SUBJECT: EXTENSION OF TIME ON TENTATIVE MAP 27770
Dear Mr. Wolfe:
In furtherance of our recent conversation, the following is
provided.
Tentative Tract 27770 was approved under the County of
Riverside on August 24, 1993. That initial approval was for a 24-
month time period. In September 1993, the State of California
legislature added Section 66452. 11 to the Government Code. This
particular section provided - for an automatic two-year time
extension to any tentative map which had not expired at the time of
legislative action. In the case of Tract 27770, this legislative
action extended the expiration date to August 24, 1997 . The map is
still subject to one-year time extensions (maximum three) as
provided in current city and state statutes .

Steve Smith reported that Eric Johnson had reviewed the
landscape plans and requested bender board instead of the
proposed border. He also indicated that the plan was
over planted with shrubs . Mr. Smith indicated that
Commissioner Connor had also noted some concerns on the
plan.
Action•
It was moved by Commissioner Connor, seconded by
Commissioner Urrutia, to approve the landscape plan
subject to compliance with Eric Johnson and Wayne
Connor' s noted conditions to the satisfaction of staff.

The Board of Supervisors has taken the following action on the above
referenced tentative map at its regular meeting of AUGUST 24 , 1993 .
X APPROVED tentative map subject to the attached
conditions.
The . tentative map has been found, unless denied or withdrawn, to be
consistent with all pertinent elements of the Riverside County Comprehensive
General Plan and is in compliance with the California Environmental Quality .
Act of 1970.
A conditionally approved tentative map shall expire 24 months after the
approval at the Board of Supervisors hearing unless within that period of
time a final map shall have been approved and filed with the County Recorder.
Prior to the expiration date, the land divider may apply in writing for an
extension of time. Application shall be made to the Planning Director thirty
(30) days prior to the expiration date of the tentative map. The Board of
Supervisors may extend the period for one year and upon further application
a second and a third year.
A revised map or minor change approval does not extend the life of the
tentative map.

18. PRIOR TO THE RECORDATION OF THE FINAL MAP, the land divider shall
submit written clearances to the Riverside County Transportation
Department that all pertinent requirements outlined in the attached
conditions relating to the following agencies have been met:

19. PRIOR TO THE ISSUANCE OF A GRADING PERMIT, the land divider shall
prepare and submit a written report to the Planning Director of the
County of Riverside demonstrating compliance with those conditions
of approval and mitigation measures of this map and E. A. No. 36490
which must be satisfied prior to the issuance of a grading permit.

The Planning Director may require inspection or other monitoring to
assure such compliance.
20. PRIOR TO RECORDATION OF THE FINAL MAP, Change of Zone No. 5809 shall
be approved by the Board of Supervisors and shall be effective; to
be effective includes, but is not limited to, the adoption of the
final zoning map by the Board of Supervisors. This land division
shall conform with the development standards of the zone(s)
ultimately applied to the property.
21. This land division shall coordinate with Tract Maps 23239 and 23240
to the north and the approved conditions thereof. Residential lots
created by this land division shall be in conformance with the
development standards of the R-2-8,000 zone.

22. Land division phasing, including any proposed common open space area
improvement phasing, if applicable, shall be subject to Planning
Department approval pursuant to Section 8.3 of ordinance No. 460.
Any proposed phasing shall provide for adequate vehicular access to
all lots and shall conform to the intent and purpose of the
approval. No approval for any number of units or phases is given
except as provided by Ordinance No. 460.
23. PRIOR TO THE RECORDATION OF THE FINAL MAP, the land divider shall
file an application with the Transportation Department for the
formation of, or annexation to, a maintenance district for the
parkways and median strip located in Country Club Drive in
accordance with the Landscaping and Lighting Act of 1972, unless the
land division is within an existing maintenance district.
24. PRIOR TO THE RECORDATION OF THE FINAL MAP, the land divider shall
submit four (4) copies of a final Design Manual, Exhibit M, to the
Planning Department for approval reflecting any and all amendments
to the approved tentative map and conditions of approval.
25. PRIOR TO RECORDATION OF THE FINAL MAP, the land divider shall
furnish to the satisfaction of the Transportation Department, Fire
Department and Planning Department sufficient evidence of having
obtained a minimum of two (2) emergency access points to serve this
tract and contiguous development at locations acceptable to the Fire
Chief and the Director of the Transportation Department; the
emergency access shall, at a minimum, comprise of a 25 foot wide
paved or all weather driveway which may be gated as approved by the
Fire Chief. The tract map C,C&Rs shall provide for appropriate
maintenance and ownership of the emergency access points and
driveways. Use of these emergency access points is intended for
emergency purposes only, and shall be restricted as directed by the
Fire Chief and the Director of the Department of Transportation.
26. PRIOR TO RECORDATION OF THE FINAL MAP, the land divider shall submit
the following documents and fees to the Planning Department for
review, which documents shall be subject to the approval of that
department and the Office of the County Counsel:
1) A declaration of covenants, conditions and restrictions;
and
2) A sample document conveying title to the purchaser of an
individual lot or unit which provides that the declaration
of covenants, conditions and restrictions is incorporated
therein by reference; and

