1. Final construction drawings including a final landscaping, grading
and irrigation plan shall be submitted to the Design Review Board.
No final inspection or occupancy permit shall be given by the
Department of Environrnental Services to this project until the
aforementioned approved plans and construction shall have been
completed.
. 2. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All conditions
shall be made a part of construction and no certificate of occupancy
shall be issued until completed.
3. Applicant shall fully improve and dedicate to the City of Palm Desert
the alley on the east side of the subject property.
4. A masonry wall , 3' high, shall be provided along Las Palmas and San
Gregornio Way.
5. Any and all utility service and distribution lines on or abutting the
subject property, shall be placed underground prior to occupancy
clearance pursuant to Section 25.56. 110 of the Municipal Code.
6. Header boards shown in the landscaping plan shall be eliminated and
a permanent delineation constructed.
7. Provide trees along wall at south and east property lines.
8. Provide trees around buildings and in open space areas.
9. Provide access from apartments, where appropriate, for use of open space.
10. Use Mexican Ash trees in parking lot area and bottle trees in open
space areas.

Dear Members of the Board,
Shortly you will be considering the construction plans submitted
by Roger Boyar Development Company for the development of Lots
3-9 inclusive and a portion of Lot 2 of Tract 4380-1. This is the
property that surrounds present property.
We have worked with the Boyer Development Company over the past
few months and have found them very cooperative. We have reache�
agreement on a number of issues .
At this point we do not know if they intend to install lights on
the two tennis courts they are planning so we are bringing before
you our thoughts and feelings on this item. We do NOT have lights
on o��r pres2nt courts - they are used only in the daylight hours.
The ten owners that have windows facing the courts are op�osed to
lights because of obstructing the view at night and also the noise
problem that night tennis would create. If Boyer Construction was
to light the courts that they build directly behind ours, then our
ten member/owners would be inconvienced just as though we had liqhts
on ours.
If you feel that you must allow lights on Boyers courts then we
certainly hope that you will condition lights only on recessed (4 '
minimum) courts. The mountains to the West of our property are
beautiful at night and lighted tennis courts would cut off this
view.

7. Traffic control provisions shall be provided as required by the

8. Curb , gutter, sidewalk or approved pathways , and tie-in paving
shall be provided in conformance with City Standards and/or as

10. Prior to issuance of a building permit for construction of anv use

Design Review Conditions :
l . Final construction dra�vings , including a final landscapinb ,
grading, lighting, tr�.sh storage, walk�vay layout , anci irrigation
plan in addition to tennis court lighting proposal or any other
amenities proposed shall be submitted to the Design Revie�v Board .
No final inspection or occupancy permit shall be given by the
Department of Environmental Sercices to this project until the
aforementioned approved plans and construction shall have been
completed.
2. The ap�licant shall e�plore tne feasibility of using solar ener��-
to heat all swimming pools.
3. Exterior lighting plans and si7n pro�ram shall be submitted for
Design Review Board process approval prior to the submittal of
plans for building permits . All requirements of the final ap-
proval shall be made as a pa.rt of construction .
4. Proposed adobe slumpstone wall separating the oriainal project

One additional handicap parking space should be provided
to meet the 5% requirement. In addition, the trees in the
parking area and on the perimeter of the project should be
upgraded in size to meet the new minimum landscaping standards.
Most of the trees shown are 15 gal1on in size where many should
be 24" box. If those changes are made Staff would recommend
approval of the final working drawings.
