CASE NO . 70C
1 . Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits . All con-
ditions shall be made a part of construction and no certificate
of occupancy shall be issued until completed.
2 . Any/all utility service and distribution lines on or abutting
the subject property, shall be placed underground prior to oc-
cupancy clearance pursuant to Section 25. 56 . 110 of the Municipal
Code .
3. Final construction drawings including a final landscaping, grading,
lighting, amenities, trash storage, walkway layout , and irrigation
plan shall be submitted to the Design Review Board. No final in-
spection or occupancy permit shall be given by the Department of
Environmental Services to this project until the aforementioned
approved plans and construction shall have been completed,
4. The applicant shall agree to join any assessment district formed
that includes the subject property within its boundaries.
5. The applicant shall grant to the City of Palm -Desert easement
rights over the parking lot area of the project site.
6 . Color and material samples shall be submitted to the Design Review
Board for approval at time of submittal of final construction draw-
ings.
7. The location of trash enclosures shall be indicated on the final
construction drawings.

I . STANDARD CONDITIONS .
1 . The development of this project shall conform substantially to
all plans submitted in behalf of this case (Exhibits A-G) , and
as revised according to the Design Review Board rpocess and/or
Planning Commission Action . Any minor changes require approval
by the Director of Environmental Services. Any substantial
change requires approval by the Planning Commission .
2. All requirements of any law, ordinance , or regulation of the
State, City, and any other applicable government entity shall
be complied with as part of the development process .
3. This approval is applicable, subject to the development of this
project , commencing within one year from approval date and being
promptly completed.
4. Any roof mounted, exhause , or air conditioning equipment shall
be fully concealed from view from any public rights-of-way and
adjoining properties by architecturally integrated means .
5. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits. All condi-
tions shall be made a part of construction and no certificate of
occupancy shall be issued until completed. Note Fire Marshal ' s
letter dated October 19, 1977• attached hereto for requirements .
6. All utility service and distribution lines on or abutting the
subject property, shall be placed undergound prior to occupancy
clearance.
7. Traffic control provisions shall be provided as required by the
City Engineer.
8. Curb , gutter, sidewalk or approved pathways, and tie-in paving
shall be provided in conformance with City Standards and/or as
required by the City Engineer .
9. A landscaping, grading, lighting, amenities, trash storage , walk-
way layout , and irrigation plan shall be submitted through the
Design Review Board. No final inspection or occupancy permit
shall be given by the Department of Environmental Services to
this project until the aforementioned approved plans and construc-
tion shall have been completed.
10. Prior to the issuance of a building permit for construction of any
use contemplated by this approval , the applicant shall first obtain
permits- and/or clearance from the following agencies :
County Department of Public Health
Palm Desert Design Review Board Process
Coachella Valley County Water District
Regional Water Quality Control Board #7
11. Plans and specifications shall conform to the City of Palm
Desert standard specifications, development procedures and design
criteria. Any modifications, thereof , shall require approval of
the City Engineer. -

II . SPECIAL CONDITIONS
A. General
1 . Approval is hereby limited to 168 hotel units, 62 con-
dominium units and 8 single family lots .
2. The proposed development shall have a master trash dis-
posal agreement acceptable to the Palm Desert Disposal
Company. If said agreement includes trash enclosures ,
said enclosures shall be to- City Standards and subject
to review by the DRB as a part of the construction draw-
ings .