3) The current fee required pursuant to Ordinance No. 671 at
the time covenants, conditions and restrictions are
submitted for review and approval.
The declaration of covenants, conditions and restrictions submitted
for review shall (a) provide for a minimum term of 60 years, (b)
provide for the establishment of a property owners' association
comprised of the owners of each individual lot or unit, (c) provide
for ownership of the common area by either the property owners'
association or the owners of each individual lot or unit as tenants
in common, (d) provide for the maintenance and ownership status of
the emergency access points required in Condition No. 25, and (e)
contain the following provisions verbatim:
"Notwithstanding any provision in this Declaration to the
contrary, the following provisions shall apply:
The property owners' association established herein shall
manage and continuously maintain the `common area' , more
particularly described on Exhibit ` ' attached hereto, and
shall not sell or transfer the `common area' , or any part
thereof, absent the prior written consent of the Planning
Director of the County or Riverside or the county's
successor-in-interest.
The property owners' association shall have the right to
assess the owners of each individual lot or unit for the
reasonable cost of maintaining the `common area' and shall
have the right to lien the property of any such owner who
defaults in the payment of a maintenance assessment. An
assessment lien, once created, shall be prior to all other
liens recorded subsequent to the notice of assessment or
other document creating the assessment lien.
This Declaration shall not be terminated, `substantially'
amended or property deannexed therefrom absent the prior
written consent of the Planning Director of the County of
Riverside or the County's successor-in-interest. A
proposed amendment shall be considered substantial' if it
affects the extent, usage or maintenance of the `common
area' .
In the event of any conflict between this Declaration and
the Articles of Incorporation, the Bylaws or the property
owners' association Rules and Regulations, if any, this
Declaration shall control.
Once approved, the declaration of covenants, conditions and
restrictions shall be recorded at the same time that the final map
is recorded.
26. The common open space area(s) shall be labeled as a common lot(s) on
the final map and shall be owned in fee simple title as tenants in
common by a property owner's association.

27. PRIOR TO RECORDATION OF THE FINAL MAP, or issuance of grading
permits, whichever shall occur first, the land divider shall comply
with the requirements of the Eastern Information Center's letter
dated May 18, 1993, a copy of which is attached; should cultural
resources be encountered on the property, the land divider shall
comply with the recommendations of the consulting archaeologist as
approved by the Planning Director, including any required
environmental constraint sheet notes.
28. All residential lots created by this land division shall have a
minimum area of 8,000 square feet net.
29. Lots less than one-half acre in size shall be calculated in terms of
net area excluding all street right-of-ways.
30. All lot length to width ratios shall be in conformance with Section
3 .8C of Ordinance No. 460.
31. Section 3 .8B of Ordinance No. 460 is waived for corner lots.
32. The land divider shall be responsible for maintenance and upkeep of
all landscaped areas and irrigation systems until such time as those
operations are the responsibilities of other parties.
33. All new electrical, telephone and television services within this
land division rated less than 35kV shall be installed underground as
approved by the affected utility.
34. All privately maintained street lights and other outdoor lighting
shall be shown on electrical plans submitted to the Department of
Building and Safety for plan check approval and shall comply with
the requirements of Riverside County Ordinance No. 655.
35. An Environmental Constraints Sheet (ECS) shall be prepared with the
final map to delineate identified environmental concerns and shall
be permanently filed with the office of the County Surveyor. PRIOR
TO THE RECORDATION OF THE FINAL MAP, a copy of the ECS shall be
transmitted to the Planning Department for review and approval. The
approved ECS shall be forwarded with copies of the recorded final
map to the Planning Department and the Department of Building and
Safety.

