ARCHITECTURAL REVIEW COMMISSION
JANUARY 25, 1994

I. CALL TO ORDER:
The meeting was called to order at 12 : 15 p.m.

II . APPROVAL OF MINUTES:
It was moved by Commissioner Holden, seconded by Commissioner
Connor, to approve the minutes of the December 14, 1993
meeting as submitted. Motion carried 5-0-1, Commissioner Van
Vliet Abstaining.
It was moved by Commissioner Holden, seconded by Commissioner
Connor, to approve the minutes of the January 11, 1994 meeting
as submitted. Motion carried 6-0 .
III . It was moved by Commissioner Holden, seconded by Commissioner
Connor, to approve the following cases by minute motion.
Motion carried 6-0.

1 . CASE NO. : 4255 SA

Jeff Winklepleck noted that the awning was 4 ' high and
extended 5 ' from the building. Signage is on the front
and sides of the awning. Mr. Smith noted that the awning
was located west of the Daily Grille.
Commission approved the awning with signage as submitted.
2 . CASE NO. : 382 C
APPLICANT (AND ADDRESS) : J.F. DAVIDSON ASSOCIATES for
AVONDALE COUNTRY CLUB, 77-564 Country Club Drive, Suite
400-B, Palm Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of final
plans for maintenance building
LOCATION: Frank Sinatra Drive and Mozambique
ZONE: PR-3
Mr. Smith noted that the plans were before the commission
with a change to waffle crete walls . He indicated that
the building size and location was the same.
Commission approved the final plans as submitted.
3. CASE NO. :

Catalina Way, Palm Desert, CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of addition
of a bell tower entry
LOCATION: 73-750 Catalina Way
ZONE: R-2 S.O.
Commission discussed the history of the project, noting
that the minor addition was approved two years ago.
Commissioner Connor noted that there were significant
setbacks .

B. Miscellaneous Cases:
1. CASE NO. :
APPLICANT (AND ADDRESS) : RALEIGH C. DeBOW, 3 Temple
Court, Rancho Mirage, CA 92270
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of proposed
landscaping and existing architecture for Certificate of
Conformance
LOCATION: 44-408 and 44-440 Acacia Drive
ZONE: R-1
Jeff Winklepleck presented pictures of the project as
well as a proposed landscape plan. He noted that it was
before the commission over a year ago and the
recommendations given by the commission at that time were
included in this plan. Commissioner Urrutia questioned
the size of the parking stalls noting that the plan
showed 18 ' but with a wheel stop at 16 ' . Mr. Winklepleck
noted that it would be the commission' s choice to ask for
additional landscaping in this area.
Commissioner Urrutia asked the city' s position in regards
to parking that was not conforming. Steve Buchanan
indicated that he was not aware of anything being done to
the property that would activate the action needed to
bring the parking up to current city standards as the
owner was just increasing the landscaping on site.
Commission approved the proposed landscaping and existing
architecture for Certificate of Conformance, subject to
relocating trees to align with parking lot stripes .

NATURE OF PROJECT/APPROVAL SOUGHT: Consideration of
grading plan as it affects 16-1/2 foot single family
residence
LOCATION: 73-190 Joshua Tree
Mr. Smith left the meeting at this time.
Jeff Winklepleck presented photographs of the lot along
with the actual grading plan. He outlined the background
of the house approval and indicated that a neighbor to
the west was now complaining about the pad height as he
feels that the Jaymes ' will now be able to see directly
into his backyard. Mr. Winklepleck noted that the house
foot print was basically at the same location as
originally approved.
The plans were previously approved in October 1993 . In
the interim considerable grading has taken place pursuant
to a grading plan issued by the city.
Commissioner Gregory questioned the slope from the upper
right corner of the lot to the street. Mr. Jaymes
indicated that it was 1/2� as that is the minimum allowed
in this area. Mrs . Jaymes indicated that the neighbor
was requesting some type of screening along their back
wall so she presented a revised landscape plan showing
oleanders placed along the back property line. Mrs .
Jaymes noted that their house would be 50 feet from their
back property line. The engineer, Jerry Dennington,
presented a plan showing the existing slopes on lots 5,
6 and 7 . He indicated how a swale was being created for
the necessary water flow.
Joe Gaugush outlined past occurrences with grade
situations in this area. He felt that the grading plan
being presented was in conformance as staff interprets
the grading ordinance as it states now. Mr. Gaugush felt
that the solution of planting mass oleanders would
mitigate the neighbor' s concerns.
Commissioner Urrutia asked if Mr. Jaymes had intended to
install a new wall . Mr. Jaymes indicated that he had not
planned on installing a wall, just planting the
oleanders . He felt that installing such a wall on his
property would create a "no mans land" . Commissioner

