NATURE OF PROJECT/APPROVAL SOUGHT: Approval of final working
drawings for 20-unit assisted living complex
LOCATION: 44-424 San Carlos and 73-685 Catalina Way

Mr. Smith reported that the applicant has submitted a revised site plan and
a revised landscaping plan. The City's landscape consultant, Eric Johnson,
has some concerns, but those matters are being resolved. Staff
recommends that the Commission grant final approval to the working
drawings and approve the landscaping plans, subject to Mr. Johnson's
comments.
Action:
Commissioner Holden moved, seconded by Commissioner Connor, to
approve the final working drawings and approve the landscaping plans
subject to incorporating the written comments listed on the landscape plans
by the City's landscape consultant, Eric Johnson. The motion carried 5-0,
with Commissioner Van Vliet absent.

NATURE OF PROJECT/APPROVAL SOUGHT: Consideration of revised
landscape plans for single-family residence in a hillside area
LOCATION: Edgehill Road west of the channel (APN 628-020-017)
ZONE: HPR
Mr. Smith reported that the Commission approved a landscape plan a few
weeks ago; however, the applicant realized that it was grossly over planted
and has submitted a revised landscape plan.
Commissioner Connor asked if the City's landscape consultant, Eric
Johnson, has reviewed the plans, to which Mr. Smith responded
affirmatively, and noted that Mr. Johnson had concerns about the slope.
Commissioner Connor felt that additional plantings need to be added to the
east slope.
Action:
Commissioner Connor moved, seconded by Commissioner Urrutia, to grant
preliminary approval of the revised plan subject to additional detail on the
east slope which may be approved by City staff. Motion carried 5-0, with
Commissioner Van Vliet absent.

identification sign

Mr. Alvarez reported that the business location is in Mervyn's shopping
center, and the sign will feature a red outline, dark green reverse channel
letters at a 15-inch height, and a graphic representation of a coffee cup with
steam, which will also be reverse channel. The salient issue is that the dark
green color does not comply with the center's sign program.
Gary Wright of Architectural Neon Sign Company pointed out the stucco wall
of the building will serve as the background and the red outline will be
painted directly onto the building.
Action:
Commissioner Urrutia moved, seconded by Commissioner Holden, to
approve the proposed sign with, including the color as an exception to the
sign program. The motion carried 5-0, with Commissioner Van Vliet absent.

4. CASE NO.: SA 98-43

monument sign for tenant identification on EI Paseo for Palms to Pines West
LOCATION: South entrance at EI Paseo
ZONE: P.C.(3)
Mr. Smith reported that, at the last meeting, the Commission approved a
monument sign and limited the number of tenant names to three. Mr.
Alvarez noted that the applicant is now requesting approval of a second
smaller monument sign which would be placed at the EI Paseo entrance, and
the colors and materials would match those of the previously approved sign.
The second monument sign would also have a landscaped area. The
applicant has also submitted a revised plan for the previously approved
monument sign, and the proposal plan includes five tenant names.
June Wachs of CGS Signs commented that the sign is large enough to be
viewed from quite a distance and the letters are eight inches high; so it
should not create a traffic hazard.
Commissioner Holden commented that the sign looks more like a directory
sign than a monument sign, and expressed concern that a precedent may
be established if the Commission approves the request as submitted
because every shopping center business which does not have street
frontage would then want signage on the street.
Chairman Gregory pointed out that the monument sign would screen the
existing electrical transformer box, and noted that the sign is considerably
larger than some of the other signs which have been proposed.

Commissioner Urrutia noted that the issue of the number of tenant names
has a lot to do with the sign background, and he feels three names looks
good on the large monument sign, but more than three names would be
difficult to read from a passing vehicle. He has observed that smaller tenants
in centers such as this seem to benefit from the advertising efforts of the
larger tenants, as customers responding to signage/advertising of larger
tenants notice the smaller businesses when they come into the center.
Commissioner Connor asked if the request for the smaller sign would be
withdrawn if approval is granted for additional signage to the larger
monument sign, to which Ms. Wachs responded negatively and indicated
that she would like approval for both. Commissioner Connor asked what will
become of the existing trees in the area of the proposed sign, to which Ms.
Wachs replied that they will be relocated, and the landscaping will be all
lawn. Commissioner Connor suggested that the area immediately around
the sign not be sprinklered because of the florescent lighting.
Chairman Gregory asked for clarification regarding the number of tenant
names requested for each sign, to which Ms. Wachs replied that she has
proposed three tenant names for the smaller sign, and she would request
that the Commission approve five tenant names as opposed to only three
tenant names for the previously approved large monument sign.
Commissioner Urrutia felt that three tenant names is too many for the smaller
monument sign, and noted that readability has a lot to do with the size of the
sign. Mr. Drell observed that the TGI Fridays sign is so big and has such a
large graphic that it makes the other finro tenant names difficult to read; so he
would suggest that the graphic around the TGI Fridays letters be eliminated.
Commissioner Urrutia felt that three tenant names would be acceptable on
the small monument sign if the graphic were removed around the TGI
Fridays letters.
Action:
Commissioner Urrutia moved, seconded by Commissioner Connor, to re-
affirm its approval of the first (larger) monument sign with a maximum of
three tenant names and approve the second (smaller) monument sign with
the condition that the proportions of the tenant names be revised to allow all
three equal billing and with the condition that a landscaping plan be
submitted for approval by City staff. The motion carried 5-0, with
Commissioner Van Vliet absent.