36. The following note shall be placed on the ENVIRONMENTAL CONSTRAINTS
SHEET: "A development design manual has been adopted for this land
division by the County of Riverside. Procedures required prior to
issuance of building permits include review of site layout and
architectural design by the Riverside County Land Use Division or
equivalent for conformance with this manual. Lot purchasers should
review the development design manual prior to commencing home design
or purchase of mobilehome units. The development design manual is
on file in the office of the Riverside County Planning Department.n
37. No environmental assessment for grading within the project
boundaries shall be required provided such grading substantially
conforms to the grading plan submitted as part of the approved
tentative map. The land divider shall comply with all conditions of
approval and ECS notes requiring performance prior to the issuance
of grading permits.
38. The land owner shall institute blowsand and dust control measures
during grading and site development. These shall include but not be
limited to: a) The use of irrigation during any construction
activities; b) planting of cover crop or vegetation upon previously
graded but undeveloped portions of the site; and, c) provision of
windbreaks or windrows, fencing, and/or landscaping to reduce the
effects upon adjacent properties and public rights-of-way. The
landowner shall comply with directives of the Director of the
Building and Safety Department with regards to the applicable
sections of Ordinance No. 484 (Blowsand Control) . All construction
and graded areas shall be watered at least twice daily while being

39. Graded but undeveloped land shall be maintained in a condition so as
to prevent a dust and blowsand nuisance and shall be either planted
with interim landscaping or provided with other wind and water
erosion control measures as approved by the Director of Building and
Safety and state air quality management authorities.

40. PRIOR TO ISSUANCE OF GRADING OR BUILbING PERMITS, for the first
dwelling unit, except model sales units, a landscaping, parking,
shading and irrigation plan for the retention basin, and the
parkway areas adjacent to the C.V.W.D. well site shall be submitted
to the Planning Department for approval pursuant to the requirements
of Section Nos. 18.12, 18. 30 and 19. 300 through 19. 303 of Ordinance
No. 348 (Planning Department only plot plan) . The name, address and
phone number of both the landscape plan preparer and project
developer, the property's Assessors Parcel Number(s) , a vicinity
map, trash collection and storage facilities, wall/fence elevations,
drainage patterns, and any outdoor lighting shall be shown on this
plan. Landscaped areas shall be graded to retain all irrigation
water on-site. All plans that depict landscaping within public road
rights-of-way shall be submitted to the Road Department for
approval. All landscaped areas shall be maintained in a viable
growth condition throughout the life of this permit. PRIOR TO FINAL
BUILDING INSPECTION APPROVAL of the first dwelling unit (except
model sales units) , the permittee shall install all improvements as
shown on the approved plan.
41. The project landscaping and irrigation plans shall incorporate the
following features:
a. A copy of the final grading plans shall be submitted to
the Planning Department with the landscaping plan.
b. Trees of a variety of species shall be placed in grouped
patterns in several different locations along the edge of
the retention basin to provide shade and provide visual
relief.
C. Tennis courts and similar recreational facilities shall
require approval of a conditional use permit pursuant to
the W-1 zone.
d. Drought tolerant and native plant species shall be
preferred over non-drought and non-native species;
however, the quantity and extent of these species shall
depend on the project's climatic zone. Alternative types
of low volume irrigation are encouraged to be used in
order to conserve water. Review of landscape and
irrigation plans by the Coachella Valley Water District
for the above standards may be required prior to Planning
Department approval.

42. This property is located within the Coachella Valley and all
landscape planting shall comply with the requirements of the State
Agriculture Code and the directives of the Riverside County
Agricultural Commissioner. All landscaping plans submitted to the
Planning Department shall include the following notation: "WARNING:
Plant material listed may or may not have been approved by the
Agricultural Commissioner's office. Landscape contractor, please
contact the developer for status of Agricultural Commissioner's
approval or denial. Plant material not conforming with quarantine
laws may be destroyed and civil action taken. All plant material is
subject to inspection at the discretion of the Agricultural
Commissioner's office. All plant material must be free from Red
Scale (Aonidiella aurantii. )"
43. The development of the land division shall comply with Ordinance
Nos. 348 and 460 standards and with all other applicable ordinances
of Riverside County, and shall be in conformance with the design
guidelines contained within the tract map's design manual on file in
the office of the Riverside County Planning Department unless
otherwise amended by these conditions of approval.
44. PRIOR TO THE ISSUANCE OF BUILDING PERMITS for construction of any
use contemplated by this approval, the land divider, or the land
divider's successor, shall first obtain permits and/or clearance
from the following public agencies:
Health Services Agency Transportation Department
Coachella Valley Recreation
and Parks District
Evidence of said permit or clearance from the above agencies shall
be presented to the Land Use Division in the Department of Building
and Safety at the time of the issuance of a building permit for the
use contemplated herewith.

