TT 5553 , SILVER SPUR ASSOCIATES Applicant : Con- sideration of a Request for Approval of the Tentative Tract Map to Create 71 Single-Family Residential Lots Ranging in Size from Approximately 10, 000 Sq. Ft . to 30, 000 Sq. Ft . from a Parcel Approximately 27. 5 Acres in Size Located Within the PR-7 (Planned Residential , Maximum 7 du/acre) Zone at Ironwood Country Club. Mayor Mullins declared the Public Hearing open and asked for Staff ' s input . Mr. Willimas reported that due to the fact that this is a departure from the previous subdivisons in Ironwood, Staff supports the request for continuance to May 11 , 1978 , to allow additional time to work out any problems they may have. Councilman Brush moved and Councilman McPherson seconded to continue the Public Hearing to the meeting of May 11 , 1978 . Motion carried unanimously_------," 1 B. CASE N . TT 5564 SILVERSPUR ASSOCIATES , Applicant : Con- sidera ion of Request for Approval of a Tentative Tract Map to a e 19 Single-Family Residential Lots on Approxi- mately 16 . 1 Acres Within the PR-7 (Planned Residential , Maximum 7 du/acre) Zone at Ironwood Country Club. Mayor Mullins declared the Public Hearing open and asked Staff for input . Mr. Williams reviewed the Staff report , stating that Ironwood is in compliance with all standards and Staff recommended approval of the Tentative Tract Map . Councilman Brush asked about Special Condition N7 which states that there will be no building permits issued until the proposed Fire Station is fully operative . He felt that this was not quite fair in that the City cannot guarantee a Fire Station tomorrow or for five years from now. Mayor Mullins invited input in FAVORof the project . MR. LARRY SPICER, President , Ironwood Country Club, addressed Council indicating that all conditions were acceptableto them with the exception of Special Condition No . 7 , which, from their point of view, would be onerous. He stated that this condition could penalize them by delaying construction due to problems beyond their control . Councilman Newbrander stated that the Council ' s concern was in knowing that the land would be made available for a Fire Station ; however , it is now the City ' s responsibility to obtain the money for construction . Councilman McPherson stated that he appreciated the planning and need for a Fire Station , but would this place an encum- berance upon the City to find the money in the next year ' s budget? . April 27 , 1978 Page 2 A _^ Mr. Bouman responded that Bud Engle , Fire Marshal , had made suggestions as to the design and costs of the Fire Station , and Staff had a pretty firm grip on what the budget appro- priations would be. He also stated that he had received a letter on April 27th from David Flake , County Fire Warden , giving more details on specifications which seem to conform to those recommended by Bud Engle . The City is ready to move ahead with Capital Improvement Budget appropriations for the Fire Station . Councilman Nilson stated that it would be most desirable to move toward construction planning this year so that when the money is available, we can proceed with the construction . Mr. Bouman responded that he would be coming to Council with a budget adjustment either next meeting or the following one , and he was confident it would not put the City in a deficit position . Mayor Mullins invited input in OPPOSITION to the project , and none was offered. He declared the Public Hearing closed. Councilman Brush moved and Councilman McPherson seconded to adopt Resolution No. 78-42 with the deletion of Special Condition #7 . Motion carried unanimously. C. CASE NO. VAR 03-78 , DAVID FULLER Applicant : Consideration of an Appeal of Planning Commission Resolution No. 347 Which Denied a Request for Approval of a Variance from the Require- ments of the Palm Desert Municipal Code Regarding the Size and Height of Signs in Residential Zones Other Than Single Family, Pursuant to the Procedures Established for the Granting of Exceptions in Sec. 25. 68 . 730 of the Municipal Code . Mr. Williams reviewed the Staff report pointing out the exhibits filed by the applicant to justify the keeping of his sign for the Siebu Garden Apartments.He also presented a letter from a resident of the apartments in favor of the sign and a letter from an adjacent property owner who opposed the sign. Mr. Williams stated that the Planning Commission , in their review of the request , found that the requirements for a variance could not be met in this instance , and there- fore denied the requested variance. Mr. Williams stated that it was Staff ' s recommendation that the City Council uphold the findings of the Planning Commission and deny the appeal . Mayor Mullins declared the Public Hearing open and requested input in FAVOR of the appeal . MR. DAVID FULLER, 44-695 San Carlos , Palm Desert , addressed Council as owner of the Siebu apartments and the appellant . He questioned why Palm