A. Case No. TT 28658 and PP 97-17 - WESTWIND DEVELOPMENT,
Applicant
Request for approval of a Negative Declaration of Environmental
Impact, Tentative Tract Map to subdivide two existing parcels
into six parcels, and a Precise Plan to build five condominium
units each 1 ,550 square feet.
Mr. Alvarez stated that the subject property consists of two parcels zoned R-3
multifamily residential located at the southeast corner of Abronia Trail and
Sunset Lane. The two parcels totaled 16,700 square feet. Six parcels would
be created by the tract map and parcel numbers one through five would be
2,100 square foot lotts, each having a 1 ,550 square foot condominium. Lot
6 would be a common lot containing landscaping and a common pool area.
The five condominiums would be divided into two clusters. The first cluster
would have two units fronting on Abronia Trail and the second cluster would
have three units fronting on Sunset Lane. The 1 ,550 square foot
condominiums would have building heights not exceeding 24 feet. Mr. Alvarez
stated that the precise plan and tract map met all city standards. The

submittal of a landscaping plan. Mr. Alvarez explained that the landscape plan
was submitted on November 25, 1997. For purposes of CEQA, this project
would not have a significant negative impact on the environment and a
Negative Declaration was prepared. Staff recommended approval of the
tentative tract and precise plan, subject to the conditions contained in the draft
resolution.
Commissioner Jonathan noted that the staff report indicated that the proposed
driveways would be 18 or 20 feet wide and pointed out that in the Fire
Marshal's conditions (specifically number 11 on page 8) required 24 foot wide
driveways. He asked if that was a conflict. Mr. Alvarez suggested that it be
amended to meet that requirement, although he was fairly certain that it
should be 20 feet. Mr. Drell explained that the condition appeared to be for
a circulation aisle in a parking lot since it didn't allow parallel parking, and
carports and garages were allowed on one side only. He said that typically
residential driveways were 16 feet wide. He recommended that the condition
be amended by adding the words "or as approved by the Fire Marshal" and
that would allow for some clarification or modification by the Fire Marshal.
Commissioner Jonathan said he didn't have a problem with the 18 foot wide
driveway he just saw a conflict within the conditions. He concurred with the
amended language.
Acting Chairperson Campbell opened the public hearing and asked the
applicant to address the commission.
MR. A.R. WOOLWORTH, Western Development, 44-817 Del Dios Court-
in Indian Wells, addressed the commission and said he was present to
answer any questions.
There were no questions for the applicant. Acting Chairperson Campbell asked
if anyone wished to speak in FAVOR or OPPOSITION to the proposed project.
There was no one and the public hearing was closed.
Commissioner Fernandez said he was in favor of the project and felt it would
be a great project.

clarification by ARC. He noted that they have not yet approved the

approval by the Planning Commission would be with the conditions as
amended and subject to the approval of the landscape plan by ARC. Mr.

Department of Community Development:
1 The development of the property shall conform substantially with exhibits on file with
the Department of Community Development, as modified by the following conditions.
2. Construction of a portion of said project shall commence within two years from the
date of final approval unless an extension of time is granted; otherwise said approval
shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the restrictions
and limitations set forth herein which are in addition to all municipal ordinances and
state and federal statutes now in force,or which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use contemplated by this
approval, the applicant shall first obtain permits and/or clearance from the following
agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Department
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit for
the use contemplated herewith.
5. Applicant shall participate in a residential recycling program as determined by the City
Environmental Conservation Manager and applicable Waste Disposal Company. Said
placement of bins shall be approved by applicable trash company and Department of
Community Development.
6. All future occupants of the buildings shall comply with parking requirements in
Section 25.58 of the zoning ordinance.
7. Applicant agrees to maintain the landscaping required to be installed pursuant to
these conditions. Applicant will enter into an agreement to maintain said landscaping
for the life of the project, which agreement shall be notarized and which agreement
shall be recorded. It is the specific intent of the parties that this condition and

