TT 28750 Department of Community Development: 1. The development of the property shall conform substantially with exhibits on file with the Department of Community Development, as modified by the following conditions. 2. Construction of a portion of said project shall commence within two years from the date of final approval unless an extension of time is granted; otherwise, said approval shall become null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Drainage fees, in accordance with Section 26.49 of the Palm Desert Municipal Code and Ordinance 653, shall be paid prior to recordation of tract map. 2. Signalization fees, in accordance with City of Palm Desert Resolution Nos. 79-17 and 79-55, shall be paid prior to recordation of tract map or issuance of grading permits. 3. Any storm drain/retention area construction shall be contingent upon a drainage study prepared by a registered civil engineer that is reviewed and approved by the Department of Public Works. 4. In accordance with Palm Desert Municipal Code Chapter 27, complete grading plans and specifications shall be submitted to the Director of Public Works for checking and approval prior to the issuance of any permits. 5. All private street construction shall be in accordance with Chapter 26 of the Palm Desert Municipal Code and be inspected by the Department of Public Works with a standard inspection fee paid prior to issuance of any permits associated with this project. Maintenance of private streets shall be the responsibility of the lot owners. 6. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the Department of Public Works prior to the issuance of the grading permit. 7. Complete final tract map shall be submitted to the Director of Public Works for checking and approval prior to the issuance of any permits associated with this project. 8. Proposed pad elevations as shown on the tentative tract map are subject to review and modification in accordance with Chapter 27 of the Palm Desert Municipal Code. Site grading design shall include consideration of existing topography as well as existing development adjacent to the subject site. 9. Applicant shall comply with provisions of Palm Desert Municipal code Section 12.12, Fugitive Dust Control. 4 PLANNING COMMISSION RESOLUTION NO. 1850 10. Riverside County Fire Department: 1. With respect to the conditions of approval regarding the above referenced plan check, Fire Department recommends the following fire protection measures be provided in accordance with City Municipal Codes, appropriate NFPA Standards, CFC, UFC, and UBC and/or recognized Fire Protection Standards: The Fire Department is required to set a minimum fire flow for the remodel or construction of all commercial buildings per Uniform Fire Code Sec. 10.301C. 2. A fire flow of 1500 gpm for a 1 hour duration at 20 psi residual operating pressure must be available before any combustible material is placed on the job site. 3. Provide, or show there exists, a water system capable of providing a potential gallon per minute flow of 1500 for single family. The actual fire flow available from any one hydrant connected to any given water main shall be 1500 GPM for two hours duration at 20 PSI residual operating pressure. 4. The required fire flow shall be available from a Super hydrant(s) (6"x 4" x 2-1/2" x 2-1/2"), located not less than 25' nor more than 200' from any portion of the building(s) as measured along approved vehicular travelways. Hydrants installed below 3000' elevation shall be of the "wet barrel" type. 5. Provide written certification from the appropriate water company having jurisdiction that hydrant(s) will be installed and will produce the required fire flow, or arrange field inspection by the Fire Department prior to request for final inspection. 6. Certain designated areas will be required to be maintained as fire lanes and shall be clearly marked by painting and/or signs as approved by the Fire Marshal. 5 PLANNING COMMISSION RESOLUTION NO. 1850 7. All buildings shall be accessible by an all-weather roadway extending to within 150' of all portions of the exterior walls of the first story. The roadway shall be not less than 24' of unobstructed width and 13'6" of vertical clearance. Where parallel parking is allowed, the roadway shall be 36' wide with parking on both sides, 32' wide with parking on one side. Dead-end roads in excess of 150' shall be provided with a minimum 45' radius turn around (55' in industrial developments). Fountains or garden islands placed in the middle of these turn-arounds shall not exceed a 5' radius or 10' diameter. City standards may be more restrictive. 8. Whenever access into private property is controlled through use of gates, barriers, guard houses or similar means, provision shall be made to facilitate access by emergency vehicles in a manner approved by the Fire Department. All controlled access devices that are power operated shall have a Knox Box over-ride system capable of opening the gate when activated by a special key located in emergency vehicles. All controlled access devices that are not power operated shall be approved by the Fire Department. Minimum opening width shall be 16' with a minimum vertical clearance of 13'6". 9. A dead end single access over 500' in length will require a secondary access, sprinklers or other mitigative measure approved by the Fire Marshal. Under no circumstances shall a single dead end access over 1300 feet be accepted. 10. A second access is required. This can be accomplished by two main access points from main roadway or an emergency gated access into an adjoining development. 