Lawn or gravel only be placed in the parkway. 2. A one ( 1) foot landscaped strip be provided on the south boundary of the project . 3. Concrete wheel stops be eliminated on the west side of the parking lot and tam junipers be planted in the adjacent planting area to allow for vehicle overhang. 4. A six (6) foot masonry wall be constructed on the south and east property lines in conformance with the requirements of the Zoning Ordinance. Staff is recommending approval of this case if the above four recommendations are adhered to with the following modification : As staff has discovered there is an existing fence on the east side of the property, we are recommending the requirement of a masonry wall at this location be deleted. 4 r' 'j •' Nuir 2/25/76 CONDITIONS OF APPROVAL CASE 1E 32MF 1. The development of this project shall conform substantially to all develop- ment plans submitted in behalf of this case (Exhibit A-1, B and C) and as revised according to Planning Commission action. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. - All requirements of any law, ordinance, or regulation of the State, City and • other applicable government entity shall be complied with as part of the de- velopment process. 3. Landscaping , shall be provided adjacent to each driveway along the property line. 8. A noncombustible trash storage area shall be provided as approved by the Director of Environmental Services. 9. Lighting of parking areas and premises shall be provided for as approved by the Design Review Board. 10. Signage shall be provided in accordance with signage plan .to be submitted to the Planning Division for final approval . 11. Traffic control provisions shall be provided as required by the Director of Environmental Services. 12. LTD. LOCATION: Shadow Mountain Resort and Racquet Club ZONING: PR_7 STAFF RECOMMENDATION: At the previous DRB meeting of Oct . 11, 1977 the Staff indicated the following concerns should be addressed before the Board approves the Case. 1 . Undergrounding on San Luis Rey not shown. 2. Timer for tennis court lights on existing courts not shown . 3. Chain link fence on south property line between the golf clubhouse and maintenance shed not shown . 4. 25 additional parking spaces not shown . 5. Turn trash enclosure sideways to allow easier pickup of bin. 6. Completion of Club Circle not shown. 7. No landscaping construction plans . Staff has met with the applicant since the last DRB meeting and the present feeling is that the above expressed concerns are either irrelevant or have been satisfactorily addressed by the applicant so Staff is, therefore, recommending approval of the final construction drawings . (See attached letter) , - June 23, 1977 CONDITIONS OF APPROVAL CASE NO. 77MF 1 . The development of this project shall conform substantially to all develop- ment plans submitted in behalf of this case (Exhibits A-G) , and as revised according to the Design Review Board process. In addition, the applicant shall comply with any and all requirements or conditions mandated by Case No. DP 07-77 and Case No. CU 03-73. Any minor changes require approval by the Director of Environmental Services. Any substantial change requires approval by the Planning Commission. 2. Al requirements of any law, ordinance, or regulation of the State, City, and any other applicable government entity shall be complied with as part of the development process. • 3. This approval is applicable, subject to the development of this project, commencing within one year from approval date and being promptly completed. 4. All service lines for utilities shall be placed underground. 5. STAFF RECOMMENDATION: The applicant has complied with all of the Special Conditions of Approval so that the Staff is recommending approval of the final construction drawings. SPECIAL CONDITIONS OF APPROVAL CASE NO. 60C 1. A detailed landscaping plan shall be submitted to the Design Review Board at time of submittal of final con- struction drawings. 2. Directional signs for the parking lot shall be submitted through the Design Review process for approval . No Other signs shall be permitted. 3. Three additional parking spaces shall be added in order to meet the requirements of the Zoning Ordinance. 4. A pedestrian ramp from the parking lot to the restaurant shall be provided. 5. The applicant shall provide a minimum of 3 handicapped parking spaces, at least 12 feet in width, and properly designated as such. 6. The applicant shall comply with all conditions of Case No. VAR 04-76, as a part of construction. 7. Final construction plans shall be submitted to the DRB for approval. Staff is recommending approval of the plans with the requirement that the applicant receive approval of plans from the Palm Desert Property Owners ' Assoc. prior to submittal of final construction drawings to the DRB. • SPECIAL CONDITIONS CASE NO. 91MF 1. The applicant shall comply with any and all requirements or conditions mandated by Case No. DP 10-77. 