The meeting was called to order at 12:30 p.m.

II. APPROVAL OF MINUTES:
It was moved by Commissioner Van Vliet, seconded by Commissioner Holden, to approve
the minutes of the April 22, 1997 meeting as submitted. Motion carried 4-0-2,
Commissioners Gregory and O'Donnell Abstaining.

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of awning with
business identification signage
LOCATION: 73-468 Highway 111
ZONE: C-1
Mr. Smith presented the revised drawings for the awning noting that the original
request was denied by this commission on June 25, 1996 and denied by the City
Council on July 11, 1996. He reported that the request had been amended and was
before the commission today for approval. Mr. Smith indicated that a vertical black
stripe separation was added between the business names. The representative for the
applicant, Mr. Ernie Brooks, indicated that the awning for Big A Auto Parts will
remain the same but with new fabric with the music store and Pasta Joes changed to
a green awning. He added that there are air conditioning units on the roof behind the
awning but were screened with a back cover. Commissioner Holden suggested
recessing the separation about 3' wide and 5' deep and recessing it back about 12".
Mr. Brooks indicated that this could not be done but he could add a return on both
sides with one side being green and the other return in ivory to match the awning.
Action:
It was moved by Commissioner VanVliet, seconded by Commissioner Urrutia, to
approve the revised awning subject to adding a return on the ends with one end being
green and the other return in ivory to match the awning colors. Applicant to provide
an accurate drawing for final approval showing the 32" to 36" separation where the
color change in the awning occurs. Motion carried 6-0.

Mr. Smith presented the landscape plan indicating that Eric Johnson had reviewed
the plan and suggested some changes. Commissioner Connor was concerned that the
proposed plan would go in as designed even if the architect does plant what is
approved. Commissioner Connor noted that on Mr. Ricciardi's last project the shrub
material installed was not what was approved and the tree sizes were smaller than
what was approved. Commissioner Gregory indicated that the trees located along the
east property line should be located where they will not be hit by cars. He added that
the trees called out on the plan are not acceptable and the ground cover suggested
was unsympathetic with the desert's natural pallet.
Action•
It was moved by Commissioner O'Donnell to deny the request based on the
comments made by the commission. Motion died due to a lack of a second.
Action•
It was moved by Commissioner Urrutia, seconded by Commissioner O'Donnell, to
continue the request directing the applicant to address the following:
1) Restudy trees selected and conform to the city's parking lot shade tree
requirements; and
2) Trees located along the east property line should be located where they will
not be hit by cars; and
3) Restudy the ground cover as the material suggested is unsympathetic with the
natural desert palette; and
4) Retain the services of a licensed landscape architect.
Motion carried 6-0.

Mr. Smith reported that the planning commission approved the tentative tract for 72
homes. Mr. Alvarez noted that Eric Johnson had reviewed the plans and noted some
suggestions. Commissioners Gregory and Connor agreed with Mr. Johnson's
comments.
Action•
It was moved by Commissioner Connor, seconded by Commissioner Gregory, to
approve the perimeter landscape plan subject to the changes noted by Eric Johnson
and the use of lawn in the retention basin. Motion carried 6-0.

treatment of tower element for Best Buy

Mr. Smith reported that the applicant did not intend on pursuing the requested change
in color of the tower elements at this time but was still requesting approval to repaint
the two tower elements perhaps at sometime in the future. He indicated that the
applicant was requesting approval to change out the pale salmon colored towers to
the more vivid salmon color.
Action•
It was moved by Commissioner Urrutia, seconded by Commissioner Connor, to
approve the tower element color change and suggested the column/fascia on the
trellis be painted to match the color of the insert beyond the fascia (a dark green
color). Motion carried 6-0.

Mr. Buchanan reported that there were no changes from the approved preliminary
plans noting that it was an addition to an existing office building.

It was moved by Commissioner O'Donnell, seconded by Commissioner Urrutia, to
approve the final working drawings as submitted. Motion carried 6-0.