11. All new residences/dwellings are required to have illuminated residential addresses meeting both City and Fire Department approval. Shake single roofs are no longer permitted in the Cities of Indian Wells, Rancho Mirage or Palm Desert. 12. As drawn, Items 7, 9 and 10 do not meet Fire Department requirements. 13. Due to the uniqueness of this piece of property and the fact that there is no other way to access it, the secondary access requirement is rescinded with the following mitigating factors: a. (Including this page) The purpose of this memo is to keep you informed of events that have taken place since I delivered my letter regarding Case No.: TT 28750, and the Sunlite Development project. A Mr. Paul Dewey representing Sunlite Corporation left a message on my phone recorder shortly after I delivered the letter Friday afternoon. He wanted to set up a meeting on Saturday 2/28/98 to discuss the concerns expressed in my letter dated 2/27/98. Unfortunately the message was not received in time to make a return call on Friday. An attempt was made to reach Mr. Dewey on Saturday 2/28/98 at his office and cellular phones. Unfortunately contact was not made so a message was left for him on his recorder. On Sunday afternoon Mr. Dewey called and we discussed the proposed development and my previously stated concerns. Mr. Dewey agreed that my concerns were legitimate and assured me that they would be handled in a mutually satisfactory and timely manner. I felt that our conversation had merit and that Mr. Dewey was sincere in his statements that all would be taken care of. Never the less, I still have reservations, and will continue to have them until the issues are resolved. Apparently storm water drainage engineering and related drawings are being prepared, and will be acted upon by a City expert in that field. I am also concerned about having to back cars out of our garage into the Heather Court, Della Robbia intersection. I discussed with Mr. Dewey the possibility of locating the extension of Della Robbia Lane on the West Side of the trees thereby reducing substantially the possibility of the storm water crossing onto our property, plus the hazard of backing into the intersection. The existing access to our property and our neighbor to the south would remain the same. He said this would not work due to access width requirements, but I believe this could be worked out if became the preferred ingress and egress to the property. We discussed the other issues in the 2/27198 letter, and came to the conclusion that we should be able to work them out. One area we did not discuss was conditions related to compliance with Ironwood Master Maintenance Association (IMMA) regulations. This certainly must be a very important condition before approval of the project. I assured Mr. Dewey that my intentions were not to stop or delay the project, but are to protect my interests as an adjacent property Owner. We agreed to set up a meeting upon my return sometime after Sunday 3/8/98 to discuss and hopefully resolve the issues. .,tCHARD & RAINY SCHOENBERI, 49-300 DELLA ROBIA LANE PALM DESERT, CA 92260 760/346-1408 or 568-6991 RECEIVED February 27, 1998 MAR 0 3 1998 COMMUNITY DEVELOPMENT DEPARTMENT Mr. Philip Drell, Secretary cmoF PALM DESERT City of Palm Desert Planning Commission 73-510 Fred Waring Drive Palm Desert, CA 92260-2578 Subject: Case No.: TT28750, Sunlite Development, APN 631-130-005 Dear Mr. Drell: I am writing to make as a matter of record, my concerns about the development being proposed by Sunlite Corporation titled Case No. TT28750. I own and reside with my wife at 49-300 Della Robbia Lane, which is the property directly to the east of the proposed development. We examined Rough Grading Plan drawings today and yesterday. A copy of the Staff Report to be presented to the Panning Commission on March 3, 1998 was also made available to us. The plans indicate that the home sites being developed are generally in harmony with the surrounding homes and home sites in the area. Some lot shapes are somewhat unique, and are triangular in shape. Whether they meet minimum width and length restrictions is questionable. The plans also indicate that the pad grades are being reasonably held within the existing topography elevations, and that no fill will be imported. In other words fill is not being imported to raise the pads an excessive amount above the existing natural grades. If this is not true we would object strenuously. Our major concern is how the ingress and egress to the development will effect our property access, and the handling of storm water. We along with our neighbor to the south currently access our property via the easterly portion of the proposed Della Robbia Lane improvement. The proposed intersection of Della Robbia Lane and Heather Court is located where we access our garage. We are very concerned about the storm water being collected on Heather Court flowing into and through our property. The water would have to take a 90 degree turn to the north at the intersection to travel down Della Robbia Lane. There is nothing on any drawings we have been permitted to examine that shows any provision to enter, and exit our garage, or the safe handling of this potentially large flow of water. The drawings do show the gathering of storm water into a concrete gutter along the eastern boundary of the portion north of Heather Court. This water is shown being dumped into the intersection to hopefully flow down Della Robbia Lane. Another concern that we have is the ingress egress easement referred to, for access from Della Robbia Lane is with Ironwood Master Maintenance. We have seen no documentation showing that they approve or disapprove the project or that they can legally pass on the easement to the Developer. 