APPLICANT (AND ADDRESS): PALMS TO PINES CANVAS for MARIO'S
RESTAURANT, 69 Pinyon Pines, Mountain Center, CA 92561
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of retractable
awning with no signage
LOCATION: 73-399 EI Paseo
ZONE: C-1
Mr. Alvarez presented the artist's rendering of the proposed retractable
awning, as well as an alternate proposal for a shade structure.
Ernie Brooks of Palms to Pines Canvas indicated that the business needs
shade on the front patio when lunch is served, and noted that the burgundy
colored retractable awning would project 10 inches from the building when
folded in, and would project nine feet two inches when fully extended. The
retractable awning would be motorized and would have sun sensors as well
as wind sensors so that the awning would automatically retract under windy
conditions.
Commissioner O'Donnell stated that he is not opposed to having a shaded
area for the front patio, but felt that it should be done differently. Mr. Brooks
indicated that the alternative to the retractable awning would be a
Mediterranean awning which would be hung on cables with four, two-inch
posts and would feature a soft, scalloped pillow look.
Commissioner Connor asked what material would be used for the top, to
which Mr. Brooks replied that it would be fabric.
Commissioner Urrutia requested that the applicant develop something more
substantial with the framework, i.e., something across the top with detail and
ornamental trusses.
Action:
Commissioner Urrutia moved, seconded by Commissioner O'Donnell, to
continue the case. Motion carried 5-0, with Commissioner Van Vliet absent.

6. CASE NO.: SA 98-53

NATURE OF PROJECT/APPROVAL SOUGHT: Approval of awning with
signage (non-illuminated)
LOCATION: 73-170 EI Paseo
ZONE: C-1
Mr. Alvarez reported that the proposed awning is antique white with eight-
inch copy.
Ernie Brooks of Palms to Pines Canvas noted that the proposed canopy
would replace the existing canopy which does not comply with height
restrictions. The new canopy would project out from the building three and
a half to four feet, and no background lighting would be involved.
Commissioner O'Donnell suggested that the scalloped edging be eliminated,
with which Mr. Brooks concurred.
Action:
Commissioner O'Donnell moved, seconded by Commissioner Connor, to
approve the proposed awning with signage with the following conditions: 1)
that the scalloped edge be eliminated; 2) that the awning be located inside
the existing wing walls; and 3) that the eight-inch letters all be located on a
single line. Motion carried 5-0, with Commissioner Van Vliet absent.

B. Preliminary Plans
1. CASE NO.: PP 98-6

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of
landscaping and architectural elevations for three industrial buildings
LOCATION: West side of Entrepreneur Lane south of Gold's Gym
ZONE: S.I.
Mr. Smith reported that the Commission previously reviewed the drawings
and suggested that the building colors be varied, and the revised plans
indicate a slight variation in the color of the three buildings. The Commission
also requested that the north side of Building 2 have a landscape strip to
prevent vehicles from baking into the wall, and the revised plans include a
planter strip at the rear of Building 2 which extends to the rear of the parking
lot. Staff recommends preliminary approval.
Action:
Commissioner Holden moved, seconded by Commissioner O'Donnell, to
grant preliminary approval of the landscaping and architectural elevations for
the three industrial buildings. Motion carried 5-0, with Commissioner Van
Vliet absent.

