The development of this project shall conform substantially to all development plans submitted in behalf of this case (Exhibits A-C) , and as revised according to the Design Review Board process. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. - 2. All requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. 3. Lighting of parking areas and premises shall be provided as approved by the Director of Environmental Services. 9. Signage shall be provided in accordance with a signage plan to be submitted to the Design Review Board and Planning Commission for final approval . 10. Traffic control provisions shall be provided as required by the City Engineer. 11 . The applicant shall agree to join any assessment district formed that includes the subject property within its boundaries. 12. The applicant shall grant to the City of Palm Desert, easement rights over the parking lot area of the project site in a form acceptable to the City Attorney prior to issuance of a certificate of occupancy. 13. The landscape plan shall provide for a minimum of 20" box trees throughout the entire project. 14. The planter at the intersection of Larkspur and El Paseo shall be re- located further away from the corner and lowered. 15. Applicant should investigate various colors and materials to be utilized for paved areas. - 16. An additional break-through shall be added in the parking lot for better circulation. 17. Final landscaping, grading, fencing, lighting, amenities, trash storage, walkway layout, sign and irrigation plans shall be submitted through the Design Review Process. The building permit when issued, shall include-.- the grading, lighting, amenities, trash storage, walkways, swimming pool equipment, irrigation systems, and other details. No final inspec- tion or occupancy permit shall be given by the Dept. of Environmental Services to this project until the aforementioned approved plans and construction shall have been completed 10. Emergency access right-of-way off of Deep Canyon shall have a minimum width of 20 feet. 11 . A complete landscaping plan, which includes landscaping in areas adjacent to the unit within the individual lots, shall be provided to the Design Review Board for approval . 12. Porches, patios, and other related amenities shall be added where possible to make the elevations more compatible with the desert environment. The applicant shall financially participate in the construction of the extension of the Marrakesh Channel (Tr. 9129) to Portola Ave . in an amount not to exceed $2 , 000. 14. As a part of the Final Map, the applicant shall prepare all the necessary documents and/or drawings and officially request that a maintenance district be created on the subject property to fully maintain the perimeter landscape treatment along Haystack and High- way 74. Design Review Board Conditions : 1. Proposed perimeter decorative wall shown along Highway 74, except for approved openings, shall be extended for the full length of Haystack Road on the northerly boundary of the proposed Green belt/ Drainage Swale or a alternative combination wall/earth berm treatment acceptable to the Design Review Board. 2. Traffic and Circulation Concerns: The applicant has assembled property at one of the most important intersections of the City. If the applicant's plans are developed, it will result in the placement of the most intensive uses possible from a traffic standpoint, i .e. restaurants, markets, service stations on a parcel which has many built-in liabilities from a traffic stand- point. Some of the liabilities are: 1 . Existing traffic volumes on Highway 111 , Highway 74, and El Paseo. 2. Physical configuration of said roadway. 3. Lack of compatibility of internal circulation with existing-con- ditions and development of adjacent property. 4. Deficiency of parking spaces. Pursuant to the requirements placed upon the Planning Commission by the Municipal Code in considering Conditional Use Permits , the matter of traffic should be of paramount concern with regards to the subject project. Therefore, it is recommended that an in-depth traffic study be conducted before the request is considered. Assuming that this issue can be resolved, the following revisions should be made to the design. B. Concerns regarding the Project Design: 1 . Market Location: From a use and a building mass standpoint, the staff must question the wisdom of the location of the market at the intersection of El Paseo and Highway 74. This appears contrary to the retail , pedestrian orientation which has been emphasized for El Paseo. Further, the placement of a 250 ft. long and 22 ft. high building approximately 12 ft. from the El Paseo propertyline, does not appear compatible to what exists in the area. This ap- parent lack of scale will be further emphasized by the absence of landscaping along the east side of the building. Existing markets in the community, provide two alternative methods of mitigating the the impact of such a facility. Said alternatives are: a. Provide pedestrian, oriented shops along El Paseo i .e. Smiths Food King. b. Increase setback from El Paseo i .e. existing Safeway. Recommendation: Increase the setback along El Paseo to a minimum of 30 ft. , provide a cutout at the intersection of El Paseo and Highway 74 of 40 ft. , provide a minimum ten ft. wide planter along the east side of the proposed mar- ket, and delete the proposed 14,480 sq. ft, two-story building proposed on El Paseo. Justification: a. The orientation of uses along El Paseo changes the east end, west of Highway 74, from a pedestrian-orientation (east) to residential and shopping center (west) . This recommendation would result in a landscaped transition between the two areas. b. Would be more compatible to the Central Commercial Redevelopment Area study. c. Would assist in mitigating traffic problems at El Paseo and Highway 74 intersection. d. Market Size: The proposed market size appears out of scale with the proposed site, which has resulted in many negative impacts on the overall site design as related particularly to the rather poor parking lot layout which is exemplified by: a. Parking along the major entrance driveways to the project which will cause conflicts. b. Unloading area conflicting with major access from Highway 74. c. General absence of good landscape treatment throughout parking lot. d. Non-conformance to Central Commercial Rdevelopment Area study. Recommendation: a. Reduce the depth of the market to a maximum of 155 ft. b. Move entrance to east side of building. c. Relocate loading area to north side of building in conformance to Central Commercial Redevelopment Area study. 3. Proposed Restaurant: As previously pointed out, the impact of the proposed project, in terms of traffic, is considered sufficient to require an in-depth traffic study. Of major concern in any such study, will be the proposed access to Highway 111 . It appears that the development of a restaurant at said entrance, further increases the impact. Of particular concern, are the proposed parking spaces accessible from the entrance road; and the conflicts created by the fact that the access to Highway 111 is two-way, in conjunction with the pro- posed revised frontage road treatment. The recommended traffic study may recommend the relocation or elimination of the proposed restaurant. 4. Trash Storage: The provision for trash storage for the total complex appears to be inadequate. • Nee • SPECIAL CONDITIONS CASE NO. 67C 1 .