Desert ' s Ad Hoc Sign Committee did not take into consideration the Ipso Facto Law which declares it unconstitutional to enact a new law after the fact . Mayor Mullins asked the Deputy City Attorney to reply . Mr. - Patterson advised that the City does have the authority to enact this. law. Ipso Facto Law applies. to Criminals , and )l this is a Civil case; it would not apply to this case . Mr. Williams reviewed the City ' s regulations relative to signs , pointing out that all sides had been considered by the Ad Hoc Sign Committee . ',Jr. Fuller continued his appeal by pointing out why he felt the changes being required would be detrimental to his busi- ness , including the fact that he depended upon his sign being visible from Highway 111 to attract business. He also stated that the sign ' s decorum was that of the entire complex , and the sign was designed with an oriental motif-to compliment the apartments . MR. RO`SEO POLUQI , 73-340 Highway 111 , Palm Desert , addressed Council in favor of the appeal and stating that he would be appealing his own case in the very near future . He pointed out that the north side of Highway 111 was 3-1 /2 ' lower than April 27 , 1978 , Page 3 i the south side and signs needed to be higher to be seen . He also stressed the importance of visibility from Highway 111 for business Mayor Mullins asked for input in OPPOSITION to the appeal , and none was offered. He declared the Public Hearing closed. Councilman {Nilson stated that he felt making one exception would obligate the Council to continue makinq exceptions. The City must hold firm; we do have an appeals committee , and it is their purpose to recommend rather than create variances. Councilman Newbrander questioned the point of visibility from Highway Ill in that motorists traveling at 45 mph would not see the sign anyway. Councilman Wilson added that there are vacant lots around the apartments now, but that with the development going on , that would probably not be the case for long. Councilman McPherson stated that ?,.fr . Poluqi had stated that the Council had had their minds made up in passing the sign ordinance . That was not the case. The City Council went through numerous public hearings with the sign ordinance , as did the Planning Commission , and hundreds of changes were made as a result of these hearings. He agreed that motorists would not see the sign while driving at 45 mph down Highway 111 , stating also that most apartments do not rely on signs but rather have just street addresses. Councilman Wilson moved and Councilman Newbrander seconded to waive further reading and adopt Resolution No. 78-43 , upholding the findings of the Planning Commission and denying the appeal . Motion carried unanimously. _ D. CASE N . TT 5565 , ILVER SPUR ASSOCIATES , Applicant : Con- sider tion of equest to Amend Various Conditions of Approv Case No. TT 5565 . Mayor Mullins declared the Public Hearing open . Mr. Williams reviewed the Staff Report indicating that this was a request for consideration of amendments for conditions imposed on TT 5565 . However , the Council will be considering the status of Portola Avenue in the near future , and this will have a bearing on the request in front of Council . Therefore , Staff was recommending that Council continue the matter to July 13 , 1978 , and adoption of a resolution to initiate a General Plan Amendment rela- tive to the status of Portola Avenue . Councilman Brush moved and Councilman Newbrander seconded to continue the Public Hearing to the meeting of July 13 , 1978 ; motion carried unanimously. Councilman Brush moved and Councilman McPherson seconded to waive further reading and adopt Resolution No. 78-55 , initiating a General Plan Amendment to reduce the status of a portion of Portola Avenue to a local street and refer the matter to the Planning Commis- sion for a recommendation . Motion carried unanimously . VIII . RESOLUTIONS A. RESOLUTION NO. 78-46 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA , AMENDING THE 1977/78 BUDGET TO PROVIDE AN APPROPRIATION FOR PAYMENT OF THE COSTS OF RELOCATING GAS TRANSMISSION FACILITIES IN SAN LUIS REY AND CATALINA WAY . Mr. Bouman explained that this was a late billing to the City. Councilman Brush moved and Councilman Wilson seconded to waive further reading and adopt Resolution No. 78-46; motion carried unanimously . Mr. Bouman replied that there was controversy over the quality or Archi- tectural features. Councilman McPherson stated that he would abstaid. The long response times from our existing Palm Desert Fire Station will cause fires that would normally be small to grow in size prior to fire depart- ment arrival , causing more damage and posing a greater risk to human life. It is my opinion that we cannot allow the area south of Haystack Road to continue it' s rapid rate of growth without providing additional fire/rescue protection. How- ever, if the Palm Desert City Planning Commission