agreement run with the land and bind successors and assigns. The final landscape
plan shall include a long-term maintenance program specifying among other matters
appropriate watering times, fertilization and pruning for various times of the year for
the specific materials to be planted, as well as periodic replacement of materials. All
to be consistent with the Property Maintenance Ordinance (Ordinance No. 801 ) and
the approved landscape plan.
8. The project shall be subject to all applicable fees at time of issuance of building
permits including, but not limited to, Art in Public Places, Fringe-Toed Lizard, TUMF,
School Mitigation and Housing Mitigation fees.
9. The project's setbacks shall conform standards in Section 25.20 of the City's Zoning
Ordinance.
Department of Public Works:
1 . Drainage fees in accordance with Palm Desert Municipal Code Section 26.49 and
Ordinance No. 653 shall be paid prior to recordation of the final map or issuance of
grading permits.
2. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and
79-55, shall be paid prior to issuance of any permits associated with this project or
the recordation of the tract map.
3. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF).
Payment of said fees shall be at the time of building permit issuance.
4. A complete preliminary soils investigation , conducted by a registered soils engineer,
shall be submitted to, and approved by, the Department of Public Works prior to the
issuance of a grading permit.
5. Complete tract map shall be submitted as required by ordinance to the Director of
Public Works for checking and approval prior to the issuance of any permits.
6. Any and all offsite improvements shall be preceded by the approval of plans and the
issuance of valid encroachment permits by the Department of Public Works.
7. In accordance with Palm Desert Municipal Code Section 26.44, complete grading
plans/site improvement plans and specifications shall be submitted to the Director of
Public Works for checking and approval prior to issuance of any permits.

8. As required under Palm Desert Municipal Code Section 26.28, and in accordance with
Sections 26.40 and 26.44, complete improvement plans and specifications shall be
submitted to the Director of Public Works for checking and approval before
construction of any improvements is commenced. Offsite improvement shall include
city standard sidewalk and driveway installation with plans to be approved by the
Public Works Department and a surety posted to guarantee the installation of required
offsite improvements prior to permit issuance.
9. All public and private improvements shall be inspected by the Department of Public
Works and a standard inspection fee shall be paid prior to issuance of any permits
associated with this project.
10. Landscape installation on the property frontages and common areas shall be water
efficient in nature and shall be in accordance with the City of Palm Desert landscape
design standards. Landscaping maintenance for said landscape shall be provided be
provided through a property owners association. Applicant shall be responsible for
executing a declaration of Conditions, Covenants and Restrictions, which declaration
shall be approved by the City of Palm Desert and recorded with the County Recorder.
The declaration shall specify: (a) the applicant shall oversee the formation of a
property owners association; (b) the property owners association shall be formed
prior to the recordation of the Parcel Map; and (c) the aforementioned landscaping
and detention basin maintenance shall be the responsibility of the property owners
association.
1 1 . Applicant shall comply with the provisions of Municipal Code Section 12.12, Fugitive
Dust Control
12. Proposed building pad elevations are subject to review and modification in accordance
with Chapter 27 of the Palm Desert Municipal Code.
13. A complete preliminary soils investigation, conducted by a registered soils engineer,
shall be submitted to and approved by, the Department of Public Works prior to the
issuance of a grading permit.
Riverside County Fire Department:
1 . With respect to the conditions of approval regarding the above referenced plan check,
the Fire Department recommends the following fire protection measures be provided
in accordance with City Municipal Codes, appropriate NFPA standards, CFC, CBC,
and/or recognized fire protection standards.

