CONDITIO�dS OF APPROVAL

1 . The development of this project shall conform substantially to all develr�p-
ment plans submitted in behalf of this case (Exhibits A-B) , and as revised
according to the Design Review Board Process and Planning Commission action.
Any minor changes require approval by the Director of Environmental Services.
Any substantial change requires approval by the Design Review Board Process
and the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State, City, and
any other applicable government entity shall be complied with as part of the
development process.
3. This approval is applicable, subject to the development of this project, com-
mencing within one year from approval date and being promptly completed.
4. The three free standing directory signs shall be white letters on a brown
background.

I accept and agree, prior to use of this permit or approval , to comply with all the
conditions set forth, and understand that the Department of guilding and Safety will
not issue a permit or allow occupancy on the use permitted until this signed confir-
mation has been received by the Department of Environmental Services.

� CONDITIONS OF APPROVAL
CASE N0. 58C
1 . The development of this project shall conform substantially to all develop-
ment plans submitted in behalf of this case (Exhibit A-K) , and as revised
according to the Design Review Board process. Any minor changes require
approval by the Director of Environmental Services. Any substantial change
requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State, City, and
any other app7icable government entity shall be complied with as part of the
development process.
3. This approval is applicable, subject to the development of this project, com-
mencing within one year from approval date and being promptly completed.
4. All service lines for utilities shall be placed underground.
5. Any roof mounted, exhaust, or air conditioning equipment shall be fully con-
cealed from view from any public rights-of-way and adjoining properties by
architecturally integrated means.
6. Final landscaping (with irrigation system) plans indicating plant sizes and
heights shall be provided to the Design Review Board for approval prior to
issuance of a building permit.
7. Lighting of parking areas and premises shall be provided as approved by the
Director of Environmental Services.
8. Signage shall be provided in accordance with signage plan to be submitted to
the Design Review Board and the Planning Commission for final approval .
9. Construction plans shall be submitted for approval to the City Fire P�arshal
prior to issuance of building permits. All conditions shall be made a part
of construction and no certificate of occupancy shall be issued until com-
pleted.
10. Right-of-ways shall be deeded to make Cook Street a 110 foot width.
11 . The plantings at all en�rances should be low growers so as not to hinder the
siaht distance on each side th�ranf,
12. The entrance sign should be moved or elevated to accomplish Itemll herein.
13. The southerly entrance on Cook Street should be a minimum of 40 feet from the
corner.
14. All curb and gutter and pavement shall be installed in accordance with City
Standards on the westerly half of Cook Street.
15. A master plan of development should be made showing how access is to be provided
for the remaining parcels. An access street should be provided and improved
(1/2 width plus 10 feet) either along the northerly side or along 42nd Street.
The sand dunes to the east preclude any major through street being developed
in this area.
16. The location of trash storage areas shall be indicated on the plot plan.
17. Applicant shall fully landscape the entire area within the required 20 foot
setback adjacent to public right-of-way.
18. The proposed development shall be limited to two (2) entrances.
19. Proposed measures to provide blowsand control , particularly on the north and
west sides of the project, shall be submitted to the Design Review Board for
approval .
20. Off-street parking shall be provided per the requirements of Sec. 25.33-7 of the
Palm Desert Zoning Ordinance.

21 . All existing overhead utility distribution lines shall be undergrounded as a
part of development per the requirements of Sec. 25.32-6.02 of the Palm Desert
Zoning Ordinance.
22. Construction plans shall be submitted for approval to the City Fire Marshal
prior to issuance of building permits. All conditions shall be made a part of
construction and no certificate of occupancy shall be issued until completed.

CONDITIONS OF APPROVAL

1 . The development of this project shall conform substantially to all develop-
ment plans submitted in behalf of this case (Exhibit A & B) , and as revised
according to the Design Review Board process. Any minor changes require ap-
proval by the Director of Environmental Services. Any substantial change
requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State, City, and
any other applicable government entity shall be complied with as part of the
development process. '
3. This approval is applicable, subject to the development of this project, com-
mencing within one year from approval date and being promptly completed.
4. All service lines for utilities shall be placed underground.
5. Curb, gutter, sidewalk, curb cuts, and tie-in paving shall be provided on San
Rafael in conformance with City Standards and the requirements of the City Engi-
neer at the time of construction or by future agreement with the City Engineer.
6. A complete and detailed landscaping and irrigation plan, fencing, lighting, and
sign plan shall be submitted to the Design Review Board prior to final approval .
7. Final construction drawings shall be submitted to the City Fire Marshal prior
to the submittal of plans for Building Plan Check.
8. Carports shall have 20'x20' of free space in the interior.
9. Applicant shall submit a written agreement in a form acceptable to the City
Attorney to join any undergrounding district involving the subject property.
10. Applicant shall submit a perimeter fencing or wall plan to the DRB for approval
as part of the submittal of final construction drawings.

12. Applicant shall create more space around the pool by moving the rear units 5
feet closer to the property line and the side units 2 feet close►� to the side