2. Applicant shall provide evidence of approval of plans by the Palm Desert Property Owners Association prior to sub- mittal of Final Construction Drawings to the Design Review Board. 3. (Date) (Applicant 's Signature) PLANNING COMMISSION RESOLUTION NO. 272 AUGUST 2, 1977 CONDITIONS OF APPROVAL CASE NO. DP 10-77 I . STANDARD CONDITIONS 1 . The development of the property shall conform substantially with that as shown on plot plan marked Exhibit ' D' on file with the Department of En- vironmental Services, Case No. DP 04-77, unless otherwise amended by the following conditions. 2. Prior to the submittal of plans for building permits, the applicant shall submit a copy of the CC&R's for approval by the City Attorney. 3. Prior to the issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following public agencies: County Department of Public Health Palm Desert Design Review Board Process Coachella Valley County Water District Regional Water Quality Control Board #7 Evidence of said permit or clearance from the above agencies shall be pre- sented to the Department of Building and Safety at the time of the issuance of a building permit for the use contemplated herewith. 4. A landscaping, grading, lighting, amenities, trash storage, walkway layout, and irrigation plan shall be submitted through the Design Review Process. The building permit when issued shall include the grading, lighting, ameni- ties, trash storage, walkways, swimming pool equipment, and irrigation systems. No final inspection or occupancy shall be given by the Department of Environ- mental Services to this project until the aforementioned approved plans and construction shall have been completed. 5. Install a water system capable of delivering 2500 GPM fire flow for a two (2) hour duration in addition to domestic or other supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 6. Install Riverside County super fire hydrants so that no point of any build- ing is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. Hydrants shall not be located closer than 25 feet to any building. b. Exterior surfaces of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. c. Curbs (if installed) shall be painted red 15 feet in either direction from each hydrant. 7. Prior to issuance of a building permit, the developer shall furnish the origi- nal and three (3) copies of the water system plan to the Fire Marshal for re- view. Upon approval , one copy will be sent to the developer. 8. The water system plan shall be signed by a registered civil engineer and ap- proved by the water company, with the following. certification: "I certify that the design of the water system in Case No. DP10-77 is in accordance with the requirements prescribed by the Fire Marshal . This approval shall be used within one (1 ) year of this action, otherwise it shall become null and void and of no effect whatsoever. By "use" is meant beginning of construction of a portion of the project. i 10. Prior to utilization of this Development Plan, the applicant shall agree in writing to any conditions of approval . 11 . The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. . II. SPECIAL CONDITIONS 1 . A wall six (6) feet in height shall be required along the full length of the west property line and along the north property line where adjacent to the C-1 Zone, design and materials as approved by the Design Review Board process. 2. A minimum of three hundred and twenty (320) square foot private yard or patio shall be provided for each dwelling unit. 3. Street trees, 40 feet on-center, shall be included in the design , with Ficus retusa nitida (24" box) utilized. 4. A second, smaller recreational facility shall be provided in an area east i of the tennis courts, as approved by the Design Review Board process. 5. The existing lighting system on the tennis courts shall be replaced with a system conforming to present design standards for height & external glare, unless written evidence is provided by the applicant that such a replace- ment is not desired by the present owners. 6. Applicant shall install 6 foot sidewalks , to City Standards , on Shadow . Mountain to the intersection with Tumbleweed. 7. Install safety lighting at the intersection of Shadow Mountain and Tumbleweed as required by the City Engineer. The applicant shall provide a cash deposit for a pro rata share of the cost of undergrounding the overhead distribution lines along the rear of the subject property prior to issuance of a certificate of occu- pancy. 7. The applicant shall submit to the City of Palm Desert a public easement covering the parking area of the subject Lot 12 prior to issuance of certificate of occupancy. 12. The property owner shall agree to join any assessment district formed that includes the subject property within its boundaries. 