2. CASE NO.: CUP 98-4
APPLICANT (AND ADDRESS): CHEVRON PRODUCTS COMPANY,
P.O. Box 2833, La Habra, CA 90632-2833
NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of
new 2,900 square foot food mart building to replace existing service building
LOCATION: 72-801 Highway 111 at Plaza Way
ZONE: PC-3
Mr. Alvarez reported that the applicant is proposing a new 2,900 square foot
food mart in place of the existing service station building, and landscaping
will be added, but the canopy will remain the same. A new trash enclosure
will also be added. The maximum building height proposed is 21'6". The
City's landscape consultant, Eric Johnson, has reviewed the plans and
provided written remarks, including that the materials should be more
compatible with the desert environment. The applicant will also be adding
a planter for 24-inch box shade trees in the parking lot. The proposed
project meets zoning ordinance requirements.
AI Naras of Chevron stated that he would like to extend another parking
finger on the south side of the building and add another tree with a
freestanding light fixture at 35 feet.
Commissioner Urrutia asked if the drawing represents the Chevron
prototype, to which Mr. Naras responded affirmatively, and added that this
will be the first such Chevron building in Southern California.
Mr. Naras pointed out that 85% of the store customers will be fueling
customers.
Commissioner Urrutia asked if the additional trees will require the elimination
of a parking space, to which Mr. Naras responded that everything would be
shifted north.

Commissioner Urrutia suggested shifting everything to the south rather than
to the north, and recommended additional landscaping for the north end, to
which Mr. Smith responded by indicating that there is a requirement that the
first 30-foot strip next to the street be landscaped.
Commissioner Urrutia reported that his firm has been retained to renovate
the entire shopping center, and even though the plans have not yet been
submitted to the City, he would be happy to share them with the applicant as
long as his client has no objections.
Commissioner Holden noted that the plans for the store include a large west-
facing window, and suggested that something be done to provide protection
from the sun.
Commissioner O'Donnell asked how much flexibility is available given that
this is a prototype, to which Mr. Naras replied that he is willing to add some
architectural treatments so that the project blends in, but it is important that
the customers to be able to recognize this as a Chevron facility.
Commissioner Urrutia commented that an additional vehicular entrance is
being planned off of Highway 111 halfinray between the Plaza Way
intersection and the Highway 74 intersection.
Commissioner Holden stressed the need for some architectural treatment of
the east elevation since it will be highly visible to westbound traffic.
Mr. Buchanan recommended that the rooftop equipment access ladder be
moved inside the building.
Action:
Commissioner O'Donnell moved, seconded by Commissioner Holden, to
continue the case. Motion carried 4-0-1, with Commissioner Urrutia
abstaining and Commissioner Van Vliet absent.

3. CASE NO.: CUP 98-5

NATURE OF PROJECT/APPROVAL SOUGHT: Preliminary approval of
wireless communication monopole
LOCATION: 77-200 California Drive (Palm Desert Country Club)
ZONE: Open Space
Mr. Alvarez reported that communication towers are allowed in various
zones, including the Open Space zone. The proposed towers would be
located 200 feet from the nearest residences. The 75-foot monopole would
be located in the maintenance yard.
Commissioner Urrutia asked if the homeowners association has given
approval, and the Commission was advised that there was no such approval
on record.
Action:
Commissioner O'Donnell moved, seconded by Commissioner Urrutia, to
continue the case to give the applicant another opportunity to be present to
respond to questions. Motion carried 4-0-1, with Commissioner Urrutia
abstaining and Commissioner Van Vliet absent.
4. CASE NO.: CUP 98-2

Mr. Smith reported that this project has been before the Commission on two
previous occasions. The last time the Commission reviewed the project, the
site plan had been revised to increase setbacks. Last Tuesday the project
was submitted to the Planning Commission,wherein one resident expressed
concern regarding building height, and another expressed concern about
hotels in general. Last Thursday,the City Council considered the project and
continued the case to a Special Meeting scheduled for Wednesday, April 29, -
1998 at 9:00 a.m. Part of the matter before the City Council involves an
exception to the height limit, and prior to making a decision, the Council
would like to have input from the Architectural Review Commission.
Mr. Smith presented the elevations submitted to the City Council which show
building heights of 41 feet and 44 feet and indicated that a revised proposal
was submitted early Friday morning which significantly alters the appearance
of the roof structure.
Mr. Smith noted the presence of several members of the public who should
be given an opportunity to address the Commission.
Bill Swank of PDH Associates stated that there was a 35-foot height concern;
so that has been established at the parapet wall. At the front entry there are
two roofs of differing heights, the tallest being 44 feet. The side elevations
have roof elements overlooking the courtyard area, and the rear entries also
have roof elements. The tallest element is 44 feet.
Mr. Swank noted that some comparisons have been made to the Palm
Springs Courtyard Hotel, which has a 40-foot ridge height.
Mr. Swank submitted color and materials boards for both the Courtyard Hotel
and Residence Inn.
Mr. Swank indicated that 50°/a more balconies have been added although
they are not yet reflected in the building elevations, and the roof of the
building has been changed so that it has movement to it, and the parapet
also has a lot of articulation. The roof elements feature tile.

