request the longer period of time for the extension be approved.
As the request mentioned in our letter dated May 20, 1996,Mr. Steven's estate is complex with some
eight beneficiaries and two trustees in all sections of the United States, along with other assets
including the Avondale property.
It is further requested that if the estate through the courts deed the property to the trust for the
benefit of the beneficiaries that all approvals, etc., will pass to the new legal owner, and the trust
would be in the same position as the Estate of',71i)liam F. Stevens, deceased is today.
We are sorry for the delay, however, you must realize how much time these cases take.
If you need any further information, please let me know as I understand this will be heard at the July
1, 1997 meeting of the Planning Commission.

Dear Mr. Smith:
The undersigned is Co-Personal Representative of the Estate of William F. Stevens,
Deceased. The Estate is the owner of the parcel of real property covered by the above
Tentative Tract Map.
At this time and on behalf of the Estate, I would respectfully request a one (1) year
extension of time within which to record Tentative Tract Map No. 26553.
Mr. Steven's Estate proved to be quite complex and involved, among other matters,
litigation relating to various assets, one of which was the Avondale property. All of these
problems have been resolved and the Estate can now proceed to deal with the above
property in a rational manner. It would seem counter-productive to allow a map, approved
by all concerned, to expire just when the owner is ready and able to proceed to either
develop under the plan or transfer the property to a developer who will comply with the
requirements relating to the Map.
Please let me know if I can supply you with any further information.

One-Year Extension of Subdivision Maps
Effective May 15, 1996
CBTA is pleased to report that Governor Pete Wilson has signed
AB 771, the CBIA-sponsored subdivision map bill, into Iaw.
AB 771, now Chapter 46 of the 1996 Statutes, grants an
automatic one-year extension to all existing tentative subdivision
maps. This means that any tentative map that hadn't expired 'by
May 15, 1996, the effective date of the bill, is now automatically
extended for one year.
AD 771 is an important victory for California home builders
because it ensures that hundreds of costly tentative subdivision
maps — representing thousands of single-family and multi-family
housing units statewide -- will not expire in 1996 ,just as We
housing market.rebounds.
A well-deserved thanks to the bill's author, Fred Aguiar, R-
Chino, for his year-long commitment and strong leadership on
this vital housing issue.
Thanks also to CBIA members for their.grassroots support on
this important measure. You helped us.win!

SUBJECT: TENTATIVE TRACT 26553 - CONDITIONS OF APPROVAL
Dear Mr. Boettcher:
At long last we have completed our review of your
correspondence of March 23, 1993 . As stated in previous
correspondence to your office, we basically concur with the
transfer of the County' s Conditions of Approval to the City of Palm
Desert. We completely agree with the specific discussion presented
in your March 23, 1993, correspondence on each of the conditions .
With respect to the issue of drainage, you have requested
verification of the offsite retention requirements . As we
discussed, it is the City' s intention to provide facilities to
intercept street flows at the intersection of Frank Sinatra Drive
and Cook Street. The installation of these facilities will
significantly reduce the offsite flows which will impact the
proposed development. In addition, the City' s Master Drainage Plan
indicates a drain line in Frank Sinatra Drive beginning at the
northwest corner of your project and extending easterly. Although
not planned for construction the near future, this link will
provide additional relief to the project. In the interim, we are
requiring that the offsite flows be retained within the subject
development and that the retention basin be sized for a 100-year
condition with a maximum side slope of 3 : 1.
The onsite and offsite street improvement issues presented in
your letter (Page 6) appear satisfactory to us . In addition, the
issue of landscaping the proposed median island needs to be
addressed. At this point, we will not be requiring the actual
landscape installation. In lieu of installation, we will require
a cash payment for the future installation. The amount of this
cash payment will be determined at the time all other fees and
exactions are prepared.

Finally, the subject of reduced lot count and substantial
conformance was recently discussed. As stated, this city has no
objection to the reduction in lot count and lot configuration. We

FROM THE COUNTY OF RIVERSIDE TO THE CITY OF PALM DESERT.
Dear Mr. Gaugush:
I would like to thank you for taking the time to meet with us during February 1993
regarding the status of Tentative Tract Map 26553. In that meeting, you requested.,.
that J.F. DAVIDSON ASSOCIATES, INC. prepare correspondence that addresses
the transfer of the Conditions of Approval from the County of Riverside to the City of
Palm Desert.
Since the Tentative Tract Map 24553 expires on July 23, 1993,.an extension will be
processed and can you provide the necessary forms for this time extension to this
office.
The.following is a breakdown of the conditions that need clarification when .
transferred to the City of Palm Desert. It is understood that nay items not mentioned
will not require any changes. The numbers refer to the condition number of the
County conditions, dated July 23, 1991.
CONDITION NUMBER:
1. All the references to the County of Riverside in this condition and all
proceeding conditions shall be understood to refer to the City of Palm Desert.
2. All references to the Road Commissioner in this condition and all proceeding
conditions shall be understood to refer to the City Engineer. The street names
shall be subject to approval by the Planning Department.

