Commission concurred that the minutes of August 13, 1985 should be held
over for discussion with Commissioner Martin regarding his comments.

Approval subject to the following condition:
1 . That the sign be reduced by a total of 8 inches, 4" on the top
of the sign and 4" on the bottom.

Chairman Gregory indicated that the final landscape plan should
show ground cover materials to be a minimum of 5 gallon and the trees
to be larger.

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of plans
for a 28 units single story apartment project.
LOCATION: South of Verba Santa between Frontage Road and Ocotillo.

Mr. Weller, building and safety department, informed the applicant
of the new handicap standards and sprinkler ordinance that will be
required by the building department.

APPLICANT (AND ADDRESS): SANBORN & RYLEE, 250 Newport Center Drive

NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of plans for a 20
unit residential project.
LOCATION: East side San Luis Rey between Shadow Mountain and Larrea.
ZONE: R-3 20,000 (3)
Mr. Smith outlined the case and noted that the roof mounted equipment
should be reviewed and that a formal lighting plan should be done by
a lighting engineer.
Mr. Diaz noted that a condition should be added so that the roof
mounted equipment be reviewed by the planning staff at the time of
inspection to determine if additional screening is necessary. The
applicants concurred with this suggestion.
It was moved by Commissioner Holden, seconded by Commissioner Leung
to approve this case subject to the conditions stated in the staff
report and the condition below. Carried 2-0- 1 (Chairman Gregory
abstaining)

1 . That staff review the roof mounted equipment at the time of
inspection to determine if additional screening is necessary.
2. CASE NO: 1030 SA
APPLICANT (AND ADDRESS) : IMPERIAL SIGN COMPANY, 46-120 Calhoun
Street, Indio, CA 92201 .
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of freestanding sign for
hotel . (Continental Inn)
LOCATION: South side Highway III east of Shadow Hills Road.
ZONE: PC (4) S.P.
Mr. Smith indicated that the proposed sign is not permitted by code
and informed the applicant that city council must determine if the
freestanding sign is to be permitted.
Commission agreed that the marquee should be deleted and that it
would not like to see a lolli-pop type of sign. Commission thought
that the sign should be scaled down and that there should be an
attempt by Continental Inn and Vacation Inn to work together in
making the two signs compatible.
Moved by Commissioner Leung, seconded by Commissioner Holden to
continue this case. Carried 3-0
3. CASE NO: 239 C
APPLICANT (AND ADDRESS): VACATION INN
NATURE OF PROJECT/APPROVAL SOUGHT: Sign plan approval for hotel .
LOCATION: South side Highway 111 , east of Shadow Hills Road.
Mr. Smith indicated that the proposed sign is not permitted by code
and informed the applicant that city council must determine if the
freestanding sign is to be permitted.
Commission noted that they would not like to see a lolli-pop type of
sign. Commission thought that the sign should be scaled down and
that there should be an attempt by Continental Inn and Vacation Inn
to work together in making the two signs compatible.

4. CASE NO: 62 C amendment
APPLICANT (AND ADDRESS) : PALMS TO PINES, Draperies & Canvas for
Michael 's Restaurant., 73-111 El Paseo, Palm Desert, CA 92260.
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of a freestanding
awning with signage.
LOCATION: South side E1 Paseo east of Ocotillo.
ZONE: C-1 S.P.
Commissioner Leung indicated that he had no objection to t_he
architecture of the awning.
Commissioner Holden stated that the freestanding awning was not
connected in any way nor did if relate to the building(s) in any way.
Moved by Commissioner Holden, seconded by Chairman Gregory to deny
this request. Carried 2- 1 (Commissioner Leung opposed)
5. CASE NO: 1038 SA
APPLICANT (AND ADDRESS) : THOMAS NOWLAN, 68-780 Olancha ##A,
Cathedral City, CA 92234.
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of business
identification signs. (Domino's Pizza)
LOCATION: 73-711 Highway III - south side Hwy 11 east of Larkspur.
ZONE: C- 1 S.P.
Moved by Commissioner Leung, seconded by Commissioner Holden to
approve this case as submitted. Carried 3-0
6. CASE NO: 289 ME
APPLICANT (AND ADDRESS): ROYCE CONNOR, 74-935 Highway 111 , Indian
Wells, CA 92210; C.W. MAXWELL, 1109 Mesquite Avenue, Palm Springs,
CA 92264.

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of a 8 unit
single story apartment project.
LOCATION: Northeast corner of Alessandro and Santa Ynez.
ZONE: R-3
Commissioner Leung indicated that the commission would need to see a
site plan showing sidewalks.
Mr. Diaz stated that curbs, gutters and sidewalks will be required
for this site.
Chairman Gregory felt that the landscape materials should be
increased and upgraded.
It was moved by Commissioner Holden, seconded by Chairman Gregory to
grant preliminary approval subject to the staff report condition and
the following:
1 . That a site plan indicating curbs, gutters and sidewalks be
submitted.
2. That a revised landscape plan be submitted.
Carried 3-0
7. CASE NO: 262 C
APPLICANT (AND ADDRESS): ROBERT S. RICHEY, 45-120 San Pablo 2d, Palm
Desert, CA 92260.
NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of plans for
office/warehouse/restaurant.
LOCATION: North west corner Eclectic and Lennon.
ZONE: S. I .
Mr. Diaz pointed out that sidewalks may be required for this site.
Chairman Gregory indicated that there was a lack of trees in the
parking area and requested that additional trees be planted.