decides to allow.continued develop- ment in this area, the following conditions shall be met: 1 . Install a water system capable of delivering 2000 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. TT 5564 is in accordance with the require- ments prescribed by the Fire Marshal . REQUEST: Request for approval of a Tentative Tract Map to create 19 single-family residential lots on approximately 16.1 acres within the PR-7 (Planned Residential , maximum 7 du/acre) zone at Ironwood Country Club. II. STAFF RECOMMENDATION: Recommend to the City Council approval of the Tentative Tract Map subject to the conditions of approval by Planning Commission Resolution No. 345. Justification is based upon: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. ' 2. The subject Tentative Map does comply with the Adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The siteis physically suited for the proposed density of the develop- . ment. 5. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. III . BACKGROUND: A.. Tract Size: - Approximately 16.1 acres B. Proposed Lots: Lots 1-19 Single-family residential , ranging in size from 20,000 to 54,000 sq. ft. C. Zoning: PR-7 and R-1 20,000 D. Adjacent Zoning: North - PR-7 South - PR-7, D and O.S. East - PR-7 West - R-1 20,000 E. Environmental Finding: The project is exempt from further environmental documentation pursuant to Sec. 5(h) of the City of Palm Desert Resolution No. 77-7. A previous EIR for the entire project, entitled "Silver Spur" , was submitted in June 1972. Case No. TT5564 March 28, 1978 Page Two III . BACKGROUND: (Cont. ) F. Utilities: Power - So. Calif. Edison Telephone - General Telephone Natural Gas - So. Calif. Gas Co. Water - C.V.C.W.D. Sewer - C.V.C.W.D. , Sanitary sewers IV. DISCUSSION: Tract 5564 is one of two proposed new single-family residential increments of the Ironwood Country Club development. Tract 5564 contains 19 lots rang- ing in size from approximately 20,000 to 54,000 square feet on approximately 16. 1 acres. This tract differs from previous increments at Ironwood in that 19 individual building sites will be offered to those who wish to con- struct custom homes within Ironwood. The design of all proposed structures and improvements will be subject to both Ironwood's approval and the City's Design Review Board process to insure quality development compatible with adjacent development. This project is designed to create a small , secluded area for large custom single residences adjacent to the 14th and 15th fairways of the north golf course at Ironwood. The project consists of two adjacent tiers of building sites separated in elevation by approximately ten feet of maximize the views from all sites of the adjacent mountains, desert, and golf courses. Access to the sites is from Irontree Drive along a long cul-de-sac easement to which the lower tier of sites is connected by common drives. An easement is pro- vided for emergency vehicle access from the end of the cul-de-sac to existing drives to the west. This design is in conformance with the purpose and intent of the original conditional use permit. Access easements will be constructed per previous increments and maintained as private drives by property owners ' associations in accordance with cove- ants, conditions, and restrictions similar to those for previous Ironwood tracts. On-site storm waters are proposed to be carried by the private street system, with structures elevated above flowing water levels. Potential off-site drainage from the west will be intercepted by "A" street and routed to Irontree Drive clear of structures. The tract is protected by the existing Dead Indian Creek Channel and levee system from off-site flows south of the tract. Natural ground adjacent to this levee is approximately 15 to 20 feet above the bottom of the channel . The Special Conditions of Approval require that the lots be developed in ac- cordance with the development standards prescribed by the City's R-E (Estate, Residential ) zoning district. This would insure large setbacks; 25' min. on the sides, 50' front and 50' rear and max. building heights of 18' or 1-story, whichever is less. Special Condition No. 2 insures that each proposed resi- dence will be reviewed by the City's Design Review process. Finally, Special Condition No. 4 requires a pedestrian connection between the phase being pro- posed and previous phases of the overall development. RUTH MARGARET FOLAN, 48-120 Birdie Way asked the Commission that they consider 40 ft . setbacks not 25 ft . Mr. Spicer asked that the lots on Portola not be re- stricted only those on the north side of A Street . Commissioner Snyder suggested that a few lots be taken out and do away with the proposed street east of Birdie Way. Mr. Spicer noted this would be considered. Some discussion followed regarding the 40 ft . setback requirement on A Street . Commissioner Kelly asked that it be stated in the conditions that all