CASE NO. TT 27698 WHEREAS, the Planning Commission of the City of Palm Desert, California, did on the 7th day of December, 1993, hold a duly noticed public hearing and continued public hearing on the 4th day of January, 1994 , to consider the request of TEMPLE CONSTRUCTION for the above mentioned map; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89 , " in that the director of community development has determined that the project has been previously assessed in connection with Case Nos . DP 09-79 and TT 15000 and no further documentation is deemed necessary; and WHEREAS, at said public hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said planning commission did find the following facts and reasons to exist to justify approval of the tentative tract map: (a) That the proposed map is consistent with applicable general and specific plans . (b) That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans . (c) That the site is physically suitable for the type of development. (d) That the site is physically suitable for the proposed density of development . (e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. ( f) That the design of the subdivision or the type of improvements is not likely to cause serious public health problems . (g) That the design of the subdivision or the type of improvements will not conflict with easements, acquired by the. public at large, for access through or use of property within the proposed subdivision. WHEREAS, in the review of this tentative tract map the planning commission has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environs , with available fiscal and environmental resources . TT 27698 Department of Community Development/Planning: 1 . Removal of six lots from this portion of the project does not provide for their addition elsewhere. Riverside County Fire Marshal : 1 . A fire flow of 2500 g.p.m. for a 2 hour duration at 20 psi residual operating pressure must be available before any combustible material is placed on the job site. 2 . The required fire flow shall be available from a Super hydrant(s) ( 6" x 4" x 2 1/2" x 2 1/211 ) , located not less than 25 ' nor more than 165 ' from any portion of the building(s) as measured along _ approved vehicular travelways . 3 . Provide written certification from the Coachella Valley Water District that hydrants will be installed and will produce the required fire flow, or arrange field inspection by the Fire Department prior to request for final inspection. 4 . Prior to the application for a building permit, the developer shall furnish the original and two copies of the water system plan to the County Fire Department for review. No building permit shall be issued until the water system plan has been approved by the County Fire Chief . Upon approval, the original will be returned. One copy will be sent to the responsible inspecting authority. 5 . Plans shall conform to fire hydrant types, location and spacing, and the system shall meet the fire flow requirements . PUBLIC HEARINGS �A Continued Case No. TT 27698 - TEMPLE CONSTRUCTION, Applicant Request for approval of a tentative tract map to re-subdivide a portion of Tract 15000-1 . MINUTES PALM DESERT PLANNING COMMISSION JANUARY 4, 1994 Mr. Winklepleck indicated that this item was continued at the December 7, 1993 meeting to allow the applicant to meet with home owners in an effort to alleviate their concerns . The applicant felt that had been accomplished. Mr. Winklepleck stated that the request was a refiling of a previous map (TT 23151) which was approved by commission in 1988, but had not been finaled. He said this map would redefine the entryway at Desert Falls Country Club and no new construction would result from this map. Staff recommended approval subject to the conditions . Commissioner Whitlock noted that the staff report indicated that the area would be used for open space/recreational amenities . She asked what recreational amenities were proposed. Mr. Winklepleck replied none, it would be as it was right now--the open space/recreational amenities was the fountain and landscaped areas . Chairman Spiegel opened the public testimony and asked the applicant to address the commission. MR. DAN KIPPER, J. F. Davidson, 3880 Lemon Street in Riverside, said that he was the engineer for the project and represented Temple Construction. As stated by Mr. Winklepleck, this was a refiling of a previous map and all the conditions of approval had been met and improvement plans and final map had been approved by the city engineer. He said he appreciated staff ' s help in the refiling and indicated that they had been unable to record the map previously in the legally prescribed time. No new structures would be added; the map would delete six .lots previously recorded and create six lots for the six existing structures . Chairman Spiegel asked why there was a certain amount of animosity expressed by residents . Mr. Kipper replied that it had to do with the association, maintenance and assessment issues, which did not effect the map and was more of a civil matter than a land use matter. Chairman Spiegel asked if anyone wished to speak in FAVOR or OPPOSITION to the proposal . There was no one and the public testimony was closed. 