Commissioner Urrutia asked if air conditioning units are depicted on the wall,
to which Mr. Swank responded affirmatively, and pointed out that most of the
air conditioning units will be located behind the balcony railing, and all of
those units will be painted to match the building. Mr. Smith noted that the
units will extend through the wall by approximately one inch.
Chairman Gregory invited the public to address the Commission regarding
this project, but the offer was declined.
Commissioner Holden asked if the conclusion reached was that eliminating
the pitched roof was the only way to lower the building roof, to which Mr.
Swank responded affirmatively.
Commissioner Holden commented that the elevation appears to be just one
long line, to which Mr. Swank responded that there will be quite a bit of
shadowing.
Commissioner Holden suggested stepping, to which Mr. Swank replied that
he toyed with the idea of bringing up some elements here and there, but he
thinks the project will have to use a flat roof, although some of the parapets
could be given some ups and downs.
Commissioner Urrutia indicated that he would like to see more pitched roofs
than flat roofs, and it seems as if this project has gone from one extreme of
pitched roof to the other extreme of a flat roof, and he would prefer to see a
happy medium. He agrees with Commissioner Holden that the height of the
roof should be varied more, and would suggest the use of more tile roof
elements in certain areas.
Commissioner Urrutia felt that the addition of more balconies would help to
create more shadowing.
Chairman Gregory stated that he would like to see the project reach a happy
medium between the plan previously submitted and the plan currently
submitted, because the first plan had too much roof, while the revised plan
looks better, but unfinished. He would also like to see more movement on
such a long roof.

Commissioner O'Donnell concurred with Commissioner Urrutia regarding
adding more pitched roof elements, and suggested that they be located on
parts of the building wings.
Mr. Swank asked the Commissioners how they felt about height, and pointed
out that the building is set back 340 feet from Cook Street. Mr. Smith noted
that there is a height limit, but there is also an exception process, which is
why this case was presented to the City Council.
Commissioner Urrutia stated that the Commission's approach to height limits
is that if the height works well architecturally and the project has balance, the
Commission is not opposed to structures in excess of the established height
limit.
Mr. Smith commented that it appeared that the Council realized that a height
exception would be necessary, and because of that, the building should look
as good as possible.
Chairman Gregory observed that the building is far enough back from the
street that a few feet of extra height won't have much impact.
Commissioner Urrutia asked if anything could be done to move away from
the flat appearance of the facade, and noted that the Courtyard Hotel in
Palm Springs has done some things to handle the situation with the air
conditioning units, the in and out movement of the facade and the roof line.
Mr. Swank indicated that the City Council would like this Commission's
comments, and he is open to suggestion.
Commissioner Holden felt that a happy medium can be achieved, though it
is yet to be found. The revised plans comply with the height issue, but the
building has too much flat roof area; so he would suggest more pitched roof
areas and more undulation in the elevation.
Mr. Swank wished that the Commission would make some comment
regarding height, to which Commissioner Holden replied that the
Commission cannot approve height, but the Commission does support
additional height if it enhances the architecture, as is the situation in this
case.

Mr. Smith observed that it appears that the Commission does not object to
the overall proposed height, but would like additional elements of similar or
varying height added to the rest of the building.
Commissioner Urrutia indicated that the Commission is open to the idea of
adding more pitched roof elements, although he does not think they should
all be the same height, and they should fit in with the overall design.
Commissioner Holden observed that there is a lot of interest at the entry, but
it appears to dwindle toward the edges.
Commissioner Holden noted that the building is set back pretty far.
Commissioner O'Donnell asked if the site lends itself to stepping any part of
the building down, to which Mr. Swank responded negatively.
Mr. Swank pointed out that balconies can be added to almost every room.
Action:
It was moved by Commissioner Urrutia, seconded by Commissioner
O'Donnell, to grant conceptual approval of the Courtyard Hotel elevations
subject to the following items:
1) Adding more pitched roof elements;
2) Altering the top parapet lines such that they are not all the same ridge
height in order to provide undulation;
3) Adding as many balconies as possible in order to hide the air
conditioning units and to provide more depth to the elevation; and
4) Maintaining an overall maximum height not to exceed 44 feet.
Motion carried 5-0, with Commissioner Van Vliet absent.
Commissioner Urrutia left the meeting at 2:20 p.m.