3. The reference to the County ,Surveyor in this condition and all proceeding
conditions shall be understood to refer to the City Engineer. The Final Map
and any associated easements shall be recorded by the clients title company
in conjunction with the City of Palm Desert.
4. The reference to County Ordinance No. 460, shall be understood to refer to
the applicable City Ordinances and Chapter 27 of the Palm Desert Municipal
Code.
6. The Grading Plan shall be submitted and approved by the Public.Works
Department and the permits shall be issued by the City of Palm Desert Public
Works Department. The grading plan shall comply with the U.B.C., Chapter
70, and as amended by Chapter 27 of the Palm Desert Municipal Code. The
County Ordinance 457, and environmental assessment is not applicable.
7. The Soils Report shall be submitted to the City Public Works Department and
the Building and Safety Department. _
8. It is understood that the City has reviewed and accepted the letter from the
County Transportation Department, dated December 26, 1990. Except that
the reference to the County Ordinances 460 and 461 shall be understood to
refer to the applicable City Ordinances, and that Frank Sinatra Drive will be
constructed with a 55 foot half width right-of-way and a 43 foot roadway with a
9 foot median as shown on the Tentative Tract maps. All references to the
County Standards shall be understood to be referring to the applicable
corresponding City Standard, in particular County Standards; 105 and 101 are
understood to be City Standard 307 (without sidewalk) and 302 respectively.
In addition, it is understood that the City will accept 4" rolled curb within said
tract area and the entry to have standard 6" curb and 24" wide gutter with
curb-gutter transitions to be about 10 feet minimum.
As for El Dorado Drive (existing) there will be no necessity to provide any
street improvement per your site inspection other than at the intersection of El
Dorado Drive and Frank Sinatra for drainage.
The County Transportation Department reference to a secondary access is not
applicable.

The Traffic Signal Mitigation fee and the Transportation Uniform Mitigation Fee
shall be adjusted to the Cities fee structure.
All references to the Transportation Department and Director of Transportation
in this condition and any proceeding condition shall be understood to refer to
the City of Palm Desert Public Work Department, and the City Engineer
respectively.
9. The City will not require a submittal to the County Health Department.
10. The Grading Plan will not be required to be submitted to the Coachella Valley
Water District Flood Control for review of the drainage. However, a submittal
of the grading, landscape and irrigation plan to CVWD will be required to
ensure efficient water management.
11. It is understood that the City of Palm Desert Fire.Department has reviewed
and accepted the requirements a stated in the County Fire Department IetteF .
dated December 10, 1990. A copy of the water plans for this site will be F
submitted to the City of Palm Desert Fire Department for approval.
12. The Grading Plan will be required to be submitted to the Public Works
Department. All references to the County Ordinance 457 shall be understood

This system will provide some relief to our existing design requirements. Reference
is made in a letter sent to you from (JFD) dated December 23, 1991, Item 9 as to
what those design requirements involve. We.have requested that the City provide a
letter stating the fact and provide confirmation as to what the design requirements
for the street and retention basin will be for the interim condition. It was also
suggested by the City that 3:1 maximum side slopes be provided for the retention
basin.

STREET IMPROVEMENTS: (Onsite)
There are no objections by the City suggesting that street improvements for "A
Street be improved with a 36750' road section, which is contrary to the Conditions of
Approval by the County of Riverside suggesting 36760' road section.
STREET IMPROVEMENTS: (Offsite)
Offsite Frank Sinatra Drive profile will have a minimum of 0.4% grades with a sump
at the basin near the proposed maintenance building. This design will result in our
median curb (south of centerline)'having a maximum differential of 2.2 feet in
elevation with respect to the existing -median curb (north of centerline). The City will
accept this condition due to its existing constraints.
We will also be required to extend the existing median west to.the existing
intersection (approximately.300 feet).

Dear Mr. Altman:
I would like to thank your staff, Mr. Joe Gaugush and Mr. Steve Smith, for meeting with us
on December 11 , 1991 regarding the status of Tentative Tract 26553. They were very
helpful in answering questions regarding the processing of this tract after the annexation will
take place. It is our understanding that they will be the City's case Planner and Engineer for
this project and that any future correspondence will be addressed to them.
In that December 11 meeting, we discussed the items outlined in our December 11 , 1991
letter to you. A brief summary of the items discussed are listed below:
1. The annexation has been approved by LAFCO and was scheduled for the
protest hearing on December 12, 1991. If significant written protest is not filed
at this hearing approval is expected and, the annexation will record 3 to 4
weeks later. An election is not expected.
2. The site will be zoned PR-5 (Planned Residential) by the City, which allows for
the single family lots, the golf course, and the golf course maintenance building
and operations.
3. The site as shown in the Tentative Map will be recognized by the City. The
Conditions of Approval will also be recognized subject to review by the City
Staff. The City will allow only one,one year, extension beyond the initial two
year period indicated in the Conditions of Approval.
4. The building setbacks will be established in accordance with the PR-5 Zoning.
The coverage will be a maximum of 35%. The Standards in the current
CCBR's for the Avondale Gold Club will also be used.