The fire department is required to set a minimum fire flow for the remodel or
construction of all commercial buildings per California Fire Code Sec. 10.401 .
2. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual operating pressure
must be available before any combustible materials are placed on the job site.
3. Provide, or show there exists, a water system capable of providing a potential gallon
per minute flow of:
a) 2500 gpm for multi-family structure
The actual fire flow available from any one hydrant connected to any given water
main shall be 1500 gpm for a two hour duration at 20 psi residual operating pressure.
4. The required fire flow shall be available from,a Super hydrant(s) (6"x4"x2-1 /2"x2-
1/2"), located not less than 25' or more than:
a)165 feet from multi-family structure.
Distances shall cover all portions of the building(s) as measured along approved
vehicular travel ways. Hydrants installed below 3000' elevation shall be of the "wet
barrel" type.
5. Provide written verification from the appropriate water company having jurisdiction
that hydrant(s) will be installed and will produce the required fire flow, or arrange for
a field inspection by the Fire Department prior to scheduling for a final inspection.
6. Install a complete fire sprinkler system per NFPA 13. This applies to all buildings
with 3000 square feet or more building area as measured by the building footprint,
including overhangs which are sprinklered as per NFPA 13R. The building area of
additional floors is added in for cumulative total square footage. Exempted are one
and two family dwellings. APPLIES TO UNITS 3-4-5.
7. Install a fire alarm (water flow) as required by the Uniform Building Code Sec. 3803
for the fire sprinkler system(s). Install supervisory (tamper) alarms on all supply and
control valves for sprinkler systems.
8. Certain designated areas will be required to be maintained as fire lanes and shall be
clearly marked by painting and/or signs as approved by the Fire Marshal. Painted fire
lanes and/or signs shall be stenciled or posted every 30' with the following:

a) No Parking Fire Lane - PDMC 15.16.090.
9. Install a fire alarm as required by the California Building Code and/or California Fire
Code. Minimum requirements is UL central station monitoring of sprinkler systems per
NFPA 71 and 72. Alarm plans are required for all UL central station monitored
systems and systems where any interior devices are required to be used. (CFC Sec.
14.103(a))
10. All buildings shall be accessible by an all-weather roadway extending to within 150'
of all portions of the exterior walls of the first story. The roadway shall be not less
than 24' of unobstructed width and 13'6" of vertical clearance. Where parallel
parking is allowed, the roadway shall be 36' wide with parking on both sides, 32'
wide parking on one side. Dead-end roads in excess of 150' shall be provided with
a minimum 45' radius turn around (55' in industrial developments). Fountains or
garden islands placed in the middle of these turn-arounds shall not exceed a 5' radius
or 10' diameter. City standards may be more restrictive.
1 1 . The minimum width of interior driveways for multi-family or apartment complexes
shall be:
a) 24 feet wide when serving less than 100 units, no parallel parking, carports
or garages allowed on one side only, or as approved by the Fire Marshal.
12. Contact the Fire Department for a final inspection prior to occupancy.
13. All new residences/dwellings are required to have illuminated residential addresses
meeting both the City and Fire Department approval. Shake shingle roofs are no
longer permitted in the Cities of Indian Wells, Rancho Mirage or Palm Desert.
14. All fire sprinkler systems, fixed fire suppression systems and alarm plans must be
submitted separately for approval prior to construction. Subcontractors should
contact the Fire Marshal's office for submittal requirements.
15. Conditions subject to change with adoption of new codes, ordinances, laws or when
building permits are not obtained within twelve months.

6 is a common area lot, containing a common swimming pool and

apartment uses. Applicant must receive Architecture Review Commission
approval for the 7 foot block wall.

The precise plan includes the construction of 5 condominium units each
1 ,550 square feet. The units are divided into two clusters. The first cluster
includes lots 1 and 2 and fronts on Abronia Trial. The second cluster has
three units and fronts on Sunset Trail. All five units are two stories or 23'8"
feet high. Each unit will have a minimum 20' x 20', two car garage and an
18' x 20' drive-way to provide two additional parking spaces.

WHEREAS, said application has complied with the requirements of the "City of Palm
Desert Procedure for Implementation of the California Environmental Quality Act,
Resolution No. 95-105," in that the Director of Community Development has determined
that the tentative tract map and the precise plan will not a significant negative impact. on
the environment and a negative declaration has been prepared; and
WHEREAS, at said public hearing, upon hearing and considering all testimony and
arguments, if any, of all interested persons desiring to be heard, said planning commission
did find the following facts and reasons to exist to justify granting approval of said precise

