CONDITIONS OF APPROVAL
CASE N0. 50C
1. ?he development of this project shall conform substantially to all
development plans submitted in behalf of this case (Exhibits A & 6} ,
and as revised according to Planning Commission action. Any minor
' � changes require approval by the Director of Environmental Services.
Any substantial change requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as a part of the development process.
3. This approval is applicable, subject to the development of this project,
commencing within one year from approval date and being promptly completed.
4. Any air conditioning equipment shall be fully concealed f rom view from
any public rights-of-way and adjoining properties by landscaping or ar-
chitecturally integrated means.
5. All service utility lines shall be placed underground, unless approvHd
otherwise by the Director of Environmental Services.
6. The applicant shall provide a cash deposit for a pro rata share of the
cost of undergrounding the overhead distribution lines along the rear
of the subject property prior to issuance of a certificate of occu-
pancy.
7. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving
shall be provided in conformance with City Standards and the requirements
of the City Engineer.
8. Traffic control provisions shall be provided as required by the Director
of Environmental Services.
9. Elevations are not approved as shown and shall be modified according to
annotated changes.
10. A complete and detailed set of final construction drawings, including but
not limited to signage, revised trash storage, parking lot lighting, land-
scaping, and irrigation plans, shall be submitted for Design Review Board
Process approval prior to submittal of plans for building permits.
11. The applicant shall submit to the City of Palm Desert a public easement
covering the parking area of the subject Lot 12 prior to issuance of
certificate of occupancy.
12. The property owner shall agree to join any assessment district formed
that includes the subject property within its boundaries.
13. The easterly parking space adjacent to the alley shall be deleted as it
is not in conformance to the Zoning Ordinance, which will leave a total
of eighteen (18) spaces approved.
r -�, 14. All projections into the public right-of-way shall conform to the Uniform
Building Code and a five (5) foot setback shall be maintained for all
� bearing walls and colurrms along the E1 Paseo frontage.

15. An additional six (6) �nches of space shall be provided between the alley
parking spaces and the north wall of the building.
16. The west wall of the building shall be treated with stucco and painted
to match other �alls.

not issue a building permit or allow occupancy on the use permitted until this signed

Gentlemen:
I am writing this letter in regard to the additional "Conditions of Approval "
Case #30C as recommended by the Design Review Board to the Planning Commission
during their meeting February 22, 1977.
Item #16 - was revised to require 110 fe2t parking area at the rear of the
property instead of 100 feet as originally approved. This recorr�nendation
would require the removal of the rear 10 feet by 50 feet wide of the pro-
posed building, a total of 500 square feet of building area.
The applicant wishes tp appeal this recommendat�on requirement. We have
secured preliminary design review approval with Conditions of Approval dated
December 14, 1976. The building size and parking lot size was clearly defined
in this approval and our final plans are in conformance with those conditions.
To make any changes in building size would create a financial hardship and
delay the start of construction. The tenent lease is settled, construction
contracts are drawn, loan documents are approved and drawn, building permit
fees are paid, fina] plans and specifications are approved,printed, and
published, Palm Desert Property Owners approval has been secured, bid
estimates have been given, color selection and tenent improvements have been
designed.
I feel the preliminary and final plans are consistant with the design intent
of the existing and proposed core area plans and that no additional parking
easement is indicated or required.
I will attend the March 1, 1977 meeting to answer any questions in regard
to this matter.

CONDITIONS OF APPROVAL
CASE N0. 62MF
1. The development of this project shall conform substantially to all
requirements of Case No. CUP 08-76 as amended and to all development
plans submitted in behalf of this case (Exhibits A-D) , and as revised
according to Planning Commission action. Any minor changes require
approval by the Director of Environmental Services. Any substantial
change requires approval by the Planning Commission.
;�,,,, 2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as a part of the development process.
3. This approval is applicable, subject to the development of this project,
cor�nencing within one year from approval date and being promptly completed.
4. Any roof mounted, exhaust, or air conditioning equipment shall be fully
concealed from view from any public rights-of-way and adjoining properties
by architecturally integrated means.
5. All utility service lines shall be placed underground.
6. Curb, gutter, street lights, sidewalk or approved pathways, bikeway,
curb cuts, and tie-in paving shall be provided in conformance with
City Standards and the requirements of the City Engineer.
7. The landscaping plan as shown is not approved.
8. Traffic control provisions shall be provided as required by the Director
of Environmental Services.
9. Elevations are approved as shown, to be modified according to annotated
changes.

10. The applicant shall provide a total of forty-nine (49) parking spaces,
including several handicapped spaces.
11. Final construction drawings, including but not limited to revised land-
scaping, irrigation, exterior lighting, fencing, trash storage, color
and material sample board, parking lot lighting, storage and loading,
and signage plans, shall be submitted for Design Review Board Process
approval prior to submittal of plans for building permits.
12. The landscaping plan shall include treatment of the equestrian trail
along the northerly property line.

�+ I accept and agree, prior to use of this permit or approval , to comply with
all the condit�ons set forth, and understand that the Department of Building
and Safety will not issue a building permit or allow occupancy on the use
permitted until this signed confirmation has been received by the Department

11. Preliminary sign plan is not approved. Maximum s7gnage based on two (2)
street and parking lot frontages, as per new Sign Ordinance.
12. Red mission tile and stucco color to match existing E1 Paseo Square
buildings shall be used.
13. Final site approval and location of improvements shall be contingent on
approval of a parcel map for the San Pable Extension project. Any changes
shall require approval of the Director of Environmental Services.
14. A block wall , similar in design to the existing wall around E1 Paseo Square
shall be installed around the perimeter of the parking lot and the southerly
landscape area.
15. A complete and detailed set of final construction plans, including but not
limited to revised color and material sample board, signage, trash storage,
parking lot lighting, landscaping, and irrigation plans, shall be submitted
for Design Review Board Process approval prior to submittal of plans for
building permits.
16. The applicant shall provide the City of Palm Desert a public easement for
� use of the parking facilities of the project.
17. The property owner shall agree to join any assessment district formed that
inc'ludes the subject property within its boundaries.
