Motion carried 3-0-2, Commissioners Holden and Gregory Abstaining. III . CASES: A. Final Drawings : 1 . CASE NO. : PP 96-3 APPLICANT (AND ADDRESS) : 0. MICHAEL HOMME, Post Office Box 258, Palm Desert, CA 92261 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of final working drawings for remodel and addition to an existing building LOCATION: 44-331 Monterey Avenue ZONE: O.P. Jeff Winklepleck presented the final working drawings showing the added windows on the back side of the building. MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 Action: It was moved by Commissioner Connor, seconded by Commissioner Van Vliet, to approve the final working drawings as submitted. Motion carried 4-0-1, Commissioner Holden Abstaining. 2 . CASE NO. : CUP 95-12 APPLICANT (AND ADDRESS) : B.G. JONASSON & ASSOCIATES for TOKYO KITCHEN, 44-655 San Benito Circle, Palm Desert, CA 92260; SHIN MATSUNANGA, 75-480 Fairway Drive, Indian Wells, CA 92210 NATURE OF PROJECT/APPROVAL SOUGHT: Review final plans for metal and wood awning structure with signage LOCATION: 73-540 Highway 111 ZONE: C-1 Steve Smith reminded the commission that the case was before them last month and that the applicant was directed to address some issues with the building department and bring back color samples to the commission for final approval. Mr. Buchanan advised that they have worked out the concerns from the building department. Commissioner Urrutia questioned the screening of the equipment. He felt that a screen was to be added around the equipment as it was located so far back. Commissioner Holden added that one of the concerns was that the store took up about half of the building and that the awning abruptly ends at the end of this unit. Commissioner Urrutia discussed his concerns with the quality of the structure and asked what the material would be for the signage as well as how the drainage would work. Mr. Buchanan noted that the structure was a candelievered awning and therefore the building department will need engineering plans and actual working drawings . Commissioner Urrutia felt that the design was acceptable but was concerned with how it would be installed and how the drainage would be addressed. 2 ®rr+ MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 Action: It was moved by Commissioner Urrutia, seconded by Commissioner Connor, to grant preliminary approval to the plans subject to the roof mounted equipment being screened on three sides . Applicant to return with material samples and details . Motion carried 5-0 . 3. CASE NO. : 4670 SA APPLICANT (AND ADDRESS) : SAEED HIJAZI for A GALLERY, 12427 W. Jefferson Blvd. , Suite 206, Los Angeles, CA 90066 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of illuminated business identification signage on existing brass awning LOCATION: 73-956 E1 Paseo, Suite B ZONE: C-1 Steve Smith presented the plans for the illuminated signage. The applicant, Saeed Hijazi, explained that it is an existing smoked glass awning and discussed how the illuminated signage would be added. Mr. Smith asked about the size of the "A" . Mr. Hijazi explained that it was 2 ' x 219" . Mr. Smith noted that the size of the "A" would be an exception on an awning, but because it is not a canopy awning, the letter size would not have to comply to awning signage restrictions . Mr. Hijazi indicated that "Gallery" would be in 8" letters with "Fine Art" in 6" letters . Action: It was moved by Commissioner Holden, seconded by Commissioner Van Vliet, 'to approve the signage as submitted. Motion carried 5-0 . 4 . CASE NO. : 4671 SA APPLICANT (AND ADDRESS) : JOHN O'HEA SIGNS for A.G. EDWARDS, Post Office Box 1078, Palm Desert, CA 92261 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of business identification signage 3 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 LOCATION: 72-795 Highway 111 ZONE: C-1 Steve Smith presented the plans for the proposed signage indicating that it is on the parapet above the roof line and therefore is something that the commission cannot approve but would make a recommendation to the planning commission. He showed how First Interstate, McDonalds, Village Lounge, and other businesses in the center have existing signage above the roof line. Commissioner Connor noted that it would be a can sign. Mr. Smith agreed that the plans did show a can sign with a blue plastic face. Commissioner Connor felt that the signage should be individual channel letters as the rest of the center has used. The representative for A.G. Edwards, Mr. Jack Kline, was present. Mr. Smith asked if changing from a can sign to individual channel letters would be acceptable. He indicated that the individual channel letters would be acceptable. Action: It was moved by Commissioner Connor, seconded by Commissioner Urrutia, to approve the signage subject to it being changed to individual channel letters and that it receives a waiver from the planning commission approving the location. Motion carried 5-0 . Mr. Smith explained to Mr. Kline that there would be another step required in the process before permits can be issued. He explained that a notice would have to be sent to the property owners within 300 feet of the building and hold a public hearing before the planning commission. 