Mr. Joy noted that planning commission added a condition that.
would require 4-5 additional trees in that area.
Moved by Commissioner Holden, seconded by Commissioner Leung to
grant preliminary approval . Carried 3-0
IV. DISCUSSION ITEMS:
1. CASE NO: 167 C
APPLICANT (AND ADDRESS): WISE ATHLETIC CLUB, 45-675 Williams Road,
Indian Wells, CA 92262.
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of satellite dish and
use of wrought iron around pool area.
LOCATION: Northeast corner of San Carlos and Alessandro Drive.
The applicant was requesting approval of a satellite dish which had
already been installed on the roof. He also was requesting that he
have the option of using wrought iron fencing instead of glass around
the proposed pool area.
Mr. Diaz concurred with the idea of wrought iron as long as persons
would not be able to climb over the fence.
Commissioner Holden was concerned that the visibility for vehicular
traffic would be reduced at the corner if wrought iron fencing was
used. Commissioner Leung was concerned with the liability aspect.
Mr. Wise indicated that he would be willing to paint the satellite
dish to match the building.
Chairman Gregory questioned if the dish could be moved closer to the
center of the building so that it would be less visible from the
street.
Mr. Wise noted that he could move it approximately 4 feet to the east
and farther south.
Moved by Chairman Gregory, seconded by Commissioner Holden to approve
this case with the following conditions to apply:
1 . If applicant chooses to utilize wrought iron, a sample should be
submitted to staff so that it may review the visibility factor.

match the building.

2. CASE NO: 1039 SA
APPLICANT (AND ADDRESS): SPORTS FEVER, 72-624 E1 Paseo, Palm Desert,
CA 92260.
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of business
identification sign.
LOCATION: 72-624 El Paseo
Mr. Smith explained that this sign would be located in the Chazan
Center which has a sign program approved. He did note that there has
been variances of the program previously.
Commissioner Holden thought that the commission should try to carry
out the original sign program that is previously approved.
Commissioner Leung suggested substituting ivory for the white.
Moved by Chairman Gregory, seconded by Commissioner Holden to approve
this case subject to the white being changed to ivory. Carried 3-0
3. BUFF'S PETS N' MORE
Mr. Diaz indicated that the applicant was requesting a 24 square foot
wooden sign which is permitted by code.
It was moved by Chairman Gregory, seconded by Commissioner Holden to
approve this case subject to the following condition.
1 . That the sign not protrude below the fascia nor above the
parapet.
Carried 2-1 (Commissioner Leung opposed)
4. CASE NO: 1028 SA
APPLICANT (AND ADDRESS): MOSS CENTER INVESTMENT, 54 San Sebastian,
Rancho Mirage, CA 92270.

NATURE OF PROJECT/APPROVAL SOUGHT: Review of monument sign for
Fred Waring Professional Building.
Mr. Smith indicated that the monument sign on the north west corner
did not meet the required setbacks for traffic visibility and could
not be approved.
Commission felt the sign concept for the building was acceptable.
It was moved by Commissioner Holden, seconded by Commissioner Leung
to approve the concept of the sign program for the Fred Waring
Professional Building. Carried 3-0
5. CASE NO: 1033 SA
APPLICANT (AND ADDRESS): EVE OWNBEY, REALTOR 73-470 El Paseo, Palm
Desert, CA 92260.
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of business
identification sign.
LOCATION: 73-470 E1 Paseo
Mr. Smith indicated that the size of the sign was allowable by code.
Commission felt that the applicant did not occupy enough space in
order to have this size of a sign.
Moved by Commissioner Holden, seconded by Commissioner Leung to deny
this case. Carried 3-0
6. CASE NO: 288 MF
APPLICANT (AND ADDRESS) : NICK JORGENSEN, 48-596 Oakwood Way, Palm
Desert, CA 92260.
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of landscape plan.
LOCATION: South side of Driftwood, west of Deep Canyon.
ZONE: R-3 (3)
Staff indicated that this project received final approval but needed
a final landscape approval .

Chairman Gregory noted that the plan could use additional trees that
should be up-sized. He felt that the plan was not acceptable as a
final landscape plan.
Moved by Chairman Gregory, seconded by Commissioner Holden to return
the plan to the applicant for restudy. Carried 3-0
7. ATTENDANCE
Mr. Diaz pointed out to the commission that there has been four times
this year that the commission has had to meet with only two
commissioner's present. This is in addition to having to cancel the
last meeting.
He indicated that this could not continue to happen. He asked if
there was a problem with the meeting time, which could be changed if
necessary.
The commission concurred that the time was not a problem and that
they would be sure that the architectural meetings will be their
first responsibility.

The meeting was adjourned at 3:35 p.m.

subject applicant , at a recently held meeting of the Architectural
Advisory Committee .
My remarks are stated in the enclosed letter , which has been
prepared for the members of the Committee , and members of the
Planning Department of the City of Palm Desert . I would like to
request that you coordinate the distribution of these letters to
their recipients at your earliest convenience .
Since , in my opinion, the comments made by the subject applicant
are potentially damaging to myself , efforts on your part to expedite
this matter would be appreciated .

Dear Mr . Smith:
It has been brought to my attention that at a recent meeting of
the Architectural Advisory Committee , the applicant , C.W. Maxwell ,
acting in reply to a committee member ' s question , stated that the
architectural building plans for his proposed project were being
prepared by , and would be signed by , Joseph Cicchini .
I would like to respond to Mr . Maxwell ' s remarks by stating that
they are entirely false , and have never been true . I do not
prepare , nor have I ever offered to prepare architectural building
plans for anyone , including, Mr . Maxwell . I do not perform, nor have
I ever offered to perform, any architectural design services for
anyone , including Mr . Maxwell , and I do not offer to , nor have I ever
"signed" architectural building plans prepared by others when
requested to do so . My services , as a Civil Engineer , continue to
be , as they always have been , in the areas of civil engineering, and
structural calculations .

the Committee , take the appropriate action to remove his remarks from