45. PRIOR TO THE ISSUANCE OF BUILDING PERMITS, a site plan shall be
submitted to and approved by the Land Use Division of the Planning
Department for each of the lots in order to ensure the conformance
of housing construction with Ordinance No. 348, the approved design
manual for Tract Map No. 27770 and the tract map conditions of
approval; the site plan shall contain the following elements:
1. A site plan for each lot legibly showing building
footprints, including detailing all setbacks, patio areas,
walkways, fencing, walls, pad mounted mechanical
equipment, and driveways locations and widths.
2. The site plan shall provide a front, and if necessary, a
side yard landscaping and irrigation plan showing at a
minimum a street tree, ground cover(s) and methods of
irrigation and maintenance.
3. The site plan shall include appropriate floor plan and
elevation assignments and details, including living floor
area calculations.
46. PRIOR TO FINAL BUILDING INSPECTION APPROVAL, all dwelling units on
lots created by this land division shall be improved in conformance
with the development standards of Ordinance No. 348 (Land Use and
Zoning) , the tract map's approved design manual and the following
development standards:
a. Building height shall not exceed one (1) story, with a
maximum height of nineteen 19 feet except chimneys and

b. All dwelling units shall have a minimum floor living area
of not less than 1,700 square feet, otherwise the floor
living area of production units may vary from the exact
specifications indicated in the design manual.

feet, unless otherwise provided by Ordinance No. 348.
d. Unless otherwise provided by Ordinance No. 348, side yards
adjacent to streets shall be a minimum of ten (10) feet,
five (5) feet otherwise and rear yards shall be a minimum
of ten (10) feet.

52. PRIOR TO FINAL BUILDING INSPECTION APPROVAL of any portion of the
development permitted hereby, all required drainage facilities
shall be constructed which shall protect the site. Plans for these
facilities shall be prepared by a California registered civil
engineer and approved by the Riverside County Flood Control District
and made a part of the construction plans submitted to the
Department of Building and Safety.
53 . PRIOR TO FINAL BUILDING INSPECTION APPROVAL, roof mounted. mechanical
equipment shall not be permitted unless fully screened from ; view
from adjoining properties and street right-of-ways. Solar equipment
and any other energy saving devices shall be similarly screened.
54. PRIOR TO FINAL BUILDING INSPECTION APPROVAL, all vehicle driveways
and pedestrian walkways to each dwelling unit shall be surfaced with
concrete or brick.
55. PRIOR TO FINAL, BUILDING INSPECTION APPROVAL, all yard areas visible
from road rights-of-way or private streets, including front yards
and, where applicable, side yards shall be landscaped with suitable

Gentlemen:
With respect to the conditions of approval for the referenced tentative land
division map, the Transportation Department recommends that the landdivider
provide the following street improvement plans and/or road dedications in
accordance with Ordinance 460 and Riverside County Road Improvement
Standards (Ordinance 461) . It is understood that the tentative map
correctly shows acceptable centerline profiles, all existing easements,
traveled ways, and drainage courses with appropriate Q's, and that their
omission or unacceptability may require the map to be resubmitted for
further consideration. These Ordinances and the following conditions are
essential parts and a requirement occurring in ONE is as binding as though
occurring in all. They are intended to be complementary and to describe the
conditions for a complete design of the improvement. All questions
regarding the true meaning of the conditions shall be referred to the
Director of Transportation.
1. The landdivider shall protect downstream properties from damages
caused by alteration of the drainage patterns, i.e. , concentration
or diversion of flow. Protection shall be provided by
constructing adequate drainage facilities including enlarging
existing facilities and/or by securing a drainage easement. All
drainage easements shall be shown on the final map and noted as
follows: "Drainage Easement - no building, obstructions, or
encroachments by land fills are allowed". The protection shall be
as approved by the Transportation Department.
2. The landdivider shall accept and properly dispose of all offsite
drainage flowing onto or through the site. In the event the
Director of Transportation permits the use of streets for drainage
purposes, the provisions of Article XI of Ordinance No. 460 will
apply. Should the quantities exceed the street capacity or the
use of streets be prohibited for drainage purposes, the subdivider
shall provide adequate drainage facilities as approved by the
Transportation Department.