CONDITIONS OF APPROVAL

Department of Community Development:
1 . The development of the property shall conform substantially with exhibits on file
with the Department of Community Development, as modified by the following
conditions.
2. Construction of a portion of said project shall commence within two years from the
date of final approval unless an extension of time is granted; otherwise said
approval shall become null, void and of no effect whatsoever.
3. The development of the property described herein shall be subject to the restrictions
and limitations set forth herein which are in addition to all municipal ordinances and
state and federal statutes now in force, or which hereafter may be in force.
4. Prior to issuance of a building permit for construction of any use contemplated by
this approval, the applicant shall first obtain permits and/or clearance from the
following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Department
Evidence of said permit or clearance from the above agencies shall be presented to
the department of building and safety at the time of issuance of a building permit for
the use contemplated herewith.
5. Applicant shall participate in a residential recycling program as determined by the
City Environmental Conservation Manager and applicable Waste Disposal Company.
Said placement of bins shall be approved by applicable trash company and
Department of Community Development.
6. All future occupants of the buildings shall comply with parking requirements in

Section 25.58 of the zoning ordinance.
7. Applicant agrees to maintain the landscaping required to be installed pursuant to
these conditions. Applicant will enter into an agreement to maintain said
landscaping for the life of the project, which agreement shall be notarized and which
agreement shall be recorded. It is the specific intent of the parties that this
condition and agreement run with the land and bind successors and assigns. The

final landscape plan shall 'include a long-term maintenance program specifying
among other matters appropriate watering times, fertilization and pruning for various
times of the year for the specific materials to be planted, as well as periodic
replacement of materials. All to be consistent with the Property Maintenance
Ordinance (Ordinance No. 801 ) and the approved landscape plan.
8. The project shall be subject to all applicable fees at time of issuance of building
permits including, but not limited to, Art in Public Places, Fringe-Toed Lizard, TUMF,
School Mitigation and Housing Mitigation fees.
9. The project's setbacks shall conform standards in Section 25.20 of the City's
Zoning Ordinance.
Deoartment of Public Works:
1 . Drainage fees in accordance with Palm Desert Municipal Code Section 26.49 and
Ordinance No. 653 shall be paid prior to recordation of the final map or issuance of
grading permits.
2. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17
and 79-55, shall be paid prior to issuance of any permits associated with this
project or the recordation of the tract map.
3. The project shall be subject to Transportation Uniform Mitigation Fees (TUMF).
Payment of said fees shall be at the time of building permit issuance.
4. A complete preliminary soils investigation , conducted by a registered soils engineer,
shall be submitted to, and approved by, the Department of Public Works prior to the
issuance of a grading permit.
5. Complete tract map shall be submitted as required by ordinance to the Director of
Public Works for checking and approval prior to the issuance of any permits.
6. Any and all offsite improvements shall be preceded by the approval of plans and
the issuance of valid encroachment permits by the Department of Public Works.
7. In accordance with Palm Desert Municipal Code Section 26.44, complete grading
plans/site improvement plans and specifications shall be submitted to the Director of
Public Works for checking and approval prior to issuance of any permits.
8. As required under Palm Desert Municipal Code Section 26.28, and in accordance
with Sections 26.40 and 26.44, complete improvement plans and specifications

shall be submitted to the Director of Public Works for checking and approval before
construction of any improvements is commenced. Offsite improvement shall
include city standard sidewalk and driveway installation with plans to be approved
by the Public Works Department and a surety posted to guarantee the installation of
required offsite improvements prior to permit issuance.
9. All public and private improvements shall be inspected by the Department of Public
Works and a standard inspection fee shall be paid prior to issuance of any permits
associated with this project.
10. Landscape installation on the property frontages and common areas shall be water
efficient in nature and shall be in accordance with the City of Palm Desert landscape
design standards. Landscaping maintenance for said landscape shall be provided be
provided through a property owners association. Applicant shall be responsible for
executing a declaration of Conditions, Covenants and Restrictions, which
declaration shall be approved by the City of Palm Desert and recorded with the
County Recorder. The declaration shall specify: (a) the applicant shall oversee the
formation of a property owners association; (b) the property owners association
shall be formed prior to the recordation of the Parcel Map; and (c) the
aforementioned landscaping and detention basin maintenance shall be the
responsibility of the property owners association.
11 . Applicant shall comply with the provisions of Municipal Code Section 12.12,
Fugitive Dust Control
12. Proposed building pad elevations are subject to review and modification in
accordance with Chapter 27 of the Palm Desert Municipal Code.
13. A complete preliminary soils investigation, conducted by a registered soils engineer,
shall be submitted to and approved by, the Department of Public Works prior to the
issuance of a grading permit.
Riverside County Fire Department:
1 . With respect to the conditions of approval regarding the above referenced plan
check, the Fire Department recommends the following fire protection measures be
provided in accordance with City Municipal Codes, appropriate NFPA standards,
CFC, CBC, and/or recognized fire protection standards.
The fire department is required to set a minimum fire flow for the remodel or
construction of all commercial buildings per California Fire Code Sec. 10.401 .

2. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual operating pressure
must be available before any combustible materials are placed on the job site.
3. Provide, or show there exists, a water system capable of providing a potential gallon
per minute flow of:
a) 2500 gpm for multi-family structure
The actual fire flow available from any one hydrant connected to any given water
main shall be 1500 gpm for a two hour duration at 20 psi residual operating
pressure.
4. The required fire flow shall be available from a Super hydrant(s) (6"x4"x2-1/2"x2-
1/2"), located not less than 25' or more than:
a)165 feet from multi-family structure.
Distances shall cover all portions of the building(s) as measured along approved
vehicular travel ways. Hydrants installed below 3000' elevation shall be of the
"wet barrel" type.
5. Provide written verification from the appropriate water company having jurisdiction
that hydrant(s) will be installed and will produce the required fire flow, or arrange for
a field inspection by the Fire Department prior to scheduling for a final inspection.
6. Install a complete fire sprinkler system per NFPA 13. This applies to all buildings
with 3000 square feet or more building area as measured by the building footprint,
including overhangs which are sprinklered as per NFPA 13R. The building area of
additional floors is added in for cumulative total square footage. Exempted are one
and two family dwellings. APPLIES TO UNITS 3-4-5.
7. Install a fire alarm (water flow) as required by the Uniform Building Code Sec. 3803
for the fire sprinkler system(s). Install supervisory (tamper) alarms on all supply and
control valves for sprinkler systems.
8. Certain designated areas will be required to be maintained as fire lanes and shall be
clearly marked by painting and/or signs as approved by the Fire Marshal. Painted
fire lanes and/or signs shall be stenciled or posted every 30' with the following:
a) No Parking Fire Lane - PDMC 15.16.090.
9. Install a fire alarm as required by the California Building Code and/or California Fire
Code. Minimum requirements is UL central station monitoring of sprinkler systems
per NFPA 71 and 72. Alarm plans are required for all UL central station monitored
systems and systems where any interior devices are required to be used. (CFC Sec.
14.103(a))
10. All buildings shall be accessible by an all-weather roadway extending to within 150'
of all portions of the exterior walls of the first story. The roadway shall be not less

than 24' of unobstructed width and 13'6" of vertical clearance. Where parallel
parking is allowed, the roadway shall be 36' wide with parking on both sides, 32'
wide parking on one side. Dead-end roads in excess of 150' shall be provided with
a minimum 45' radius turn around (55' in industrial developments). Fountains or
garden islands placed in the middle of these turn-arounds shall not exceed a 5'
radius or 10' diameter. City standards may be more restrictive.
11 . The minimum width of interior driveways for multi-family or apartment complexes
shall be:
a) 24 feet wide when serving less than 100 units, no parallel parking,
carports or garages allowed on one side only.
12. Contact the Fire Department for a final inspection prior to occupancy.
13. All new residences/dwellings are required to have illuminated residential addresses
meeting both the City and Fire Department approval. Shake shingle roofs are no
longer permitted in the Cities of Indian Wells, Rancho Mirage or Palm Desert.
14. All fire sprinkler systems, fixed fire suppression systems and alarm plans must be
submitted separately for approval prior to construction. Subcontractors should
contact the Fire Marshal's office for submittal requirements.
15. Conditions subject to change with adoption of new codes, ordinances, laws or
when building permits are not obtained within twelve months.