2 MINUTES PALM DESERT PLANNING COMMISSION JANUARY 4, 1994 Action: Moved by Commissioner Whitlock, seconded by Commissioner Jonathan, approving the findings as presented by staff. MISCELLANEOUS A. SECTION 4 PRESENTATION BY LON RUBIN AND PBR. Mr. Winklepleck introduced Mr. Lon Rubin, who would be giving the presentation. MR. LON RUBIN, with Palm Desert Golf Partners at 77-570 Springfield Lane, Suite D in Palm Desert, said that on December 20, 1993 they made a presentation to the city council on the progress they had made on their plan to develop Section 4 . As a result of that presentation, city council recommended that they schedule as soon as possible a study session with the planning commission to get their input on their plan because they were on a fast track to finalize a preferred plan by the end of January so they could be in a position to file for their environmental impact report the first of February. They had a project schedule that was fairly ambitious, but was in keeping with council ' s wish to stay on a fast track. Hopefully by the end of July the project would be approved. First, they had to make a presentation of their present plan and get comments and suggestions . He introduced Mr. Ken Ryan and Mr. Mike Doty with the planning firm PBR. He turned the meeting over to Mr. Ryan to describe the details of the current plan. MR. KEN RYAN, PBR, said he would provide a brief overview of how they got to where they are today with the plan and the specific elements of the concept and answer any questions . He indicated that their booklet provided the concept for the plan, the schedule and a brief overview of the primary elements and direction they had received and the city's vision for the property. BACKGROUND: This case was continued from the December 7, 1993 planning commission meeting to allow the applicant to meet with more homeowners in order to alleviate concerns regarding this map. According to the applicant, this has been accomplished. II . DISCUSSION• This tentative tract map is a refiling of TT 23151 which was approved by the planning commission on February 18, 1988 . The map was not finaled within the time limits prescribed by law, and subsequently, lost its approval status . The purpose of this map is to redefine the entryway at the Villas at Desert Falls . The map will retain six lots containing existing structures with the remaining lots eliminated to provide for an open space/recreational amenity. The elimination of six lots on this site does not provide for six additional lots elsewhere. Approval of this map will not result in the construction of additional units . III . RECOMMENDATION: A. PUBLIC HEARINGS Chairman Spiegel explained to the audience that for Public Hearing Item B - Case No.� TTI2 67 98 the applicant was requesting a continuance to the first meeting in January (January 4, 1994) to get together with the homeowners and try to work out concerns . A lady from the audience asked about the legal noticing of the hearing in the newspaper and objected that it was placed in the Desert Post instead of the Desert Sun. Mr. Diaz explained that the Desert Post was used because it was a newspaper that had legal judication. He said staff attempted to notify everyone within 300 feet on the latest equalized assessment rolls and hoped that neighbors talked with each other and informed others . He also noted that anyone could give planning staff self-addressed stamped envelopes and the agendas would be mailed to them. The lady in the audience stated that she felt that more people would be reached if the notice was placed in the Desert Sun. A. Case No. CUP 93-9 - CIRKO INC. , Applicant Request for approval of a conditional use permit and negative declaration for a 5780 square foot family billiard parlor and entertainment center licensed for the sale of beer and wine at 73-608 Highway 111. Mr. Smith explained that the building was constructed in 1986 as a furniture store with 20 parking spaces on the north side of the building adjacent to Alessandro. The proposal was for the billiard room, an entertainment room to offer darts, snacks, beer, wine and soft drinks . He noted the property was zoned commercial and designated commercial in the general plan. A conditional use permit