5. The Park Fee, Signalization Fee, Drainage Fee, Fringe-Toed Lizard Fee, Final
Map Fee, Plan Check Fee's, Bonds, and deposit for monumentation were
confirmed as requiring payment prior to the recordation of the Map. For the
T.U.M.F. Fee, Fire Fee, School Fee, Inspection Fee and the Grading Fee
payment is required when permits are pulled. There are no additional fees
necessary for environmental, entitlement or Tentative Map purposes.
6. The reconfiguration of the site from that as tentatively approved, including the
reduction in the number of lots and the shortening of the cul-de-sacs, were
reviewed and are considered to be in substantial conformance to the Tentative
Map. Therefore, no revisions to the Tentative Map will be required.
7. The concept of mapping the project in two phases, one phase for the single
family lots and one for the golf course lots, was discussed. It was understood
that this was proposed to defer payment of a portion of the drainage fee. It was
also discussed that the golf course lots, Phase II, may never be recorded. The
City staff did not have any objections to this concept and also stated that we
would not have to process a phasing map. It is understood that J.F.
DAVIDSON ASSOCIATES, INC. could submit the Improvement Plans for the
single family lots and that the City would process them without any additional
planning or tentative map activity.
8. The relocation of the existing maintenance building was reviewed and the staff
did not have any objections at this time.
9. The offsite drainage issue was discussed, and the staff inquired about the
volumes of stormwater that might be anticipated vs. the volume of stormwater
that could be contained onsite. This was asked because there may be a
regional storm channel in the future that will convey this water. Therefore, the
staff would consider reducing the design requirements as a temporary solution,
knowing the channel will eventually be built to handle the excess stormwater.
This would also involve allowing the stormwater to pond in the street until it
overflowed the high point and then continued east down Frank Sinatra Drive.
However, this is subject to review upon the presentation of approximate
stormwater volumes associated with the offsite runoff vs. retention volume
available.
10. The staff did not have any objections to the retention basin being located on the
west side of the single family lots; this is not currently shown on the Tentative
Map.

11. The staff mentioned that the Conditions do require the "repair" of El Dorado
Drive as directed by the Director of Transportation. This may also be enforced
by the City.
12. The staff mentioned that the cul-de-sac radius as shown was not adequate for
emergency vehicles. The radius should be 45 feet to the face of curb.
13. The Conditions of approval indicate that Frank Sinatra Drive should be
constructed within a 50 foot half right-of-way with a curb and gutter located 38
feet from the centerline. The City requires that this road be constructed with a
55 foot right-of-way, and a 43 foot roadway with a 9 foot median as shown on
the Tentative Map.
The above summary is our understanding of the issues that were discussed. If there is any
item that is not properly summarized, please notify us at once so that we may correct it.
We currently have a meeting scheduled for January 3, 1991. At that meeting, we would like
to discuss the following issues:
1. Upon your review of the County of Riverside Conditions of Approval, will the
City prepare any formal acceptance of, additions to, or clarifications to these
conditions?
2. On December 19, 1991, 1 faxed a copy of our preliminary stormwater volume
calculations to Mr. Gaugush. Has the City staff reviewed these estimated
volumes? If so, have they established the design criteria to allow this site to
feasibly control the offsite flows?
3. The County has previously approved the plot plan for relocation of the existing
maintenance building. What will be required to process the county approved
plot plan through the City of Palm Desert?
4. What will be the extent of repair to El Dorado Drive? Will this require
improvement plans or will this be limited to resurfacing as directed by the
inspector in the field?
5. Are there any changes to the requirements for landscaping as outlined by the
County? Will this plan be required at the time building permits are issued.

Frank Sinatra Drive, the SPRR right-of-way and Highway 1-10, an acoustical
I analysis of the project has been requested by the Riverside County
Environmental Health Department.

CRITERIA
' California State Criteria:
The "California Noise Insulation Standards" contained in Part 2, Title 24, CCR
,I of the State Building Code, Appendix 35 Sound Transmission Control specify
maximum allowable interior noise level limits, due to exterior noise sources,
for new multiple residential structures. The interior noise standard is Ldn or.
CNEL 45 with doors and windows closed. The code specifies that a
acoustical analysis shall be performed for new residential construction to be
located where the CNEL or Ldn exceeds 60 dB in order to insure that the
interior noise standards will be met. However, detached single family
dwellings are specifically excluded from the standard.
i Riverside County Criteria:
In a memo dated October 4, 1990, Mr. William D. Redden, CIH of the County
of Riverside Department of Health specifies the current Riverside County
noise standards for residential development. The requirements are as

The interior noise levels in residential dwellings shall not exceed 45 Ldn
(or CNEL)
The exterior noise level shall not exceed 65 Ldn*

PROJECT DESCRIPTION
The proposed project is an approximately 8.5 acre parcel located on the
southerly side of Frank Sinatra Drive between Sweetwater Drive and
Eldorado Drive at the northerly end of the Avondale Country Club in the Palm
Desert area of Riverside County. It is to be divided into 22 lots for single
family residences and two lots that will remain as golf course fairways. The
project will include the extension of Mozambique Drive from its present l
northerly terminus to intersect with Frank Sinatra Drive.
The Southern Pacific Transportation Company railroad right-of-way is located
approximately 1100 It northeasterly of the northeasterly corner of the site and
the 1-10 Freeway right-of-way is located approximately 200 ft beyond the
railroad.
NOISE SETTING AND IMPACTS {
Field Measurements: ll
In order to characterize the existing noise environment at the project site and I
to serve as a basis for the subsequent analyses, an acoustical measurement
program was undertaken on November 27, 1990 between approximately 3:30
and 6:30 pm. The measurement microphone was located just north of the
northerly property line near the center of the tract.
The measurements were taken with a Rion type NA-29E precision sound level J
meter octave band real time analyzer connected to a PC compatible Epson
portable computer. Each of the measurement periods was 15 minutes total
duration and consisted of a series of 900 consecutive 1 second time average -I
(LBg1Sed samples. The analyzer simultaneously measured the overall
A-weighted level and the A-weighted level in each of the octave bands over
the range of 31 Hz to 8000 Hz. At the end of each 15 minute period, the --
analyzer calculated statistical levels for the measurement period and all of
the measured and calculated data were transferred to the computer for J
storage on magnetic disk and subsequent laboratory analysis. . Prior to the
measurements, the overall calibration of the system was checked with a 1
Bruel & Kjaer type 4230 acoustic calibrator. The results of the
measurements are summarized in Table 1, below, and copies of the
computer printouts are contained in Appendix B. 1

