The meeting was called to order at 12:30 p.m.

II. APPROVAL OF MINUTES:
It was moved by Commissioner Urrutia, seconded by Commissioner Holden, to
approve the minutes of the October 14, 1997 meeting as submitted. Motion carried
5-0, with Commissioner O'Donnell absent.

Mr. Smith distributed copies of the Planning Commission's conditions of
approval , and noted that Conditions 15, 16 and 29 come into play in this
case, as Condition No. 15 requires that the landscape plan include a dense
landscape buffer west of the west parking lot to effectively screen the
building from view from Silktree Court and the Sagewood residences to the
west of the site; Condition No. 16 requires that the landscape plan include
material to create an effective visual barrier between Las Serenas
apartments and the loading dock/loading dock enclosure; and Condition No.
29 requires that trees or other plant material at the property line adjoining the
Housing Authority property shall be a low maintenance type which will not
drop material over the adjoining wall onto the Housing Authority property.
Mr. Smith pointed out that Condition No. 25 requires that the parking lot
south of the new building entrance be fenced off to prevent access after
hours and on weekends.
Commissioner Connor observed that although there is a mix of 36-inch and
24-inch box trees, the plan does not indicate which are white; so he would
recommend that the plan label the trees accordingly.
Commissioner Connor recommended that the size of the Holly Oak trees be
increased to 36-inch box.
Action:
It was moved by Commissioner Urrutia, seconded by Commissioner Connor,
to approve the final working drawings with the condition that the plans be
labeled to designate which trees are 36-inch box and which trees are 24-inch
box, and to increase the size of the Holly Oak trees to 36-inch box. Motion
carried 5-0-1, with Chairman Gregory abstaining.
2. CASE NO.:

Action:
It was moved by Commissioner Holden, seconded by Commissioner Connor,
to approve the 16-foot high residence. Motion carried 6-0.
A. Final Drawings

APPLICANT (AND ADDRESS): CITY OF PALM DESERT for CITY OF

signage

Mr. Alvarez reported that the sign is four feet high and 25 feet long, will have
a split face stone, and the interior portion, which will be inset, will be made
of corian and sandblasted with beige letters.
June Wachs was present on behalf of the applicants to answer questions.
Action:
It was moved by Commissioner O'Donnell, seconded by Commissioner
Urrutia, to approve the monument signage. Motion carried 6-0.
2. CASE NO.: PP 97-11

Commissioner Connor expressed concern regarding the use of Queen
Palms, and commented that even though they work well in narrow spaces
initially, as they mature, they outgrow the space; so he would suggest using
Bottle Trees with a bio barrier, with which Mr. Hermann concurred.
Action:
It was moved by Commissioner Connor, seconded by Chairman Gregory, to
approve the final landscaping plan with the following conditions: 1) substitute
Bottle Trees for Queen Palms and use a bio barrier; 2) substitute
Bougainvillaea for Star Jasmine; and 3) backfill be native material. Motion
carried 6-0.
C. Preliminary Plans
1. CASE NO.: TT 25102
APPLICANT (AND ADDRESS): RANCHO CAPISTRANO DEVELOPMENT

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary and final
approval of elevations for model complex and production units and
conceptual approval of landscaping plan for model complex
LOCATION: Southeast corner of Deep Canyon Road and Magnesia Falls
ZONE: PR-5
Mr. Tracy Dale was present on behalf of the applicant.
Mr. Alvarez reported that there where are two gabled roofs together, there
will be a nine-foot side yard setback on each lot.
Mr. Alvarez directed the Commissioners' attention to the elevations, and
asked the applicant if Plan 2 will have a three-car garage, to which Mr. Dale
responded that a single-car garage in addition to the two-car garage will'be
offered as an option, and that second garage would replace the area where
the window is located.
Commissioner O'Donnell commented that two garages on the front elevation
will give the appearance of too much garage, with which Commissioner
Urrutia agreed, and Commissioner Connor stated that he could not image
having two driveways with the entry to the house in between. Mr. Smith
noted that the second garage is only being offered as an option, so if the

applicant wants to sell and build the second garage, prior approval would be
required.
Commissioner Urrutia stated that a different design would be needed in order
to accommodate the second garage because the lots are so narrow.
Mr. Smith suggested that when the applicant submits the landscaping plans
for the two models, one of the models should have drought tolerant
landscaping.
Action:
It was moved by Commissioner O'Donnell, seconded by Commissioner
Urrutia, to approve the preliminary elevations and landscaping for the model
complex with the following conditions: 1) that the elevations submitted be
approved, but not the proposed second garage option; and 2)that where the
the two models with gabled ends are adjacent as on Lots 8 & 9 and 14 & 15,
the maximum side yard setback requirements shall be required. Motion
carried 5-0-1, with Chairman Gregory abstaining.

Mr. Smith reported that the applicant has requested a meeting with staff,
which is scheduled for tomorrow; so he would recommend that this case be
continued.
Action:
It was moved by Commissioner Urrutia, seconded by Commissioner Connor,
to continue the case. Motion carried 5-0, with Commissioner O'Donnell
absent.

APPLICANT (AND ADDRESS): U.S. FILTER, 44-004 COOK STREET,
PALM DESERT CA 92260
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of 4,500 square
feet of office/storage space addition
LOCATION: 44-004 Cook Street
ZONE: PR-4
Mr. Alvarez reported that the proposed expansion is to be located at either
end of the existing building.
Mr. Smith stated that the applicant has worked out parking arrangements,
but since the Code requires a 32-foot setback, a Variance request will have
to be reviewed by the Planning Commission.
Action:
It was moved by Commissioner Holden, seconded by Commissioner Connor,
to approve the 4,500 square feet of office/storage space addition. Motion
carried 5-0, with Commissioner O'Donnell absent.
D. Miscellaneous
1. CASE NO.: MISC 97-1
APPLICANT (AND ADDRESS): BILL WRIGHT, 48-114 Silver Spur Trail,

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of six-foot high
wall, five to nine feet from face of curb
LOCATION: 48-114 Silver Spur Trail

Mr. Alvarez reported that the applicant proposes a six-foot slump stone wall
to be softened with landscaping, and pointed out that the property line varies
from five feet on the south end to nine feet on the other end, and even
though the Code requires a 12-foot setback, staff would suggest a nine-foot
even setback, as long as landscaping is maintained as well a four-foot

walkway.
Mr. Wright, the applicant stated that he would like to attach his wall to the
neighbor's wall, to which Chairman Gregory responded that the neighbor's
wall does not comply with setback requirements; however, in order to
achieve a compromise, he would suggest that Mr. Wright attach to the
neighbor's wall six feet back from the face of the curb, and continue the wall
past the citrus trees, at which point the wall should transition to nine feet
back from the curb, and continue to the end of the property.
Action:
It was moved by Commissioner Urrutia, seconded by Commissioner Connor,
to approve the six-foot high wall with the following conditions: starting at the
existing wall, the new wall shall begin six feet back from the curb, continuing
past the existing citrus trees, where it will then transition to nine feet from the
curb, continuing to the end of the property. Motion carried 5-0, with
Commissioner O'Donnell absent.
