1 . Final construction drawings including a final landscaping, grading

1 . The development of the property shall conform substantially with that as
shown on Plot Plan marked Exhibit A on file with the Department of Environ-
mental Services , Case Na. CUP 13-77, unless otherwise amended by the follow-
ing conditions.
2. Prior to the issuance of a building permit for construction of any use con-
templated by this approval , the applicant shall first obtain permits and
clearance from the following public agencies :
Department of Public Health Palm Desert City Fire Marshal
Department of Public Works Coachella Valley County LJater District
Palm Desert Design Review Board Regional lJater Qua7ity Control Board r7
Evidence of said permit or clearance from the above agencies shall be presented
to the Building and Safety Department at the time of the issuance of a building
permit for the use contemplated here�rith.
3. A preliminary landscaping, grading, lighting, amenities , trash storage, walk�•�ay
layout, signage, and irrigation plan shall be submitted through the Design
Review Board process for approval prior to issuance of building permits.
4. The sewage dispQsal system shall be submitted to and approved by the Coachella
� Valley County 4Jater District prior to issuance of a building permit.
5. This approval, shall be used within one year, othe n,rise it shall become null and
void. - .
6. All utility distribution service lines within or adjacent to the subject property
shall be placed underground.
7. A six (6) foot decorative masonry wall or alternate as approved by the Design
Review Board process shall be installed along the complete frontage of the north
and west property lines. All other fencing shall be approved by the Design
Review Board process.
8. The applicant shall compiy with any laws , regulations, and requirements of the City
of Palm Desert, the State of California or any other applicable government agency
as a part of construction.
9. Construction of all private streets shall be inspected by the Engineering Depart-
ment and a standard fee shall be paid.
10. Install Riverside County Standard Fire Hydrants , located at intersections so
no mobile home is more than 250 feet from a hydrant.
11 . Fire hydrants shall be installed on approved looped water mains as follows :
a. A minimum of 6 inch diameter to serve all buildings and recreational vehicle
storage lots.
12. Provide the following fire flows for a t�•ro (2) hour duration in addition to domestic
or irrigation supply. All computations shall be based upon a minimum of 20 psi
residual operating pressure in the supply main from which the flow is measured
at the time of ineasurement.
a. 500 GPM to serve all buildings and mobiie homes.
b. 500 GPM to serve recreational vehicle storage lot.

13. Prior to issuance of building permits , the developer shall furnish the origir�al
and three (3) copies of the water system plan to the Fire t�"arshal for review.
14. The water system plan shall be signed by a registered civil engineer and approved
by the water company with the following certification: "I certify that the
design of the water system in CUP 13-77 is in accordance with the requirements
prescribed by the Fire P�arshal ". Upon approval , the original plan will be return-
ed to the developer.
15. The subject site shall be annexed to Improvement District Nos. 54 & 80 of the
C.V.C.I�J.D for sanitation service and to the Coachella Valley Stormwater Unit of
the C.V.C.W.D.

CONDITIONS OF APPROVAL
CASE N0. 28C
1. The development of this project shall conform substantially to all develop-
ment plans submitted in behalf of this case (Exhibits A & B) , and as revised
according to the Design Review Board process. Any minor changes require ap-
proval by the Director of Environmental Services. Any substantial change
requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State, City,
and any other applicable government entity shall be complied with as part
fof the development process.

3. This approval is applicable, subject to the development of this project com-
mencing within one year from approval date and being promptly completed.
4. Any roof mounted, exhaust, or air conditioning equipment shall be fully con-
cealed from view from any public rights-of-way and adjoining properties by
architecturally integrated means.
5. All utility lines shall be placed underground.
6. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving
shall be provided in conformance with City of Palm Desert Standards.
7. Landscaping (with irrigation system) shall be provided and submitted to the
Design Review Board for final approval. �
8. Lighting of parking areas and premises shall be provided for with plans sub-
mitted to the Design Review Board for final approval.
9. Signage shall be provided in accordance with signage plan to be submitted
to the Design Review Board for final approval.
10. Traffic control provisions shall be provided as required by the Director of
Environmental Services.
11. Elevations are approved as shown.
12. All signs on the existing restaurant shall be removed.
13. The existing billboard on the new restaurant site shall be removed.
14. The applicant shall grant easement rights over the parking lot area to the
City of Palm Desert in a form acceptable to the City Attorney.
15. Colors are approved as shown.
16. This approval is contingent upon Planning Commission approval of Case No.
CUP 07-76, and City Council approving the abandonment of a portion of the
right-of-way along De Anza Way.
X7. Landscaping plan be revised as follows: 1) A minimum 24" box size trees
be used in parking lot. Tree type should be Carob. 2) Eliminate land-
scaping in front of trash enclosure. 3) Add street trees along project
perimeter. Tree type should be Rhus lancea.
18. Revise plan to maintain 25' line of site radius clear at intersection of
DeAnza Way and Palm Desert Drive.

STAFF RECOMME"JDATION:
The revised site plan is an i.mprovement over the
original submitted mainly due to the wind protection it will offer users
of the center. Staff is recommending a slight modification to the site
plan expressed in Special Condition No. 6 which will improve service access
to the store and open up more of the central site for parking. The City's
parking requirement for District Commercial Centers is 5 spaces per 1,000
sq, ft. of gross area. The proposed plan would require 522 spaces to meet
the Ordinance; 348 are being proposed. One o� the proposed structures
will probably have to be deleted or all or some of them made smaller in order
to provide the required parking. Staff is recommending approval of the
preliminary site, floor and elevation plans.
