2. In addition , the applicant shall submit particular detailed
plans , as a part of the, construction drawings , for the follow-
ing items which the Board feels are of major concern :
a. Wall materials - both on the interior & exterior of the pro-
ject .
b. Mechnical equipment locations , such as A/C units.
c. Comprehensive sign program
d. Major entrance to the project .
3. The loading area for proposed Drug Store and Shop 'B' shall be
deleted.
4. Drive-in window shall be deleted at the proposed savings and loan.
5. Proposed walk between restaurant and Highway 111 shall be deleted.
6. Light standards shall not exceed 10 ' in height per the requirements
of the Municipal Code .
7. Signs are not approved at this time. A complete detailed sign pro-
gram shall be reviewed at the time of review of final construction
drawings.
8. Central intersection shall be redesigned to provide for better traf-
fic circulation .
9. Principal access off of El Paseo shall be restudied and one-way
drives in this area considered in addition to a relocation of the
proposed driveway to the west .
10. Potential vehicle conflicts caused by the location of various park-
ing- spaces throughout the project shall be reso;ved prior to sub-
mittal of final construction drawings .
11 . Applicant shall provide a specific detailed plan for the loading
dock adjacent to the market .
12. The stucco color of the buildings shall be darkened to a sandy
beige or a color more compatible with the existing phases of the
Palms to Pines Shopping Center.

1 . Construction plans shall be submitted for approval to the
City Fire Marshal prior to issuance of building permits . All
conditions shall be made a part of construction and no certifi-
cate of occupancy shall be issued until completed.
2. Any/all utility service and distribution lines on or abutting
the subject property , shall be placed underground prior to oc-
cupancy clearance pursuant to Section 25. 56 . 110 of the Municipal
Code.
3. Curbs , gutter and tie-in paving shall be provided in conformance
with City Standards and/or as required by the City Engineer.
4. Prior to entering Plan• Check . the applicant shall submit detail-
ed construction drawings to the Design. Review Board for consid-
eration and approval . Said drawings shall comply to the Condi-
tions of Approval herein , to the Conditions of all related City

CONDITIONS OF APPROVAL
CASE NO. 50C
1. The development of this project shall conform substantially to all
development plans submitted in behalf of this case (Exhibits A & B) ,
and as revised according to Planning Commission action. Any minor
changes require approval by the Director of Environmental Services.
Any substantial change requires approval by the Planning Commission.
2. All requirements of any law, ordinance, or regulation of the State,
City, and any other applicable government entity shall be complied
with as a part of the development process.
3. This approval is applicable, subject to the development of this project,
commencing within one year from approval date and being promptly completed.
4. Any air conditioning equipment shall be fully concealed from view from
any public rights-of-way and adjoining properties by landscaping or ar-
chitecturally integrated means.
5. All service utility lines shall be placed underground, unless approved
otherwise by the Director of Environmental Services.
6. The applicant shall provide a cash deposit for a pro rata share of the
cost of undergrounding the overhead distribution lines along the rear
of the subject property prior to issuance of a certificate of occu-
pancy.
7. Curb, gutter, sidewalk or approved pathways, curb cuts, and tie-in paving
shall be provided in conformance with City Standards and the requirements
of the City Engineer..
8. Traffic control provisions shall be provided as required by the Director
of Environmental Services.
9. Elevations are not approved as shown and shall be modified according to
annotated changes.
10. A complete and detailed set of final construction drawings , including but
not limited to signage, revised trash storage, parking lot lighting, land-
scaping, and irrigation plans , shall be submitted for Design Review Board
Process approval prior to submittal of plans for building permits.
11. The applicant shall submit to the City of Palm Desert a public easement
covering the parking area of the subject Lot 12 prior to issuance of
certificate of occupancy.
12. The property owner shall agree to join any assessment district formed
that includes the subject property within its boundaries.
13. The easterly parking space adjacent to the alley shall be deleted as it
is not in conformance to the Zoning Ordinance, which will leave a total
of eighteen (18) spaces approved.
14. All projections into the public right-of-way shall conform to the Uniform
Building Code and a five (5) foot setback shall be maintained for all
bearing walls and columns along the El Paseo frontage.
15. An additional six (6) inches of space shall be provided between the alley
parking spaces and the north wall of the building.
16. The west wall of the building shall be treated with stucco and painted
to match other walls.