! ' With usual temporal distribution of traffic, the Ldn is approximately equal
(within 1 dB) to the time average noise level (Leq) during the peak traffic
period. Therefore, on the basis of the measurement data the estimated
present noise exposure at the northerly edge of the site is Ldn 60 to 61 dB.
Future Traffic Noise Modeling:
The projected year 2010 traffic on Highway 1-10 (per Caltrans) is 51,000 ADT
with 1.2% medium trucks and 14% heavy trucks. The time of day distribution
was assumed to be similar to the Riverside County standard for secondary
and larger highways. The average traffic speed was assumed to be 65 mph.
In accordance with the October 4, 1990 County Health Department memo,
the future traffic condition on Frank Sinatra Drive was assumed to be
24,000 ADT (level of service C capacity for a four lane secondary road). The
truck mix and time of day distribution utilized were the County standard mix,
per the same memo, and the average traffic speed was assumed to be
40 mph.

I model based on the FHWA RD-77-108 Highway Noise Prediction Model. The
computer model incorporates the reference noise emission levels contained
in Caltrans Report FHWA/CA/TL-84/13. Calculations were run utilizing both
the standard FHWA hard .site model, per the County memo, and an
alternative model that incorporates atmospheric absorption as well as wave
. spreading effects and thus produces more realistic results at long distances.
The calculated Ldn contour locations for both distance attenuation models are
summarized in Table 2, below. It should be noted, that these calculations
I are for a "bare site" condition and do not include the shielding that would be,
provided by any intervening development and/or roadside barriers.

The County memo specifies that in the absence of specific site information,
the distance from the center of the street to the nearest building face should .
be assumed to be 85 ft. At this distance, the unmitigated exterior noise
exposure at the building, due to the future traffic on Frank Sinatra Drive,
would be approximately Ldn 74 based on either site model. The exterior I
noise exposure due to 1-10, located approximately 1400 ft away, would be
approximately Ldn 71 based on the worst case FHWA hard site model or
approximately Ldn 64 based on the more realistic site model. i
Railroad Noise: r�
The results of recent measurements of two typical SPRR freight operations
taken at a nearby site located approximately one half mile west of this project
site and the same distance from the tracks as this site were as follows:
Eastbound, Leq 60.4 dB for a 2.5 minute sample period
Westbound, LeQ 64.9 dB for a 3.5 minute sample period.
It was recently reported by a representative of SPRR that an average of
approximately 32 trains pass by the site per day, distributed random-
uniformly over 24 hours. This translates to an Ldn weighted (nighttime events
are multiplied by a factor of 10) equivalent number of 140 operations per day.
If it is assumed that the noise produced by an average train event is no
higher than the higher of the two measured operations, the Ldn at the site
due to the railroad operations would be approximately 60 dB.

( Composite Noise Exposure:
The noise exposure at the northerly border of the site due to future design
capacity traffic on Frank Sinatra Drive would be approximately Ldn 74, the
noise due to the future traffic on 1-10 would be a maximum of Ldn 71 based
on the worst case hard site model or approximately Ldn 64 based on the real
site model, and the railroad noise would be approximately Ld, 60. The
composite of these three sources would range from approximately Ldn 74,
assuming the realistic site model for the noise from the 1-10 freeway to a
maximum of approximately Ldn 76 assuming the worst case hard site model
for 1-10.
Thus, this composite exterior noise exposure of approximately Ldn 75 would
require the structures to achieve a minimum of approximately 30 dB of
exterior-to-interior noise reduction in order to conform with the Ldn 45
maximum interior noise criterion.
The County memo also specifies that exterior noise exposures are to be
calculated for a location 10 It from the barrier on the site, at an elevation of
3 ft above the ground. At this location, the unmitigated future noise
exposure would be approximately Ldn 76. Thus, a barrier providing a
minimum of approximately 11 dB of shielding would be necessary to meet the
Ldn 65 exterior noise exposure criterion.
MITIGATION
Outdoor Noise:
Attenuation calculations were run for a barrier constructed at the southerly
edge of the right-of-way of Frank Sinatra Drive, 50 ft from the center of the
street. At the specified location, 3 ft elevation 10 ft from the wall, a top of
wall elevation of 8 ft relative to the finished grade in the yard would reduce
the future noise exposure to below Ldn 65.
The exact details of the barrier construction are not critical, provided that it
is of impervious construction and not less than 4 pounds per square foot
surface density. Concrete block, stucco plaster over wood frame, precast
masonry plank or heavy timber construction would all be acceptable options.
Access gates, if required, should be impervious construction (4 p.s.f.
minimum) as well and should be provided with overlapping stops at the

Since no building plans have been developed for the project, detailed noise
control specifications are not possible at this time. Demonstration of

Normal residential construction with closed, well sealed windows and doors
typically provides approximately 20 dfl of exterior-to-interior noise reduction.
Normal construction with windows open for natural ventilation typically
provides approximately 10 dB of exterior-to-interior noise reduction.
Therefore, since the exterior noise exposure is higher than Ldn 65, closed,
acoustically upgraded windows will be necessary in all areas of the project
to meet the Ldn 45 interior noise criterion.

