Report On: Appeal of denial by Planning Commission for a 12-month time
extension of Tentative Tract 5567
Applicant: MERCURY ENTERPRISES, INC.
Case No. : T.T. 5567
I. REQUEST: That the City Council override the Planning Commission and
grant a 12-month extension for Tentative Tract 5567 consisting of 65
acres located near the southeast corner of Homestead and Highway 74.
II. RECOMMENDATION: That the City Council uphold the Planning Commission
finding and deny the request for extension by City Council Resolution
No. 75-125.
Justification is based upon:
1. The tract map presents several circulation problems within the
project itself as well as surrounding areas that need to be more
adequately addressed and would require some modification to the
Tentative Map.
2. The CUP would become invalid with the adoption of the new Zoning
Ordinance, thus making the Tract Map also invalid.
III. BACKGROUND:
A. Applicant: Mercury Enterprises, Inc.
B. Engineer: Pacific Rim
C. Location: Southeast corner of Homestead Road and Highway 74.
The project is bounded on the south by Indian Hills and an un-
developed portion of Ironwood, on the west by Highway 74, on the
east by an existing single family development, and on the north
by Homestead and single-family homes. Mesa View Drive extended
splits the property.
D. Parcel Size: 65 acres
E. Existing Roads: Homestead Road, State Highway 74
F. Existing Land Use: Vacant
G. Surrounding Land Use: Condominiums, Single Family Residential
H. Existing Zoning: R-1, R-2, and R-3
I. Proposed Zoning: PR-5
J. General Plan Elements: Land Use - Low Density Residential (3-5 du/acre)
Medium Density Residential (5t10 du/acre)
K. Plot Plan Description: (No. lots/units) 327 lots/326 units
L. History: The original tract was filed 8/22/73 with Riverside
County. The Palm Desert Planning Commission approved the tentative
tract map 5/20/74, with City Council approval on 6/13/74. The
tract will expire 1/13/75 if not extended.

IV. DISCUSSION: Staff finds no evidence to indicate an extension of
Tentative Tract 5567 should be granted, even though the project is
within the scope of the Palm Desert General Plan, as the adoption of
the new Zoning Ordinance would require some drastic modifications to
the project. The staff feels that a more appropriate design within
the range of 5 dwelling units/acre and conforming to the new Zoning
Ordinance is in order at this time.
Condition #11 of the original conditions of approval states. . .
"A valid CUP shall be in effect at the time of 'recordation of the
final map." The Tentative Map shall .be in substantial conformance
with the CUP.
Section 25.5-3 of the newly adopted Zoning Ordinance states. . .
"Continuation of Previously Granted Variances, Conditional Use
Permits, Permits, Licenses. Notwithstanding the provisions of this
Ordinance, no new or additional variance, conditional use permit or
license shall be required for any land use heretofore authorized by
the City of Palm Desert or the County of Riverside by a variance,
conditional use permit, building permit, license, or tentative or
final tract map, provided there has been substantial reliance upon
the above mentioned governmental entitlement, and provided further
that conditions thereof are complied with and that substantial
-..construction has begun on a portion of the project.
This means that the applicant must process a new conditional use permit.
It would not be possible for a new CUP that would conform to the new
Zoning Ordinance to use the existing tract map.

CALTFORNIA, SETTING FORTH I1' S FINDINGS AND RECOMMENDING TO THE
CITY COUNCIL, DENIAL OF A 12-MONTH EXTENSION OF TENTATIVE MAP TO

WHEREAS, the Planning Commission of the City of Palm Desert, did receive
a verified application from E. W. WRIGHT for Mercury Enterprises , Inc. requesting
approval of a 12-month extension of a tentative map on 65 acres of .land, located
in the R-1-8000 & R-2-7000 zones and situated new the southeast corner of
Homestead and Highway 74, more particularly described as:

WHEREAS, said application has complied with the requirements of the
"City of Palm Desert Environmental Quality Procedure Resolution No. 74-14" .
WHEREAS, the Planning Commission did take into consideration the
Tentative Map as submitted, and the reports of the various reviewing agencies; and
WHEREAS, the Planning Commission did find that the subject Tentative Map
does not substantially comply with the proposed Palm Desert Zoning Ordinance; and
WHEREAS, the Planning Commission did find that the subject map does
comply with the Palm Desert General Plan, but did also find a more appropriate
Development Plan 'and Tentative Map should be required.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Palm Desert as follows: (1 ) that the above recitations are true and correct
and constitute the findings of the Commission in this case; (2) that it does
hereby recommend denial to the. City Council of the City of Palm Desert to the
above described Tentative Map No. 5567.

Subject: Tentative Tract 5567
Dear Mr. Williams:
It is our understanding that initial City approval of the subject
Tentative Map will expire on December 13, 1975, and that the Conditional
Use Permit (Case No. 2-73-PD) for this Tract is in effect until July 24,
1977.
Adverse financial and market conditions have caused delays in the
commencement of subdivision maps and construction since these approvals
were granted; in light of recent improvements in these areas, we now
plan to go ahead with this project in the near future.
Application is hereby made for a twelve-month extension of time in which
to record a final map on this tract, as provided by the City Subdivision
Ordinance and State Map Act.
Please advise this office and Pacific Rim when this request for extension
of approval will be considered.