Urrutia felt it would clean up the area some if a typical
garden wall was placed along the property line.
Commission felt that the best solution would be if all
three property owners were to install a common wall .
The property owners who made their concerns known to
staf f, Mr. and Mrs . Kaban, arrived at the meeting stating
that their main objection was that the plans were not
approved by the Palm Desert Property Owners Association.
Mr. Diaz explained how a property owner can approach the
city and demand that his application be processed if he
meets all the city ordinances . He added that if the
property owners associations wish to avail their legal
rights within their C.C.&R. 's, they may do so, but the
city does not have to comply with the organization' s
C.C.&R. ' s; however, they simply try to do their best to
cooperate with the various associations . Mr. Diaz
explained that the property owners association was not
the agency that would assure the accuracy of the grading
and drainage, as that is the responsibility of the city.
He added that the property owners association' s only
concern was aesthetics .
Mr. Kaban asked who each individual was in attendance and
if they needed to be at this particular meeting. Mr.
Diaz introduced the commissioners, himself, and all staff
members . Mr. Gaugush explained to Mr. and Mrs . Kaban why
the lot was elevated in some places to accommodate the
correct drainage.
Mr. Diaz stated that decisions of the Architectural
Review Commission are appealable to the council .
Commission reiterated the fact that the plans had already
been approved. Mr. Gaugush quoted Municipal Code Section
27 . 12 . 090 which requires that the architectural review
commission review grading situations where there is a
potential impact on adjacent properties .
Mr. Buchanan stated that the property owners would have
to install some type of fence around the pool or the
entire property. Commissioner Gregory asked if the
neighbors fence would meet the requirements . Mr.
Buchanan indicated that the fence would have to be
structurally sound and this would have to be determined
by a site inspection. Mr. Jaymes noted that there would
be a wrought iron fence placed on the interior of the

property to surround the pool.
Mrs. Kaban asked if there was any way she could be shown
what will be seen from her home. Commissioner Gregory
felt that a 2 x 4 could be placed at the ridge line to
show the height of the house and along the property line
to show the height of the oleanders . Commissioner
Urrutia suggested that a civil engineer do a site line
inspection and show where the house would be, the fence
and the line of site.
Commission discussed how they wanted this issue settled
as the two parties would be neighbors now. Mr. Kaban
agreed and wanted to try to open up the lines of
communication.
Commissioner Connor felt that the oleanders should be
installed now so that a year from now when the house is
completed, the oleanders would be matured. Commissioner
Urrutia also suggested installing a chain link fence with
the oleanders planted on both sides . He added that this
would also help with the security problems .
Commissioners Gregory and 0'Donnell offered to help the
applicant in acquiring the line of site and make a report
back to staff on their concerns . Commissioner Holden did
not feel that 5 gallon oleanders placed 4 ' apart would be
sufficient. Mrs . Jaymes indicated that she could plant
15 gallon plants .
Commission directed the applicant to install a 2 x 4
indicating the height of the proposed oleanders and the
height of the house showing Mr. and Mrs . Kaban the actual
line of site.
IV. The following case was added to the agenda by a unanimous
vote:

Jeff Winklepleck presented plans for the proposed
banners . The banners would be 30" x 94" , white with
burgundy cactus . The request was to install 15 banners .
Commissioner Holden felt the banners were acceptable if
done with nice graphics .
Commission recommended approval of the proposed banners
to the city council.