5 . CASE NO. : 4675 SA APPLICANT (AND ADDRESS) : THE OLIVE TREE, 73-940 E1 Paseo, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of exterior remodel to include new canvas awning, trellis, doors and windows on front and back 4 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 LOCATION: 73-940 E1 Paseo ZONE: C-1 Steve Smith presented the proposed drawings for the front and rear of the building. He noted that on the E1 Paseo side they are looking at creating a new look with columns . The olive green awning is being relocated from another location, is 25 ' x 7 ' high, and is centered over the windows and doors on the parking lot side of the building. Action: It was moved by Commissioner Urrutia, seconded by Commissioner Connor, to approve the exterior remodel plans as submitted. Motion carried 5-0. 6 . CASE NO. : 4679 SA APPLICANT (AND ADDRESS) : ATLAS AWNING CO. for FOUNDATION FOR THE RETARDED, 754 Williams Road, Palm Springs, CA 92264 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of aluminum entry structure for handicap loading area LOCATION: 73-255 Country Club Drive ZONE: P Steve Smith presented the drawings for the proposed awning. He indicated that most people arrive by school bus and they are asking for approval to install an aluminum awning at the entrance extending out over the west side of the building towards Sagewood. The awning will extend out 9-1/2 feet and there is 10-1/2 feet of curb/sidewalk. Action: It was moved by Commissioner Urrutia, seconded by Commissioner Holden, to approve the aluminum entry structure as submitted. Motion carried 5-0 . 7 . CASE NO. : 4680 SA APPLICANT (AND ADDRESS) : PLASTI-LINE WEST for UNION BANK, 13489 Slover, Bldg. B, Fontana, CA 92337 5 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of business identification signage LOCATION: 73-785 E1 Paseo ZONE: C-1 Steve Smith presented the plans for the proposed signage indicating that the bank was located on the southeast corner of San Luis Rey and E1 Paseo. They are requesting removal of the two existing illuminated wall signs and the one set of non-illuminated letters and logo. They will be replaced with two non-illuminated wall signs, one internally illuminated wall sign, and two sets of three directional signs. Action: It was moved by Commissioner Urrutia, seconded by Commissioner Holden, to approve the revised business signage as submitted. Motion carried 5-0 . 8. CASE NO. : APPLICANT (AND ADDRESS) : ANA MARIA KRAUSE for EL MONARCH CUSTOM FURNITURE, 74-214 Highway 111, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of business identification signage LOCATION: 74-214 Highway 111 ZONE: C-1 Steve Smith presented the drawing for the proposed sign. He explained that they are looking to add the sign onto the fascia. Commissioner Gregory felt that the commission needed to see an exact drawing of the sign, not the rough sketch as presented, as it looked too rustic. The applicant indicated that the material would be metal to match the existing stucco color with the letters mounted on the metal. Mr. Smith informed the applicant that there is a limit of two menu items, i .e. wood and iron or hand carving and interior design. The applicant asked if under the name E1 Monarch Custom Furniture they could have "hand carving" on one side and "interior design" on the other side, eliminating "wood" 6 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 and "iron" . Mr. Smith felt this would meet the criteria. Action: It was moved by Commissioner Holden, seconded by Commissioner Connor, to approve the signage subject to the applicant submitting a revised drawing to staff for final approval . Motion carried 5-0 . 9 . CASE NO. : 430 C APPLICANT (AND ADDRESS) : MIKE THORNTON for HOME SAVINGS OF AMERICA, 10821 Airport Drive, E1 Cajon, CA 92020 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of relocation of three ATM drive-up lanes LOCATION: 44-495 Town Center Way ZONE: PC-3 Steve Smith presented the plans showing the relocation of the drive-up lanes. They are presently located on the Highway 111 side of the building and will be moved to the Town Center Way side. He noted that you still will be able to bypass the drive-up lanes and access the parking lot in the corner. Action• It was moved by Commissioner Van Vliet, seconded by Commissioner Gregory, to approve the plans for the relocation of the ATM drive-up lanes as submitted. Motion carried 5-0 . 