The following conditions apply to the Project:
1. With respect to the conditions of approval regarding the above referenced plan check,
Fire Department recommends the following fire protection measures be provided in
accordance with City Municipal Codes, appropriate NFPA Standards, CFC, CBC, and/or
recognized Fire Protection Standards.
The Fire Department is required to set a minimum fire flow for the remodel or
construction of all commercial buildings per Califomia Fire Code Sec. 10.401.
2. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual operating pressure must
be available before any combustible materials are placed on the job site.
3. Provide, or show there exists, a water system capable of providing a potential gallon per
minute flow of:
a) 2500 gpm for multi-family structure.
The actual fire flow available from any one hydrant connected to any given water main
shall be 1500 gpm for a two hour duration at 20 psi residual operating pressure.
4. The required fire flow shall be available from a Super hydrant(s) (6" x 4"x 2-1/2" x 2-
1/2"), located not less than 25' nor more than:
a) 165'from mufti-family structure.
Distances shall cover all portions of the building(s) as measured along approved
vehicular travel ways. Hydrants installed below 3000' elevation shall be of the"wet
barrel"type.
5. Provide written certification from the appropriate water company having jurisdiction that
hydrant(s) will be installed and will produce the required fire flow, or arrange for a field
inspection by the Fire Department prior to scheduling for a final inspection.

6. Install a complete fire sprinkler system per NFPA 13R. This applies to all buildings with
3000 square feet or more building area as measured by the building footprint, including
overhangs which are sprinklered as per NFPA 13R. The building area of additional
floors is added in for a cumulative total square footage. Exempted are one and two
family dwellings. APPLIES TO UNITS 3-4-5
7. Install a fire alarm (water flow) as required by the Uniform Building Code Sec. 3803 for
the fire sprinkler system(s). Install supervisory (tamper) alarms on all supply and control
valves for sprinkler systems.
8. Certain designated areas will be required to be maintained as fire lanes and shall be
clearly marked by painting and/or signs as approved by the Fire Marshal. Painted fire
lanes and/or signs shall be stenciled or posted every 30'with the following:
a) No Parking Fire Lane - PDMC 15.16.090
9. Install a fire alarm as required by the California Building Code and/or California Fire
Code. Minimum requirement is UL central station monitoring of sprinkler systems per
NFPA 71 and 72. Alarm plans are required for all UL central station monitored systems
and systems where any interior devices are required or used. (CFC Sec. 14.103(a))
10. All buildings shall be accessible by an all-weather roadway extending to within 150' of all
portions of the exterior walls of the first story. The roadway shall be not less than 24' of
unobstructed width and 13'6" of vertical clearance. Where parallel parking is allowed,
the roadway shall be 36'wide with parking on both sides, 32' wide with parking on one
side. Dead-end roads in excess of 150' shall be provided with a minimum 45' radius turn
around (55'in industrial developments). Fountains or garden islands placed in the
middle of these tum-arounds shall not exceed a 5' radius or 10' diameter. City standards
may be more restrictive.
11. The minimum width of interior driveways for multi-family or apartment complexes shall
be:
a) 24 feet wide when serving less than 100 units, no parallel parking, carports or
garages allowed on one side only.
12. Contact the Fire Department for a final inspection prior to occupancy.
13. All new residences/dwelling are required to have illuminated residential addresses
meeting both City and Fire Department approval. Shake shingle roofs are no longer
permitted in the Cities of Indian Wells, Rancho Mirage or Palm Desert.
14. All fire sprinkler systems, fixed fire suppression systems and alarm plans must be
submitted separately for approval prior to construction. Subcontractors should contact
the Fire Marshal's office for submittal requirements.
15. Conditions subject to change with adoption of new codes, ordinances, laws or when
building permits are not obtained within twelve months.

