The meeting was called to order at 12 : 30 p.m.

II . APPROVAL OF MINUTES:
It was moved by Commissioner Urrutia, seconded by Commissioner
Gregory, to approve the minutes of the April 9 , 1996 meeting
as amended on Pages 6 and 11. Motion carried 5-0 .
III . ORAL COMMUNICATIONS:
Commissioner 0'Donnell discussea his concerns regarding the
chain link fence that was recently installed around the
driving range at College of the Desert without a permit issued
by the city. He distributed a draft memorandum for the
commission to forward to the city council relating to the
college not meeting basic architectural standards required by
all others in the city. Mr. Smith indicated that he would
refer the draft memorandum to the city attorney.

NATURE OF PROJECT/APPROVAL SOUGHT: Addition of "open"
sign to legal, non-conforming, free standing sign
LOCATION: 73-925 El Paseo
ZONE: C-1
Steve Smith presented photographs showing the existing
free standing sign in front of the building. Ms . Garcia
informed the commission that she thought the sign was
there before the incorporation of the city. Mr. Smith
reported that in 1995 the city council passed an
amendment to the sign ordinance allowing for "open"
pedestal signs for E1 Paseo businesses . The signs are to
be removed when the business is closed. Ms . Garcia
explained the restrictions placed on the "open" signs .
Commissioner 0'Donnell questioned why businesses had to
have open signs at all .
Mr. Smith showed how the applicant had added a small open
sign on top of the free standing sign in the planter
rather than put up on additional pedestal sign on the
sidewalk.
Action:
It was moved by Commissioner Gregory, seconded by
Commissioner Holden, to approve the "open" sign on top of
the existing free standing siqn in the planter because it
is implementing a portion of the ordinance to help keep
clutter off the streets/sidewalks by using only one sign.
Motion carried 5-0 .

3. CASE NO. : 4636 SA
APPLICANT (AND ADDRESS) : RIOFINE NEON for BANANAZ , 3500

NATURE OF PROJECT/APPROVAL SOUGHT: Approval to change
existing non-illuminated entrance sign to exposed neon
LOCATION: 72-291 Highway 111
ZONE: C-1
Mr. Smith presented pictures of the existing, non-
illuminated, sign indicating where the applicant is
asking to add exposed neon. Commissioner Holden noted
that the sign faces the parking lot. The applicant
indicated that they would be using a german glass which
is a low intensity neon. Mr. Winklepleck asked if the
color tended to loose its color and suggested the use of
a rheostat.
Action:
It was moved by Commissioner 0'Donnell, seconded by
Commissioner Gregory, to approve the revised business
identification signage subject to installing a rheostat
to control the intensity of the neon. Motion carried
5-0 .
4 . CASE NO. : 422 C
APPLICANT (AND ADDRESS) : PACIFIC BELL MOBILE SERVICES,
2955 Red Hill Avenue, Suite 100, Costa Mesa, CA 92626
NATURE OF PROJECT/APPROVAL SOUGHT: Approval to install
wireless communication facility
LOCATION: 72-770 E1 Paseo
ZONE: C-1
Mr. Smith indicated that the existing tower is 35 feet
high. He noted the insert in the commission' s packets of
"Wireless Update" stating that we are likely to see as
many as nine different carriers in the valley. The
applicant, Amy Stanton, indicated that they can keep the

height below 45 feet for the bell tower. Mr. Smith
indicated that the commission will be making a
recommendation to the city council because the structure
is over the allowable height limit.
Commissioner Holden felt that this was not an aesthetic
issue. Commissioner Urrutia felt that the applicant had
complied with the commissions request in terms of height,
however he felt the design of the tower would not be
acceptable. He thought that the tower needed to be
designed better. Commissioner 0'Donnell agreed and felt
that the tower should be designed by a licensed
architect. He added that the commission also needed to
see the architecture for all four sides of the tower.
Action:
It was moved by Commissioner Van Vliet, seconded by
Commissioner 0'Donnell, to continue the request to allow
the applicant to redesign the tower showing the
architecture on all four sides and using more creativity.
The commission felt that the 45 ' tower would be
acceptable if it were more aesthetically pleasing.
Motion carried 5-0 .
5. CASE NO. : 425 C
APPLICANT (AND ADDRESS) : PACIFIC BELL MOBILE SERVICES,

NATURE OF PROJECT/APPROVAL SOUGHT: Approval to install
wireless communication facility
LOCATION: 74-876 Avenue 42
ZONE• S. I .
Mr. Smith presented the plans indicating that the tower
would be located next door to Continental Cable. The
applicant, Amy Stanton, indicated that they would be able
to lower the antenna to 60 feet.
Action:
It was moved by Commissioner Holden, seconded by
Commissioner O'Donnell, to recommend to the city council
approval of the 60 ' hiqh tower as it is half the height
of the neighboring antenna. Motion carried 5-0 .