the lots have 40 ft . set- backs. Chairman Berkey noted the letter from Bud Engel , City Fire Marshal , noting that he had been informed that the City was concluding its deal for a fire station to be located west of the proposed tract . The Commission requested that an additional condition be added that no permits be issued until the fire station is operational . Commis- sioner Kryder stated that it should be sufficient that the fire sta- tion be in the process of being built . There was some discussion between the Commission and members of the audience about this developer being penalized for the lack of a fire station when this is the City ' s problem. Chairman Berkey stated that the City has an obligation to people to give them fire protection , which is already needed, and not to compound the issue by allowing this development to be started with- out some fire protection. Mr. Williams noted the changes in the Special Conditions . _ No. 1 with its 5 subsections; No. 5 add: The additional width shall be taken from the south of the proposed street; and, the addition of No. 13 regarding nogpermits issued until the fire station is fully operative. On a motion by Commissioner Kelly, seconded by Commissioner Reading, the Commission approved the case with the noted conditions of approval by Planning Commission Resolution No . 344 ; carried unamious- ly (5-0) . B. Case No . TT 5564 - SILVER SPUR ASSOCIATES, Applicant Consideration of a request for approval of a Tentative Tract to create 19 single-family residential lots on approximately 16. 1 acres within the PR-7 (Planned Re- sidential , maximum 7 du/acre) zone at Ironwood Country Club . Mr . Williams reviewed the case noting that the big issue is flood control . He stated that the Director of Public Works feels that the problem can be resolved by careful engineering. He noted an amendment to Special Condition No . 1 regarding setbacks and height limitations to read as follows : 1-a The front yard setback shall be 25 ' ; 1-b The rear yard setback shall be 20 ' ; 1-c The side yard setback shall be 20 ' ; and, 1-d All proposed residences shall be single-story or 18 ' in height maximum , whichever is less. Commis- sioner Kelly asked about bikeways , if a Special Condition is needed . Mr. Williams noted it was covered already. CUP 02-78 and 112MF, CATHOLIC BISHOP OF SAN DIEGO, Applicant Consideration of a request for approval of a Conditional Use Permit and Preliminary Design Review to construct and operate a 40 unit , church-related retirement center and related recreation structure on approximately 7. 96 acres within the R-1 9, 000 (Single-family residential , minimum 9, 000 sq . ft . site are) zone located on the west side of Deep Canyon , north of 44th Avenue . Mr . Williams reviewed the case noting that Deep Canyon would be extended to the Parkview Estates project . If approved as institu- tional the center would be used for retired priests of the diocese . The Design Review Board suggested changes in the landscaping and the church has agreed to the changes . Unless the demand for electrical generating capacity exceeds our estimates, and provided that there are no unexpected outages to major sources of electrical supply, we expect to meet our electrical load requirements for the next several years. Our total system demand is expected to continue to increase annually; and, if our plans to proceed with future construction of new generat- ing facilities are delayed, our ability to serve all customer loads during peak demand periods could become marginal by 1981. In addition, the major fuel used in Edison's generating facilities is low sulfur fuel oil. We now believe our low sulfur fuel oil inventory, together with our contractual commitments for delivery, and our customers' conservation efforts, will permit us to meet the forecasted demand for electricity during 1978. It is our intention to continue to do everything that can reasonably be accomplished to provide our customers with a continuous and sufficient supply of electricity. DISCUSSION: Tract 5564 is one of two proposed new single-family residential increments of the Ironwood Country Club development. Tract 5564 contains 19 .1ots rang- ing in size from approximately 20,000 to 54,000 square feet on approximately 16`1 acres.: This tr` aet�differs from previous increments at Ironwood in that 19 individual building sites will be offered to those who wish to con- struct custom homes within Ironwood. The design of all proposed structures and improvements will be subject to both Ironwood's approval and the City's Design Review Board process to insure quality development compatible with adjacent development. This project is designed to create a small , secluded area for large custom single residences adjacent to the 14th and 15th fairways of the north golf course at Ironwood. The project consists of two adjacent tiers of building sites separated in .elevation by approximately ten