1. The development of ttiis pro�ect shall conform substantially to all develop-
ment plans submitted in bchalf of this case (Exhibits C & D) , and as revised
according to the Design Review Board process. Any miilor changes require ap-
proval by tbe Director o£ Environmental Services. Any substantial chan�e re-
quires approval by the Planning Cor.unission.
2. All reqUirements of any law, ordinance, or regulation of the State, City, and
any other applicable government entity shall be complied with as part of the
development process.

3. This approval is applicable, subject to the development of this project, com-
, nencing within one year from approval date and being promptly completed.
4. Any roof mounted, exhaust, or air conditioning equipment shall be fully con-
cealed from view from any public rights-of-way and adjoining properties by
architecturally integrated means as shown.
S. Al1 utility service and distribution lines shall be placed underground.
6. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving shall
be provided in conformance with City Standards for the following:
a) The applicant shall install curb, gutter, and sidewalk along the full
frontage of E1 Paseo, Lantana, and Larrea.
b) An opening in the median strip on E1 Paseo opposite the northwest drive;aay.
7. Final landscaping (with irrigation system) plans indicating plant sizes and
heights shall be provided to the Design Review Board for approval prior to is-
suance of a building -permit.
8. Lighting of parking areas and premises shall be provided as approved by the
Director of Environmental Services.
�- 9. Signage shall be provided in accordance with signage plan to be submitted to the
Design Review Board and the Planning Commission for final approval.
10. Traffic control provisions shall be provided as required by the Traffic Engineer.
11. Overhangs shall be provided for all windows on the west elevation.
12. Construction plans shall be submitted for approval to the City Fire Marshall
prior to issuance of building permits. All conditions shall be made a part of
construction and no certificate of occupancy shall be issued until completed.
13. A detailed grading plan shall be submitted to the City Engineer for approval.
14. The applicant shall agree to join any assessment district formed that includes
the subject property within its boundaries.
15. The applicant shall grant to the City of Palm Desert, easement rights over the
. parking lot area of the project site.
16. The landscape plan shall provide for a minimum of 20" box trees throughout the
entire project.
17. All parking spaces shall conform to minimum City requirements. No parking space

shall be within six (6) feet of any street property line. '
18. A sidewa�k six (6) feet in width in addition to_� landscaped berm a minimum of

13. The applicant may install the required landscaping within the required 82-
foot public right-of-way along 42nd Avenue.
14. The proposed development shall be limited to ta�o (2) entrances.
15. Proposed measures to provide bloti•�sand control , particularly on the north and
west sides of the project, shall be submitted to the Design Revie�,� Board for
approval .
16. Off-street parking shall be provided per the requirements of Sec. 25. 33-7 of
the Palm Desert Zoning Ordinance.
- 17. The applicant shall agree to join any undergrounding district which is formed
and which encompasses the subject property. -
18. Construction plans shall be submitted for approval to the City Fire �•!arshal

STAFF RECOMMENDA7ION:
The modified plans submitted indicate a change in the location of
the patios, resulting larger patios. The two uncovered spaces have
been relocated to provide easier maneuverability. Additional land-
scaping is now being shown between the buildings and the parking
areas and between the driveway and the property line. Finally, a
jacuzzi is being shown as an amenity in the common are. With these
modifications, staff is prepared to recommend approval of the project.

1 . Final construction drawings including a final landscaping, grading,
and irrigation plan shall be submitted to the Design Review Board. -
No final inspection or occupancy permit shall be given by the
Department of Environmental Services to this project until the
aforementioned approved plans and construction shall have been
approved.
2. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. Al1 conditions '
shall be made a part of construction and no certificate of occupancy
shall be issued until completed.
3. Parking layout shall be revised in order to improve maneuverability
in and out of southerly two parking spaces. �
� 4. Landscaping shall be provided along the west perimeter of the
project.
5. Applicant shall provide a minimum of 10 feet between carports and
structures. _
6. Applicant shall install fencing along the west property line to be
approved by the Design Review Board.
7. Floor plan of building on Santa Rosa shall be reversed.

9. Roof material shall be crushed rock, shake, or tile in earth tones.
10. A 6 foot high wood fence shall be constructed at the rear and on the
sides of the complex.
11 . A garden wall shall be provided to enclose the patio area off of the
front building.
12. The landscaping plan shall be revised as follows: Ficus shall be used
in front of walls; azaleas shall be removed and replaced with raphiolepis;
gazanias shall be submitted for creeping fig as ground cover; landscaping
between the driveway and the fencing shall include the use of pyracanthia
or tecoma capensia.