10. CASE NO. : PP 94-4 APPLICANT (AND ADDRESS) : GEORGE BUONO/DR. HARRIS for SUNLIFE MEDICAL BUILDING, 42-005 Cook Street, Suite 300, Palm Desert, CA 92260; ROBERT A. RICCIARDI, AIA, 39-000 Bob Hope Drive, Rancho Mirage, CA 92270 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of final working drawings for a medical/office building LOCATION: Southwest corner of Fred Waring Drive and San Anselmo Avenue ZONE: O.P. 7 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 Steve Smith reminded the commission that the plans were denied preliminary approval by this commission. The issue was appealed to the city council and the council approved the preliminary plans subject to the applicant amending those plans to comply with the setback requirements . The building has been revised from a site planning perspective to the point where it complies with the 15 feet of setback from Fred Waring Drive and in fact in many areas is greater than 15 feet. The architecture is similar to the preliminary plans which commission felt was not acceptable at that time. Mr. Smith informed the commission that a landscaping plan had not been submitted as yet. Commissioner Gregory asked why the plans were before the commission today without landscaping plans as this has always been a requirement. Commissioner Gregory asked that a landscape plan be submitted in order for the commission to review the project as a whole. Action: It was moved by Commissioner Holden, seconded by Commissioner Van Vliet, to grant final approval to the working drawings as the plans were substantially consistent with what the city council approved. Approval is subject to an approved landscaping plan being submitted prior to issuing building permits . Motion carried 5-0 . 11. CASE NO. : 424 C APPLICANT (AND ADDRESS) : AMERICAN PROPERTIES LLC for GENEVIEVE COURT APARTMENTS, 100 West Mesa Drive, Suite 214, Fullerton, CA 92635 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of final working drawings for remodel of 15-unit apartment complex LOCATION: 73-555 San Gorgonio ZONE: R-3 Steve Smith presented the final working drawings . He indicated that the applicant has added water heater units to the roof mounted equipment. The applicant indicated that they were low profile water heaters in metal enclosures . Commissioner Gregory asked if this equipment would be placed within the parapets that will be screening the air conditioning equipment. The applicant 8 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 indicated that they would not. Mr. Buchanan indicated that the plans did not reflect the added water heaters, but that the information was noted on the plans being reviewed today. Commissioner Connor felt that the commission could not review the additional changes without seeing the corrected plans . Commissioner Holden agreed and felt that a detailed roof plan should be submitted showing to scale where the equipment is going and how it is planned. Commissioner Gregory suggested that the water heater units be located adjacent to the air conditioning compressors so that the equipment is somewhat consolidated and straight lined. Action: It was moved by Commissioner Van Vliet, seconded by Commissioner Holden, to grant final approval to the working drawings subject to the applicant providing an amended roof plan detailing where the water heater units will be located in a reasonably orderly fashion and that all roof mounted equipment is screened. Motion carried 4-0-1, Commissioner Urrutia Abstaining. B. Preliminary Plans : 1. CASE NO. : CUP 96-19 APPLICANT (AND ADDRESS) : SANTA FE HOMES OF AMERICA, INC. for PORTOLA PROFESSIONAL OFFICE BUILDING, 74-170 Highway 111, Suite 3, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of revised preliminary plans for residential conversion to office use and expansion LOCATION: Northwest corner of Portola Avenue and Alessandro Drive ZONE: R-3 Steve Smith distributed the revised plans noting that the necessary variances for the setbacks were approved by the planning commission on July 16th and the plans have been revised to reflect these setbacks . He noted that the parking lot was turned around as required by public works, the elevations were revised to reflect the changes to the site plan, and the landscaping plan has been 9 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 amended but not reviewed by