II . APPROVAL OF MINUTES:
It was moved by Commissioner Connor, seconded by Commissioner
O'Donnell, to approve the minutes of the September 27 , 1994
meeting as submitted. Motion carried 6-0 .

III . It was moved by Commissioner O'Donnell, seconded by

Steve Smith presented the drawings for the proposed
signage. Commissioner Urrutia thought that the signage
on both sides of this store looked much smaller. The
applicant noted that the sign would be hung over the
planter area.
Commission approved the signage as submitted subject to
it being located over the planter area and not encroach
into the sidewalk. Motion carried 6-0 .

Steve Smith presented the drawings for the proposed
signage in teal letters . He indicated that this was the
end unit at the corner of Larkspur and E1 Paseo.
Commission approved the signage as submitted.

Steve Smith reminded the commission that this case was
before them at its last two meetings and that the final
working drawings were altered when submitted to the
building department. The applicant, Mr. Ludington,
indicated that the alterations were to allow for a

handicap access to the front entrance. He added that
there were two doorway accesses on the north side of the
building that went to hallways leading to the front
reception office.
Commissioner Urrutia asked if the handicap access could
be relocated closer to the front entrance. He noted that
the handicap parking could be located on the opposite
side of the parking lot as long as it was marked on the
pavement.
Chairman Gregory asked to review the landscape plan.
Commissioner Connor asked if there was room to have cut
outs along the wall for planting some type of vines .
Commissioner Holden asked if they could delete one
parking space. Mr. Smith indicated that the building
grew considerably and they were very tight on parking.
Mr. Ludington indicated that the stairway leading to the
air conditioning equipment had been removed, and there
also would be no storage in this area. Chairman Gregory
felt that the revised plans showed the entire north side
of the building looking like a utility building.
Commissioner Urrutia suggested using one of the back
access doors at the parking area as entrance to the
reception area. He indicated that if the applicant would
change the way the floor plan would flow, he would meet
the handicap access requirements of code.
Commission retained the previously approved landscape
plan subject to the internal function of the floor plan
being slightly changed to relocate the reception area to
the rear of the building.

Phil Drell presented the drawings for the wall noting
that the property was on a private road off Catalina
which was not improved as part of the city' s assessment
district. Mr. Drell reported that the request was before
the commission because of the ordinance that restricts a
6 ' wall closer than 15 ' from the curb. He indicated that
because the existing roadway was originally placed on
only one side of the road, other homeowners have placed
walls all the way out into the street. Mr. Drell added
that the ultimate goal would be to place a wrought iron
fence across the front. Mr. Smith informed Mr. Schilling
that if he were to come back in the future with a request
for a 6 ' fence across the front of his property, he would
need a minimum of 2 ' from the pavement for landscaping.
Commission approved the 6 ' high block wall with the
condition that it be placed 2 ' back from the edge of the
existing pavement.

NATURE OF PROJECT/APPROVAL SOUGHT: Approval to recover
existing awning for new business identification signage
LOCATION: 73-130 E1 Paseo
ZONE: C-1 S .P.
Steve Smith presented the drawings for the awning noting
that the applicant was requesting 9" letters .
Commissioner Urrutia indicated that unless the commission
was shown some type of hardship, they could not approve
anything larger than 8" letters as stipulated by code.
The applicant indicated that the owner of the business
felt that 9" letters on this awning were appropriate as
there were quite a few awnings along E1 Paseo with larger
than 8" letters . Commission explained the different
situations where it allowed larger than 8" letters on
awnings, but felt that there was no justification in this
situation.
Action:
It was moved by Commissioner Connor, seconded by
Commissioner Holden, to approve the awning as submitted
with 8" maximum letter height. Motion carried 6-0 .
B. Preliminary Plans :

Steve Smith reminded the commission that the elevations
received preliminary approval at its last meeting with
conditions that hip roofs needed to be placed where there

was minimum 10 ' sideyard separations . Mr. Smith
indicated that the applicant had revised the site plan
and showed how the units would relate to each other. He
reported that the applicant did not wish to do the hip
roof design and came up with a new site plan where the
minimum separations would be 16 ' .
The request was now for approval of this site plan and to
eliminate Condition No. 1 from the October 11, 1994
meeting. The applicant, Mr. Joe deCoster, outlined the
project showing where the buildings were pulled further
apart. Mr. deCoster indicated that he had a letter from
the existing homeowners at Woodhaven approving the
revised plan.
Action:
It was moved by Commissioner Holden, seconded by
Commissioner Van Vliet, to approve the revised site plan,
eliminating Condition No. 1 from the October 11, 1994
meeting. The gable roofs were acceptable given the extra
distance between the units . Color samples were also
approved as submitted. Motion carried 6-0 .
C. Miscellaneous Plans :
1 . CASE NO. :

Mr. Smith presented the house plans noting that the
setbacks were 10 ' on each side and the lot was located on
the lower side of the street.
Action:
It was moved by Commissioner Van Vliet, seconded by
Commissioner O'Donnell, to approve the plans for the
single family residence as submitted. Motion carried
6-0 .

