The meeting was called to order at 5:30 p.m. , in the Council Chambers of the Palm Desert City Hall after an hour study session. Members present: Eric Johnson Vern Barton Jim Hill (left meeting at 7:00 p.m. ) Paul Williams t,,,,,,, Frank Urrutia (entered meeting at 6:45 p.m. ) Members absent: Bernie Leung Phyllis Jackson Staff present: Murrel Crump Ralph Cipriani It was moved by Williams, seconded by Barton, that the minutes of the September 12, 1978, be approved as written; carried 4-0 (Johnson, Barton, Hill , Williams). II. A Minute Motion was made by Williams, seconded by Hill , that items numbered 2, 5, 10, 11 , and 12 on the Design Review Board agenda be approved; carries 4-0 (Johnson, Barton, Hill , Williams) . III . Discussion Cases (not previously covered in Minute Motion) : 1 . Case No. 93C - WILLIAM BURNETT - Preliminary approval of a commercial center to be located on the southeast corner of E1 Paseo and Highway 111 . Applicant was present. The Board reviewed a revised site plan submitted by the applicant which reflected an attempt to improve internal traffic circulation and El Paseo access, addressed by conditions in the previous review on September 12, 1978. The Board felt that the subsequent revision was now more in keeping with the objectives of DRB Conditions No. 8 and 9. Also addressed by Condition was the specific detail plan for the loading dock adjacent to the market. Discussion of the applicants concept plan for this was centered on: the need for berming as an important design feature; the use of trees with varing heights; elimination of trellaces as shown; and, a continuation of roof ele- ments (and other architectural design features) to the E1 Paseo elevation. Motion by Williams, seconded by Barton, that the revised preliminary site plan be approved; carried 4-0 (Johnson, Barton, Hill , Williams). 3. Case No. 50C - PRINCIPAL INTERESTS IN THE CRAINE BUILDING - Revised exterior stucco color and revised landscaping plan for a commercial structure to be located on the north side of E1 Paseo, west of Lan- tana extended. Applicant was present. tow The Board reviewed with the applicant the necessity for the requested changes. On a motion by Williams, seconded by Barton, the Board approved the revised colors, subject to the Condition that the stucco columns be painted a color between the shade of the wood trim and the requested shade for the columns; carried 3-0-1 (AYES: Johnson, Bartin, Williams; ABSTAIN: Hill ) . On a motion by Williams, seconded by Barton, the Board approved the revised landscape plan subject to the street trees being changed to a minimum 10' Washatonian Palms; carried 3-1 (AYES: Williams, Bar- ton, Hill ; NOES: Johnson). .e PO Minutes Palm Desert Design Review Board S(.:-ptember 26, 1978 Page Two III. Discussion Cases (Cont. ) 4. Case No. 126MF - CHACAHUALA DEVELOPMENT - Revised site plan for a 117 unit condominium project to be located south of Little Bend and north of Mesa View extended, between Alamo and Arrow Trail . Applicant was present. The Board noted that the revised site plan met the intent of the conditions. On a motion by Barton, seconded by Williams, the Board approved the revised preliminary site plan; carried 4-0 (Williams, Johnson, Hill , Barton) . Frank Urrutia entered the meeting at 6:45 p.m. 6. Case No. 149MF - ROBERT RICCIARDI - Preliminary site, floor and elevations for a 13-unit apartment building to be located on the north side of Shadow Mountain, east of San Luis Rey. Applicant was present. The Board' s discussion centered on the following subjects: - clustering units to the center of the property - splitting the parking area up - abruptness of end building elevations - consideration for single story on ends of the two story building At the request of the applicants' representative, a motion was made by Williams, seconded by Barton, to continue the project for restudy; carried 4-0-1 (AYES: Hill , Johnson, Barton, Williams; ABSTAIN: Urrutia). ' At this point Jim Hill left the meeting (7:00 p.m. ) 7. Case No. 150MF - ROBERT RICCIARDI - Preliminary site, floor and elevations for a 12-unit apartment building to be located west of Portola, between Larrea and Shadow Mountain. Applicant was present. The Board found that the building configuration did not lend itself to the size of property being developed; and, that the location of the parking area in relation to dwelling units was not functional , encouraging occupant parking in the street. On a motion by Williams, seconded by Barton, the Board rejected the application; carried 4-0 (Williams, Urrutia, Barton, Johnson) . 