Eric Johnson yet. Commissioner Urrutia discussed his concerns with the parking on the building side as he felt that the curb should still be pulled back enough to keep the cars from hitting the building. Commissioner Gregory felt that the landscaping for a remodel of an existing building should be better quality and with running lawn right next to the building means that the sprinkler heads will be right next to the building and eventually the mineral deposits from the sprinklers spraying against the building will start to show. He suggested that if the applicant did not want shrubs against the building, there would need to be a gravel or concrete band to push the sprinkler heads farther away from the building. He also noted that the bottle tree is not a tree used to meet the city' s shade tree requirements . Commissioner Holden asked when the widening of Portola Avenue would take place. Mr. Smith indicated that it is not in the very near future and that the six feet to the east of the new property line will remain in the landscape form so they need to insure that the trees are within that area. Action: It was moved by Commissioner Gregory, seconded by Commissioner Urrutia, to grant preliminary approval to the architectural plans only with the condition that the parking spaces be revised and subject to the applicant submitting a revised landscaping plan incorporating the comments discussed with the commission and approved by Eric Johnson. Motion carried 5-0 . 2 . CASE NO. : CUP 96-18 APPLICANT (AND ADDRESS) : McFADDEN & McINTOSH ARCHITECTS for CAM'S CORNER, 73-929 Larrea, Suite 1A, Palm Desert, CA 92260 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of revised preliminary architectural and landscaping plans for fuel station/convenience store/video store LOCATION: Northwest corner of Highway 111 and Deep Canyon 10 1400, MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 ZONE: C-1 Commissioners Urrutia and Connor declared that they were part of the competition when the applicant was selecting an architect/landscape architect. Mr. Smith read from the Municipal Code Section 25.70 . 130 Part A that reads in part "any member of the architectural commission who shall be employed to execute a plan, building or structure of any kind requiring the approval of the commission or who shall take part in competition for any such building or structure, shall be disqualified from voting and shall abstain and step down from proceedings on that item" . Mr. Smith explained to the applicant' s representatives that unless the applicant specifically requests that Commissioners Urrutia and Connor participate, that they would abstain from the discussion and voting. After several minutes of deliberation Mr. Tim Bartlett requested that both Commissioner Urrutia and Commissioner Connor participate fully in the discussion and voting. Mr. Smith also noted to the chairman that there were residents and nearby business owners in attendance that may wish to address the commission. Mr. Bill Barnett, a resident at Hidden Palms, expressed opposition to a service station and convenience store in this location and felt that the city did not need more of these uses . Ms . Burns, a resident at Hidden Palms, asked the commission why they thought the city needed another convenience store across the street from a new Luckys store which will probably be open until midnight or maybe 24 hours a day and across the street from Country Club Liquor which is also a mini market. Commissioner Holden replied that it was the planning commission' s decision on uses and that this commission was an aesthetic review commission only. Mr. Smith informed the commission that the matter will go back to the planning commission on August 6th and asked that the residents give him a call on Tuesday morning, August 6th, to confirm that the item is still on the agenda and if the applicant is asking for a continuance because at this point in time he was not sure if the applicant would be ready by the August 6th meeting. Mr. Dennis Goedecke addressed the commission discussing his concerns with the setback on the north side being so 11 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 He added that he agreed with Mr. Goedecke in that the building setback on the north side is very tight. Commissioner Gregory continued to say that the setback of the building should not be less than the height of the building. He added that the planters have been substantially widened and with the type of trees, the berming and the shrubs, that from a landscape point of view, the project is screened, perhaps too much. Commissioner Holden felt that having the driveway so close to the