Since the windows will have to be kept closed at least part of the time in
order to satisfy the Ldn 45 indoor noise criterion, alternative ventilation may
be necessary, per the State and City codes, to provide an acceptable indoor

Definitions
The following is not intended as a comprehensive glossary of acoustic
terminology, however it will provide sufficient information to allow a better
understanding of the technical language contained in this document. _j
■ Decibel (dB) - A unit division on a logarithmic scale whose base is the
tenth root of ten, used to represent ratios of quantities proportional to
power. [In simple terms, if the power is multiplied by a factor of ten,
then ten is added to the representation of the power on the decibel i
scale. If 0 dB represents 1 unit of power, 60 dB represents one million
units, etc.]
■ Sound Pressure Level (SPL - dB) - The ratio, in decibels, of the mean
squared sound pressure to the square of the reference pressure,
20 micropascals.
■ A-weighted Sound Level (SLA - dB) - Sound pressure level measured
using the A-weighting network, a filter which discriminates against low
and very high frequencies in a manner similar to the human hearing
mechanism at moderate sound levels (ref. ANSI S1.4).
■ Time Average Sound Level (L.QT - dB) - The level, in decibels, of the
mean squared sound pressure averaged over time period T. This is
often referred to as the "equivalent sound level" and hence the "eq"
subscript. The equivalence is to a sound of constant level which has
the same total acoustic energy content.

pressure level measured using a band-pass filter whose upper cutoff
frequency is the cube root of two times the lower cutoff frequency, and
which is identified by the nominal geometric center frequency of the
pass band.
■ Sound Spectrum -The representation of an acoustic signal in terms of
its level versus frequency. The most common method for determining
( : the sound spectrum is with an analyzer consisting of a series or bank
of contiguous octave or 1/3 octave band filters and a bar-graph or
numerical tabular display, known as a real-time analyzer
■ Ambient Noise - The noise which results from the combination of all

ambient sound level near or around known sources of noise. In
practice, noise contours are often shown as calculated for the
dominant sources of noise only.

■ Noise Reduction (NR) - The difference in decibels, in a specified
frequency band, between the average sound pressure levels in two
enclosed spaces connected by one or more sound transmission paths
due to a sound source in one of the spaces (ref. ASTM E336).
■ Sound Transmission Loss (TL) - The difference in decibels, in a
specified frequency band, between the sound.power incident on the
"partition' and the sound power transmitted by the partition and
radiated on the receiving side (ref. ASTM E90).
■ Sound Transmission Class (STC) -A single number rating of the sound
isolating capability of a building construction element with to respect
speech, radio, television, and similar sources of noise in offices and
dwellings. The rating is derived from the measurement of the sound I
transmission loss of the element over a series of 16 contiguous 1/3
octave bands centered from 125 Hz to 4000 Hz. The application of the
STC rating to the isolation of sounds due to exterior noise sources
such as motor vehicles or aircraft and sounds due to machinery,
industrial noise sources, transformers, etc., is specifically excluded by
the defining standard (ref. ASTM E413).

TENTATIVE TRACT NO. 26553 AMENDED NO. 1
The tentative land division shall comply with the state of California
Subdivision map Act and to the requirements of Riverside County Ordinance
No. 460, Schedule A, unless modified by the conditions listed below.
This approved tentative parcel map will expire two years after the Board
of Supervisors approval date of July 23, 1991 unless extended as
provided by Ordinance No. 460. Approval of a revised map or minor
change will not extend the life of the tentative map.
1. The land divider shall defend, indemnify, and hold harmless the
County of Riverside, its agents, officers, and employees from any
claim, action, or proceeding against the County of Riverside or its
agents, officers, or employees to attack, set aside, void, or annul
an approval of the County of Riverside, its advisory agencies,
appeal boards or legislative body concerning Tentative Tract
Map No. 26553, Amended No. 1 which action is brought about within
the time period provided for in California Government Code Section
66499.37. The County of Riverside will promptly notify the land
divider of any such claim, action, or proceeding against the County
of Riverside and will cooperate fully in the defense. If the County
fails to promptly notify the land divider of any such claim, action,
or proceeding or fails to cooperate fully in the defense, the land
divider shall not, thereafter, be responsible to defend, indemnify,
or hold harmless the County of Riverside.
2. All road easements shall be offered for dedication to the public as.-
required by the Road Commissioner and shall continue in force until
the governing body accepts or abandons such offers. All dedications
shall be free from all encumbrances as approved by the Road
Commissioner. Street names shall be subject to approval of the
Road Commissioner.
3. . Easements, when required for roadway slopes, drainage facilities,
utilities, etc. , shall be shown on the final map if within the land
division boundary. All offers of dedication shall provide for
non-exclusive public road and utility access. All easements, offers
of dedication and conveyances shall be submitted and recorded by the
County Surveyor.