8. Case No. 95C - ROBERT RICCIARDI - Exterior remodelling of an exist- ing commercial structure located on the northwest corner of El Paseo and Larkspur Lane. Applicant was present. The Board reviewed the addition of wood facing to the existing build- ing and other remodelling requested. On a motion b Urrutia, seconded b Barton, the Board Y y approved the remodelling subject to the condition that the canopy on the south elevation be completely faced in wood; carried 3-0-1 (AYES: Barton, Urrutia, Johnson; ABSTAIN: Williams) . 9. Case No. 96C - ROBERT RICCIARDI - - Final construction drawings on 80 condominium units to be located on the northwest corner of 44th Avenue and Cook Street. Applicant was present. Case No. 96C (Cont. ) The Board discussed the relationship of the building to the site topography, circulation and parking design, and building materials. On a motion by Williams, seconded by Urrutia, the Board approved the preliminary site, floor and elevation plans subject to condi- two tions as follows: 6. The building shall be stepped to conform to the existing site topography, resulting in the building pad being at two to three different elevations. 7. That a minimum of two building cross-sections shall be submit- ted for review which illustrate how the building is fitted to the site (as required in No. 6 above) . 8. The planter area to the northwest corner of the building shall be designed with an end radius to permit vehicular turning movements. 9. That brick veneer is to be used on the building columns located between window areas. Carried; 4-0 (William, Urrutia, Johnson, Barton) . Lyons , Jr. , and I reside at 73-860 Shadow Mountain Drive. I am a permanent resident of Palm Desert and a registered voter. I would like to request that my statement be made part of this hearing and a copy of my statement will be made avail- able to the Secretary to the Commission. I am here this evening to represent the Continental Six, Inc. , which is a six (6) unit owner-occupied cooperative housing corporation. As Secretary/Treasurer, I have been authorized !)y the Board of Directors to represent our Corporation before this Commission. You have on your Agenda a request by a Mr. H.L. Maddy for approval of a thirteen (13) unit complex to be developed directly west of us on Shadow Mountain Drive. I have reviewed the plans submitted to the City with a member of your staff prior to this ,meeting and I find them to be totally out of character with the surrounding area and displays a totally insensitive attitude on the part of the developer and architect. I would like to point out to the Members of the Commission that this very same architect recently submitted to the City a plan for the easterly half of this property for a seven unit complex on a piece of land that was zoned for a. maximum of six (6) units . '*.r' Minutes Palm Desert Design Review Board September 26, 1978 Exhibit P-2 � a It is not my role here tonight to stymie development of the .. property next to us . I am a Certified Public Accountant, and as a CPA I am very cognizant of the unproductive costs that this developer will incur because of delays . However, the plans that are submitted for approval will have a very detrimental impact on the livability of our property in addition to the inverse effect such a development will have on the economic value of our property. Although these two (2) parcels of land are zoned R-3 which permits two story structures , a landowner does not have a vested right in the zoning that is attached to a particular property until the rights that are provided for that zoning have actually been exercised. Therefore, it is within the power of the w..r Commission to deny a request for two story structures for all or part of this proposed development. There are no two story buildings on Shadow Mountain Drive be- tween Portola Avenue and San Luis Rey and it is our feeling that this proposed project would be completely out of character with the present land use on Shadow Mountain Drive. If the developer insists on the use of two story structures , a layout could be developed with a combination of both single and two story structures that could blend in with the surroui,ding properties . Such a plan would not deny us sunlight (particularly during the winter months ) and would enhance the visual appearance of this particular street. ow —2- Mi!-iutes Palm Desert Design Review Board Se,itember 26, 1978 Exhibit P-3 I would like to quote a statement by the City Manager of Palm Desert recently carried in the Wheeler's Desert Letter regarding land use in Palm Desert : "It seems clear that vacant land will be developed at some time as long as rigid controls are maintained to ensure quality and low density, there is no reason to think that later growth will necessarily be better than current growth".