5. CASE NO.: PP 98-5 and TT 28818
APPLICANT (AND ADDRESSI: MARRIOTT OWNERSHIP RESORTS,
INC., 6649 Wesfinrood Boulevard, Suite 500, Orlando, FL 32809-6090
NATURE OF PROJECT/APPROVAL SOUGHT: Approval of plans for an
18-hole golf course and 1,200 unit timeshare resort
LOCATION: East side of Monterey between Frank Sinatra and Gerald Ford
ZONE: PR-5
Mr. Smith reported that the proposed project would be located on a 300+
acre area on the east side of Monterey Avenue between Frank Sinatra Drive
and Gerald Ford Drive. The project includes an 18-hole golf course
designed by Nick Faldo, and 1,200 time share units. The main entry would
be located off of Monterey Avenue approximately 1,430 feet south of Gerald
Ford. The sales center would be located to the north of the entry, and further
east on the entry driveway there would be a circular road, with the
restaurant, clubhouse and check-in facilities. The time share units would be
divided into four villages, and a second entry would be located on Gerald
Ford approximately 2,400 feet from the corner. The maintenance facility
would be located in a large parking lot. The driving range would be
positioned in the center of the site. Because of the length of the residential
cul du sacs, fire connection roads would be included. One issue of concern
is the proximity of the project to the existing K&B single-family residential
development.
Stephen Withers of Marriott Vacation Club commented that the main
amenities buildings would be clustered together, and the Faldo Institute
training center would be located here. The project consists of two-, three-
and four-story time share units divided into four phases, each with a large
pool and amenity complex. The entry will feature a waterfall element.
Chairman Gregory asked if the four-story units will be located in the center
of the site only, to which Mr. Withers responded affirmatively.

Mr. Withers pointed out that each village will have a theme using color
palettes, i.e., terra cotta roofs versus tan or buff colored roofs. There will be
six units per floor, and elevators will be included in buildings over three
stories.
Chairman Gregory noted that there appears to be a lot of openings in the
wall where the wrought iron allows people to look in from the street to the
fairway.
Mr. Smith stated that the maximum height in the zone is 24 feet and two
stories; so this project will need Council approval regarding the height, as
well as the development agreement. The Commission should indicate
whether or not there is a concern regarding the three- and four-story
stru ctu res.
Action:
Commissioner Holden moved, seconded by Commissioner O'Donnell, to
grant conceptual approval and indicate there should not be a problem with
three- and four-story elements because of the excess setbacks afforded
them, but that the elevations along Frank Sinatra and next to K&B should be
limited to two-stories, and that the Commission looks forward to reviewing
detailed plans for the sales center, clubhouse, restaurant and check-in area,
fencing plan and plan and landscape plan when available. The motion
carried 4-0, with Commissioners Urrutia and Van Vliet absent.

NATURE OF PROJECT/APPROVAL SOUGHT: Approval to park and
store 9' x 21' recreational vehicle in the front yard

Mr. Smith reported that the Code Enforcement Division recently issued
citations for quite a few recreational vehicles which were parked in residential
areas. The agenda packet includes a copy of the ordinance regarding
recreational vehicles. There is a process whereby an applicant may request
approval to park in the front yard, and that is the nature of this particular
request. A notice was circulated to neighbors within 300 feet to ascertain
whether or not a public hearing should be conducted, and thus far, no
responses have been received. The proposal is to locate an enclosure at
the west end of the property, which would involve a new curb cut. There is
a substantial amount of landscape material in that area which is as tall as the
house, and some of the girth would have to be trimmed in order to fit the
vehicle in that space.
Mr. Hepburn indicated that he is considering constructing a gate, and would
use four by four redwood posts and lattice work with bougainvillea planted
on the west side.
Commissioner Connor asked if the proposed gate would be located directly
across from the front door of the home across the street, to which Mr.
Hepburn responded negatively, and noted that the next-door neighbor would
be the most affected by this project.

Commissioner Holden indicated that it would be nice if the gate had a bit of
design to give it a nice texture and feeling so that it blends in with the house,
to which Mr. Hepburn responded by suggesting redwood fence which would
be stained, and have lattice work on top.
Commissioner O'Donnell commented that he would prefer a finished wood
material six feet in height, and that a six-foot trellis be placed alongside with
landscaping to grow over it.
Action:
Commissioner O'Donnell moved, seconded by Commissioner Connor, to
grant approval based on the comments and suggestions made by the
Commission regarding the use of finished wood material for a six-foot high
gate with lattice on top and a six-foot trellis alongside with landscaping to
grow over the trellis. The motion carried 3-0, with Commissioners Gregory,
Urrutia and Van Vliet absent.