The submitted site plan reflects changes that resulted from Planning Com-
mission action on the development plan. The Board may still desire a
more staggered approach to the position of the units to comply with
Design Review Condition No. 3.

1 . Final construction drawings , including a final landscaping ,
grading, lighting , trash storage , walkway layout , and irrigation

pancy permit shall be given by the Department of Environmental
Services to this project until the aforementioned approved plans
and construction shall have been completed .
2 . Adjustments shall be made to the southside of the project to pro-
vide for future 44 ' road dedication .
3. Revise orientation of structures throughout project for more
interest and variety.
4 . Resubmit a revised plot plan to the Board prior to completion of
working drawings .

Sec. 25.56.310 of the Municipal Code requires that in residential
districts, open parking spaces for more than 5 cars shall be screened
from properties in a residential district across a street. Staff does
not believe the proposed development complies with this requirement
and, therefore, recommends a continuance to allow for a redesign of
the entire site plan to get the parking in the rear or on one of the
sides of the site.

Staff is recommending that the parking space closest to Larkspur Lane
be deleted for traffic safety purposes. As the existing shopping
center has always had a trash storage problem, Staff believes the pre-
sent proposal does not include sufficient area for trash storage. It
is being recommended that the large planter directly west of the 12
proposed parking spaces be devoted partially to trash storage.

8. The planter area to _the northwest corner of the building shall be
designed with an end radius to permit vehicular turning movements.
9. That brick veneer is to be used on the building columns located
between window areas.

Special Conditions :
1 . All curbs and gutters , pavement and improvements shall be installed
in accordance with the City of Palm Desert Standards and Specifi-
cations including sidewalks on 44th Avenue and Cook Street .
2. All drainage facilities shall be installed in accordance with
the Director of Public Works ' approval .
3. A perimeter wall shall be provided around the project and shall
be approved by the Design Review Board.
Design Review Board Conditions :
1 . Final construction drawings , including a final landscaping,
grading, lighting, trash storage, walkway layout , and irriga-
tion plan in addition to a proposed sign program and tennis court
lighting proposal or any other ammenities proposed shall be sub-
mitted to the Design Review Board. The final landscaping plan
shall include information with regard to the relocation of exist-
ing trees and blowsand control measures proposed . No final in-
spection or occupancy permit shall be given by the Department of
Environmental Services to this project until the aforementioned
approved plans and construction shall have been completed.
2 . Veneer plant-ons on the garage doors for Plan No. 2 shall be verti-
cal.
3. Applicant shall avoid placing flowering trees adjacent to the
pool area.

I accept and agree , prior to use of this permit or approval , to comply
with all the conditions set forth , and understand that the Department
of Building and Safety will not issue a building permit or allow occu-
pancy on the use permitted until this signed confirmation has been re-

Standard Conditions
1 . The development of this project shall conform substantially to
[- all plans submitted in behalf of this case (Exhibit A) , and as
revised according to the Design Review Board process and/or
Planning Commission Action. Any minor changes require approval
by the Director of Environmental Services . Any substantial change
requires approval by the Planning Commission .
2. All requirements of any law, ordinance , or regulation of the State ,
City, and any other applicable government entity shall be complied
with as part of the development process.
3. This approval is applicable, subject to the development of this
project , commencing within one year from approval date and being
promptly completed.
4 . Prior to the issuance of a building permit for construction of any
use contemplated by this approval , the applicant shall first obtain
permits and/or clearance from the following agencies :
County Department of Public Health
Palm Desert Design Review Board Process
Coachella Valley County Water District
Regional Water Quality Control Board #7
5. Plans and specifications shall conform to the City of Palm Desert
standard specifications , development procedures and design criteria.
Any modifications , thereof , shall require approval of the City
Engineer.
Design Review and Special Conditions
1 . The site plan shall be modified in order to eliminate driveway
openings on Lupine Lane and Sun Lodge Lane as indicated on the
Revised Exhibit 'A' on file with the Department _of Environmental
Services . Driveways shall be designed so that no vehicle shall
back out into the public rights-of-way.
2 • All curbs , gutters, sidewalks and tie-in paving should be installed
on the development .
3. Right-of-way dedications shall be eight feet on Shadow Mountain
and four feet on Sun Lodge.
4. Construction plans shall be submitted for approval to the City
Fire Marshal prior to issuance of building permits . All conditions
shall be made a part of construction and no certificate of occupancy
shall be issued until completed.