B. Hotel Facilities .(Exhibit A)
1 . If the proposed hotel units are to be sold to separate
individuals , the applicant shall provide , as a part of
the tentative -tract application , proposed covenents , con-
ditions and restriction a limitation of a maximum of
thirty ( 30) consecutive days of occupancy by the owner and/
or leaser of any dwelling unit .
2. The proposed landscape area adjacent to the proposed exten-
tion of the frontage road shall be incrased to a minimum of
20 feet in width.
3. A 6 ft . high decorative block wall shall be provided on
the east, south and west boundary lines of the proposed hotel
complex-. Said wall shall be extended along the north bound-
ary of the project setbacks 15 feet from the proposed property
line with the following exceptions :
a. at approved entrances, said wall shall be reduced to a
maximum height of three feet or held back a sufficient
distance to guarantee adequate sight distance .
4 . The proposed tennis courts shall be recessed a minimum of
three feet and shall not' be lighted except under the follow-
ing limitations :
a. any proposed lighting system shall be subject to the
approval of the DRB as a part of review of the construe-
; tion drawings .
b. the landscape treatment around the proposed tennis courts
shall consist of tall trees to reduce side glare .
5. The proposed east=west driveways adjacent to the north bound-
ary of the project shall be limited to 20 feet in width.
6. The proposed parking shall be increased to a total of 219
spaces by making the changes to the proposed plot plan .
a. move the eight unit portion of the two southerly most ,
east-west oriented building fifteen feet to the north
and add six spaces to the parking byas' at the rear of
said buildings .
b . add two spaces at each end of the parking area on the
southerly boundary of the complex.
c. add a total of four spaces to the parking bays located
on the entrance driveway to the complex.
d. add one space to the parking areas located in the north-
east and northwest corners of the project .
e. the proposed entrance street shall be widened to 32 ft .
adjacent to the tennis courts to provide for parallel
parking adjacent to the courts .

C. Condominium Complex (Exhibit B)
1 . A 6 foot high decorative block wall shall be provided in
the following areas :
a. along the boundary line between the proposed condominium
area and the single family lots along Candlewood .
b. east property line where a wall does not presently exist .
c. west property line, except in the area of the proposed
public street connection of Driftwood Drive and Shadow
Hills Road said wall shall be set in five feet from the
proposed right-of-way line and shall be setback 15 feet
from the proposed main entrance to the proposed complex .
2 . The major circular private street shall be increased to 32
feet in width to provide for parking on one side and the
proposed 12 guest spaces at the entrance to the complex
- shall be deleted.
3. The proposed tennis. courts shall conform to the requirements
of Condition II B(4) above.

1 . The proposed roof line for the Hotel buildings shall be
restudied to better tie it into the design of the building.
2 . Diffirent material should be utilized for the fencing
adjacent to the patio areas for the hotel units .
3. Applicant shall consider the use of stamped concrete
in the driving court areas in the condominium portion
of the project .

drawings. The carports proposed will have to be attached to

white tones.
6 . A more detailed landscaping plan shall be provided.
7.. Landscaping shall include materials to the edge of the sidewalk
along the full frontage of the project .
8. Fencing material throughout the project shall be shown.
9. The jacuzzi shall be relocated to center on the common area of
the project . Appropriate landscaping and screening shall be
provided.
10. Reverse the parking area and provide a 3 ft . setback between car-
ports and the adjacent units.

11 . The parking area should terminate on the north at the proposed
walkway with an uncovered parking space .
12 . The applicant shall provide an 18" planting strip along the west
property line .

13. Substitute ficus nitida or similar plant for pinus halepensis .

5. Proposed walk between restaurant and Highway 111 shall be deleted.
6. Light standards shall not exceed 10 ' in height per the requirements
of the Municipal Code .
7. Signs are not approved at this time. A complete detailed sign pro-
gram shall be reviewed at the time of review of final construction
drawings.
8. Central intersection shall be redesigned to provide for better traf-
fic circulation.
9. Principal access off of El Paseo shall be restudied and one-way
drives in this area considered in addition to a relocation of the
proposed driveway to the west .
10. Potential vehicle conflicts caused by the location of various park-
ing-- spaces throughout the project shall be resolved prior to sub-
mittal of final construction drawings .
11 . Applicant shall provide a specific detailed plan for the loading
dock adjacent to the market .
12. The stucco color of the buildings shall be darkened to a sandy
beige or a color more compatible with the existing phases of - the
Palms to Pines Shopping Center.

5. In addition , the applicant shall submit particular detailed
plans , as a part of the, construction drawings, for the follow-
ing items which the Board feels are of major concern :
a. Wall materials.
b. Mechnical equipment locations, such as A/C units and pool
equipment .
c. Design of pool enclosures.
d. Proposed landscaping.
6. First proposed uncovered parking space shall be eliminated.
7. Driveway entrance shall be 26 ' in width.
8. Walkway to Tumbleweed Lane to be relocated west of the inter-
section.
AGREEMENT
I accept and agree, prior to use of this permit or approval , to comply
with all the conditions set forth, and understand that the Department
of Building and Safety will not issue a building permit or allow oc-
cupancy on the use permitted until this signed confirmation has been
received by the Department of Environmental Services .