4. Legal access as required by Ordinance No. 460 shall be provided from
the parcel map boundary to a county maintained road.
5. All delinquent property taxes shall be paid prior to recordation of
the final map.
6. If any grading is proposed, the subdivider shall submit one print of
a comprehensive grading plan to the Riverside County Surveyor's
Office. The Plan shall comply with the Uniform Building Code,
Chapter 70, as amended by Ordinance 457. A grading permit shall be
obtained from the Department of Building and Safety prior to
commencement of any grading outside of County maintained right-of-
way. Proposed grading in excess of quantities indicated in
Ordinance 457 may require environmental assessment approval from the
Planning Department prior to acceptance of the plans by the Building
Department. One mylar copy of the approved grading plan shall be
submitted to the Department of Building and Safety for transmittal
to the Road Department.
7. The subdivider shall submit one copy of a soils report to the
Riverside County Surveyor's Office and two copies to the Department
of Building and Safety. The report shall address the soils
stability and geological conditions of the site.
*8. The land divider shall comply with the street improvement
recommendations outlined in the Transportation Department's letter
dated December 26, 1990, a copy of which is attached.
9. The land divider shall install all water and sewage disposal
facilities in accordance with the-provisions set forth in the Health
Department's letter dated December 20, 1990, a copy of which is
attached.
10. The land divider shall comply with the flood control recommendations
outlined by the Coachella Valley Water District's letters dated
January 8, 1991, December 14, 1990 and October 30, 1990, copies of
which are attached. If the land division lies within an adopted
flood control drainage area pursuant to Section 10.25 of Ordinance
No. 460, appropriate fees for the construction of area drainage
facilities shall be collected by the Road Commissioner prior to
recordation of the final map.

the requirement for sidewalks within interior streets of the proposed land

11. The land divider shall provide fire protection improvements in
accordance with the Fire Marshal's letter dated December 10, 1990,
a copy of which is attached.
12. The land divider shall comply with the land use and grading
recommendations outlined in the Department of Building and Safety's
memorandums dated December 18, 1990 and December 18, 1990, copies of
which are attached.
13 . The land divider shall comply with the water and sewer service
recommendations contained in the Coachella Valley Water District
letter dated October 30, 1990, a copy of which is attached.
14. The land divider or the land divider's successor-in-interest shall
comply with the recommendations outlined in the Riverside County
Health Department's Division of Special Services transmittal dated
December 13, 1990, a copy of which is attached.
15. The Habitat Conservation Plan has identified this parcel map as
being within the boundaries of the mitigation area of the Coachella
Valley Fringe-toed Lizard. PRIOR TO THE RECORDATION OF THE FINAL
MAP OR ISSUANCE OF ANY GRADING PERMITS OR BUILDING PERMITS,
whichever occurs first, the land divider shall submit to the
Riverside County Surveyor's Office a document which demonstrates to
the satisfaction of the County that the land divider has provided
sufficient mitigation for the taking of habitat area. The total
amount of land to be disturbed by this project will be 12 acres, and
no improvements are authorized that will disturb an area in excess
of this amount of land unless additional sufficient--mitigation has..
been provided.
16. The land divider shall comply with the recommendations outlined in
the Coachella Valley Recreation and Park District's transmittals
dated October 22, 1990 and January 3, 1991.
17. PRIOR TO THE RECORDATION OF THE FINAL MAP, the land divider shall
submit written clearances to the Riverside County Transportation
Department that all pertinent requirements outlined in the attached

36. No environmental assessment for grading within the project
boundaries shall be required provided such grading substantially
conforms to the grading plan submitted as part of the approved
tentative map. The land divider shall comply with all conditions of
approval and ECS notes requiring performance prior to the issuance
of grading permits.
37. The land owner shall institute blowsand and dust control measures
during grading and site development. These shall include but not be
limited to: a) The use of irrigation during any construction
activities; b) planting of cover crop or vegetation upon previously
graded but undeveloped portions of the site; and, c) provision of
windbreaks or windrows, fencing, and/or landscaping to reduce the
effects upon adjacent properties and property owners. The
landowner shall comply with directives of the Director of the
Building and Safety Department with regards to the applicable

used to prevent the emission of dust and blowsand.
38. Graded but undeveloped land shall be maintained in a condition so as
to prevent a dust and blowsand nuisance and shall be either planted
with interim landscaping or provided with other wind and water
erosion control measures as approved by the Director of Building and
Safety and state air quality management authorities.
39. PRIOR TO THE ISSUANCE OF BUILDING OR GRADING PERMITS, the land �.
divider, or the land divider's successor-in-interest, shall enter
into an agreement with the Department of Building and Safety for the
planting of street trees in connection with the development of this