feet of maximize the views from all sites of the adjacent mountains, desert, and golf courses. Access to the sites is from Irontree Drive-along- a -long cul-de-sac easement to which the lower tier of sites is connected by common drives. An easement is pro- vided for emergency vehicle access from the end of the cul-de-sac to existing drives to the west. This design is in conformance with the purpose and intent of the original conditional use permit. Access easements will be constructed per previous increments and maintained as private drives by property owners ' associations in accordance with cove- ants, conditions , and restrictions similar to those for previous Ironwood tracts. On-site storm waters are proposed to be carried by the private street system, with structures elevated above flowing water levels. Potential off-site drainage from the west will be intercepted by "A" street and routed to Irontree Drive clear of structures The tract is protected by the existing Dead Indian Creek Channel and levee system from off-si.te flows south of the tract. Natural ground adjacent to this levee is approximately 15 to 20 feet above the bottom of" the channel . The Special Conditions of Approval require that the lots be developed in ac- cordance with the development standards prescribed by the City's R-E (Estate, Residential ) zoning district. This would insure large setbacks; 25' min. on the sides, 50' front and 50' rear and max. building heights of 18' or 1-story, whichever is less. Special Condition No. 2 insures that each proposed resi- dence will be reviewed by the City's Design Review process. Finally, Special Condition No. 4 requires a pedestrian connection between the phase being pro- posed and previous phases of the overall development. The long response times from our existing Palm Desert Fire Station will cause fires that would normally be small to grow in size prior to fire depart- ment arrival , causing more damage and posing a greater risk to human life. It is my opinion that we cannot allow the area south of Haystack Road to continue it's rapid rate of growth without providing additional fire/rescue protection. How- ever, if the Palm Desert City Planning Commission decides to allow continued develop- ment in this area, the following conditions shall be met: 1 . Install a water system capable of delivering 2000 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. TT 5564 is in accordance with the require- ments prescribed by the Fire Marshal . The long response times from our existing Palm Desert Fire Station will cause fires that would normally be small to grow in size prior to fire depart- ment arrival , causing more damage and posing a greater risk to human life. It is my opinion that we cannot allow the area south of Haystack Road to continue it' s rapid rate of growth without providing additional fire/rescue protection. How- ever, if the Palm Desert City Planning Commission decides to allow continued develop- ment in this area, the following conditions shall be met: 1 . Install a water system capable of delivering 2000 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants located at each street intersection (a.) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in Tract No. TT 5564 is in accordance with the require- ments prescribed by the Fire Marshal . This tract differs from previous increments at Ironwood in that we propose to offer the 19 individual building sites to those wishing to construct large custom homes within our development. This project is designed to create a small, secluded area for large custom single residences adjacent to the 14th and 15th fair- ways of the north golf course at Ironwood.. The project consists of two adjacent tiers of building sites separated in elevation by approximately ten feet to maximize the views from all sites of the adjacent mountains, desert, and golf courses. Access to the sites is from Irontree Drive along a long cul de sac easement to which the lower tier of sites is connected by common drives. An ease- ment is provided for emergency vehicle access from the end of the cul de sac to existing drives to the west. This design is in conformance with the purpose and intent of the original conditional use permit. On-site storm waters are proposed to be carried by the private street system, with structures elevated above flowing water levels. Potential off-site drainage from the west will be intercepted by "A" street and routed to Irontree Drive clear of structures. The tract is protected by the existing Dead Indian Creek channel and levee system from off-site flows south of the tract. Natural ground adjacent to this levee is approximately 15 to 20 feet above the bottom of the channel. The City Director of Environmental Services has waived any require- ment at the Tentative .Map stage for proposed CC&R' s, Health Officer Statement, tree planting, landscaping, irrigation, preliminary soils report and grading plan.