ENVIRONMENTAL EVALUATION CHECKLIST COMMENTS AND POSSIBLE MITIGATION
MEASURES (CATEGORIES PERTAIN TO ATTACHED CHECKLIST)
1. EARTH
a. The site is relatively flat and pre-graded. Grading will not result in any
alterations to geologic substructures and will not create unstable earth
conditions.
b. As part of the normal grading activity soil will be moved, displaced, over-
covered and compacted. This activity will be done per permit and approved
grading plans to assure that the site is properly prepared for the structural
developments which will take place on the site.
C. The site is relatively flat and changes in topography and surface relief will be
required to assure proper drainage and avoid increased runoff to adjoining
properties. The after condition of the property will result in less water runoff
from the property to adjoining properties and better direction.
d. The site does not contain any unique geologic or physical features.
e. The project as stated previously will result in less potential water damage to the
site through proper grading, resulting in the appropriate directing of runoff from
the site.
MITIGATION MEASURES
The City of Palm Desert grading and building permits procedures required detailed
geotechnical reports addressing grading specifications and the settlement and
expansive characteristics of on site soils. All structures must be designed to UBC
requirements to insure that buildings are constructed within the acceptable level of risk
set forth herein for the type of building and occupancies being developed.
2. AIR
a. During construction, particularly grading, a potential dust problem is a short
term impact. Requiring that the ground be moistened during days in which
grading occurs, will mitigate this problem. This is required by City of Palm
Desert Grading Ordinance.
Because the site is already within an urbanized setting, its development will not
result in an overall deterioration of ambient air quality. Completed development
of the site will result in less dust leaving the site then currently occurs with the
site's vacant condition.

b. The proposed development does not call for any odorous land uses.
C. Development of this site will not result in any climatic changes. This is due to
its size and identified uses.
3. WATER
a. Water will be redirected to drainage facilities designed and constructed to
accept the water from the site.
b. The site will absorb less water due to ground coverage, however, the
landscaped areas will absorb more water because of the plant material. The
alterations in drainage patterns will result in a benefit to adjoining property as it
is directed in a controlled manner.

d. There is no ground water present on the site.

f. While any development results in the use of water and therefore reduces the
amount otherwise available for public water supplies; the Coachella Valley
Water District assures that there is sufficient water supplies to accommodate
this growth. In addition, the Coachella Valley Water District plans to construct
additional water facilities in the Palm Desert area to accommodate current and
future development.
4. PLANT LIFE
a. The project when completed will introduce a diversity of species to the site.
The plants that will be introduced to the site will, however are materials
previously used in the desert.
b. The site does not contain any unique, rare or endangered species of plant life.

d. The project will introduce new plant species to the site, but material used will
be those previously used in the desert and will be reviewed by the agricultural
inspector of Riverside County to assure that the plants being used do not pose
a hazard to agricultural production in the area.
5. ANIMAL LIFE

a-d. The site is surrounded by urbanized uses and any impact on animal life
occurred previously.
6. NOISE
Construction and subsequent operation of five condominiums will increase ambient
noise level. This use is a similar use to adjacent properties and will not create and
significant noise problems.
MITIGATION MEASURES
Strict adherence to construction hours and days will be required.
7. LIGHT AND GLARE
a. The project will create new light and glare from outdoor lighting and the sun's
reflection off of building materials. Any outdoor lighting will comply with the
City's lighting ordinance to assure that light and glare is reduce to a level of
insignificance.
8. LAND USE
The project will not alter the present developed and proposed land use in the area.
The planned land use for the area is identified as multi-family residential; the project is
a permitted land use within the existing land use designation.
9. NATURAL RESOURCES
a. The project will obviously use natural resources, but will not increase the rate of
usage of these resources because the new building will be a modern energy
efficient commercial building.
b. All material resources used on the site are renewable.
10. RISK OF UPSET
The site does not contain any substances that could result in explosion or escape of
hazardous materials.
11. POPULATION
a. The property is designated multi-family residential and its proposed use is
consistent with the general plan. The project will not result in any changes to
location, distribution, density, or growth rate of the city's population.

b. The project will not generate changes in the socio-economic characteristics of
the area.
12. HOUSING
a. The project will not change the housing picture in the community or region.
This is based on the conclusions reached in items 13 and 14. Development of
this type of use will create new housing in the city.
13. TRANSPORTATION/CIRCULATION
a. Trip generation for the proposed land use is consistent with general plan an
existing streets have adequate capacity to handle this new traffic.
b. There will be a demand for additional parking facilities which will be supplied by
the project on site.
C. Except for additional vehicular movements discussed above the project should
not generate additional demands on existing transportation systems. In
addition these systems have adequate capacity.
d. No impact to circulation patterns.
f. none.
14. PUBLIC SERVICE
a-f. None.
The property is presently vacant. A commitment to urban uses was made as
the area surrounding the area has been developed, and the general plan and
zoning maps designated the area for multi-family residential. Infrastructure
improvements (i.e. streets, utilities) have been made and are adequate to serve
the proposed development. The proposed land use would increase the
economic productivity of the land in terms of land efficiency and greater
economic return generated from these uses, versus the current state of the
property.
16. UTILITIES
All utilities have indicated an ability to serve the proposed development.
17. HUMAN HEALTH