Mr. Smith updated the commission on the proposal for the
installation of an antenna at Woodhaven Country Club. He
indicated that Amy Stanton met with the homeowners
association for the Palm Desert Resort which is adjacent
to the proposed antenna location. Ms . Stanton reported
that she went to the actual site with the representative
for the association and showed where the antenna would be
installed and explained how a landscaping maintenance fee
could be paid by Pacific Bell to insure that the proper
landscape screening was maintained. She indicated that
they took up the issue with their board members on
Friday, April 19th and their response was that they were
not sure what their roll was . Ms . Stanton explained to
them that they would be notified of the public hearing.
She had not heard anything else from them. Mr. Stanton
did state that she had received a letter of support from
Woodhaven Country Club Homeowners Association.
Commissioner Holden felt that the other two antennas were
located in more appropriate areas and felt that there
would be a better solution for this area as they are
proposing an antenna that is twice as high as the highest
tree. Mr. Stanton indicated that the tower would be
located 12 ' back from Hovley Lane East.
Mr. Smith asked the commission if they felt an ordinance
should be created dealing with the installation of towers
in residential areas. Commissioner Holden indicated that
he did not want to see the antennas scattered around the
valley. Commissioner Urrutia agreed with Mr. Smith' s
suggestion.
Commissioner Holden asked about installing the antennas
in conjunction with the high freeway poles just a couple
hundred feet away. Commissioner Urrutia felt this would
be a good solution. Commissioner Gregory asked about the
shopping center at Hovley Lane East and Washington
Street. Ms . Stanton indicated that the property owners
were not interested. Commissioner Gregory asked if the
applicant had contacted the property owners on the south
side of Hovley Lane East. Ms . Stanton indicated that she
had not done this yet.

Commissioner Gregory felt that the commission could not
take any action on this antenna until they receive some
direction from the city council on their feelings about
these towers. Commissioner Holden indicated that he
would have to take a negative stand on any towers in
residential areas . Commissioner Urrutia felt that the
commission should make a recommendation to the city
council with specific guidelines .
Commission suggested that city council create an
ordinance regulating the maximum heights, specifically in
residential areas, and that they be installed along major
transportation corridors relating to other high
structures in the area and can be co-located with other
agencies ' equipment. They added that a condition should
be added that the equipment be removed once it is not
being used.
B. Preliminary Plans :
1 . CASE NO. : PP 96-4
APPLICANT (AND ADDRESS) : OLIPHANT, MATZNER, 77-900

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of
preliminary architectural and landscaping plans for
remodel and addition to an existing office structure
LOCATION: 44-311 Monterey Avenue
ZONE: O.P.
Jeff Winklepleck presented the plans for the remodel
noting that it was similar to the Homme building next to
Commissioner Holden' s building. He indicated that the
only comment staff had was that additional shade trees
were needed to meet the city' s parking lot shade tree
requirements.
Action:
It was moved by Commissioner O'Donnell, seconded by
Commissioner Gregory, to approve the preliminary
architectural and landscape plans subject to the addition
of two 24" box trees to meet the city' s parking lot shade
tree requirements . Motion carried 4-0-1, Commissioner
Holden Abstaining.

C. Miscellaneous :
1. CASE NO. :
APPLICANT (AND ADDRESS) : SANTA ROSA DEVELOPERS, 2300
Olive Street, Gavelin Hills, CA 92570
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of a single
family residence above 15 ' in height
LOCATION: 23 Taylor
Steve Smith presented the plans indicating that the house
was in the Montecito project. Commissioner Holden
indicated that most the houses in this neighborhood are
approximately 18 ' high. Commissioner Urrutia felt that
the elevations had enough interest to warrant the height.
Action:
It was moved by Commissioner Urrutia, seconded by
Commissioner O'Donnell, to approve the plans for the
single family residence as submitted. Motion carried
5-0 .
V. ORAL COMMUNICATIONS:
Commissioner Holden questioned whether staff had given final
approval to the landscaping at 5t. Margaret' s Church. Mr.
Winklepleck responded that the city was still holding a bond
on the project and that they had not given final approval on
the landscaping. Commissioner Gregory felt that staff needed
to set a date when the landscaping had to be completed or the
bond would be forfeited to the city. Mr. Winklepleck
indicated that he would talk to the public works department on
the status of the sidewalk and report back to the commission.