5. Any/all utility service and distribution lines on or abutting the
subject property , shall be placed underground prior to occupancy
clearance .

Standard Conditions :
1 . The development of the property shall conform substantially with
that as shown on plot plan marked Exhibit 'A_l ' on file with the
Department of Environmental Services, Case No. DP 02-78 , unless
otherwise amended by the following conditions.
2. Prior to the issuance of a building permit for construction of any
use contemplated by this approval , the applicant shall first obtain
permits and/or clearance from the following public agencies :
County Department of Public Health
Dir. of Public Works - City of Palm Desert
Palm Desert Design Review Board Process
City Fire Marshal - City of Palm Desert
Coachella Valley County Water District
Regional Water Quality Control Board #7
Evidence of said permit or clearance from the above agencies shall I
be presented to the Department of Building and Safety at the time
of issuance of abuilding permit for the use contemplated herewith.
3. A landscaping , grading, lighting, amenities, trash storage , walkway
layout , and irrigation plan shall be submitted through the Design
Review Process. The building permit when issued shall include the
grading, lighting, amenities, trash storage, walkways , and irriga-
tion systems. No final inspection shall be given by the Depart-
ment of Environmental Services to this project until the afore-
mentioned approved plans and construction shall have been completed.
4. Construction of the development permitted hereby shall be done as
a single project .
5. The sewerage disposal system shall be submitted to and approved by
the Coachella Valley County Water District prior to issuance of
a building permit .
6. Construction shall commence within one (1) year after final approval,
otherwise said approval shall become null and void and of no effect
whatsoever .
7. Prior to the issuance of any permits, the applicant shall agree in
writing to any conditions of approval.
8. The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations , and restrictions
of all municipal ordinances and State and Federal Statutes now in
force, or which hereafter may be in force.
9 . The fire protection requirements as specified in the Fire Marshal ' s
memorandum, attached hereto, shall apply.
10. All new electrical distribution lines , telephone, cable antenna
television, and similar service wires or cables, which are adja-
cent to and provide service to the property being developed shall
be installed underground as a part of development from the nearest
existing pole not on the property being developed.
11 . Any possible line-of-sight problems shall be resolved through the
Design Review Board process during their preliminary and final
review.

Special Conditions :
1 . Applicant shall develop and provide a preliminary sign program
for total project .
2. Landscaping shall be upgraded. The number, type , size and loca-
tion of trees are not approved. Such approval shall be granted
through the Design Review Board process .
3. Submitted elevations _are , not approved and shall .be resubmitted
through the Design Review process .
4. Landscaping shall be increased around all structures , particularly
Buildings A and B.
5. Any and all existing overhead utility distribution lines shall be
undergrounded pursuant to the provisions in the Municipal Code.
6. Applicant shall pay fees into the Palm Desert "Planned Local
Drainage Facilities Fund" in an amount to be determined by the
provisions of Ordinance No. 175.
7. Applicant shall make a cash contribution in the amount of $12 , 500
towards the future signalization of El Paseo and Highway 74 .
8. Curbs , gutters and .tie-in paving shall be installed on the perimeter
of this development .
9. Sidewalks shall be installed on El Paseo and Highway 111 .
10. No ingress or egress shall be given to this parcel from Highway 74
or Highway 111.
11. Traffic safety lighting shall be installed as required by the
Director of Public Works.
12 . Right-of-ways shall be dedicated as required by Caltrans.
13 . The median modification on El Paseo shall be the responsibility of
the applicant and shall be subject to the approval of the Director
of Public Works.
14. The drainage of storm waters shall be handled in a manner acceptable
to CalTrans and the Director of Public Works.
