II. APPROVAL OF MINUTES:
It was moved by Commissioner Van Vliet, seconded by Commissioner O'Donnell, to
approve the minutes of the September 24, 1996 meeting as submitted. Commission does
not endorse the accuracy or validity of documentation received from Mr. Chris
McFadden regarding his suggested corrections to the minutes. Motion carried 5-0-1,
Commissioner Holden Abstaining.
It was moved by Commissioner Van Vliet, seconded by Commissioner O'Donnell, to
approve the minutes of the October 8, 1996 meeting as submitted. Commission does not
endorse the accuracy or validity of documentation received from Mr. Chris McFadden
(Exhibit"A"). Motion carried 5-0-1, Commissioner Connor Abstaining.

Steve Smith presented the colored rendering of the sign indicating that the
applicant is requesting approval to install the 48" x 42" sign in the existing can.
Action
It was moved by Commissioner Holden, seconded by Commissioner Connor, to
approve the business identification signage as submitted. Motion carried 6-0.

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of free standing
monument sign at entry

Martin Alvarez presented colored renderings of the proposed free standing sign to
be placed at the entrance to Deep Canyon Tennis Club off Highway 74. He
indicated that the sign is a 4'x 10' double sided monument sign with gold letters
on a green background.
Action
It was moved by Commissioner Van Vliet, seconded by Commissioner Connor, to
approve the free standing monument sign subject to the applicant obtaining an
encroachment permit from the public works department. Motion carried 6-0.

Steve Smith reported that the fitness center would be moving into the north
building of the 111 Town Center. He indicated that Festival Management
processed a request in 1995 for a new sign program but that the current architect
did not want to use this sign program so they reverted back to the original sign
program which was individual channel letters with lighting through the face. He
added that part of the original approval in 1985 limited the signage on the north
side of the building facing Fred Waring Drive to non-illuminated letters. The
World Gym Fitness Center will be asking the city council to waive this non-
illuminated requirement. Mr. Smith indicated that the commission's position on
the proposed signage would be a recommendation to the city council because they
are the ones who limited the signage to non-illuminated letters on the north
elevation.
Mr. Smith noted that One Quail Place had just been completed when this project
was approved and therefore the landscaping at the apartment complex was not as
lush as it is today. Commissioner Gregory asked if a rheostat could be installed to
control the intensity. He felt that the landscaping at One Quail Place was so lush
now that the proposed sign would not be seen from the apartment complex.
Mr. Smith stated that the proposed sign is their registered trademark in red and
black. He added that the commission could not prevent them from installing a
sign with their registered trademark but this does not mean that it has to be the
size they are requesting and it does not mean that it has to be illuminated. Mr.
Smith continued to say that the size allowed for signage is reduced by 20% for
each of the trademark colors which are added to an approved sign program.
Commissioner Urrutia felt that reverse channel lit letters would be acceptable in
their trademark colors. The applicant, Gary Wright, felt that this would be
inconsistent with the rest of the signs in the center. Commissioner Urrutia felt that
this would not matter, as the sign on the north elevation would not be visible
when viewing the rest of the signage in the center. Mr. Wright asked if it would
be acceptable to dim the neon in the sign to make it not so bright as he felt the
reverse channel letters would cost more than what the applicant could afford.
Commissioner Urrutia thanked Mr. Wright for trying to work with the
commission's requests but felt there should be a compromise. Commissioner
Gregory agreed with Commissioner Urrutia's suggestion adding that this was a
way to add some subtle elegance to the signage.

Action
It was moved by Commissioner Urrutia, seconded by Commissioner Connor, to
recommend to the city council to approve the signage on the north elevation in
reverse channel lit letters with a maximum 4500 white neon and their registered
trademark colors in red and black. Motion carried 6-0.
5. CASE NO.: 4731 SA
APPLICANT (AND ADDRESS): LITECO SIGNS for TRIBAL TOUCH

identification signage

Martin Alvarez presented a colored drawing showing the two proposed signs at
Portola Avenue and Highway 111. The one sign proposed for the south elevation
would be 1'8" x 16'with black letters on a white background and the east
elevation signage would be 1'8" x 8' with black letters on a white background in a
single face cabinet. Mr. Alvarez added that the applicant is aware that they will
have to remove the sign on the east side of the building if the property to the east
is developed.
Commissioner Holden felt that the sign on the east elevation should not be placed
on the ribbon because is it much larger than the ribbon. He added that it should
be either above or under the band.
Ms. Garcia stated that the sign approval should be subject to the applicant not
putting his furniture out on the sidewalk as he does every weekend. She
continued to say that she has spoken to the applicant about this and nothing is
being corrected on the weekends.
Commissioner Gregory asked what the height was from the sidewalk to the
bottom of the fascia on the south elevation. Commissioner Urrutia felt it would
look better if individual letters were placed on the band itself as he felt that the
can sign did not belong on the building because it interferes with the fascia detail

on the building.
Action
It was moved by Commissioner Urrutia, seconded by Commissioner O'Donnell,
to approve the sign on the east elevation subject to placing it below the banding.
The commission continued the signage request for the north and south elevations
as they felt that the size of the can was too big for the space allowed. The
commission suggested a narrow can sign at a maximum of 12" high to hang below
the fascia or placing individual letters on the face of the band. Motion carried 6-0.
6. CASE NO.: 4732 SA
APPLICANT (AND ADDRESS): STEVE WILLIAMSON for FITIGUES,

