STAFF RECOMMENDATION :
Staff is recommending approval of the final construction
drawings as the applicant has modified the plans as required
by the Conditions of Approval. The only Condition the applicant
may have failed to address is Condition No. 17 which required
the relocation of the handicap ramp. Staff is uncertain as
to where the ramp has been relocated.

CONDITIONS OF APPROVAL
CASE NO. 57C
1 . The development of this project shall conform substantially to all
development plans submitted in behalf of this case (Exhibits A-C) ,
and as revised according to the Design Review Board process. Any
minor changes require approval by the Director of Environmental
Services. Any substantial change requires approval by the Planning
Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as part of the development process.
3. This approval is applicable, subject to the development of this
project, commencing within one year from approval date and being
promptly completed.
4. All service and distribution lines for utilities shall be placed
underground.

5. Any roof mounted, exhaust or air conditioning equipment shall be fully
concealed from view from any public rights-of-way & adjoining prop-
erties by architecturally integrated means.
6. Construction plans shall be submitted for approval to the City Fire
Marshall prior to issuance of building permits. All conditions shall
be made a part of construction and no certificate of occupancy shall
be issued until completed.
7. Final landscaping (with irrigation system) plans indicating plant
sizes and heights shall be provided to the Design Review Board for
approval prior to issuance of a building permit.
8. Lighting of parking areas and premises shall be provided as approved
by the Director of Environmental Services.
9. Signage shall be provided in accordance with a signage plan to be
submitted to the Design Review Board and Planning Commission for
final approval .
10. Traffic control provisions shall be provided as required by the City
Engineer.
11 . The applicant shall agree to join any assessment district formed that
includes the subject property within its boundaries.
12. The applicant shall grant to the City of Palm Desert, easement rights
over the parking lot area of the project site in a form acceptable
to the City Attorney prior to issuance of a certificate of occupancy.
13. The landscape plan shall provide for a minimum of 20" box trees
throughout the entire project.
14. The planter at the intersection of Larkspur and El Paseo shall be re-
located further away from the corner and lowered.
15. Applicant should investigate various colors and materials to be utilized
for paved areas.
16. An additional break-through shall be added in the parking lot for better
circulation.
17. The applicant shall change the location of the handicap ramp.

18. The location of the trash enclosure shall be shown on the site plans.

the requirements of the scenic preservation overlay zoning
district , Staff would recommend approval of the preliminary
site, floor and elevations .

CASE NO. 63C
1 . Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits . All con-
ditions shall be made a part of construction and no certificate
of occupancy shall be issued until completed.
2. Any/all utility service and distribution lines on or abutting
the subject property, shall be placed underground prior to oc-
cupancy clearance.
3. Final construction drawings including a final landscaping, grad-
ing, lighting, amenities trash storage, walking layout , and ir-
rigation plan shall be submitted to the Design Review Board. No
final inspection or occupancy permit shall be given by the Dept .
of Environmental Services to this project until the aforementioned
approved plans and construction shall have been completed.
4. Applicant shall comply with all of the requirements of the related
Case CUP 09-77.
5. Final landscaping plan shall include proposed improvements for
pedestrians, bicycles and landscaping for area along Highway 111
as required by Condition No. 9 of the Conditional Use Permit
CUP 09-77.

1 . Final construction drawings including a final landscaping,
grading, lighting, trash storage , walkway layout , and
irrigation plan in addition to a proposed sign program
and tennis court lighting proposal or any other ammenities
proposed shall be submitted to the Design Review Board.
The final landscaping plan shall include information with
regard to the relocation of existing trees and blowsand
control measures proposed. No final inspection or occu-
pancy permit shall be given by the Dept . of Environmental
Services to this project until the aforementioned approved
plans and construction shall have been completed.
2. Site plan shall reflect a variation in setbacks.
3. Proposed elevation shall be submitted with color material
and sample boards prior to submittal of final construction
drawings to the Design Review Board.
4. A preliminary landscaping plan shall be submitted prior to
submittal of final construction drawings to the Design Review
Board.

I . GENERAL CONDITIONS - DP 12-77
1 . The development of this 786 condominium development with
related recreational and commercial facilities shall con-
form to all plans submitted in behalf of the case (Exhibit
A) , and to the concept presented in the application as
revised according to the Design Review Board process and/
or Planning Commission action . Any minor changes require
approval by the Director of Environmental Services . Any
substantial change requires approval by the Planning
Commission.
2. All requirements of any law, ordinance , or regulation of the
State, City, and any other applicable government entity
shall be complied with as part of the development process.
3. This approval is applicable , subject to the development of
this project, commencing within one year from the date of
annexation and being promptly completed. If the development
under this amendment is not commenced, CUP-1450E remains
in effect .
4. Construction plans shall conform to the requirements of the
City Fire Marshal as expressed in the attached letter dated
November 15, 1977.
5. Construction drawings, including but not limited to , a
landscaping, grading, lighting, amenities , trash storage,
walkway layout , and irrigation plan shall be submitted
through the Design Review Board. No final inspection or
occupancy permit shall be given by the Department of Environ-
mental Services to this project until the aforementioned
approved plans and construction shall have been completed.
II . SPECIAL CONDITIONS - DP 12-77
1 . Prior to the issuance of a building permit for construction
of any use contemplated by this approval , the applicant
shall first obtain permits and/or clearance from the follow-
ing agencies :
County Department of Public Health
Palm Desert Design Review Board Process
Coachella Valley County Water District
Regional Water Quality Control Board #7
2. Plans and specifications shall conform to the City of Palm
Desert standard specifications, development procedures and
design criteria. Any modifications , thereof , shall require
approval of the City Engineer .
3 . Blow sand protection should be maintained for this area,
especially on the north, west and east sides.
4. Emergency access should be provided to Monterey Avenue on
the north end of this development .
5. Construction of improvements shall conform to the City of
Palm Desert Ordinance No. 125 .
6 . Stacking space for a minimum of eight vehicles shall be
provided off Monterey at the entrance.