Gentlemen:
The above-listed subdivision, subject to the attached conditions, was
recommended for approval by the Planning Commission at its regular
meeting of May 20, 1974. Enclosed is the tentative map, the proposed
conditions and copies of the Health Department and Flood Control Dis-
trict -letters on the subject matter.
This matter must be set for public hearing at 7 :00 P.M. on the City
Council' s agenda of June 13 , 1974, at which--time the City Council
must approve, conditionally approve or disapprove the tentative map,
unless the time limit is extended by mutual consent of the subdivider
and the City Council.
The provisions of CEQA have previously been complied with, with respect
to the project, and there has been no substantial change in either the
project as originally reviewed or the circumstances under which the
project is to be undertaken. An Environmental Impact Report. #8 was
filed in connection with C .U. Case No. 1541-E, 7-12-73..
It was found by the Planning Commission that the subject tract is
consistent with the Riverside County General Plan of Land Use.
The Subdivision Map Act provides that approval of a tentative map
shall terminate 18 months after the date of approval by the City

Council unless an extension of time is subsequently granted by the
City Council. If the subdivider is unable to record a final map
within the 18-month period, he may file a request with the City
Council for a one-yeas extension at least 20 days prior to the
last City Council meeting prior to the expiration date. If he
is unable to record a final map within the one-year extension,
he may request a second extension of time by following this same

A water system shall be installed according to plans and specifi-

Permanent prints of the plans of tine water system shall be submitted

200 feet, along with the original drawing, to the County Surveyor.
The prints shall show the internal pipe diameter, location of valves

Permanent prints of the plans of the sewer system shall be submitted in triplicate,
along with the original drawing, to the County Surveyor. The prints shall show the
internal pipe diameter, location of manholes, complete profiles, pipe and joint
specifications, and the size of the sewers at the junction of the new system to

cone. This area is protected from stormwater flows by a system of
channels and dikes built and maintained by this District. This tract may
be considered safe from stormwater flows except in rare instances.
The Coachella Valley County Water District will furnish domestic water
and sanitation service to said tract in accordance with the currently
prevailing regulations of this District.
The sewage effluent for this tract will be treated at the District's
Water Reclamation. Plant No. 10 located at Cook Street and the Whitewater

Gentlemen:
The above tract lies on the Dead Indian Canyon and Deep Canyon debris
cone. This area is protected from stormwater flows by a system of
channels and dikes built and maintained by this District. This tract may
be considered safe from stormwater flows except in rare Instances.
The Coachella Valley County Water District will furnish domestic water
and sanitation service to said tract in accordance with the currently
prevailing regulations of this District.
The sewage effluent for this tract will be treated at the District's
Water Reclamation Plant No. 10 located at Cook Street and the Whitewater
River Stormwater Channel .
The District requests that the attached Conditions of Approval be
Included with the recommendations to be made to the Planning Commission.

Questions 3d, 4b, lal , la3: Construction of project will necessarily result in
minor disruption of sparse population of reptiles and plant life , and generation or
minor dust and noise, similar to all other other construction projects . similar
projects of much smaller and much larger magnitude creating these construction
-
related effects have been found by the County of Riverside to have no adverse
environmental effect.
Dust and noise caused by construction activity will be minimized as much as possible,
and will be of a short-term nature. The completed project will tend to shield
adjacent residences and project residents from future construction nuisance and
highway noise.
Project residents are projected to be second-home purchasers and retirees with no
significant school-age population. Project recreation facilities will result in
no significant increased demand for community recreation facilities .
Approval of all agencies routinely required in CUP and subdivision processing of
PRD will be acquired prior to recordation of map, commencement of construction or sales .
Attractive low profile architectural and landscaping features of the project , and
liberal setback from highway will adequately satisfy applicable goals and policies
of the Circulation Element of the Cove Communities General Plan, preserving and
enhancing the scenic value of the route.
The project as proposed conforms with all applicable requirements of County zoning
and subdivision ordinances and the Cove Community General Plan. No variance from
established policies and conditions are, proposed.

Gentlemen:
We have reviewed the tentative map for Tract No. 5567 and our
comments are as follows:
This section of Route 74 has .been officially designated
as a scenic highway. It is desireable for any future
development to enhance the beauty of this scenic high—
way corridor.
A left—turn pocket should be provided on Route 74 at
Mesa View Drive an access opening to this development.
In developing drainage plans for this area care should
be taken to preserve and perpetuate the existing drain—
age pattern.
The impact of the proposed development on the highways
providing access to this area should be evaluated.
Presently Route 111 is operating at approximately 82%
and Route 74 at approximately L; o of their capacities.
Even if the impact of this individual project should
prove to be insignificant, consideration should also
be given to the cumulative impact of future higher
densities in this area which could result in transpor�.
tation problems. The highway program is limited to
available funds and must concentrate its efforts on the
project with the most overall benefit to the public.
Funds for improvement to these existing facilities may
not be available when required in this area.

This development area is subjected to varying degrees
of noise generated by traffic on the highway. There—
fore consideration should be given to the compatibility
of the type and design of the development with both
existing and future noise levels along this important
transportation facility. The developer should be in—
formed that the State will not be responsible for sound
attenuation considered desireable or necessary by the
occupants of this property.
The developer must obtain an encroachment permit from
this office prior to performing any work in the State
Right of Way.