The project will not create hazard to human health in the long or short term nor will it
impact the level of community health.
18. AESTHETICS
All building setbacks, heights and ordinance requirements will be met. Other two story
buildings exist in the general vicinity and will not impact any scenic vista or views open
to the public.
The proposed development must be approved by the Palm Desert Architectural
Commission. An aesthetically offensive site will not be created.
20. CULTURAL RESOURCES
There has been no evidence of any archeological or historical significance of this site.
In addition, state law requires that should any evidence be found during construction,
construction must cease and the site cleared.
21. MANDATORY FINDINGS OF SIGNIFICANCE
Because of the mitigation measures identified herein and required of the project, the
proposal will not have a significant adverse impact on the environment.

The following should be considered conditions of approval for the
above-referenced project :
(1) Drainage fees in accordance with Palm Desert Municipal Code
Section 26 . 49 and Ordinance No. 653 shall be paid prior to
recordation of the final map or issuance of grading permits .
(2) Signalization fees, in accordance with City of Palm Desert
Resolution Nos . 79-17 and 79-55 , shall be paid prior to
issuance of any permits associated with this project or the
recordation of the tract map.
(3) The project shall be subject to Transportation Uniform
Mitigation Fees (TUMF) . Payment of said fees shall be at the
time of building permit issuance .
(4) A complete preliminary soils investigation , conducted by a
registered soils engineer, shall be submitted to, and approved
by, the Department of Public Works prior to the issuance of a
grading permit .
(5) Complete tract map shall be submitted as required by
ordinance to the Director of Public Works for checking and
approval prior to the issuance of any permits .
(6) Any and all offsite improvements shall be preceded by the
approval of plans and the issuance of valid encroachment
permits by the Department of Public Works .
(7) In accordance with Palm Desert Municipal Code Section 26 . 44,
complete grading plans/site improvement plans and
specifications shall be submitted to the Director of Public
Works for checking and approval prior to issuance of any
permits .
(8) As required under Palm Desert Municipal Code Section 26 . 28,
and in accordance with Sections 26 . 40 and 26 . 44 , complete
improvement plans and specifications shall be submitted to.the
Director of Public Works for checking and approval before
construction of any improvements is commenced. Offsite
improvement shall include city standard sidewalk and driveway
installation with plans to be approved by the Public Works
Department and a surety posted to guarantee the installation
of required offsite improvements prior to permit issuance .
(9) All public and private improvements shall be inspected by the
Department of Public Works and a standard inspection fee shall
be paid prior to issuance of any permits associated with this
project .
(10) Landscape installation on the property frontages and common
areas shall be water efficient in nature and shall be in
accordance with the City of Palm Desert landscape design
standards . Landscaping maintenance for said landscape shall
be provided be provided through a property owners association.
Applicant shall be responsible for executing a declaration of
Conditions, Covenants and Restrictions, which declaration
shall be approved by the City of Palm Desert and recorded with
the County Recorder. The declaration shall specify: (a) the
applicant shall oversee the formation of a property owners
association; (b) the property owners association shall be
formed prior to the recordation of the Parcel Map; and (c) the
aforementioned landscaping and detention basin maintenance
shall be the responsibility of the property owners
association.
(11) Applicant shall comply with the provisions of Municipal Code
Section 12 . 12 , Fugitive Dust Control
(12) Proposed building pad elevations are subject to review and
modification in accordance with Chapter 27 of the Palm Desert
Municipal Code .

Chamber at the Palm Desert Civic Center, 73-510 Fred .Waring Drive, Palm Desert,