1� February 27, 1998 Mr. Philip Drell, Secretary City of Palm Desert Planning Commission Page (2) The plans show removal of trees and landscaping material from our property to accommodate improvements to Crosby Lane and Della Robbia. What is to be done with these items. Do we have the right to require the Developer to relocate them elsewhere on our property? Is the Developer aware where the 12"water main really is? It is actually slightly west of the median strip palms. It is not buried very deep either, just a few feet below the surface. Maybe there is a better way to handle ingress and egress to the development. Possibly the median could be eliminated and the trees relocated to the West Side of Della Robbia Lane. Who will maintain and water the trees where ever they are located? As drawn some of the trees do not appear be in the center of the median. Will the Developer move them so they do not interfere with the street? Item no. 2 of the conditions of approval state that a portion of the project shall commence within two years. Does this mean that the project site work can drag out over many years. Having heavy grading equipment coming and going over a period of years is very disagreeable and we certainly would object to it. As you can see there a number of issues that need addressing. I am sure these problems can be worked out satisfactorily, but they need to be addressed up front. To date we have not been contacted by the Developer or any of it's Agents regarding this project. This seems very strange to us since what they are proposing impacts all of the surrounding properties. Mr. Phil Joy an Associate Planner has been most helpful and cooperative. Unfortunately he can not act as an intermediary between myself and the Developer. Unfortunately I will be away on a business trip on March 3, 1998, the day of the hearing, and will not be able to attend the meeting. Since we feel there are a number of issues that require resolution, we respectfully request that approval of the project be withheld until they are resolved. Sincerely, Richard C. DISCUSSION The subject 10 acres is the last undeveloped part of an approximately 40-acre area wedged between Ironwood Country Club and the "Canyons at Bighorn." An addendum to the CC&R's of Ironwood Country Club allowed the property access through Ironwood subject to its inclusion in the "master maintenance agreement"for streets within the club. The subdivision is designed with a 720-foot long east/west cul-de-sac surrounded by 12 lots and a 180-foot long north/south cul-de-sac surrounded by six lots. 1 PLANNING COMMISSION MARCH 3, 1998 TT 28750 Due to the length of the cul-de-sac, the applicant negotiated with the Fire Marshal to provide 5/8" drywall for fire mitigation. The project extends Della Robbia Lane south another 220 feet. The east side of this extension currently serves as a driveway to two developed single-family lots with rows of palm trees on both sides. This driveway will act as the egress from the subdivision. The westerly row of palms will remain in a center median and the new 16-foot wide section of Della Robbia Lane will serve as ingress to the subdivision. The site is currently bordered to the south by a 10-foot high earthen dike, formerly used to divert flood waters, but now not needed due to construction of the Palm Valley Channel and other flood control work completed by the Canyons at Bighorn. Most of the dike is located on the Canyons project and is shown to be removed on their rough grading plan. Sunlite's proposed lots that back up to the dike will be four to 10 feet lower still due to the depth of the lots and the natural sloping terrain in this portion of Palm Desert. Sunlite's proposal shows this cut slope to be accommodated on their lots so that the property line will be at top of slope. The perimeter wall will be reviewed by staff at a later date -- unless any controversy comes up -- in which case the wall would be reviewed by the City's Architectural Review Commission. The lots on the north side of the proposed cul-de-sac are proposed to be graded following the natural terrain. The drainage of these lots will be to the rear into a channel that will take the water to the northeast portion of the tract. The entire property is zoned R-1, 20,000 so the building setbacks/building heights will be as permitted in that zone: front setback 25 feet; rear setback 20 feet; side setbacks 15 feet; and maximum building heights 15 to 18 feet if approved by the City's Architectural Review Commission. Riverside County Fire Department: 1. With respect to the conditions of approval regarding the above referenced plan check, Fire Department recommends the following fire protection measures be provided in accordance with City Municipal Codes, appropriate NFPA Standards, CFC, UFC, and UBC and/or recognized Fire Protection Standards: The Fire Department is required to set a -minimum fire flow for the remodel or construction of all commercial buildings per Uniform Fire Code Sec. 10.301 C. 2. I own and reside with my wife at 49-300 Della Robbia Lane, which is the property directly to the east of the proposed development. We examined Rough Grading Plan drawings today and yesterday. A copy of the Staff Report to be presented to the Panning Commission on March 3, 1998 was also made available to us. The