4. Barrington Drive and Eastwood Lane shall be improved within the
dedicated right-of-way in accordance with County Standard No. 103,
Section A.
5. Westbrook Court, Marlowe Court, Justin Court and Ashberry Court
between Barrington Drive and Eastwood Lane shall be improved
within the dedicated right-of-way in accordance with County
Standard No. 104, Section A (401/601 ) .
6. Cheviot Court, Alcot Circle, Marlowe Court, Justin Court and
Ashberry Court shall be improved within the dedicated right-of-
way in accordance with County Standard No. 105 Section A
(361/601 ) .
7. Corner cutbacks in conformance with County Standard No. 805 shall
be shown on the final map and offered for dedication.
8. Standard cul-de-sacs and knuckles and off-set cul-de-sacs shall be
constructed throughout the landdivision.
9. Improvement plans shall be based upon a centerline profile
extending a minimum of 300 feet beyond the project boundaries at a
grade and alignment as approved by the Director of Transportation.
Completion of road improvements does not imply acceptance for
maintenance by County.
10. Asphaltic emulsion (fog seal) shall be applied not less than
fourteen days following placement of the asphalt surfacing and
shall be applied at a rate of 0.05 gallon per square yard.
Asphalt emulsion shall conform to Section 37, 39 and 94 of the
State Standard Specifications. .
11. Concrete sidewalks shall be constructed throughout the
landdivision in accordance with County Standard No. 400 and 401
(curb sidewalk) .
12. Prior to the issuance of a building permit the developer shall pay
a fee to the County of Riverside Transportation Department for the
mitigation of traffic signal impacts within Traffic Signal
Mitigation District No. 12. The fee amount shall be based on the
fee schedule applicable at the time of building permit
application.

13. Prior to the issuance of a .building permit, the applicant shall
pay a Transportation Uniform Mitigation Fee (TUMF) in accordance
with the provisions of Riverside County Ordinance No. 673. The
TUMF shall be paid at a rate of $83 per residential trip. The
amount of the TUMF may be periodically adjusted by the Board of
Supervisors and the applicant shall pay the fee amount in effect
at the time of building permit issuance.
14. Street lights shall be installed throughout the development in
accordance with Ordinance No. 461 and County procedures. The
landowner shall provide for perpetual street light maintenance and
energy funding through a County Service Area, Services District or
other funding mechanism as approved by the Transportation
Director. Certified documentation of ongoing maintenance and
energy funding shall be received and provided prior to the
recordation/occupancy.
15. A 25-foot wide emergency access connection to Preston Trail from
Marlowe Court, as indicated, shall be improved to provide all-
weather vehicular conveyance as approved by the Director of
Transportation.
16. Should this project lie within any assessment/benefit district,
the applicant shall, prior to recordation, make application for
and pay proportional assessments or unit fees of the benefit
district unless said fees are deferred to building pe 't stage.

With respect to the conditions of approval for the above referenced
land division, the Fire Department recommends the following fire
protection measures be provided in accordance with the Riverside
County Ordinances and/or recognized fire protection standards:
1 . Schedule A fire protection approved Super fire hydrants,
(6" x 4" x 2 1 /2 x 2 1/2" ) shall be located at each street
intersection spaced not more than 330 feet apart in any
direction with no portion of any frontage more than 165 feet
from a fire hydrant . Minimum fire flow shall be 1000 gpm for 2
hours duration at 20 psi .
2. Prior to recordation of the final map, applicant/developer shall
furnish one blueline copy of the water system plans to the Fire
Department for review/approval . Plans shall conform to the fire
hydrant types, location and spacing , and the system shall meet
the fire flow requirements. Plans shall be signed/approved by a
registered civil engineer and the local water company with the
following certification: " I certify that the design of the water
system is in accordance with the requirements prescribed by the
Riverside County Fire Department . "
3. The required water system including fire hydrants shall be
installed and accepted by the appropriate water agency prior to
any combustible building material being placed on an individual
lot .
4. A temporary water supply for fire protection may be allowed for
the construction of the model units only. Plans for a temporary
water system must be submitted to the Fire Department for review
prior to issuance of building permits.
5. Prior to recordation of the final map , the applicant shall
provide alternate or secondary access as approved by the County
Road Department.
6. Prior to the recordation of the final map , the developer shall
deposit with the Riverside County Fire Department a cash sum of