was required as part of getting approval from Alcoholic Beverage Control . As well, billiard parlors were a conditional use in the C-1 zone. Staff considered parking and impacts on nearby properties . The ordinance required parking at a ratio of two spaces per billiard table. The facility was proposing 18 tables so 36 parking spaces would be required. As indicated, the onsite parking lot would provide 20 parking spaces, the street parking in the frontage road between San Pablo and the slip ramp at the east end of this property from Highway Ill would provide 78 additional parking spaces . , Mr. Smith noted that 2 MINUTES PALM DESERT PLANNING COMMISSION DECEMBER 7, 1993 Chairman Spiegel asked if this had been reviewed by the Sheriff ' s department. Mr. Smith said staff had not received any comments from them. Chairman Spiegel questioned the necessity of the business to remain open until 2 : 00 a.m. Mr. Diaz said that a condition could be placed that the 2 : 00 a.m. closing time was approved for a six month period and if any complaints were received, then the hours would be reduced. He clarified that if there was a problem after the six months, the city could still review the hours of operation. He said another alternative was to alert the applicant that the city was concerned about what happened there late at night. Commissioner Jonathan said that with the added conditions, he would move for approval . Carried 4-0 . 1 Case No. TT 27698 - TEMPLE CONSTRUCTION, Applicant �1 Request for approval of a tentative tract map to re-subdivide a portion of Tract 15000-1 . Chairman Spiegel opened the public hearing and indicated that this matter would be continued. Mr. Winklepleck said that he wanted to provide some clarification. Approval of this map would not result in the construction of any additional units . The tract map request was a refiling of Tract 23151 which the planning commission approved in February of 1988 . The units on the map were actually built under Tract 15000-1 . After building the first six units they decided to put in a cul-de- sac road and what happened was that two years after the approval, the applicant did not get the map finaled within the time limit so it reverted back to the original configuration. The developer was refiling the map to clean up the existing situation. No physical changes to the site would take place. 6 MINUTES PALM DESERT PLANNING COMMISSION DECEMBER 7, 1993 Chairman Spiegel noted that there was concern on the part of the residents . Mr. Winklepleck concurred. He indicated that letters had been received and he had spoken to approximately 30 people about it. Chairman Spiegel said that he assumed the developer between now and the January 4 meeting would attempt to get together with the people that live there. Mr. Winklepleck said that was staff ' s suggestion to him that he request a continuance to speak with the homeowners associations to clarify as many things as possible. Case No. ZOA .93-2 - CITY OF PALM DESERT, Applicant Request for consideration of an amendment to the zoning ordinance to establish a definition for "fast food restaurants" . Mr. Smith explained that during the processing of the commercial complex known as Desert Springs Marketplace at Country Club and Cook Street, a condition was placed , that there would not be any fast food restaurants . The city did not have a definition of fast food restaurant so that was what was being done now. He read the definition and explained that when staff started having questions coming up as to what a fast food restaurant was, staff went to council and asked them their intent; they said to come back with a definition and this was what they came up with. Staff recommended that planning commission recommend approval of the definition to city council and codify the definition for fast food restaurants . Chairman Spiegel noted that the last sentence said delivered food items would not be counted in the take out or to go category. He indicated that Domino' s Pizza would not be considered fast food because they deliver most of their food; Mr. Smith said that was correct. The question was raised because of a chinese restaurant that wanted to locate in the center. Mr. Diaz felt the concern with the shopping center wasn' t the type of people the food was delivered to, but the type of people who might go and get the food. The map will retain six lots containing existing structures with the remaining lots eliminated to provide for an open space/recreational amenity. My response will refer to the Item number set forth in the Deficiency. Those items not addressed in this correspondence will be addressed directly by Lisa Alexander of Fidelity Title. ITEM-I-R-2 : 1. As I am sure you are aware, the Desert