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of business
identification signage and awnings
LOCATION: 73-100 El Paseo, Suite 6
ZONE: C-I
Steve Smith presented photographs of the building, plans and a sample of the
brushed aluminum letters proposed for the building signage. Commissioner
Urrutia asked if the proposal included awnings. Mr. Smith indicated that the
request included approval of the awnings but staff had not received color or
material samples as yet and the applicant was not present.
Action
It was moved by Commissioner Connor, seconded by Commissioner Holden, to
approve the building signage only as submitted and continued the request for the
awnings as the applicant was not present with material and color samples. Motion
carried 6-0.

business identification signage

Martin Alvarez presented photos of the restaurant outlining the location for the
proposed 4' x 7' sign indicating that"Dakota"would be turquoise, "Bar& Grill"
would be red and the logo would be white on a brown background. He added that
the applicant is asking that the white be considered a non color for the logo (cow
head). Mr. Smith indicated that the sign is considered a roof mounted sign, and
that the commission could not approve a sign above the roof line. The
representative for the applicant, Gary Wright, replied that he was trying to keep in
line with the tile roof line.
Commissioner Urrutia felt that the applicant should look at other designs as the
proposed sign does not fit the long and narrow area they have to work with.
Commissioner Gregory asked if there was any room below the awning for the
sign placing it more at a pedestrian level. Mr. Wright indicated that there was not.
Commissioner Gregory suggested removing the logo and stretching the name out
some.
Action
It was moved by Commissioner Urrutia, seconded by Commissioner O'Donnell,
to continue the request directing the applicant to redesign the sign as it did not fit
the long,narrow area as proposed and could not be placed above the roof line.
Motion carried 6-0.
8. CASE NO.: 4735 SA

Steve Smith presented photos of the existing building at the corners of Cook
Street, Velie Way and 42nd Avenue indicating the location of the proposed signs.
He noted that there is a very evident sign program for the development in copper
patina letters. The applicant is asking approval to take down the street numbers
on the towers and place the bank identification sign on both sides of the towers.
Mr. Smith indicated that the owner of the center has approved the sign proposal.
Action
It was moved by Commissioner Holden, seconded by Commissioner O'Donnell,
to approve the exception to the sign program for the building as submitted.
Motion carried 6-0.
9. CASE NO.: PP 95-8
APPLICANT (AND ADDRESS): DESIGN DEVELOPMENT for FRED
WARING OFFICE PLAZA, 69-730 Highway 111, Suite 118, Rancho Mirage,

NATURE OF PROJECT/APPROVAL SOUGHT: Final approval of
landscaping plan for medical office building
LOCATION: South side of Fred Waring Drive between San Pasqual and San
Pablo
ZONE: O.P.
Steve Smith presented the landscape plan for a medical office building for Dr.
Shaw at San Pasqual and Fred Waring Drive. He indicated that Eric Johnson
made comments on the plan stating that some of the plants identified were not
called out on the pallet and that he thought the plan was over planted.
Action
It was moved by Commissioner Connor, seconded by Commissioner Urrutia, to
approve the landscaping plan as submitted. Motion carried 5-0-1, Commissioner
Gregory Abstaining.

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of revised
preliminary elevations

Steve Smith presented the revised preliminary elevations for Best Buy noting that
at their last meeting the commission asked them to break up the building and
provide more shading. Commissioner Urrutia stated that they wanted them to
stretch the trellis structure out more. Commissioner Gregory agreed and felt that
the trellis looked like an add on. Commissioner Holden added that they wanted
the trellis to extend to cover the service areas. Commissioner Urrutia asked if the
trellis was wood because the commission suggested that they use a more
contemporary material and to get away from the spanish style look.
Commissioner O'Donnell added that he was looking for more of a contemporary
steel grill work at the entry. Commissioner Urrutia noted that the entrance to Best
Buy is a real departure from the rest of the centers design and felt that the entire
building should have this contemporary design.
Action
It was moved by Commissioner Urrutia, seconded by Commissioner Connor, to
continue the revised preliminary elevations for Best Buy directing the applicant to
extend the trellis structure one bay to the north and one bay to the south and to
change the trellis style to a more contemporary design eliminating the exposed
ends of the trellis beams creating more of a horizontal beam/fascia. Motion
carried 6-0.

Steve Smith reported that the case still continues as no agreement has been made.
Action:
It was moved by Commissioner Urrutia, seconded by Commissioner O'Donnell,
to continue the case as requested by the applicant. Motion carried 6-0.
2. CASE NO.: TT 24984-2
APPLICANT (AND ADDRESS): FOXX DEVELOPMENT CORP. for THE

action of October 10, 1996

Steve Smith reminded the commission that this was regarding solar protection on
the east and west elevations of the homes to be built in the last phase of The
Grove. Mr. Smith reported that Mr. Foxx appealed the A.R.C.'s action of
September 24, 1996 requiring solar protection stating that Title 24 has changed
twice since 1991 when the original homes at The Grove were built. Mr. Foxx felt
that his homes met the current Title 24 requirements and are far more energy

efficient than the homes built in 1991. Mr. Smith stated that on a 3-2 vote, the
council granted the appeal.

Mr. Smith indicated that the commission received a copy of a faxmittal from Mr.
Chris McFadden and suggested that the commission receive and file it.
Commissioner Holden stated for the record that the document would not be
considered as part of the minutes.
Action
It was moved by Commissioner Urrutia, seconded by Commissioner O'Donnell,
to receive and file the documentation received from Mr. Chris McFadden dated
October 14, 1996. Motion carried 6-0.