plans indicate that the home sites being developed are generally in harmony with the surrounding homes and home sites in the area. Some lot shapes are somewhat unique, and are triangular in shape. Whether they meet minimum width and length restrictions is questionable. The plans also indicate that the pad grades are being reasonably held within the existing topography elevations, and that no fill will be imported. In other words fill is not being imported to raise the pads an excessive amount above the existing natural grades. If this is not true we would object strenuously. Our major concern is how the ingress and egress to the development will effect our property access, and the handling of storm water. We along with our neighbor to the south currently access our property via the easterly portion of the proposed Della Robbia Lane improvement. The proposed intersection of Della Robbia Lane and Heather Court is located where we access our garage. We are very concerned about the storm water being collected on Heather Court flowing into and through our property. The water would have to take a 90 degree turn to the north at the intersection to travel down Della Robbia Lane. There is nothing on any drawings we have been permitted to examine that shows any provision to enter, and exit our garage, or the safe handling of this potentially large flow of water. The drawings do show the gathering of storm water into a concrete gutter along the eastern boundary of the portion north of Heather Court. This water is shown being dumped into the intersection to hopefully flow down Della Robbia Lane. Another concern that we have is the ingress egress easement referred to, for access from Della Robbia Lane is with Ironwood Master Maintenance. We have seen no documentation showing that they approve or disapprove the project or that they can legally pass on the easement to the Developer. February 27, 1998 Mr. Philip Drell, Secretary City of Palm Desert Planning Commission Page (2) The plans show removal of trees and landscaping material from our property to accommodate improvements to Crosby Lane and Della Robbia. What is to be done with these items. Do we have the right to require the Developer to relocate them elsewhere on our property? Is the Developer aware where the 12"water main really is? It is actually slightly west of the median strip palms. It is not buried very deep either, just a few feet below the surface. Maybe there is a better way to handle ingress and egress to the development. Possibly the median could be eliminated and the trees relocated to the West Side of Della Robbia Lane. Who will maintain and water the trees where ever they are located? As drawn some of the trees do not appear be in the center of the median. Will the Developer move them so they do not interfere with the street? Item no. 2 of the conditions of approval state that a portion of the project shall commence within two years. Does this mean that the project site work can drag out over many years. Having heavy grading equipment coming and going over a period of years is very disagreeable and we certainly would object to it. As you can see there a number of issues that need addressing. I am sure these problems can be worked out satisfactorily, but they need to be addressed up front. To date we have not been contacted by the Developer or any of it's Agents regarding this project. This seems very strange to us since what they are proposing impacts all of the surrounding properties. Mr. Phil Joy an Associate Planner has been most helpful and cooperative. Unfortunately he can not act as an intermediary between myself and the Developer. Unfortunately I will be away on a business trip on March 3, 1998, the day of the hearing, and will not be able to attend the meeting. Comply with Title 24 of the California Code of Regulations, adopted January 1, 1990, for all occupancies. 11. Install a complete fire sprinkler system per NFPA 13. The post indicator valve and fire department connection shall be located to the front, not less than 25' from the building and within 50' of an approved hydrant. This applies to all buildings with 3000 square feet or more building area as measured by the building footprint, including overhangs which are sprinklered per NFPA 13 . The building area of additional floors is added in for a cumulative total . Exempted are one and two family dwellings. 12. Install a fire alarm (water flow) as required by the Uniform Building Code 3803 for sprinkler system. Install tamper alarms on all supply and control valves for sprinkler systems. 1pqCertain designated areas will be required to be maintained as fire lanes and shall be clearly marked by painting and/or signs approved by the Fire Marshal. 14. The roadway shall be not less than 241 of unobstructed width and 131 6" of vertical clearance. Dead-end roads in excess of 150' shall be provided with a minimum 45' radius turn-around (55' in industrial developments) . The minimum width of interior driveways for multi-family or apartment complexes shall be: a. 24 feet wide when serving less than 100 units, no parallel parking, carports or garages allowed on one side only. b. 28 feet wide when serving between 100 and 300 units; carports or garages allowed on both sides, no parallel parking. A dead end single access over 500' in length will require a secondary access, sprinklers or other mitigative measure approved by the Fire Marshal. Contact the Fire Department for a final inspection prior to occupancy. 24. This project may require licensing and/or review by State agencies.