and phone number of both the landscape plan preparer and project
developer, the property's Assessors Parcel Number(s) , a vicinity
map, and the proposed location of all. handicapped parking spaces,
trash collection and storage facilities, wall/fence elevations,
drainage patterns, Agricultural Commissioner's note and any outdoor I )
lighting shall be shown on this plan. Landscaped areas shall be
graded to retain all irrigation water on-site. All plans that
depict landscaping within public road rights-of-way shall be
submitted to the Road Department for approval. All landscaped areas
shall be maintained in a viable growth condition throughout the life
of this permit. PRIOR TO FINAL BUILDING INSPECTION APPROVAL of the `
first dwelling, excluding model sales units, the permittee shall
install all improvements as shown on the approved plan.
42. PRIOR TO FINAL BUILDING INSPECTION APPROVAL, each applicable
dwelling unit shall incorporate window and exterior wall, roof and �QQ�
other design specifications identified in the acoustical analysis
prepared on by- Walker, Celano 6 .Associates in December 1990. � r
Alternative wall and roof design may be submitted upon written

decorative masonry wall or combination landscaped earthen berm and
decorative masonry wall shall be constructed along the project's
northern boundary adjacent to Frank Sinatra Drive (see Health
Department Special Division letter dated December 20, 1990) and a
six (6) foot high decorative masonry wall shall be constructed along
those portions of the project's western and eastern perimeters where
no six (6) foot high (measured from finish grade level on the
project site property) decorative block wall(s) exist. The wall
and/or berm shall be subject to the approval of the Director of
Building and Safety, and the appropriate flood control agency, .and7

44. Notwithstanding the preceding conditions, wherever an acoustical
study is required for noise attenuation purposes, the heights of all

Gentlemen:
With respect to the conditions of approval for the above referenced tentative land
division map, the Transportation Department recommends that the landdivider provide the
following street improvement plans and/or road dedications in accordance with Ordinance
No. 460 and Riverside County Transportation Improvement Standards (Ordinance No. 461).
It is understood that the tentative map correctly shows acceptable centerline profiles,
all existing easements, traveled ways, and drainage courses with appropriate Q's, and
that their omission or unacceptability may require the map to be resubmitted for further
consideration. These Ordinances and the following conditions are essential parts and a
requirement occurring in ONE is as binding as though occurring in all . They are intend-
ed to be complementary and to describe the conditions for a complete design of the
improvement. All questions regarding the true meaning of the conditions shall be
referred to the Office of the Director of Transportation.
1 . The landdivider shall protect downstream properties from damages caused
by alteration of the drainage patterns, i .e. , concentration or diversion
of flow. Protection shall be provided by constructing adequate drainage
facilities including enlarging existing facilities and/or by securing a
drainage easement. All drainage easements shall be shown on the final map
and noted as follows: "Drainage Easement - no building, obstructions-;-or--- ---
encroachments by land fills are allowed". The protection shall be as
approved by the Transportation Department.
2. The landdivider shall accept and properly dispose of all offsite drainage
flowing onto or through the site. In the event the Director of Transpor-
tation permits the use of streets for drainage purposes, the provisions of
Article XI of Ordinance No. 460 will apply. Should the quantities exceed
the street capacity or the use of streets be prohibited for drainage
purposes, the subdivider shall provide adequate drainage facilities as
approved by the Transportation Department.

* 3. Mozambique Drive shall be improved within the dedicated right-of-way in
accordance with County Standard No. 105, Section "A" (361/601 ) modified
by widening to accommodate four car vehicular storage from the stopping
position for gate actuation and the curb face of Frank Sinatra Drive and
a turn around area with a minimum 38-foot turning radius. This street
shall be extended southerly as necessary to connect with existing paved
streets. Sidewalk is not required.
* 4. Street "A" shall be improved within the dedicated right-of-way in accord-
ance with County Standard No. 105, Section "A" (36'/60' ). Sidewalk is
not required.
5. Frank Sinatra Drive shall be improved with 8-inch concrete curb, gutter
and 6-foot wide concrete sidewalk located 38 feet from centerline and }
/xych-up asphalt concrete paving; reconstruction; or resurfacing of
sting paving as determined by the Director of Transportation within a
C5 -foot half-width dedicated right-of-way in accordance with County
Standard No. 101. Improvements shall include the construction of a
barrier curb median.
6. Eldorado Drive shall be improved with asphalt concrete reconstruction or
resurfacing of existing paving as determined by the Director of Transpor-
tation.
7. A secondary access shall be constructed in accordance with County Standard
No. 106, Section "B", (32'/60' ).

This subdivision has a statement from Coachella Valley
Municipal Water District agreeing to serve domestic water to
each and every lot in the subdivision on demand providing
satisfactory financial arrangements are completed with
the subdivider . It will be necessary for financial
arrangements to be made prior to the recordation of
the final map .
This subdivision is within the Coachella Valley Municipal
Water District and shall be connected to the sewers of the
District . The sewer system shall be installed according to
plans and specifications as approved by the District , the
County Surveyor and the Health Department . Permanent prints
of the plans of the sewer system shall be submitted in
triplicate , along with the original drawing , to the County
Surveyor . The prints shall show the internal pipe diameter .
location of manholes , complete profiles , pipe and joint
specifications and the size of the sewers at the junction of
the new system to the existing system. A single plat
indicating location of, sewer lines and water lines shall be
a portion of the sewage plans and profiles . The plans shall
be signed by a registered engineer and the sewer district
with the following certification: "I certify that the
design of the sewer system in Tract Map 26553 is in
accordance with the sewer system expansion plans of the
Coachella Valley Municipal Water District and that the waste
disposal system is adequate at this time to treat the
anticipated wastes from the proposed tract map. "