V. ORAL COMMUNICATIONS:
Mr. Charles Kaban asked to speak to the commission
regarding the problems he was having at his home on
Shadow Mountain Drive because of the drainage situation
from his neighbor' s new home on Joshua Tree. He informed
the commission that the sprinkler system installed in
June at the Jaymes ' residence has been draining onto Mr.
Kaban' s property and distributed photos showing the
results of this drainage problem. Mr. Kaban has been
working with Joe Gaugush, of the Public Works Department,
on the situation, and feels that nothing has been done to
correct the problem. He indicated that Mr. Gaugush has
spoken to Mr. Jaymes regarding the drainage and suggested
digging a ditch on Mr. Jaymes property to repel the water
draining from the oleanders . Mr. Jaymes did dig the
swale, however, it is located on Mr. Kaban' s property.
Mr. Kaban met with Mr. Jaymes in September, at which time
Mr. Jaymes felt that it was Mr. Kaban' s responsibility to
repel the water from Mr. Jaymes ' property.
Commissioner Urrutia reviewed the discussion commission
had with the two homeowners when the plans were before
the commission earlier this year and the possibility of
moving Mr. Kaban' s fence to the property line or building
a new common block wall . He felt that if this had been
done, there would not be the problem today. Commissioner
Holden remembered that Mr. Jaymes did not feel there was
a requirement by the city to install a block wall when a
fence already exists and that is why there is oleanders
on the slope now.
Commissioner Urrutia noted that the grading plan showed
the water draining to the street and felt there would be
no problem if the grading plan was followed correctly.
Commissioner O'Donnell went over to the house two months
ago at the request of Mr. Kaban and saw that the water
was not being contained properly from the home on Joshua
Tree. Commissioner O'Donnell brought pictures of the
situation to Joe Gaugush and Mr. Gaugush informed him at
that time that he would meet with the property owners to
try and resolve the situation. Mr. Smith asked if the
issue was that the trench isn' t effective or the fact
that it is on Mr. Kaban' s property. Mr. Kaban noted that
the trench was starting to seep down and he is starting
to get more water onto his property. Mr. Kaban discussed
his concerns with flash flooding that occurs in this

area. He is concerned because there is no insurance
policy that will cover his property from flood damage.
Chairman Gregory informed the Mr. Kaban that his first
step would be to talk to Joe Gaugush again, and if Mr.
Gaugush felt that the property was not properly graded so
that it functions properly, than Mr. Jaymes is violating
his agreement with public works . If Mr. Gaugush can't
get this matter resolved, than it becomes a civil matter.
Chairman Gregory questioned the type of sprinkler system
and thought that it should be controlled better by just
watering each individual oleander.
Chairman Gregory felt that if Mr. Gaugush could not
resolve the matter satisfactorily than perhaps Mr. Kaban
should talk to someone higher up. Mr. Kaban felt that it
was the commission' s responsibility to inform Mr. Jaymes
that his approved plans were not followed properly.
Chairman Gregory disagreed and felt it was not the
commission' s responsibility to follow through on grading
plans . Mr. Smith noted that he had spoken to Mr. Gaugush
on the situation and Mr. Gaugush informed him that he has
been getting very little cooperation from Mr. Jaymes and
Mr. Jaymes wasn't returning his phone calls .
Commissioner Urrutia noted that staff had to give Mr.
Jaymes a Certificate of Occupancy so that tells him that
everything had to be inspected and approved by staff. He
asked if the building department, public works department
and the planning department all signed off on this home.
Mr. Smith indicated that since the Jaymes ' are living in
the dwelling then this process must have been completed.
Commissioner Holden felt that this was more an irrigation
problem than a grading problem.
Commissioner O'Donnell discussed the history of the house
plans which came to A.R.C. after the grading had been
completed, and reminded the commission that Mr. Jaymes
did not obtain the approval of his homeowners association
and ended in a law suit with the association.
Commissioner Urrutia felt that the next step should be to
go to the city council with the problem. Commission
directed staff to prepare a brief history of what the
project went through and present it to the city council
asking them for their help in resolving this .
Commissioner Urrutia felt that it was not right that Mr.
Kaban is getting the run-a-round and that no one can bear

enough pressure to get this situation corrected. He
reiterated that this commission had waived the normal
requirement for the installation of a block wall but had
requested that the slope be planted with oleander in
order to reduce the view from the Jaymes property into
the Kaban property. The view problem had resulted from
the grading ( filling) which took place on the Jaymes
property. Considering that the planting on the slope was
done at the direction of the A.R.C. to address an A.R.C.
concern, then the city should be able to resolve the
water drainage issue. The city council should get
involved and suggest how this should be handled.
Commissioner Urrutia asked staff to review the grading
plan and make sure that it was adhered to. He felt that
if the grading plan was adhered to than there is another
issue that has to do with an irrigation problem. He
added that if the grading plan was not adhered to then
the city has grounds to back to the property owner to
make sure that he corrects the situation. Commissioner
Urrutia stated that in this situation the grading was so
critical that there really wasn't any room for margin of
error or deviation.
Action:
It was moved by Commissioner Urrutia, seconded by
Commissioner O'Donnell, to direct staff to prepare a
brief history and staff report on the project to include
the intent of the grading plan (not to drain on Mr.
Kaban' s property) and forward this onto the city council
for action. Motion carried 6-0 . Commissioner O'Donnell
suggested that the photographs taken by Mr. Gaugush be
attached to the staff report for city council .