13. The easterly parking space adjacent to the alley shall be deleted as it is not in conformance to the Zoning Ordinance, which will leave a total of eighteen (18) spaces approved. 14. All projections into the public right-of-way shall conform to the Uniform Building Code and a five (5) foot setback shall be maintained for all bearing walls and columns along the El Paseo frontage. 15. All utility service and distribution lines on or abutting the subject property, shall be placed undergound prior to occupancy clearance. - 7. Traffic control provisions shall be provided as required by the City Engineer. 8. Curb, gutter, sidewalk or approved pathways, and tie-in paving shall be provided in conformance with City Standards and/or as required by the City Engineer. 9. A landscaping, grading, lighting, amenities, trash storage , walk- way layout , and irrigation plan shall be submitted through the Design Review Board. No final inspection or occupancy permit shall be given by the Department of Environmental Services to this project until the aforementioned approved plans and construc- tion shall have been completed. 10. Prior to the issuance of a building permit for construction of any use contemplated by this approval , the applicant shall first obtain permits and/or clearance from the following agencies : County Department of Public Health Palm Desert Design Review Board Process Coachella Valley County Water District Regional Water Quality Control Board #7 11. Plans and specifications shall conform to the City of Palm Desert standard specifications, development procedures and design criteria. If the proposed hotel units are to be sold to separate individuals , the applicant shall provide , as a part of the tentative tract application, proposed covenents, con- ditions and restriction a limitation of a maximum of thirty ( 30) consecutive days of occupancy by the owner and/ or leaser of any dwelling unit . 2. The proposed landscape area adjacent to the proposed exten- tion of the frontage road shall be incrased to a minimum of 20 feet in width. 3. A 6 ft . high decorative block wall shall be provided on the east, south and west boundary lines of the proposed hotel complex. Said wall shall be extended along the north bound- ary of the project setbacks 15 feet from the proposed property line with the following exceptions : a. at approved entrances, said wall shall be reduced to a maximum height of three feet or held back a sufficient distance to guarantee adequate sight distance . 4. The proposed tennis courts shall be recessed a minimum of three feet and shall not be lighted except under the follow- ing limitations : a. any proposed lighting system shall be subject to the approval of the DRB as a part of review of the construc- tion drawings. b. the landscape treatment around the proposed tennis courts shall consist of tall trees to reduce side glare. 5. The proposed east=west driveways adjacent to the north bound- ary of the project shall be limited to 20 feet in width. 6. The proposed parking shall be increased to a total of 219 spaces by making the changes to the proposed plot plan. a. move the eight unit portion of the two southerly most , east-west oriented building fifteen feet to the north and add six spaces to the parking byas at the rear of said buildings. b . add two spaces at each end of the parking area on the southerly boundary of the complex. c. add a total of four spaces to the parking bays located on the entrance driveway to the complex. d. add one space to the parking areas located in the north- east and northwest corners of the project. e. the proposed entrance street shall be widened to 32 ft . adjacent to the tennis courts to provide for parallel parking adjacent to the courts. A 6 foot high decorative block wall shall be provided in the following areas : a. along the boundary line between the proposed condominium area and the single family lots along Candlewood. b. east property line where a wall does not presently exist . c. west property line, except in the area of the proposed public street connection of Driftwood Drive and Shadow Hills Road said wall shall be set in five feet from the proposed right-of-way line and shall be setback 15 feet from the proposed main entrance to the proposed complex. 2 . The major circular private street shall be increased to 32 feet in width to provide for parking on one side and the proposed 12 guest spaces at the entrance to the complex shall be deleted. 3. Design Review Conditions (Case No. 92MF) 1. The proposed roof line for the Hotel buildings shall be restudied to better tie it into the design of the building. 2 . Diffirent material should be utilized for the fencing adjacent to the patio areas for the hotel units . 3. Applicant shall consider the use of stamped concrete in the driving court areas in the condominium portion of the project .