Mr. Smith indicated that the owner was requesting approval to change one of the
three approved sign colors far the center. The approved colors are red,teal and green
with white as a non-color. He indicated that the request is to change the teal (which
has not been used) to orange to accommodate Orange Julius. Mr. Smith noted that
there is a revised plan coming from Dairy Queen which staff had not seen yet, but
would be substantially close to the plans the commission was reviewing today.
Commissioner O'Donnell questioned the"just juice" signage under"Orange Julius"
and "an American Original" under Dairy Queen. He felt these two bottom lines

cluttered the signage and should be eliminated. The representative for applicant,Mr.
7ohnson Go, indicated that "NST JIJICE" was part of the new logo for Orange
Julius. Commissioner O'Donnell suggested that "NST JtJICE" be placed
elsewhere. Commissioner Gregory agreed and felt that the bottom lines take away
from the signage and would be very hard to read unless you were right up next to the
sign. Commissioner Connor agreed that the signs were too hard to read with the
clutter of the bottom line. Mr. Smith noted that the plans indicate that the"Orange
Julius" is a registered trademark, but questioned if "just juice" was part of the
registered trademark. He added that if the entire sign was considered a registered
trademark than the colors would not be an issue and that the sign would have to be
reduced in size.
Action:
It was moved by Commissioner Holden, seconded by Commissioner Urrutia, to
approve the color change for the center from teal to orange and approved the signage
for Dairy Queen/Orange Julius subject to deleting the bottom line ("An American
Original" and"Just Juice"). Motion carried 6-0.

Mr. Smith presented the revised preliminary landscape plan noting that Eric Johnson
had reviewed the plan and noted his comments/suggestions. Commissioner Connor
felt that the plant palette submitted was acceptable.

It was moved by Commissioner Connor, seconded by Commissioner Urrutia, to
approve the preliminary landscape plan as submitted subject to grouping the trees
within species. Motion carried 6-0.

preliminary architectural plans

Mr. Smith presented the revised preliminary plans noting that there were some major
changes from the plans submitted to the commission three weeks ago. Mr. Alvarez
introduced the architect for the project, Mr. Dan Thornbury. Mr. Thornbury noted
that some of the changes included a metal roof over the expanded area with a brick
red color instead of the original bright red and the addition of two tower elements
tieing it all together with a colonnade. Commissioner Urrutia noted that the colar
board submitted showed the brick red metal roof while the colored rendering showed
a more subtle color roof treatment. He added that he liked the proposed color
changes but needed to see what the actual roof color would look like. Mr. Walker
stated that he would rather use the lighter terra cotta color for the metal roof.
Commissioner Holden suggested that the roof tower elements be expanded.
Commissioner Urrutia agreed and felt that they needed to be wider to make it look
more substantial.
Action:
It was moved by Commissioner Holden, seconded by Commissioner Connor, to
approve the revised preliminary architectural plans subject to increasing the depth on
the roof tower elements and changing the metal roof color to terra cotta. Motion
carried 6-0.

Mr. Smith presented the plans to the commission noting his concern with the amount
of parking when looking at the floor plan and the intensity of the use. He questioned
how adequate the parking was, but noted that the parking did meet code
requirements. Commissioner Gregory asked about a shaxed driveway for future use
as he felt there was an opportunity there to not take up so much space for a driveway
if it is shared with the adjacent property in the future. The representative for the
applicant,Mr. Gabriel Lujan,indicated that the owner informed him that the people
who own the vacant lot adjacent to this property do not want to participate in a shared
driveway. Commissioner Urrutia noted that this was because the property owner
received an offer from Dr.Harris in order to add to his property and the homeowner
on the west side is not interested in selling. Commissioner Gregory asked if the city
could get involved to insist that a shared driveway be used here. Commissioner
Holden stated that he would rather see landscaping on the side instead of 24 feet of
asphalt and suggested that they expand the size of parking space No. 7.
Commissioner Holden asked about the required recycling bins. Mr. Smith indicated
that it was conceivable that the two buildings could share the recycle bins.
Commissioner Urrutia stated that he thought it was unfortunate that this entire area
has not had any special planning done. Commissioner Holden agreed and stated his
concerns that there could be a driveway along Fred Waring Drive every fifty feet.
Commissioner Holden added that the east elevation needed more interest.

Action•
It was moved by Commissioner Gregory, seconded by Commissioner Connor, to
approve the preliminary architectural plans and continue the landscaping site plan to
allow for a reduced width driveway and to restudy the property line landscaping lay-
out as well as providing additional landscaping on the east side. Motion carried
5-0-1, Commissioner Urrutia Abstaining.

Mr. Smith reported that the commission approved a minor expansion on May 14,

It was moved by Commissioner Gregory, seconded by Commissioner Holden, to
approve the 60-day extension as requested. Motion carried 6-0.

Mr. Alvarez presented photographs of the complex. Mr. Smith explained that the
apartment complex became legal,non-conforming,when the city did the zone change
in Section 4.

It was moved by Commissioner Holden, seconded by Commissioner Gregory, to
approve the Certificate of Zoning Conformance. Motion carried 6-0.