Falls project has a quite complicated history. Without belaboring the point, Tract No. 23151 encompasses six (6) fully completed condominium units on Lots 1 through 6 of Tract No. 15000-1 and completed Common Area improvements. Lots 1 through 6 of Tract No. 15000-1 were annexed to the Desert Falls Homeowners Association and have been paying assessments since 1984 . Lots 7 through 12 were never improved and never annexed to the Association. All Common Area and unimproved Lots were acquired by the Subdivider pursuant to a Federal Bankruptcy Court Plan of Re-organization. The recording of Tract No. 23151 is being accomplished by the Subdivider merely to reflect "as built" conditions on such Tract. All improvements on Tract No. 23151 have been completed. 2. Tract No. 23151 is a short distance from Tract No. 19814-1. 'However, pursuant to a highly negotiated Settlement Agreement with the existing Desert Falls Homeowners Association, dated December, 1990 ("Settlement Agreement") Tract Nos. 23151 PALMIERI,TYLER,WIENER,WILHELM&WALDRON Mr. Rick Masters February 7, 1991 Page 2 and 19814-1 will be combined in the Courtyard Project. This arrangement is reasonable for the following reasons: (i) the properties are contiguous connected by Lot F of Tract No. 15000- 1; (ii) Tract No. 23151 will constitute a "bubble" whether annexed to Tract .No. 19814-1 property or the existing Desert Falls Homeowners Association; (iii) as reflected in the Project budget, no unreasonable burden is placed upon the proposed Homeowners Association by reason of the inclusion of Tract No. 23151 within the development; and (iv) the omnibus Settlement Agreement between the Subdivider and the Desert Falls Homeowners Association will fail without inclusion of Tract No. 23151 within the Courtyard project. 3 . The granting of exclusive easements over those portions of the Common Area lots is necessary because of the original subdivision of Tract No. 19814-1. As you may recall, the Subdivider acquired Tract No. 19814-1 through a Bankruptcy Re- organization. Unfortunately, the Common Area lots within Tract No. 19814-1 were not divided in a manner to accommodate Phased construction. Rather, there are blanket Common Area lots as described in the Application. The grant of exclusive easements over portions of such Lots based upon metes and bounds descriptions engineered by the Subdivider is fully consistent with both the Subdivision Map Act and the Subdivided Lands Law. All Owners within the Project are assured of the full use of such portions of the Common Area until such time as the Project is built out. Pursuant to the Department of Real Estate policy, such easement will not be subject to any blanket monetary encumbrance. 4 . The original budget for Tract No. 15000-1 contemplated a 100-Lot built out budget. However, the Subdivider' s predecessor in interest, never constructed units on Lots 7 through 12 of Tract No. 15000-1. Again, the Subdivider' s predecessor in interest went bankrupt and the Subdivider has agreed not to construct any further dwelling units on Tract No. 23151 (which encompasses Lots 7 through 12 of Tract No. 15000-1) . The Settlement Agreement includes a monetary payment for any assessment deficiencies. ITEM-5-A-4• Attached to the application is a copy of the proposed Recreational Facilities Agreement between the Courtyard Homeowners Association and the owner of the Recreational Facility. The form of such agreement is the same as the form approved for use with the adjacent Villas at Desert Falls. ITEM-34-A Attached to the application is a form of Subsidy/Maintenance Agreement by the Subdivider will maintain and subsidize the maintenance of the Common Area. ITEM-23139 . 1. Yes, a Notice of Completion recorded against a portion of a overall Common Area Lot is valid as to Mechanic's Liens. As discussed earlier, the Subdivider's proposal with respect to portions of the Common Area is fully consistent with both the Subdivision Map Act, Subdivider Lands Law and applicable sections of the Civil Code pertaining to Mechanic' s Liens. 2. We will incorporate the cluster PD language attached to. this letter in the Irrevocable Escrow Instructions. ITEM-40-B. Again, grant of an exclusive easement to the Homeowners Association with respect to those portions of a blanket Common Area lot included within a particular Phases is fully consistent with the Subdivision Map Act and Subdivided Lands Law. As set forth above, vehicular and pedestrian ingress and egress to the subdivision is provided through the Grant of Easement and Agreement between Landowners attached to this letter. ITEM-46. 1. Pursuant to the Settlement Agreement, all of Tract No. 19814-1 will be de-annexed from the existing Desert Falls Homeowners Association.