7. There shall be a minimum of a 20 foot setback between
buildings except said setbacks may be reduced to a
minimum of 15 feet to provide for more interesting
building placement and to provide for better vistas
from the roadways to the proposed golf course .
III . DESIGN REVIEW BOARD CONDITIONS - 99MF
1 . Final construction drawings including a final landscaping,
grading, lighting, trash storage , walkway layout , and
irrigation plan in addition to a proposed sign program and
tennis court lighting proposal or any other ammenities pro-
posed shall be submitted to the Design Review Board. The
final landscaping plan shall include information with regard
to the `location'pf existing trees andblowsand control mea-
sures prdposed No final inspection or occupancy permit shall
be given by the Dept . of Environmental Services to this pro-
ject until the aforementioned approved plans and construction
shall have been completed.

Reference: Case No. G+P12-77
Gentlemen:
Prior to construction of any of the proposed buildings , the following
conditions must be met:
1 . Install a water system capable of delivering 2500 GPM fire flow for a
two (2) hour duration in addition to domestic or other supply. The
computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time
of measurement.
2. Install Riverside County super fire hydrants so that no point of any
building is more than 250 feet from a fire hydrant measured along approved
vehicular travel ways.
A. Hydrants shall not be located closer than 25 feet to any building.
B. Exterior surfaces of hydrant barrels and heads shall be painted chrome
yellow and the tops and nozzle caps shall be painted green.
C. Curbs (if installed) shall be painted red 15 feet in either direction
from each hydrant.
3. Prior to issuance of a building permit, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire Marshal
for review. Upon approval , one copy will be sent to the Building Department,
and the original will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "I certify
that the design of the water system in Case No. COUP 12-77, is in accordance
with the requirements prescribed by the Fire Mar hal . "

5. Main clubhouse shall be fully protected by a completely automatic fire
sprinkler system.
6. Provide an emergency access road to Portola Avenue. The access road shall
be a minimum of fifteen feet wide, and subject to approval of the City
Fire Marshal .

STAFF RECOMMENDATION :
Staff is recommending approval of the preliminary site,
floor and elevation plans as the submittal complies
with all of the requirements of the Zoning Ordinance.
Staff has discussed with the applicant the possible
redesign of the window areas to eliminate the wood treat-
ment and replace the wood with raised stucco plant-ons .
The applicant has agreed to this change.
SPECIAL CONDITIONS FOR
CASE NO. 100MF
1. Tile tappings shall be deleted and all windows shall be modified
by eliminating wood bars, utilizing stucco plant-ons .
2 . Rock roof shall be beige or tan in color.
3. Perimeter fencing material shall be specified in final construc-
tion drawings.
4. A detailed landscaping and irrigation plan shall be submitted
as a part of the submittal of final construction drawings .

STAFF RECOMMENDATION:
These preliminary site, floor and elevation plans do conform
with the requirements of the Zoning Ordinance as far as
setbacks and parking. Staff believes a better pedestrian link
between the front of the units and the parking area ought to
be provided. Additionally, Staff recommends that the trash
enclosure be relocated. As drainage is not a critical concern
with regard to this lot , Staff believes review of the grading
plan at the review of final construction drawings is appro-
priate . Staff is recommending approval of the preliminary
site, floor and elevations.
SPECIAL CONDITIONS FOR
CASE NO. 101MF
1. Applicant shall provide a pedestrian link between the
front of the units and the parking area.
2. Trash enclosure shall be relocated.
3 . A complete and detailed landscaping and irrigation plan ,
fencing, lighting, and sign plan whall be submitted to
the Design Review Board prior to final approval .
4. Final construction drawings shall be submitted to the
City Fire Marshal as a part of the submittal of plans for
Building Plan Check.
5. Sidewalk along the full frontage of the project on Abronia
and Sunset shall be provided as a part of construction .

Staff is recommending approval of the preliminary site, floor
and elevation plans . The only modification that will have
to be made involves an adjustment to the plan in order to
achieve the 20 foot rear yard setback.
SPECIAL CONDITIONS FOR
CASE NO. 103MF
1 . Curb , gutter, sidewalk , curb cuts, and tie-in paving shall
be provided on San Rafael in conformance with City Standards
and the requirements of the City Engineer at the time of
construction or by future agreement with the City Engineer.
2. A complete and detailed landscaping and irrigation plan,
fencing, lighting, and sign plan shall be submitted to
the Design Review Board prior to final approval .
3. Final construction drawings shall be submitted to the City
Fire Marshal prior to the submittal of plans for Building
Plan Check.
4. Applicant shall submit a written agreement in a form accept-
able to the City Attorney to join any undergrounding district
involving the subject property.
5. Applicant shall submit a perimeter fencing or wall plan to
the DRB for approval as part of the submittal of final con-
struction drawings.
6. Rear yard setback shall be a minimum of 20 feet.