corner is still not a good traffic solution. *Note - Commissioner Holden left meeting at 2 :00 p.m. Commissioner Connor discussed his concerns with the narrowness of the perimeter along Deep Canyon. He also felt that planting the filiferas onto the corner near the driveway closest to Deep Canyon, as suggested by Eric Johnson, would create an even worse problem because it will cut down any kind of site visibility. He also discussed his concerns with the lack of landscaping along Alessandro Drive and felt that eliminating the third island would solve a lot of these problems . Commissioner Van Vliet noted his concerns with the setback along Alessandro Drive being too tight and the predominance of the canopy. He felt that the canopy still needed to be pulled back some because it really crowds the corner. Mr. McFadden distributed a set of photographs of various service stations around the valley. Commissioner Urrutia noted that picture No. 1 shown (Plaza de Monterey) versus picture No. 7 is no comparison. These two comparisons show a very large canopy. Picture No. 1 shows a very large setback off the corner with some nice walls, a very low profile mass which is the back of the station, and landscaping. Commissioner Urrutia agreed with Commissioners Connor and Van Vliet in that there needs to be more setbacks . He added that since the commission has not seen any alternatives, i .e. a reverse site plan, they do not know what other solutions could be done. Commissioner Urrutia felt that if the proposed site plan is the only way the applicant wants to do it, there still needs to be ample setback to allow the canopy not to come out to the front. He felt that the setback along Alessandro Drive is marginal at best. Mr. McFadden 12 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 indicated that the setback from the corner to the closest point of the canopy is 12 feet. Commissioner Gregory felt that if the building were brought back somewhat on the Alessandro Drive side to a point where the commission felt was minimally acceptable, then he feels enough concerns have been addressed and the project could fly. He asked Mr. McFadden how far back could he pull the building on Alessandro Drive. Mr. McFadden replied that he could probably pull the building back two to three more feet to match the Arco setback on Alessandro Drive. This would put the building back nine feet from the back of the sidewalk. Action: It was moved by Commissioner Gregory to approve the preliminary architecture, the site planning, and landscaping plans subject to moving the building three feet farther in along the entire frontage of Alessandro Drive (the north side) and that the comments made by Eric Johnson be adhered to with the exception of relocating half of the palm trees to the northeast corner of the site. Motion died due to a lack of second. Commissioner Van Vliet indicated that the canopy is still an issue being too tight to the corner. Mr. McFadden replied that the canopy could be pulled back four or five feet at the most but the cars will only be partially covered at that end. Commissioner Connor felt that he could not support a motion to grant preliminary approval with the plans presented today. Action: It was moved by Commissioner Gregory, seconded by Commissioner Van Vliet, to continue the case to allow the applicant to return with a revised site plan and landscaping plan addressing the concerns noted by the commission. Motion carried 4-0, Commissioner Holden Absent. 13 MINUTES ARCHITECTURAL REVIEW COMMISSION JULY 23, 1996 C. Miscellaneous: 1. CASE NO. : APPLICANT (AND ADDRESS) : RICK JOBE CONSTRUCTION, 72-288 Barabara Street, Rancho Mirage, CA 92270 NATURE OF PROJECT/APPROVAL SOUGHT: Approval of plans for single family residence over height limit LOCATION: 73-100 Bel Air Road ZONE: R-1 Steve Smith presented the plans for the single family house noting that it was the typical 17-1/2 ' height for most of the homes in that neighborhood. Action: It was moved by Commissioner Connor, seconded by Commissioner Van Vliet, to approve the plans for the single family residence as submitted. Motion carried 4-0 . The commission discussed their concerns with specific landscaping plans being approved for projects and seeing the landscaping not being maintained properly over the years . Mr. Smith explained that the city council recently adopted Ordinance No. 801, available from the city clerks office, outlining the city' s new property maintenance ordinance so all projects now going through the planning commission will be required to enter into a property maintenance agreement to maintain the landscaping in the fashion shown on the final map.