The consultant's assessment of this project is accurate.
Recommendations:
The following conditions shall be applied to the project
based on the information provided by the acoustical
consultant:
1. Seven foot noise barrier, block wall, berm or
combination shall be constructed along Frank Sinatra
Drive (Lots 116 to Ila and 119 to 122, and
continuing west to the end of the cul-de-sac of
Street "A") . These walls shall be erected so that
the top of each wall extends at least 7 feet above
the pad elevation. In cases where the road is
elevated above the pad, the wall shall extend at
least 7 feet above the highest point between the
house and the road.
2. Prior to issuance of building permits, an acoustical
report shall be submitted and receive approval from
Riverside County Health Department, Division of
Special Services. The acoustical consultant shall
design specifications for first second stories of
the dwellings along Frank Sinatra so that a 74.6 Ldn
- unshielded (as projected at 65 feet from the .
center of Frank Sinatra Drive) will be reduced to
an interior level of 45 Ldn.
3. The applicant shall pay review fees to the Division
of Special Services, Riverside County Health
Department, not to exceed the Division's Hourly
Rate.

Drainage from this area is contributory to the Mid-Valley Stormwater Project.
The interim flood control study for this project is presently being reviewed for
adoption by the affected agencies. Mitigation measures shall be incorporated
into the development to prevent flooding of the site or downstream properties.
These measures shall include on-site retention of water from the 100-year storm,
and payment of drainage fees or other participation in the financing of regional
flood control facilities.
Plans for stormwater protective works shall be submitted to Coachella Valley
Water District for review.
The district will furnish domestic water and sanitation service to this area in
accordance with the current regulations of this district. These regulations
provide for the payment of certain fees and charges by the subdivider and said
fees and charges are subject to change.
This area shall be annexed to Improvement District Nos. 16 and 70 of Coachella
Valley Water District for domestic water service.
This area shall be annexed to Improvement District Nos. 58 and 81 of Coachella
Valley Water District for sanitation service.
There are existing district facilities not shown on the development plans.
There may be conflicts with these facilities. We request the appropriate public
agency to withhold the issuance of a building permit until arrangements have
been made with the district for the relocation of these facilities.

With respect to the conditions of approval for the above referenced land division,
the Fire Department recommends the following fire protection measures be provided
in accordance with Riverside County Ordinances and/or recognized fire protection
standards:
1. Schedule A fire protection approved Super fire hydrants, (6" x 4" x 2}" x
2}") shall be located at each street intersection spaced not more than 330
feet apart in any direction with no portion of any frontage more than 165
feet from a fire hydrant. Minimum fire flow shall be 1000 gpm for 2 hours
duration at 20 psi.
2. Prior to recordation of the final map, applicant/developer shall furnish
one blueline copy of the water system plans to the Fire Department for
review/approval. Plans shall conform to the fire hydrant types, location
and spacing, and the system shall meet the fire flow requirements. Plans
shall be signed/approved by a registered civil engineer and the local water
company with the following certification: "I certify that the design of the
water system is in accordance with the requirements prescribed by the
Riverside County Fire Department."
3. The required water system including fire .hydrants shall be installed and
accepted by the appropriate water agency prior to any combustible building
material being placed on an individual lot.
A temporary water supply for fire protection may be allowed for the
construction of model units only. Plans for a temporary water system must
be submitted to the Fire Department for review prior to issuance of building
permits.
4. MITIGATION
Prior to the recordation of the final map, the developer shall deposit with
the Riverside County Fire Department a sum of $400 per lot/unit as mitigation
for fire protection impacts.
5. Gates installed to restrict access shall be power operated and equipped
with a Fire Department override system. Improvement plans for the entry
street and gates shall be submitted to the Fire Department for review/approval
prior to installation.

on a contrasting background.
- Landscaping design should eliminate areas which might
conceal criminal activity.
- As population increases, an increase in calls for service
can be expected. This will impact fire, medical and
law enforcement services.

I would like to thank your staff, Mr. Joe Gaugush and Mr. Steve Smith, for meeting with us,
on December 11, 1991 regarding the status of Tentative Tract 26553. They were very. .
helpful in answering questions regarding the processing of this tract after the annexation will '
take place. It is our understanding that they will be the City's case Planner and Engineer for
this project and that any future correspondence will be addressed to them.
In that December 11 meeting, we discussed the items outlined in our December 11, 1991.
letter to you. A brief summary of the items discussed are listed below:
1, The annexation has been approved by LAFCO and was scheduled for the
protest hearing on December 12, 1991. If significant written protest is not filed
at this hearing approval is expected and, the annexation will record 3 to 4 =
weeks later. An election is not expected.
2. The site will be zoned PR-5 (Planned Residential) by the City, which allows for
the single family lots, the golf course, and the golf course maintenance building
and operations.
3. The site as shown in the Tentative Map will be recognized by the City. The
Conditions of Approval will also be recognized subject to review by the City
Staff. The City will allow only one,one year, extension beyond the initial two
year period indicated in the Conditions of Approval.
4. The building setbacks will be established in accordance with the PR-5 Zoning. .,
The coverage will be a maximum of 35%. The Standards in the current
CC&R's for the Avondale Gold Club will also be used.

and address the additional issues.
